title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Survivor Financial Safety and Inclusion Working Group Act</short-title></quote>.</text></section><section id="H87D52301EFDD42858B2872D86B3519F0"><enum>2.</enum><header>Working Group for Financial Safety and Inclusion for Survivors</header><subsection id="H7BD42871AC604FB7AF132AB981F58E8F"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H76183052B14349198AA18848F164EC5F"><enum>(1)</enum><header>Covered agency</header><text>The term <term>covered agencies</term> means the following:</text><subparagraph id="HE1E284F22D4746F9ABFBCD031CCCE530"><enum>(A)</enum><text>The Department of the Treasury.</text></subparagraph><subparagraph id="H2EDADABD28494C6EB231D3E8252C9335"><enum>(B)</enum><text>The Board of Governors of the Federal Reserve System.</text></subparagraph><subparagraph id="H0C6D4EFE421848EA8E51BD1F176B7517"><enum>(C)</enum><text>The Bureau of Consumer Financial Protection.</text></subparagraph><subparagraph id="H603BB87031EE45F0B42B59891D397FC2"><enum>(D)</enum><text>The Federal Deposit Insurance Corporation.</text></subparagraph><subparagraph id="H8832A5ACCCFF4F3C83EB21428C764CCA"><enum>(E)</enum><text>The Office of the Comptroller of the Currency.</text></subparagraph><subparagraph id="H9A0EC538A1B94D688F6096B6CFDBD53D"><enum>(F)</enum><text>The National Credit Union Administration.</text></subparagraph><subparagraph id="HB7891371F2CE4A3BB5A5FB1E318A3158"><enum>(G)</enum><text>The Securities and Exchange Commission.</text></subparagraph><subparagraph id="H5FFF4681BB8B47878D80FF93D494C66D"><enum>(H)</enum><text>The State insurance regulators.</text></subparagraph></paragraph><paragraph id="H792925EF33C540A48209E85D8FB475A4"><enum>(2)</enum><header>Domestic violence</header><text display-inline="yes-display-inline">The term <term>domestic violence</term> means the use or attempted use of physical abuse or sexual abuse, or a pattern of any other coercive behavior committed, enabled, or solicited to gain or maintain power and control over a survivor, including verbal, psychological, economic, or technological abuse that may or may not constitute criminal behavior, by a person who—</text><subparagraph id="H2BC21A478C8044DD8CF4F04EA89641A0"><enum>(A)</enum><text>is a current or former spouse or intimate partner of the survivor, or person similarly situated to a spouse of the survivor;</text></subparagraph><subparagraph id="HDD5A629FE9A247BBA193AEE8F36153EE"><enum>(B)</enum><text display-inline="yes-display-inline">is cohabitating, or has cohabitated, with the survivor as a spouse or intimate partner;</text></subparagraph><subparagraph id="H1A5EFFCD31884A3AB96D62955DC0388A"><enum>(C)</enum><text>shares a child in common with the survivor; or</text></subparagraph><subparagraph id="H16ECCFD206014D4896843D173F47404B"><enum>(D)</enum><text display-inline="yes-display-inline">commits acts against a youth or adult survivor who is protected from those acts under the family or domestic violence laws of the jurisdiction.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H2E715E2BC9154C458B4EFE20C9C32B0F"><enum>(3)</enum><header>Economic abuse</header><text>The term <term>economic abuse</term> means behavior that is coercive, deceptive, or unreasonably controls or restrains the ability of a person to acquire, use, or maintain economic resources to which they are entitled, including using coercion, fraud, or manipulation, to—</text><subparagraph id="HB5076F25AA4841518584EE6CB0CDD7B9"><enum>(A)</enum><text>restrict access of a person to money, assets, credit, or financial information;</text></subparagraph><subparagraph id="H786AAF7B301D45A493801601B3BFB08B"><enum>(B)</enum><text>unfairly use the personal economic resources of another person, including money, assets, and credit, for the advantage of the person;</text></subparagraph><subparagraph id="HAC372C391B5C4E5790C36701B4A9D5E5"><enum>(C)</enum><text>exert undue influence over the financial and economic behavior or decisions of another person, including forcing default on joint or other financial obligations;</text></subparagraph><subparagraph id="H61493CB40C004F49931CAA8AEF990AC7"><enum>(D)</enum><text>exploit powers of attorney, guardianship, or conservatorship; or</text></subparagraph><subparagraph id="H87B01079E8154BFBA6EE1C81B3A394A1"><enum>(E)</enum><text>fail or neglect to act in the best interest of another person to whom one has a fiduciary duty.