<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3859</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>February 29, 2024</action-date><action-desc><sponsor name-id="S153">Mr. Grassley</sponsor> (for himself and <cosponsor name-id="S414">Mr. Ossoff</cosponsor>) introduced the following bill; which was read twice, considered, read the third time, and passed</action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that homicides can be prosecuted under Federal law without regard to the time elapsed between the act or omission that caused the death of the victim and the death itself.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Murder Victims Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id23dd2e5007494243ba3bfe3a52c9396f"><enum>2.</enum><header display-inline="yes-display-inline">Homicide offenses</header><subsection id="id1E2D39B721344EC0A5D93F41FE6562BD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/51">Chapter 51</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idE2C8B0C2676749338C0597C661A3BC62"><section id="id4C043DF20EBF4396A94647945B338756"><enum>1123.</enum><header>No maximum time period between act or omission and death of victim</header><subsection commented="no" display-inline="no-display-inline" id="id4471b173f91a4a2b9b7c6204d83a8c49"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A prosecution may be instituted for any homicide offense under this title without regard to the time that elapsed between—</text><paragraph id="id3E2224232121404DBA7886224189EF58"><enum>(1)</enum><text display-inline="yes-display-inline">the act or omission that caused the death of the victim; and</text></paragraph><paragraph id="idA193F7360F90437D9FF022178870E8A4"><enum>(2)</enum><text display-inline="yes-display-inline">the death of the victim.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id73f7883e00db442a96dcacfcd7ee2d75"><enum>(b)</enum><header>Relation to statute of limitations</header><text display-inline="yes-display-inline">Nothing in subsection (a) shall be construed to supersede the limitations period under section 3282(a), to the extent applicable.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id93999df9e89b46baaa7c87c0572669e4"><enum>(c)</enum><header>Maximum time period applicable if death penalty imposed</header><text display-inline="yes-display-inline">A sentence of death may not be imposed for a homicide offense under this title unless the Government proves beyond a reasonable doubt that not more than 1 year and 1 day elapsed between—</text><paragraph id="idCA52924B741B4DA0B709A5BF6A5D3D31"><enum>(1)</enum><text display-inline="yes-display-inline">the act or omission that caused the death of the victim; and</text></paragraph><paragraph id="id56EFC04C2DD74B40AF30501BDE0A65FB"><enum>(2)</enum><text display-inline="yes-display-inline">the death of the victim.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idBDD13FDA8C7044C6B9C8110954DB05CD"><enum>(b)</enum><header>Table of contents</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/51">chapter 51</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8FAFFB6E52114FEE89B83CC852D0C60B"><toc><toc-entry bold="off" level="section">1123. No maximum time period between act or omission and death of victim.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb1173f91a754426387612ba790ecc30b" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Applicability</header><text>Section 1123(a) of title 18, United States Code, as added by subsection (a), shall apply with respect to an act or omission described in that section that occurs after the date of enactment of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id93e4839da56f43b4992ecb6613b64ed2"><enum>(d)</enum><header>Maximum penalty for first-degree murder based on time period between act or omission and death of victim</header><text>Section 1111(b) of title 18, United States Code, is amended by inserting after <quote>imprisonment for life</quote> the following: <quote>, unless the death of the victim occurred more than 1 year and 1 day after the act or omission that caused the death of the victim, in which case the punishment shall be imprisonment for any term of years or for life</quote>.</text></subsection></section></legis-body></bill>
