which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require certain forest supervisors of units of the National Forest System to submit to the Chief of the Forest Service a harvesting improvement report, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Timber Harvesting Restoration Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idf12d6af194444e4db3f418e5a463d217"><enum>2.</enum><header>Harvesting improvement on National Forest System land</header><subsection commented="no" display-inline="no-display-inline" id="idfe57455ac0914d1f9b4c66f8d4c5cc95"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph id="id513a374c3a564e4d83d2400ac0227316"><enum>(1)</enum><header>Allowable sale quantity</header><text>The term <term>allowable sale quantity</term> means the maximum volume of timber potentially available in a unit of the National Forest System as part of regularly scheduled timber sales from land suitable for timber production over a 10-year period. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4de827b59c71489c9ec695c4b3446f96"><enum>(2)</enum><header>Covered NFS unit</header><text>The term <term>covered NFS unit</term> means a unit of the National Forest System with respect to which, as determined by the Secretary, the actual volume of timber sold from the unit during the fiscal year preceding the date of enactment of this Act is not more than <fraction>2/3</fraction> of the allowable sale quantity. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf9e692293ab64e38aefd943283dfe76c"><enum>(3)</enum><header>Forest supervisor</header><text>The term <term>forest supervisor</term> means a forest supervisor of a unit of the National Forest System. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb4a71b1a6794e0794a878e9eabf2bb8"><enum>(4)</enum><header>Harvesting improvement report</header><text>The term <term>harvesting improvement report</term> means a harvesting improvement report described in subsection (b)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf1d694b4f06d49b4bfba51c29a3002c6"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id81d229a44b8b4f9e9c6b2933b58c44f3"><enum>(b)</enum><header display-inline="yes-display-inline">Harvesting improvement reports</header><paragraph commented="no" display-inline="no-display-inline" id="id9ef71472374144a8b9dbd075a221a2e4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, each forest supervisor of a covered NFS unit shall submit to the Secretary a harvesting improvement report that identifies areas of the covered NFS unit that could be used, and any actionable steps that may be taken, to increase the volume of timber sold from the covered NFS unit.</text></paragraph><paragraph id="idab4b5bacf5624d508468b512b6c9ebe3"><enum>(2)</enum><header>Consultation</header><text>In preparing a harvesting improvement report, a forest supervisor shall consult with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id07f613b6c75b404f88a5e11bf2b4d8ef"><enum>(A)</enum><text display-inline="yes-display-inline">relevant members of private industry;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b76d3fce9e9474f99f2da23c3ed1df3"><enum>(B)</enum><text display-inline="yes-display-inline">relevant advisory committees;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9d4f9a0da3844cbc92bb9ade654a126b"><enum>(C)</enum><text display-inline="yes-display-inline">State, local, and Tribal governments; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida34237153ba54f9cbf416af5bb4db161"><enum>(D)</enum><text display-inline="yes-display-inline">relevant stakeholder groups.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7144442d20064bb4aa8274039dcf34be"><enum>(3)</enum><header>Notification</header><text>Not later than 30 days after the date of enactment of this Act, the Secretary shall notify each forest supervisor of whether that forest supervisor is required to file a harvesting improvement report. </text></paragraph></subsection><subsection id="id040688dc852740fd8443d7b199646306" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Actionable steps</header><text>Not later than 1 year after the date of enactment of this Act, each forest supervisor required to submit a harvesting improvement report shall demonstrate, to the satisfaction of the Secretary, that the forest supervisor has taken actionable steps toward increasing the volume of timber sold from the applicable covered NFS unit.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc0e80ae5cb234619a2efaf1e1342e016"><enum>(d)</enum><header>Measuring performance</header><paragraph commented="no" display-inline="no-display-inline" id="id1d30084fde8a4ab3b19d9d4f8479e3a0"><enum>(1)</enum><header>Review of progress</header><text>1 year after the date on which a forest supervisor submits a harvesting improvement report, the Secretary shall review the progress made toward increasing the volume of timber sold from the applicable covered NFS unit.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54a3fe54e6bc491fb3a8648ad2e7d9d0"><enum>(2)</enum><header>Improvement</header><text>If the Secretary determines, after a review under paragraph (1), that the actual volume of timber sold from the unit is more than ¾ of the allowable sale quantity for the unit, the forest supervisor of that unit shall not be required to submit any additional harvesting improvement reports under this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ddb40ed14404755b0fd6bb115a76e11"><enum>(3)</enum><header>Lack of improvement</header><text>If the Secretary determines, after a review under paragraph (1), that the actual volume of timber sold from the unit is not more than ¾ of the allowable sale quantity for the unit, the forest supervisor of that unit shall, not later than 180 days after the review under paragraph (1), submit to the Secretary another harvesting improvement report.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5d37dafe220c43b5a0f6edd1c5359386"><enum>(e)</enum><header>Supporting harvesting improvements</header><text>With respect to a unit described in subsection (d)(3), the Secretary shall allocate any available resources to that unit for the purpose of increasing the volume of timber sold, which resources may include—</text><paragraph commented="no" display-inline="no-display-inline" id="idaf925eecb7884a70a6cc351ee23d6a84"><enum>(1)</enum><text>providing additional personnel;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e9cccc3708149c9be05e2fcae90f89f"><enum>(2)</enum><text>expanding the use of good neighbor agreements under section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida37e629c5e40458eba6c109f4c0c99f7"><enum>(3)</enum><text>using any feasible actions and authorities to expedite environmental review processes.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1a37d65fe4214ce0aca077782b75b7e4"><enum>(f)</enum><header>Waiver</header><text>The Secretary may waive a requirement to submit a harvesting improvement report under this section with respect to a unit of the National Forest System if the Secretary determines that there is a plausible reason, such as a natural disaster, for the lack of progress toward increasing the volume of timber sold. </text></subsection></section></legis-body></bill>
