which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Low-Income Household Water Assistance Program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Low-Income Household Water Assistance Program Establishment Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id7d15162236df4a8aa6d236596b5399a9"><enum>2.</enum><header>Low-Income Household Water Assistance Program</header><subsection id="id9aa6b9827f024acca04e132dbb729d7a"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="idf7b5ec636c4d46f6ac20e79985c1837b"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="ide5f5e514364146a09af1227bb3d840a9"><enum>(2)</enum><header>Household</header><text>The term <term>household</term> means any individual or group of individuals who are living together as 1 economic unit.</text></paragraph><paragraph id="id8cbdf0fb33fa426d935332c88e05ba87"><enum>(3)</enum><header>Low-income household</header><text>The term <term>low-income household</term> means a household—</text><subparagraph id="id013c284c25894aae96a93effc17e15b9"><enum>(A)</enum><text>in which 1 or more individuals are receiving—</text><clause commented="no" display-inline="no-display-inline" id="id9f9602d158d7424881c35930f4526302"><enum>(i)</enum><text>assistance under the State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id509763e6ac46412c8c0f1c87a6d85e9f"><enum>(ii)</enum><text>supplemental security income payments under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="idc10d7dbe464249b6a65257d54b578511"><enum>(iii)</enum><text>supplemental nutrition assistance program benefits under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); </text></clause><clause commented="no" display-inline="no-display-inline" id="id550e9962965a4cac916820d8aab9f3f7"><enum>(iv)</enum><text>payments under—</text><subclause commented="no" display-inline="no-display-inline" id="ida7e57f1cd9864faea01a0e06e7eb72b5"><enum>(I)</enum><text>section 1315, 1521, 1541, or 1542 of title 38, United States Code; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id66dda042f05c4174bfd5be90bb51d218"><enum>(II)</enum><text>section 306 of the Veterans’ and Survivors’ Pension Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/38/1521">38 U.S.C. 1521</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/95/588">Public Law 95–588</external-xref>); or</text></subclause></clause><clause id="id77d9909f3ddf4e768bf14b919820e9b0"><enum>(v)</enum><text>assistance under the Low-Income Home Energy Assistance Act of 1981; or</text></clause></subparagraph><subparagraph commented="no" id="idfc9c327623404051a46c08fca787992b"><enum>(B)</enum><text>that has a household income that, as determined by the State or Indian tribe, does not exceed the greater of—</text><clause commented="no" display-inline="no-display-inline" id="idaee26cb6a59d4b029b7729adeda4efcb"><enum>(i)</enum><text>an amount equal to 150 percent of the poverty level; </text></clause><clause commented="no" display-inline="no-display-inline" id="idc0377396473941cfb1fa7ff08c2dd9c0"><enum>(ii)</enum><text display-inline="yes-display-inline">an amount equal to 60 percent of the State median income for that State or the State in which the Indian tribe is primarily located; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id276273d4ce6843fb850316eef10a1945"><enum>(iii)</enum><text>an amount equal to 60 percent of the area median income for the area in which the household is located.</text></clause></subparagraph></paragraph><paragraph commented="no" id="idc0112f64898c4482b300e72f050887be"><enum>(4)</enum><header>Poverty level</header><text>The term <term>poverty level</term> means the poverty line determined pursuant to section 673 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>).</text></paragraph><paragraph id="idb409d5379a67488f9748ad9b8fada0df"><enum>(5)</enum><header>Public water system</header><text>The term <term>public water system</term> has the meaning given the term in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9847cf4668e941c1a2ec2ff50070f387"><enum>(6)</enum><header>Qualified nonprofit organization</header><text>The term <term>qualified nonprofit organization</term> includes a nonprofit organization described in section 680(a)(3)(B) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9921">42 U.S.C. 9921(a)(3)(B)</external-xref>).</text></paragraph><paragraph id="idc375e9a2fa154e0d86a01532edfd9c29"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph><paragraph id="id99183a60118d4ccd958df1824dd367e5"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means any of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the United States Virgin Islands, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text></paragraph><paragraph id="id8a38e270ae694221867c253d237dd612"><enum>(9)</enum><header>Treatment works</header><text>The term <term>treatment works</term> has the meaning given the term in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>). </text></paragraph></subsection><subsection id="idb7b00ab2c0a642dc81e7c6c15fc2b4b1"><enum>(b)</enum><header>Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="idbd84447a5c1d45a6ad25a73fc14ec2f3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary, in consultation with the Administrator, shall establish the Low-Income Household Water Assistance Program to award grants, in accordance with paragraph (3), to eligible entities described in paragraph (2) to provide funds to owners and operators of public water systems or treatment works to assist low-income households in paying arrearages and other rates charged to such households for drinking water or wastewater services.