which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve financial literacy training for members of the Armed Forces.</official-title></form><legis-body><section id="id633BD31FD997402A87C0E3F41BBEF236" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Service Members Are Ready To Save Act of 2024</short-title></quote> or the <quote><short-title>SMART Save Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idef6eb4dfb5c24c5c90cea0e92195b159"><enum>2.</enum><header display-inline="yes-display-inline">Improvements to financial literacy training</header><subsection id="id50816E603D76430A8F02DCC5C144BD8B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) of section 992 of title 10, United States Code, is amended—</text><paragraph id="id46AEA6EFE3DF4239B6FB97E546843A95"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(C), by striking <quote>grade E–4</quote> and inserting <quote>grade E–6</quote>;</text></paragraph><paragraph id="id451894D250074DB6ABC2F9F9FCECD0B9"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBF5C1533E2F64F8A8F925F60D6295364"><paragraph id="id0A09C3ED3D0B492189269F749EBC05FD" indent="up1"><enum>(5)</enum><text>In carrying out the program to provide training under this subsection, the Secretary concerned shall—</text><subparagraph id="idDBB5482A7249443D921092724D95C5CC"><enum>(A)</enum><text>use a curriculum across all military departments for such training that—</text><clause id="idF7473B00D99A47A998A955EAFF35640A"><enum>(i)</enum><text>focuses on ensuring that members of the armed forces who receive such training develop proficiency in financial literacy rather than focusing on completion of training modules;</text></clause><clause id="id97914C311BAF4B15A797AD347021B075"><enum>(ii)</enum><text>is based on best practices of the Financial Literacy Education Commission established under section 513 of the Financial Literacy and Education Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9702">20 U.S.C. 9702</external-xref>); and</text></clause><clause id="idF65DCB1CC4344660924E9CED7914834D"><enum>(iii)</enum><text>is designed to address the needs of members and their families;</text></clause></subparagraph><subparagraph id="id1FF2FE49A5F2401DBC1BB1EA3AF50060"><enum>(B)</enum><text>ensure that such training—</text><clause id="id49A565C80DC348499FBD27B65E46F0DA"><enum>(i)</enum><text>is conducted by a financial services counselor who is qualified as described in paragraph (3) of subsection (b) or by other means as described in paragraph (2)(A)(ii) of that subsection; </text></clause><clause id="id8B27DD51507342ECAB95D77A85AB5BC9"><enum>(ii)</enum><text>is provided, to the extent practicable and in a manner that does not harm mission readiness—</text><subclause id="id8FD848097C154BBF9CD639EDFB2E95B4"><enum>(I)</enum><text>in a class held in person with fewer than 100 attendees; or</text></subclause><subclause id="id2E0516A42CE8430EA35F2C6B6670D74E"><enum>(II)</enum><text>one-on-one between the member and a financial services counselor or a qualified representative described in subsection (b)(2)(A)(ii)(III); and</text></subclause></clause><clause id="idCBCB205C2C274CD58895500FA62085C9"><enum>(iii)</enum><text>is provided using computer-based methods only if methods described in clause (ii) are impractical or unavailable;</text></clause></subparagraph><subparagraph id="idAD6B89812A6D4DE5B8729470E584A680"><enum>(C)</enum><text>ensure that—</text><clause id="id5F3C3FC8A1794373A34EA14DC09118DE"><enum>(i)</enum><text>an in-person class described in subparagraph (B)(i)(I) is available to the spouse of a member; and</text></clause><clause id="id234E7641E7454F9AB40CA63B33E33ED3"><enum>(ii)</enum><text>if a spouse of a member is unable to attend such a class in person—</text><subclause id="id475CC6708CA14C45BAB29FEBCE0FF93C"><enum>(I)</enum><text>training is available to the spouse through an online program managed by the Department of Defense; and</text></subclause><subclause id="id9E013B5AF07B49678BC6C7201F204A01"><enum>(II)</enum><text>the member is informed during the in-person training of the member under subparagraph (B)(i) with respect to how the member's spouse can access the training; and</text></subclause></clause></subparagraph><subparagraph id="id8F589122F52846538546527A19FD5AAC"><enum>(D)</enum><text>ensure that such training, and all documents and materials provided in relation to such training, are presented or written in manner that the Secretary determines can be understood by the average enlisted member.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="id056CC4517F1040FF883840A91C5BC8F2"><enum>(b)</enum><header>Provision of retirement information</header><text>Such section is further amended—</text><paragraph id="id7FAC80CF9A1E415B97D3789AC6D3D4A9"><enum>(1)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (g), respectively; and</text></paragraph><paragraph id="id1A81EAAE16A641379ED6E99F90F74C27"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection (d):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id725CDBDAD3364752B34AB27FD1035C68"><subsection id="id65548730F1FF438A9A55233622C57A09"><enum>(d)</enum><header>Provision of retirement information</header><text>In each training under subsection (a) and in each meeting to provide counseling under subsection (b), a member of the armed forces shall be provided with—</text><paragraph id="id88FF522EA5C04D119BDD48C84DF2ECF6"><enum>(1)</enum><text>all forms relating to retirement that are relevant to the member, including with respect to the Thrift Savings Plan;</text></paragraph><paragraph id="idFFEBBF14A4514ACC9F2E549B67C6F2B2"><enum>(2)</enum><text>information with respect to how to find additional information; and</text></paragraph><paragraph id="id2F4BB0D04DA646B6AD0C8F6F74F3CA60"><enum>(3)</enum><text>contact information for counselors provided through the Personal Financial Counselor program, the Personal Financial Management program, or online programs managed by the Department of Defense.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD98E4519B15340799EF83312D4FCA149"><enum>(c)</enum><header>Report on effectiveness of financial services counseling</header><paragraph commented="no" display-inline="no-display-inline" id="id204c1c7575aa4b1eaa8ff73a04ad1b9d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees a report on financial literacy training and financial services counseling provided under section 992 of title 10, United States Code, as amended by this section, that assesses—</text><subparagraph id="id5AA7A3A0AC30455D93643A3620FCA62E"><enum>(A)</enum><text display-inline="yes-display-inline">the effectiveness of such training and counseling, which shall be determined using actual localized data similar to the Unit Risk Inventory Survey of the Army; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDA8FC9F840C54F16BF335A13ED914597"><enum>(B)</enum><text>whether additional training or counseling is necessary for enlisted members of the Armed Forces or for officers.</text></subparagraph></paragraph><paragraph id="idaecc0e7d2bcb467ebfecd45e82d5e6bb"><enum>(2)</enum><header>Follow-on report</header><text>Not later than 6 years after the date of the enactment of this Act, the Secretary shall submit to the congressional defense committees a report on the efforts of the Department of Defense to address any concerns raised in the report required by paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1699483aa86b4db48038b0888ffc66b7"><enum>(3)</enum><header>Congressional defense committees defined</header><text>In this subsection, the term <term>congressional defense committees</term> has the meaning given that term in section 101 of title 10, United States Code.</text></paragraph></subsection><subsection id="id5373AB03625C4123A38888DAEB7B1DCC" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Defense may prescribe such regulations as are necessary to carry out the amendments made by this section.</text></subsection></section></legis-body></bill>