</text></subparagraph></paragraph><paragraph id="idAAE905CA5D954B5EB83800BA87437373"><enum>(4)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> means an Indian tribe included on the list published by the Secretary of the Interior under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>). </text></paragraph><paragraph id="H0A6D1E9F318B42ADABFDE0D6565BBCC6"><enum>(5)</enum><header>Low- or moderate-income community</header><text display-inline="yes-display-inline">The term <term>low- or moderate-income community</term> means a census tract designated as low-income or moderate-income by the Financial Institutions Examinations Council on a public website of the Council.</text></paragraph><paragraph display-inline="no-display-inline" id="H7F1325A7281E48EBB155E7C791A18420"><enum>(6)</enum><header>Regulated financial institution</header><text>The term <term>regulated financial institution</term> means—</text><subparagraph id="HA75F77D97A5740BFAE4539570EE91926"><enum>(A)</enum><text>a depository institution, as defined in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>);</text></subparagraph><subparagraph id="H6C0DD9DE919E4F149BB73F0FB6500931"><enum>(B)</enum><text>a Federal credit union or a State credit union, as those terms are defined in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>);</text></subparagraph><subparagraph id="H3FB6DA6F7B5F4FD0B3DD9F99DA7B184E"><enum>(C)</enum><text display-inline="yes-display-inline">an investment adviser, as defined in section 202(a) of the Investment Advisers Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80b-2">15 U.S.C. 80b–2(a)</external-xref>);</text></subparagraph><subparagraph id="H334FC3AEF2374FFFBECBE99F9C2E6F45"><enum>(D)</enum><text display-inline="yes-display-inline">a broker or dealer, as defined in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>); </text></subparagraph><subparagraph id="H7762697D3C15455F95F1198F31E48A16"><enum>(E)</enum><text display-inline="yes-display-inline">an insurance company, as defined in section 2(a) of the Investment Company Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-2">15 U.S.C. 80a–2(a)</external-xref>);</text></subparagraph><subparagraph id="HB8BE678E30124053BCC7515A4B6EA1F6"><enum>(F)</enum><text display-inline="yes-display-inline">any business entity that sells, solicits, or negotiates insurance coverage;</text></subparagraph><subparagraph id="H52B153A45F21425982B04008EE8211A3"><enum>(G)</enum><text display-inline="yes-display-inline">a transfer agent, as defined in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>);</text></subparagraph><subparagraph id="H5401847113B1403E84A60EFC7AF55B87"><enum>(H)</enum><text>an individual who is required under State law to be licensed to sell, solicit, or negotiate insurance coverage; and</text></subparagraph><subparagraph id="H1EF809B5AE214054829A2DFC4F653E2E"><enum>(I)</enum><text>an individual who—</text><clause id="HFBA2E044C81D4C4EBB33930076C9D864"><enum>(i)</enum><text>is employed by, or associated with, an investment adviser; and</text></clause><clause id="H06770086436E4B8280F32A84510217D6"><enum>(ii)</enum><text>does not perform solely clerical or ministerial acts.</text></clause></subparagraph></paragraph><paragraph id="HD4B0F41985D94F4A92B2A507E4F34407"><enum>(7)</enum><header>Rural area</header><text display-inline="yes-display-inline">The term <term>rural area</term> means any county that is mostly rural or completely rural in the latest available decennial census. </text></paragraph><paragraph display-inline="no-display-inline" id="H8B147C85174C4395A005266C5065B30E"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means each of the several States of the United States and the District of Columbia.</text></paragraph><paragraph id="H917DC74C2AE9403691DEFDCF64912841"><enum>(9)</enum><header>Survivor</header><text>The term <term>survivor</term> means an individual who is or has previously been subjected to domestic violence, including economic abuse.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7204e2e11a2b484caa29a6ae0e21e934"><enum>(10)</enum><header>Territory of the United States</header><text>The term <term>territory of the United States</term> means—</text><subparagraph id="ID3101047A4BF14895A4996D0E3B56607E"><enum>(A)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph id="ID7162086E82BE4862A921D0568448B976"><enum>(B)</enum><text>Guam;</text></subparagraph><subparagraph id="IDC397CB348D70414D852ED0B69C50A495"><enum>(C)</enum><text>American Samoa;</text></subparagraph><subparagraph id="IDEC09872E97EB435AA63029F6A624BB53"><enum>(D)</enum><text>the Commonwealth of the Northern Mariana Islands; and</text></subparagraph><subparagraph id="ida5f3a097818e42c2b472f379e74493c4" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>the United States Virgin Islands. