Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require rental car companies to allow customers to terminate a rental car agreement if they would otherwise be forced to rent an electric motor vehicle against their wishes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Requiring EV Notification and Transparency Act of 2024</short-title></quote> or the <quote><short-title>RENT Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="iddd8cea6f687344e992737c20bb1d61af"><enum>2.</enum><header>Requirements for rental car companies pertaining to electric motor vehicles</header><subsection id="idd68ff738595b44afbdb60fafb011d44d"><enum>(a)</enum><header>Customer choice</header><text>A rental car company shall only provide a customer with an electric motor vehicle pursuant to a rental agreement between the rental car company and the customer if the customer opts in to renting an electric motor vehicle.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id56b3bf1860b94c1b9d5acb8c671918ed"><enum>(b)</enum><header>Requirements To provide notice and opportunity To terminate rental agreement</header><paragraph commented="no" display-inline="no-display-inline" id="id4e79fffa2d7948188ca3566314a1939b"><enum>(1)</enum><header>Notice</header><text display-inline="yes-display-inline">A rental car company shall notify a customer not later than 12 hours before the customer is scheduled to pick up a motor vehicle pursuant to a rental agreement between the customer and the rental car company that the rental car company believes that it is more likely than not that the only motor vehicles available to rent are electric motor vehicles if—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbf6563a120104a77a98cc4a839693037"><enum>(A)</enum><text display-inline="yes-display-inline">the customer enters into such rental agreement at a time earlier than 24 hours before the customer is scheduled to pick up a motor vehicle; and</text></subparagraph><subparagraph id="id06a7295708e242ec80caa09a9826481a"><enum>(B)</enum><text>the customer did not opt in to renting an electric motor vehicle.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8c40c8e24c94a849a990896d0294b48"><enum>(2)</enum><header>Opportunity to terminate rental agreement; Waiver of fees or penalties</header><text>A rental car company shall allow a customer to terminate a rental agreement and may not subject the customer to any fees or penalties associated with terminating a rental agreement if the customer did not opt in to renting an electric motor vehicle and—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3756270b56c64a8eaf154e80aeb20e37"><enum>(A)</enum><text display-inline="yes-display-inline">the customer receives a notice described in paragraph (1); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida53aee6976794a948ebad469afa95173"><enum>(B)</enum><text>there are only electric motor vehicles available when the customer arrives to pick up a motor vehicle.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7c5e29bcb8cc42cdb4347eee611d2710"><enum>(c)</enum><header>Enforcement by the Commission</header><paragraph commented="no" display-inline="no-display-inline" id="idf727a728e3e24ae09532830c1ab03c3b"><enum>(1)</enum><header>Unfair or deceptive act or practices</header><text>A violation of this Act or a regulation promulgated under this Act shall be treated as an unfair or deceptive act or practice in violation of a rule promulgated under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="idec9ce7fd5e64418794d84b509ba9f389"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="id9634cac1647b4a6abf6429d322205c1a"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc6c9156025694bf1b271ffee551f1ab7"><enum>(B)</enum><header>Privileges and immunities</header><text>Any rental car company that violates this Act or a regulation promulgated under this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph id="id496aa348c7834a5b8ceb9c1edbd9a0f3"><enum>(C)</enum><header>Authority preserved</header><text>Nothing in this Act shall be construed to limit or expand the authority of the Commission under any other provision of law.</text></subparagraph><subparagraph id="id519bdf9dcd8e4d1e92c440b2732c8139"><enum>(D)</enum><header>Rulemaking</header><text>Not later than 90 days after the enactment of this Act, the Commission shall promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this Act.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb83a6b231df34c2393c29aded659cff8"><enum>(3)</enum><header>Effect on State law</header><text>Nothing in this Act shall preclude the application of the law of any State that requires rental car companies to disclose more information to customers regarding renting an electric motor vehicle. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id89491ff110df476286ffeddecbe6db80"><enum>(d)</enum><header>Enforcement by individuals</header><paragraph commented="no" display-inline="no-display-inline" id="id64b17bedff3f4bcbaf15b3bc4e4fc433"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any individual who has been harmed by a violation of this Act by a rental car company may bring a civil action against such company in a Federal court of competent jurisdiction.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8154969827ab4e87906868f80e2defac"><enum>(2)</enum><header>Relief</header><text display-inline="yes-display-inline">In a civil action brought under paragraph (1) in which the plaintiff prevails, the court may award the plaintiff—</text><subparagraph commented="no" display-inline="no-display-inline" id="id16222baad7224699b80e3131ddc0c210"><enum>(A)</enum><text display-inline="yes-display-inline">an amount equal to the sum of any damages sustained for each violation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ided7e686c85f84f5a90f4639e76ec7b4f"><enum>(B)</enum><text>reasonable attorney fees and litigation costs.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6620fd3048b24f67a1c861d796cebb63"><enum>(e)</enum><header>Definitions</header><text>In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idf81a45338b26400da4e67f8e1530d6f9"><enum>(1)</enum><header display-inline="yes-display-inline">Airport</header><text>The term <term>airport</term> has the meaning given that term in section 40102 of title 49, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ab9e8edaafb4e17889a942863dbae5b"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5dd081bfc828427182333341374d18b2"><enum>(3)</enum><header>Electric motor vehicle</header><text>The term <term>electric motor vehicle</term> means a motor vehicle designed to operate exclusively on electricity stored in a rechargeable battery, multiple batteries, or a battery pack.</text></paragraph><paragraph id="idffc3e22d1479480ab8fb8d8e5d0d28d5"><enum>(4)</enum><header>Motor vehicle</header><text>The term <term>motor vehicle</term> means any vehicle which is manufactured primarily for use on public streets, roads, and highways (not including a vehicle operated exclusively on a rail or rails) and which has at least 4 wheels. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id959c027fe42c464784c6b037ad78a2db"><enum>(5)</enum><header>Rental car company</header><text>The term <term>rental car company</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id93254878884c4f0ca7ed09ffc1c8b23b"><enum>(A)</enum><text display-inline="yes-display-inline">means any person engaged in the business of renting motor vehicles of any type that—</text><clause commented="no" display-inline="no-display-inline" id="idd8b9847ec22745a9bdb6757b3079c348"><enum>(i)</enum><text display-inline="yes-display-inline">operates in 2 or more States;</text></clause><clause commented="no" display-inline="no-display-inline" id="iddb3c6a2ff7ea4ff7971e6dd70b068a67"><enum>(ii)</enum><text>operates on or within 5 miles of an airport; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ideb565d883ef843a7ab6cd6139490597b"><enum>(iii)</enum><text display-inline="yes-display-inline">used for rental purposes a motor vehicle fleet of 1,000 or more motor vehicles, on average, during the most recent calendar year; and </text></clause></subparagraph><subparagraph id="idc64a3a0272e244f6aa8251791d1dee03" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>includes any entity that is a subsidiary of a person described in subparagraph (A).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
