which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Credit Act of 1978 to authorize the Secretary of Agriculture to carry out emergency watershed protection measures on National Forest System land, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Watershed Protection and Forest Recovery Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id01fdd75a867946a5a7dfd16d6ff37ba2"><enum>2.</enum><header>Emergency forest watershed program</header><subsection commented="no" display-inline="no-display-inline" id="ide466efbded52461ba7588f8b2391c6e5"><enum>(a)</enum><header>Funding and administration</header><text>Section 404(b) of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2204">16 U.S.C. 2204(b)</external-xref>) is amended by inserting <quote>to carry out section 401</quote> after <quote>for a fiscal year</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id2a502ced960d4edb9abd1dc44372f048"><enum>(b)</enum><header>Emergency forest watershed program</header><text>Title IV of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2201">16 U.S.C. 2201 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5d021b93a63c4653b01b6b07dd21cc36"><section commented="no" display-inline="no-display-inline" id="iddea15cb7c8784560a521f5f8f74d4cc8"><enum>408.</enum><header>Emergency forest watershed program</header><subsection commented="no" display-inline="no-display-inline" id="id98778baf85d447699b5ac694d532cc4a"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id5581bc0337284c46858aec787ef36c5d"><enum>(1)</enum><header>Emergency watershed protection measures</header><text>The term <term>emergency watershed protection measures</term> means measures that—</text><subparagraph id="IDF910FA6B05AA4F6E92E55E7E91C04513"><enum>(A)</enum><text>are necessary to address runoff retardation, soil-erosion prevention, and flood mitigation caused by a natural disaster or any other natural occurrence that has caused a sudden impairment to natural resources on National Forest System land, and the damage, if not treated—</text><clause id="ID39B6CAD9C6874409AEDFC61C80BAAB25"><enum>(i)</enum><text>would significantly impair or endanger the natural resources on the National Forest System land; and</text></clause><clause id="ID16A609C42D66442AA95F2F1E687E22DA"><enum>(ii)</enum><text>would pose an immediate risk to water resources or loss of life or property downstream of the National Forest System land; and</text></clause></subparagraph><subparagraph id="ID201F2FD1C5D443BB83744470BB064B32"><enum>(B)</enum><text>would maintain or restore forest health and forest-related resources on the National Forest System land.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb35cffdda7ad4d0da1dd86cff3efd5e0"><enum>(2)</enum><header display-inline="yes-display-inline">Natural disaster</header><text>The term <term>natural disaster</term> has the meaning given the term in section 407(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0f18261a9eff4e25b26eca7bd139dfa1"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary, acting through the Chief of the Forest Service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe37db60b5a640b2bbbc5e7c9ee4dab0"><enum>(4)</enum><header>Sponsor</header><text>The term <term>sponsor</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb9e224b3bfa34538b298ab8ef3574448"><enum>(A)</enum><text>a State or local government;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idff2114527ae74079b6c9c53166fa9d7b"><enum>(B)</enum><text>an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbb0c41b218d549de9fe6e77d296b7bbd"><enum>(C)</enum><text>a water district, water conservation district, water utility, or special district.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id37141df96d7f4239a78f25d4006b64e5"><enum>(b)</enum><header>Authorization</header><text>The Secretary, acting through a sponsor, is authorized to undertake emergency watershed protection measures on National Forest System land.</text></subsection><subsection id="idbf98979f25e7488cafaaad17c3ab3e36"><enum>(c)</enum><header>Agreements; payments</header><paragraph commented="no" display-inline="no-display-inline" id="id07ad8ba04ca04170a1bc695917b8b164"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may enter into an agreement with a sponsor and make payments to the sponsor, on request of the sponsor, to carry out emergency watershed protection measures.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e69ca01da75454bbef55fe82af21e4c"><enum>(2)</enum><header>Requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="id0566a27e6f7c46fb982fe5cf3fd75307"><enum>(A)</enum><header>Project timelines</header><clause commented="no" display-inline="no-display-inline" id="ide0820322e1534b9288556e869031bbd9"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Following a natural disaster or natural occurrence that necessitates the carrying out of emergency watershed protection measures, the Secretary shall execute agreements under paragraph (1) as expeditiously as possible.