which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase duties imposed with respect to autos imported into the United States that originate in the People’s Republic of China, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting American Autoworkers from China Act of 2024</short-title></quote>.</text></section><section id="id5240ad8dac324391ad9c8b8fe86efe4e"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id396b6ef7930d40fca5f4d1130013df13" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Control</header><text>The term <term>control</term> has the meaning given that term in section 800.208 of title 31, Code of Federal Regulations (as in effect on the date of the enactment of this Act). </text></paragraph><paragraph id="id0a9aefb435f44551910fd5fee779ed51"><enum>(2)</enum><header>GATT 1947</header><text>The term <term>GATT 1947</term> has the meaning given that term in section 2 of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3501">19 U.S.C. 3501</external-xref>).</text></paragraph><paragraph id="ide4301a89171f4451999cc618bb606dbf"><enum>(3)</enum><header>HTS</header><text>The term <term>HTS</term> means the Harmonized Tariff Schedule of the United States.</text></paragraph><paragraph id="id00dc10e401844b75828fc2e2f67ce577" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Schedule of concessions</header><text>The term <term>Schedule of Concessions</term> has the meaning given the term <term>Schedule XX</term> in section 2 of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3501">19 U.S.C. 3501</external-xref>). </text></paragraph></section><section id="ida83c39c1dfbe4d5e84ef69dcc8af2009"><enum>3.</enum><header>Increase of duty on autos originating in People’s Republic of China</header><subsection id="id6a70b720bf7d4726b7cff05cf0543226"><enum>(a)</enum><header>In general</header><text>Effective on the date of the enactment of this Act, heading 8703 of the HTS shall be applied and administered with respect to imports originating in the People’s Republic of China—</text><paragraph id="idE9E243ED01014A5890B3B5066987A23C"><enum>(1)</enum><text>in the column 1 general rate of duty column, by substituting <quote>100%</quote> for the rate of duty otherwise applicable; and</text></paragraph><paragraph id="idF6E2F2F0030144789B76096B4579C8DB"><enum>(2)</enum><text>in the column 2 rate of duty column, by substituting <quote>100%</quote> for the rate of duty otherwise applicable.</text></paragraph></subsection><subsection id="ida99e7c24e47b41ddb1f3a94c3bf7f13f"><enum>(b)</enum><header>Modification of schedule of concessions to GATT 1994</header><text display-inline="yes-display-inline">With due regard for the international obligations of the United States, particularly Article XXXVIII of the GATT 1947 requiring any suspension of trade agreement concessions to be made on a most-favored nation basis, the United States Trade Representative shall take the necessary steps to modify the Schedule of Concessions to accommodate the increase under subsection (a) in the rate of duty applicable to articles covered under heading 8703 of the HTS that originate in the People’s Republic of China. </text></subsection><subsection id="id79cb5c6eb6bd4fafb1e0eb470afbab86"><enum>(c)</enum><header>Rules of origin</header><text display-inline="yes-display-inline">For purposes of this section, an article covered under heading 8703 of the HTS originates in the People’s Republic of China if the article is—</text><paragraph id="id27f28ccc58484648944f84923c5ef769"><enum>(1)</enum><text>produced in the People’s Republic of China;</text></paragraph><paragraph id="id4ca3bd73a19a4f53a5913af41b92ad4c"><enum>(2)</enum><text>produced by an entity organized under the laws of or otherwise subject to the jurisdiction of the People’s Republic of China, without regard to the country in which that entity is located; or</text></paragraph><paragraph id="idaeddca3793134ab68f56a02f2c684da0"><enum>(3)</enum><text>produced by an entity over which control is exercised by an entity organized under the laws of or otherwise subject to the jurisdiction of the People’s Republic of China, without regard to the country in which either such entity is located.</text></paragraph></subsection></section></legis-body></bill>