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id729d4b417f804da69b4b5c267b4bf00f"><enum>(11)</enum><header>Working Group</header><text>The term <term>Working Group</term> means the interagency working group established under subsection (b).</text></paragraph></subsection><subsection id="H88D7984B58EA4F59A15862FACEABDC40"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established an interagency working group to study the following:</text><paragraph id="HFFB9926A0D254C7D9300E055DA15AAAC"><enum>(1)</enum><text>How Congress and covered agencies can support regulated financial institutions in safely and confidentially collecting data on—</text><subparagraph id="HB24D77EDB6E344C497E81F292C5E2B31"><enum>(A)</enum><text>the types and prevalence of economic abuse tactics that are being carried out through regulated financial institutions; and</text></subparagraph><subparagraph id="H08B0F0777AC443A39948BA987C1D9378"><enum>(B)</enum><text>the impacts of economic abuse tactics on consumers and regulated financial institutions.</text></subparagraph></paragraph><paragraph id="H41C17E8D6EEF4A3ABE2051C785F9A346"><enum>(2)</enum><text>Data from regulated financial institutions on the statistics, trends, and impacts of economic abuse carried out through regulated financial institutions.</text></paragraph><paragraph id="H995C4656257943C99B4D2F73F778A4A7"><enum>(3)</enum><text>How regulated financial institutions can improve existing financial products and services and design and offer new financial products and services specially tailored to meet the financial and safety needs of survivors.</text></paragraph><paragraph id="H917ACC7291CD46ADBC766D1B976A121A"><enum>(4)</enum><text display-inline="yes-display-inline">How the recommendations and guidance provided by the Working Group account for any additional financial or safety needs of historically underbanked and underserved communities, including rural communities, low- or moderate-income communities, Indian tribes, and territories of the United States. </text></paragraph><paragraph id="HF28B88DA7C944FD3A6B9D0DED486AD4A"><enum>(5)</enum><text>Any legislative or regulatory authority necessary to implement any recommendations or guidance provided by the Working Group.</text></paragraph></subsection><subsection id="HDA410465C4BA48978E50A8D629DB278C"><enum>(c)</enum><header>Membership</header><text>The Working Group shall be comprised of the following:</text><paragraph id="H088B3CD0D98642259CC76D81ECECA9A1"><enum>(1)</enum><text>The head of each of the following, or the head’s designee:</text><subparagraph id="H8F7096EA71D54C7AA52D6B1D59E848ED"><enum>(A)</enum><text>The Department of the Treasury.</text></subparagraph><subparagraph id="H6C490DA9C592478AA63AC29EA751B1AD"><enum>(B)</enum><text>The Board of Governors of the Federal Reserve System.</text></subparagraph><subparagraph id="H1CD6E53169DD468D8E958BB105A36864"><enum>(C)</enum><text>The Bureau of Consumer Financial Protection.</text></subparagraph><subparagraph id="HEF01F348181A43E28DA588578554485E"><enum>(D)</enum><text>The Federal Deposit Insurance Corporation.</text></subparagraph><subparagraph id="H5886B428663246DC9423C2E9D79FFF31"><enum>(E)</enum><text>The Office of the Comptroller of the Currency.</text></subparagraph><subparagraph id="H3A9CC566D2ED464D834E9F0F3F5DB8AA"><enum>(F)</enum><text>The National Credit Union Administration.</text></subparagraph><subparagraph id="H97097E93478C4ABB8050F0A8E5FEF03D"><enum>(G)</enum><text>The Securities and Exchange Commission.</text></subparagraph></paragraph><paragraph id="H8CACA5CF55804BDB995712C11573A509"><enum>(2)</enum><text>A State insurance commissioner selected by the State insurance commissioners (through the National Association of Insurance Commissioners).</text></paragraph><paragraph id="H3FB5018A2FB44C61875ADEDCACB03F9E"><enum>(3)</enum><text display-inline="yes-display-inline">One individual with expertise in economic abuse and experience working with and advocating on behalf of survivors of domestic violence, appointed by the Secretary of the Treasury. </text></paragraph><paragraph id="H1E45AA804DF5499D96D131EABBA3C9F3"><enum>(4)</enum><text display-inline="yes-display-inline">One individual with expertise in consumer protection and experience working with and advocating on behalf of consumers, appointed by the Secretary of the Treasury. </text></paragraph><paragraph id="H0877319D6F8F4216A7F4B0495DA4C65B"><enum>(5)</enum><text display-inline="yes-display-inline">One individual who is a member of, and has experience working with and advocating on behalf of, communities that have been historically underbanked and unbanked, including rural communities, low- or moderate-income households, Indian tribes, and territories of the United States, appointed by the Secretary of the Treasury.