<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3777</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240208" legis-day="20240207">February 8 (legislative day, February 7), 2024</action-date><action-desc><sponsor name-id="S401">Mr. Romney</sponsor> (for himself and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBU00">Committee on the Budget</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require Congress to budget in advance for disasters, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id2FB213F915054C258C1F3E160E74EE0B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Budgeting for Disasters Act</short-title></quote>.</text></section><section id="ide1867e834c104f689e2988379795ffed"><enum>2.</enum><header>Termination of exemptions from the annual budget caps</header><text display-inline="no-display-inline">Subparagraphs (D) and (F) of section 251(b)(2) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901(b)(2)</external-xref>) shall not apply with respect to fiscal year 2025, or any fiscal year thereafter.</text></section><section id="id673d003aadde427aa18355af43d89b13"><enum>3.</enum><header>Emergency spending point of order</header><subsection id="id6D4486E486184484BE2C07F1977DFF5A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 314(e)(2) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/645">2 U.S.C. 645(e)(2)</external-xref>) is amended by striking <quote>three-fifths</quote> each place it appears and inserting <quote>two-thirds</quote>.</text></subsection><subsection id="id5EA4DF69C0164657B232A0B65B758B9F"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall—</text><paragraph id="id0C79E16729B34A4F8030D4B1029758E5"><enum>(1)</enum><text>take effect on the date of enactment of this Act; and</text></paragraph><paragraph id="id168A78E93D8D4DB3BE2D38E34D4F7ADB"><enum>(2)</enum><text>apply with respect to fiscal year 2025, and each fiscal year thereafter.</text></paragraph></subsection></section><section id="idb8378be1bacb4624b15c41c1174e63ef"><enum>4.</enum><header>GAO review of emergency spending</header><subsection id="id366F25687CE648889AD7F6E91FE51A7D"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id4F3EAB98FF8D4C9690026BB55FBA4179"><enum>(1)</enum><text>the term <term>designated as being for an emergency requirement</term>, with respect to amounts appropriated, means that the amounts are designated as an emergency requirement pursuant to—</text><subparagraph id="id2FB0AF7CA362446693F826E992F69623"><enum>(A)</enum><text>section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901(b)(2)(A)(i)</external-xref>); or</text></subparagraph><subparagraph id="id042E54C74A114361A52D4F0B78CFFC00"><enum>(B)</enum><text>a provision of a concurrent resolution on the budget;</text></subparagraph></paragraph><paragraph id="id6E3DE65B5D5D420AA3FBD7202B00A017"><enum>(2)</enum><text>the term <term>designated as being for disaster relief</term>, with respect to amounts appropriated, means that the amounts are designated as being for disaster relief pursuant to section 251(b)(2)(D) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901(b)(2)(D)</external-xref>);</text></paragraph><paragraph id="idABE36B424DAA4DC99AA239BA2EECEF2D"><enum>(3)</enum><text>the term <term>emergency</term> means an emergency declared by the President under section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>); and</text></paragraph><paragraph id="id19c8ea22fa4b4d25b3c9902e4310e06e" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>the term <term>major disaster</term> means a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>).</text></paragraph></subsection><subsection id="idE726327966104912A8CB8DF423128D67"><enum>(b)</enum><header>Report</header><text>Not later than 540 days after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that—</text><paragraph id="id0F3E2771FB1F4B5AB74508A71F7D06C6"><enum>(1)</enum><text>identifies amounts appropriated for each of fiscal years 2015 through 2024 that were—</text><subparagraph id="id3E4F9C6EDD5D4BDAB32301F4E2E1FE08"><enum>(A)</enum><text>designated as being for an emergency requirement;</text></subparagraph><subparagraph id="id6A45C7B3EBA743758448330EF1C62D83"><enum>(B)</enum><text>designated as being for disaster relief; or</text></subparagraph><subparagraph id="id6FE868CBEB5F49328FD3202A1A4B4F86"><enum>(C)</enum><text>made available to provide assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>);</text></subparagraph></paragraph><paragraph id="id878DBA815AD74C48B5436A39E87057FF"><enum>(2)</enum><text>addresses—</text><subparagraph commented="no" display-inline="no-display-inline" id="id37adcd475a7f4c66a295a733c32ec7d7"><enum>(A)</enum><text display-inline="yes-display-inline">the definition of emergency requirements for purposes of appropriated amounts being designated as being for an emergency requirement;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf1fc543ebd6428c83610ce0a5f8343b"><enum>(B)</enum><text>the time period during which recipients of appropriated amounts designated as being for an emergency requirement may obligate those amounts;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1abcacc6e7c54793ac26ebc2ec2471bf"><enum>(C)</enum><text display-inline="yes-display-inline">any cost-sharing requirements relating to major disasters and emergencies for State, local, Tribal, and territorial governments; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4c8657620a6546f2a9a1f46bf0fc7e40"><enum>(D)</enum><text display-inline="yes-display-inline">forecasting and budgeting for disaster-related appropriations; and</text></subparagraph></paragraph><paragraph id="id347D08374CC14EC5A53E5EC423A3BF24"><enum>(3)</enum><text>provides recommendations to—</text><subparagraph id="id4BAB3FA0EA7B4FFB96173371AE8EA7C5"><enum>(A)</enum><text>clarify the definition of emergency requirements for purposes of appropriated amounts being designated as being for an emergency requirement;</text></subparagraph><subparagraph id="id12CAD4D1E9194CDD911AAD0A372715A5"><enum>(B)</enum><text>implement an appropriate time limit for recipients to spend appropriated amounts that are designated as being for an emergency requirement;</text></subparagraph><subparagraph id="idE3A29C3B584642738DDFF5DFF34D4F80"><enum>(C)</enum><text>improve cost-sharing relating to major disasters and emergencies among Federal, State, and local governments; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id73ACCE3762DD4526B57410BAF160785E"><enum>(D)</enum><text>improve forecasting and budgeting for appropriations for emergency requirements and disaster relief.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