</text></paragraph><paragraph id="id02bee35a5fcf49b5a5e6841e895dc5e0"><enum>(2)</enum><header>Eligible entities</header><text>An eligible entity described in this paragraph is a State, or Indian tribe, that is eligible to receive or previously received a grant under the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8621">42 U.S.C. 8621 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id564d6f0f768b4cfda5c18438df07e884"><enum>(3)</enum><header display-inline="yes-display-inline">Formula</header><text>In awarding grants under this subsection to eligible entities, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2b745213e7454fa7a1d0482496b0cd23"><enum>(A)</enum><text display-inline="yes-display-inline">allot amounts made available for grants under this subsection to an eligible entity that is a State or Indian tribe based on—</text><clause id="id94efad533b534896adaecb351d716133"><enum>(i)</enum><text>the percentage of households in the State, or under the jurisdiction of the Indian tribe, with income equal to or less than 150 percent of the poverty level; or</text></clause><clause commented="no" id="id0a68f4e9e58b4b43973b300f6bf7c00c"><enum>(ii)</enum><text>the percentage of households in the State, or under the jurisdiction of the Indian tribe, that spend more than 30 percent of monthly income on housing; and</text></clause></subparagraph><subparagraph id="id3ec0223e7c794a2083d0a86dc2d9d2b2"><enum>(B)</enum><text>reserve up to 3 percent of amounts made available for grants under this subsection to eligible entities that are Indian tribes.</text></subparagraph></paragraph></subsection><subsection id="id8ca8b002ff7946239a4821090f4f37e4"><enum>(c)</enum><header>Rural, underserved, and Indian Tribe access grants</header><text>The Secretary shall provide grants to qualified nonprofit organizations to assist owners or operators of public water systems or treatment works, in rural or underserved areas or in the jurisdiction of an Indian tribe, in accessing funds through the Low-Income Household Water Assistance Program. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd589524885d84621947c8c5c09a75680"><enum>(d)</enum><header display-inline="yes-display-inline">Applications</header><text>Each eligible entity seeking a grant under subsection (b) shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary shall require.</text></subsection><subsection id="id022ec187f61a4cc493fc0c4679c758ca"><enum>(e)</enum><header>Limitations</header><text>A recipient of a grant under subsection (b) or (c)—</text><paragraph id="id457847974cbf476e9958234c645851b7"><enum>(1)</enum><text>shall not use the funds from the grant to supplant any other funds for any program that assists low-income households in maintaining access to affordable drinking water or wastewater services; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id855b384f5bee4967914968a07fa0848f"><enum>(2)</enum><text>may use the funds from the grant to supplement or otherwise enhance any such program that satisfies the requirements under this section. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idddb88790190546c8bb95dd989a3ea0f2"><enum>(f)</enum><header>Technical assistance for eligibility requirements</header><text>The Secretary shall provide technical assistance to eligible entities receiving a grant under subsection (b) for such eligible entities to establish data sharing agreements to streamline categorical eligibility requirements for low-income households. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id2f4d20ef25cf447a81d433e6d25ed201"><enum>(g)</enum><header>Transfer to the Environmental Protection Agency</header><paragraph commented="no" display-inline="no-display-inline" id="idc334981e6ea34576a56407e47c6228a2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On the date on which the final report described in section 50109(d) of the Infrastructure Investment and Jobs Act (42 U.S.C. 300j–19a note; <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 1148) is submitted to Congress under such section, the Secretary, in coordination with the Administrator, shall transfer the Low-Income Household Water Assistance Program established under this section to the Environmental Protection Agency for administration of such program by the Administrator in accordance with this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida1c6bf1e92ce43c1af27a4362cbd5f6f"><enum>(2)</enum><header>Administration</header><subparagraph commented="no" display-inline="no-display-inline" id="ida915caec190a4932855c2b6531eb56ea"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Beginning on the date described in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="idebaf9185f59942c59132585cdacdd718"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator shall carry out all functions of the Secretary under this section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id82bf764c4eb44064aea2740ff4dbdf57"><enum>(ii)</enum><text>for purposes of administering the program established under this section, each reference in subsections (b)(3), (c), (d), and (f) to the Secretary shall be deemed a reference to the Administrator.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8dbc6d9b88a4f8394a4a1327386f2b6"><enum>(B)</enum><header>Grants previously awarded</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1) and subparagraph (A), the Secretary shall continue, after the transfer under paragraph (1), administering each grant awarded under this section prior to such transfer until the expiration of the term of such grant.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd24ef1ac996f443eb3c4a07713d44de2"><enum>(3)</enum><header>Unobligated balances</header><text>On the date described in paragraph (1) and subject to section 1531 of title 31, United States Code, the Secretary shall initiate transfer of all unobligated balances of appropriations, authorizations, allocations, or other funds available to the Low-Income Household Water Assistance Program established under this section (except for any such balances related to grants awarded prior to the transfer under paragraph (1)) to the Administrator. The amounts of any such unobligated balances so transferred shall be used only for the purposes for which the amounts were originally authorized and appropriated.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3285551a33594fe598683746af9042f0"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section></legis-body></bill>
