<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3841</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240229">February 29, 2024</action-date><action-desc><sponsor name-id="S363">Mr. King</sponsor> (for himself and <cosponsor name-id="S398">Mr. Cramer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Veterans Affairs to submit a report on the impact of a proposed rule submitted by the Centers for Medicare &amp; Medicaid Services on access of veterans to long-term care facilities.</official-title></form><legis-body><section id="id53ca76b85eca4f3fb7b7c47919a9ce8b" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Report on Proposed CMS Staffing Ratios Act</short-title></quote>.</text></section><section id="id337574F8D41940DD84AA7490BFE65041"><enum>2.</enum><header>Report on impact of proposed rule on access of veterans to long-term care facilities</header><subsection commented="no" display-inline="no-display-inline" id="idf7cc7ccf666e4dd5bdc13212de7b253c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the impact of the proposed rule submitted by the Centers for Medicare &amp; Medicaid Services relating to <quote>Medicare and Medicaid programs; minimum staffing standards for long-term care facilities and Medicaid institutional payment transparency reporting</quote> (88 Fed. Reg. 61352; published September 6, 2023) on the access of veterans to long-term care facilities under the laws administered by the Secretary, which shall include the following:</text><paragraph id="iddc9b0eb52b4c4de99161592082df7394"><enum>(1)</enum><text>The number of State homes at which current staffing would not meet the threshold for minimum staffing outlined in such proposed rule.</text></paragraph><paragraph id="id5ab8ec6ea56b421e8f787f797d446392"><enum>(2)</enum><text>The number of veterans who reside in a State home described in paragraph (1).</text></paragraph><paragraph id="id908f8edd14ae468e9780497f54d8b155"><enum>(3)</enum><text>The number of community nursing homes currently contracted with the Department of Veterans Affairs that would not meet the threshold for minimum staffing outlined in such proposed rule.</text></paragraph><paragraph id="id2d9d3f34f40f47fba1e7ebc181d90363"><enum>(4)</enum><text>The number of veterans who reside in a community nursing home described in paragraph (3).</text></paragraph><paragraph id="id39bf5d9ea1f64563b65a30a909dc9db4"><enum>(5)</enum><text>An assessment of whether or not such proposed rule would have any impact on community living centers of the Department.</text></paragraph><paragraph id="id603799f2367848d19c8b89e1cb132706"><enum>(6)</enum><text>An analysis of whether the Department will be able to adequately meet the long-term care needs of veterans after the full implementation of such proposed rule, including veterans in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id449fa8b9246f4c3fbbee103d5eeb3e13"><enum>(A)</enum><text display-inline="yes-display-inline">rural and highly rural areas;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5b143b3d6a27488bba3d5d775a0f2d1b"><enum>(B)</enum><text>medically underserved areas;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id042b0f6c078b4f74b748bf89eb6ab481"><enum>(C)</enum><text display-inline="yes-display-inline">territories of the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6e8a75d143fc4736b4100dcd96c80792"><enum>(D)</enum><text display-inline="yes-display-inline">Tribal areas.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b5f350359c1468081b97a16bc3b812e"><enum>(7)</enum><text display-inline="yes-display-inline">Such other matters as the Secretary considers appropriate.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id487cfcf4958048d188d260bde44198a8"><enum>(b)</enum><header display-inline="yes-display-inline">State home defined</header><text>In this section, the term <term>State home</term> has the meaning given that term in section 101(19) of title 38, United States Code. </text></subsection></section></legis-body></bill>