<italic></italic></text></paragraph><paragraph id="HA87A7A5607A0475E9D78D288FC43C8A9"><enum>(6)</enum><text display-inline="yes-display-inline">Any other individuals, but no more than 4, appointed by the Secretary of the Treasury, as the Secretary determines appropriate. <italic></italic></text></paragraph></subsection><subsection id="H499F13B094064696BDCD7D1DF4396F53"><enum>(d)</enum><header>Chairperson</header><text>The Secretary of the Treasury (or the Secretary’s designee, as applicable) shall serve as the chairperson of the Working Group.</text></subsection><subsection id="H5215B9170E1E4BB4A387F90A01ACCA72"><enum>(e)</enum><header>Terms</header><paragraph id="HE4B0D96421464522972420CF4F1C9C99"><enum>(1)</enum><header>In general</header><text>A member of the Working Group shall serve a term of 2 years.</text></paragraph><paragraph id="H2A645F454563426086C8517F36FC5F07"><enum>(2)</enum><header>Limitation</header><text>Each individual appointed under paragraphs (3) through (6) of subsection (c) may only serve 1 term. </text></paragraph><paragraph id="H1651BA3526ED40CC82BB9AF8381CDEDE"><enum>(3)</enum><header>First term</header><text>The first term of the Working Group shall begin on January 1st of the first calendar year that begins after the date of enactment of this Act. </text></paragraph></subsection><subsection id="HABD89D14D08146DCA82DBB723034BE15"><enum>(f)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Working Group shall convene not later than 60 days after the beginning of the first term of the Working Group and shall meet not less frequently than twice a year thereafter.</text></subsection><subsection id="H939F784E43004E20906AADA6AE448D7F"><enum>(g)</enum><header>Compensation</header><text>Members of the Working Group shall receive no additional compensation by reason of their service on the Working Group.</text></subsection><subsection id="H027145193B124C019A98653CFFE3B857"><enum>(h)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">Members of the Working Group shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from home or regular places of business in performance of service for the Working Group. </text></subsection><subsection id="H654E1A641971417F9FE82AA0DC6C0F9D"><enum>(i)</enum><header>Annual reports</header><paragraph id="H48B5ED16352A43C98F662CF3A5B1081A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Working Group shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives an annual report regarding—</text><subparagraph id="H5D227BDE75CA4E118E4CED0D1E464528"><enum>(A)</enum><text>the activities of the Working Group; and</text></subparagraph><subparagraph id="H87F394742F6C4F859827709301A870A0"><enum>(B)</enum><text>the study required under subsection (b).</text></subparagraph></paragraph><paragraph id="HAB877E2CFC884C1699A5905A3668159F"><enum>(2)</enum><header>Public availability</header><text>The report under paragraph (1) shall be made publicly available online and in accessible format that complies with section 4(b) of the Plain Writing Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/5/301">5 U.S.C. 301</external-xref> note) and Executive Order 13166 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-1">42 U.S.C. 2000d–1</external-xref> note; relating to access to services for persons with limited English proficiency). </text></paragraph></subsection><subsection id="H26290554E2DB4E0480C417C6E2FC4762"><enum>(j)</enum><header>Congressional testimony</header><text>The head of an agency described under subparagraphs (A) through (G) of subsection (c)(1) shall, when providing the semiannual written testimony and appearing before the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives, include information on the activities of the agency as part of the Working Group.</text></subsection><subsection id="HBC248AB86B9A4CBB939B2DCE252D366A"><enum>(k)</enum><header>Transparency</header><text>To the greatest extent practicable, the Working Group shall operate in a transparent manner that adheres to the requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code, with the exception that the Working Group shall be permitted to freely communicate both during and between meetings in a confidential manner to discuss non-public information and other sensitive and nonpublic issues.</text></subsection></section></legis-body></bill>
