<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3805</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240227">February 27, 2024</action-date><action-desc><sponsor name-id="S373">Mr. Cassidy</sponsor> (for himself and <cosponsor name-id="S275">Ms. Cantwell</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XI of the Social Security Act to prohibit health plans from imposing fees on health care providers for electronic funds transfers and health care payment and remittance advice transactions, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H31F13A4B78B3474BBD7F9270443E676D"><section section-type="section-one" id="H79A79BD5F3394A0BA2903A11EBA209F9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Fees for EFTs Act</short-title></quote>.</text></section><section id="H58FEE3742FFB41C5A33480ACD67B39BF"><enum>2.</enum><header>Prohibiting health plans from imposing fees on health care providers for electronic funds transfers and health care payment and remittance advice transactions</header><text display-inline="no-display-inline">Section 1173(g)(4)(B)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2(g)(4)(B)(ii)</external-xref>) is amended—</text><paragraph id="HA0FDA5AF93DB46CE9CF9FC006D7D4D22"><enum>(1)</enum><text>in subclause (I), by striking at the end <quote>and</quote>;</text></paragraph><paragraph id="H6FCC3FA94A674C25BA30DF4606A19C3C"><enum>(2)</enum><text>in subclause (II), by striking at the end the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H83EC1074BDB14874BB0DB45209673FC4"><enum>(3)</enum><text>by adding at the end the following new subclause:</text><quoted-block style="OLC" id="H304AAB7D429C40939C04D4956F9FF39D"><subclause id="H5DBC7D8ADB6745029044DA6BD1C01531"><enum>(III)</enum><text display-inline="yes-display-inline">prohibit the imposition of any charge, fee, or other payment (including through a withhold from payment) by a health plan or entity completing the transaction on the plan’s behalf, on a health care provider for electronic fund transfers and health care payment and remittance advice transactions made on or after January 1, 2025.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