</text></clause><clause commented="no" display-inline="no-display-inline" id="idf7244b3fe8d049a6a9f3898da1bb1238"><enum>(ii)</enum><header>Timeline</header><text>A sponsor that has entered into an agreement under paragraph (1) shall complete all emergency watershed protection measures not later than 2 years after the conclusion of the applicable natural disaster or natural occurrence, as determined by the Secretary, that necessitated the carrying out of those measures.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2bc1b6b5b6454c15beb3494d1eb31f37"><enum>(iii)</enum><header>Continued monitoring</header><text>A sponsor that has entered into an agreement under paragraph (1) may monitor, maintain, repair, or replace emergency watershed protection measures for a period of not more than 3 years following the conclusion of the natural disaster or natural occurrence, as determined by the Secretary, that necessitated the carrying out of those measures when failure to do so would result in unacceptable risk to National Forest System land or downstream water users.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22563ec3f8d041208b3db9bc2cd67039"><enum>(B)</enum><header display-inline="yes-display-inline">Payments</header><text>The Secretary, in accordance with an agreement entered into under paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="idd0c74f0c88eb4a1cb3e9cb612bc436a1"><enum>(i)</enum><text display-inline="yes-display-inline">may make partial payments prior to completion of the applicable project; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idec130f9215674925948aba75486e82dd"><enum>(ii)</enum><text>shall make final payment for the project not later than 30 days after the date on which the project is completed.</text></clause></subparagraph></paragraph></subsection><subsection id="id724bd1be6be74272ab214dda78d09eb2"><enum>(d)</enum><header>Waived matching requirements</header><text>The Secretary shall waive any matching requirements for payments made under subsection (c)(1).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4fbb0b38b15e4a1682b09fa1092cc660"><enum>(e)</enum><header>Liability</header><paragraph commented="no" display-inline="no-display-inline" id="id17c64782185b4e628c810ee1f663a4cd"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A sponsor that carries out emergency watershed protection measures pursuant to an agreement under subsection (c)(1) shall not—</text><subparagraph commented="no" display-inline="no-display-inline" id="idae5bb4777c414483868c6078a1d12a19"><enum>(A)</enum><text display-inline="yes-display-inline">be required to indemnify the United States for any liability resulting from carrying out emergency watershed protection measures pursuant to that agreement; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f578caeeba941c0869e3a473e6880e1"><enum>(B)</enum><text display-inline="yes-display-inline">except as provided in paragraph (2), be liable for injury, loss, or damage resulting from carrying out emergency watershed protection measures pursuant to that agreement. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9f056a74afe47eabf524f2dbe129984"><enum>(2)</enum><header>Savings provision</header><text display-inline="yes-display-inline">Nothing in this subsection precludes liability for damages or costs relating to the carrying out of emergency watershed protection measures by a sponsor pursuant to an agreement entered into under subsection (c)(1) if the sponsor acted with willful or wanton negligence or reckless conduct in carrying out those measures.</text></paragraph></subsection><subsection id="id5627c66df359433b9c8e24686f9e6468"><enum>(f)</enum><header>Assumption of risk</header><text display-inline="yes-display-inline">A sponsor that carries out emergency watershed protection measures prior to entering into an agreement under subsection (c)(1) shall assume the risk of incurring any cost or liability resulting from carrying out those measures.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id317e2384e31d4aa888c7c1fb5a190d25"><enum>(g)</enum><header>Coordination</header><text>The Chief of the Natural Resources Conservation Service shall coordinate on the use of funds distributed under this section and section 403.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf7cca1eda6bd496a921019513b63585a"><enum>(h)</enum><header>NEPA compliance</header><text>Emergency watershed protection measures carried out pursuant to this section shall be deemed emergency response actions for purposes of section 220.4(b)(1) of title 36, Code of Federal Regulations (or a successor regulation).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
