which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Credit Act of 1978 to authorize assistance for emergency measures in response to pine beetle outbreaks, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Pine Beetle Response Act of 2024</short-title></quote>.</text></section><section id="id946f4297978a48808d7449630f90e684"><enum>2.</enum><header>Emergency measures in response to pine beetle outbreaks</header><text display-inline="no-display-inline">Section 407 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2206">16 U.S.C. 2206</external-xref>) is amended—</text><paragraph id="id1be32dfb3cb54e74bd7d505abb1619ef"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60eeccff70e247c4adee28cfe9a19868"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0ad81e87c3e246a7ab49d2f959822fb5"><subsection id="iddecd7f5de2394cbd9a029cc53cfda93f"><enum>(e)</enum><header>Emergency measures in response to pine beetle outbreaks</header><paragraph id="id36ecbd34b97045a6a60d2f58c956ff09"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id0172d2c2dd3d4010b150cd141cfc78e9"><enum>(A)</enum><header>Eligible itemized costs</header><text>The term <term>eligible itemized costs</term> means expenses incurred by a timber service business in carrying out contractual services associated with outbreak response measures, including—</text><clause id="id74a917d84b5b4f41a6da0c274714d516"><enum>(i)</enum><text>labor or hours for truck drivers or equipment operators;</text></clause><clause id="id2d0ab90053784fe68d60e542e712dd8d"><enum>(ii)</enum><text>mileage or hours for use of equipment, such as transports, bulldozers, and skidders; and</text></clause><clause id="id8af6dcb8e40a4cfe9706a8e50136c45c"><enum>(iii)</enum><text>materials, such as gravel, grass seed, culverts, and mats. </text></clause></subparagraph><subparagraph id="id3da0defecabc4865893aa26bbf47bfb1"><enum>(B)</enum><header>Outbreak response measures</header><text>The term <term>outbreak response measures</term> means measures necessary to address pine beetle outbreaks on nonindustrial private forest land, including—</text><clause commented="no" display-inline="no-display-inline" id="idb8f431b4c7124096849f97643cdfdd37"><enum>(i)</enum><text display-inline="yes-display-inline">timber harvesting or thinning;</text></clause><clause commented="no" display-inline="no-display-inline" id="id67075fd3dfa543b3b18b1eaeb298ec27"><enum>(ii)</enum><text display-inline="yes-display-inline">prescribed burning; </text></clause><clause commented="no" display-inline="no-display-inline" id="id7608bb076047487fa21d77b396e55201"><enum>(iii)</enum><text display-inline="yes-display-inline">debris removal;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd3e520c0f795439090f5f1a36b2ae50c"><enum>(iv)</enum><text display-inline="yes-display-inline">insecticide treatment;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2d7f60eafa8442cb9648ca30e0b7c357"><enum>(v)</enum><text display-inline="yes-display-inline">establishment of buffer areas; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id85e704ee600340faa597cf6bdee76287"><enum>(vi)</enum><text display-inline="yes-display-inline">such other measures as the Secretary determines to be appropriate.</text></clause></subparagraph><subparagraph id="idcb4471cfb6d449a1a3e5a74d57772317"><enum>(C)</enum><header>Timber service business</header><text>The term <term>timber service business</term> means a business that derives gross revenue from—</text><clause id="idb83b8f70e76d4330a1e9acbf124b907d"><enum>(i)</enum><text>cutting or transporting timber from forest land; or</text></clause><clause id="ide88d49080d2648d9a351790b61cf5fd7"><enum>(ii)</enum><text>inspecting, planting, pruning, or removing trees in residential or commercial areas.</text></clause></subparagraph></paragraph><paragraph id="id528ffa99cfeb48ff97a40767908d404f"><enum>(2)</enum><header>Assistance for owners of nonindustrial private forest land</header><subparagraph commented="no" display-inline="no-display-inline" id="idd215db1c617042ae919ab970dc470b93"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall make payments to an owner of nonindustrial private forest land who carries out outbreak response measures to restore forest health and forest-related resources after the land is damaged by a pine beetle outbreak.</text></subparagraph><subparagraph id="idb7adb956c90342408f94e82a8bc446d0"><enum>(B)</enum><header>Cost share requirement</header><text>Payments made under subparagraph (A) shall not exceed 85 percent of the total cost of the outbreak response measures carried out by an owner of nonindustrial private forest land.</text></subparagraph></paragraph><paragraph id="ide26ef08e37d94ee4acafa60a01789236"><enum>(3)</enum><header>Assistance for timber service businesses</header><subparagraph commented="no" display-inline="no-display-inline" id="id9233ae9f17504e779f4dfbbed14afd0d"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall make payments to a timber service business to cover eligible itemized costs incurred in carrying out contractual services associated with outbreak response measures to restore forest health and forest-related resources on nonindustrial private forest land after the land is damaged by a pine beetle outbreak.</text></subparagraph><subparagraph id="id8d193ffdc3f74f689a6f2ea998ada98a"><enum>(B)</enum><header>Cost share requirement</header><text>Payments made under subparagraph (A) shall not exceed 50 percent of the total eligible itemized costs incurred by a timber service business.</text></subparagraph></paragraph><paragraph id="id091b9877446d4440987ae3c84baee5c5"><enum>(4)</enum><header>Eligibility and provision of payments</header><subparagraph commented="no" display-inline="no-display-inline" id="idf73b72505d74464ca2e5212c591c5eda"><enum>(A)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible for a payment under paragraph (2) or (3), an owner of nonindustrial private forest land or a timber service business, respectively, shall submit to the applicable local office of the Farm Service Agency an application demonstrating that—</text><clause id="ida3f76c16dd844f7fb7f06ff8d9a4576f"><enum>(i)</enum><text>to the satisfaction of the local office, the nonindustrial private forest land on which the outbreak response measures are carried out had tree cover immediately before the pine beetle outbreak;</text></clause><clause id="id4bbb21b4223b44c18301a8239e5902a0"><enum>(ii)</enum><text>the nonindustrial private forest land is located in a county that the Secretary has designated as a primary natural disaster area due to drought in the most recent calendar year; and</text></clause><clause id="id2c1f096668bf4a1fbb997fc3571abb0d"><enum>(iii)</enum><text>forest pest surveys conducted by the Forest Service or a State forestry agency confirm pine beetle infestations on or within a reasonable distance from the nonindustrial private forest land on which the outbreak response measures are carried out.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16b19b88bd834618b1b996f6f9fda074"><enum>(B)</enum><header>Implementation by local offices</header><text>The local offices of the Farm Service Agency, in consultation with the applicable county committees of the Farm Service Agency, shall—</text><clause commented="no" display-inline="no-display-inline" id="id7bcbf813314c4cd69fbe710e2af7a100"><enum>(i)</enum><text display-inline="yes-display-inline">determine whether applicants for payments under paragraphs (2) and (3) are eligible for the payments; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0ed479fd19ad47b6838240cbeedd7b3a"><enum>(ii)</enum><text>provide payments to eligible applicants.</text></clause></subparagraph></paragraph><paragraph id="id15f6deae696c4b8a8dccfba64c8d7865"><enum>(5)</enum><header>Emergency outbreak public assistance grants</header><text>The Secretary may provide supplemental grants to State, Tribal, and local governments to aid in the response to, and repair of damage caused by, pine beetle outbreaks.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id4a40cb0ba13c44d29b416de0fae5dbdb"><enum>3.</enum><header>Emergency loans</header><text display-inline="no-display-inline">Section 321 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1961">7 U.S.C. 1961</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idc71ef7d15e7f47be82524e0a9832e60d"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idefede3955e45414496c29024de1ffaf3"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1151512c1b1449ebb515ccb9d3266817"><subsection id="id920f268e803c49b0a8300fb3fcf118c2"><enum>(d)</enum><header>Loans to owners of nonindustrial private forest land</header><paragraph commented="no" display-inline="no-display-inline" id="idb367a9b5f7e14776ab46a3208218f8f2"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="idc7401744392b4b49b37be26151028259"><enum>(A)</enum><header>Nonindustrial private forest land</header><text>The term <term>nonindustrial private forest land</term> has the meaning given the term in section 407(a) of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2206">16 U.S.C. 2206(a)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8dd5a9928edd4089a62e43e2db035d22"><enum>(B)</enum><header>Outbreak response measures</header><text>The term <term>outbreak response measures</term> has the meaning given the term in section 407(e)(1) of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2206">16 U.S.C. 2206(e)(1)</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida22b35f82f28482abcaf88b24be3aceb"><enum>(2)</enum><header>Loans</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this subtitle, the Secretary may make an emergency loan to an owner of nonindustrial private forest land to carry out outbreak response measures.</text></paragraph><paragraph id="idbf4e62d051154286b0807b2ea368221b"><enum>(3)</enum><header>Amount</header><text>The amount of an emergency loan under this subsection shall be not less than 75 percent of the estimated total cost of the outbreak response measures to be carried out to address a pine beetle outbreak.</text></paragraph><paragraph id="idf00ad4f821944918a2780e6389e1c4a7"><enum>(4)</enum><header>Loan repayment options</header><text>In the case of an owner of nonindustrial private forest land who receives an emergency loan under this subsection and subsequently receives a cost-share payment under section 407(e)(2) of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2206">16 U.S.C. 2206(e)(2)</external-xref>) with respect to the same pine beetle outbreak on the same land, the owner may, at the option of the owner, apply the amount of the cost-share payment to the remaining principal on the emergency loan.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
