which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Mississippi River Restoration and Resilience Initiative to carry out projects for the protection and restoration of the Mississippi River Corridor, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB88080CBC22E404C8D27469E219FB8BE"><section section-type="section-one" id="HCD2695060D5F4CD5B4AD1E904886D9C5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mississippi River Restoration and Resilience Initiative Act</short-title></quote> or the <quote><short-title>MRRRI Act</short-title></quote>.</text></section><section id="H702BEE3646564D00AA82416AF3C72D79"><enum>2.</enum><header>Findings; purpose</header><subsection id="HC9ED435E2DBD473E976D3AC40BF5328A"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="H15A02CDA624D4AD1A7762289C2A11EC2"><enum>(1)</enum><text>the Mississippi River flows more than 2,300 miles from its source at Lake Itasca through the center of the continental United States to the Gulf of Mexico;</text></paragraph><paragraph id="H075E21A5C102400FA06324057DA0A42D"><enum>(2)</enum><text>as of 2019, the main stem of the Mississippi River flows through 10 States that collectively are home to 55,400,000 people;</text></paragraph><paragraph id="HD451043E43B04A928DDB45E1DA81A9ED"><enum>(3)</enum><text>the Mississippi River provides drinking water to more than 20,000,000 people in 50 cities;</text></paragraph><paragraph id="H82FADE424D3949899A15F8E3A1174017"><enum>(4)</enum><text>the Mississippi River drives a vibrant natural resource and recreation-based economy that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf50d85b6d1204c26b5d355c7fb81f5a1"><enum>(A)</enum><text display-inline="yes-display-inline">generates nearly $500,000,000,000 in annual revenue; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8e91746cf1d1487490fef508167f1774"><enum>(B)</enum><text display-inline="yes-display-inline">directly employs more than 1,500,000 people;</text></subparagraph></paragraph><paragraph id="HF4684195CB364D3F89AFC0B0A112FD28"><enum>(5)</enum><text>the Mississippi River and its 30,000,000 acre floodplain provide an ecological lifeline for all of North America, supporting more than 780 species of fish and wildlife and providing a vital migration corridor for 60 percent of all North American birds and 40 percent of the migratory waterfowl in the United States;</text></paragraph><paragraph id="HF4776D011E294BE1B502B2F120F35C75"><enum>(6)</enum><text>the Mississippi River serves as a major transportation corridor for grain and cargo;</text></paragraph><paragraph id="H59AF00F2E59B429399B682DDC2CFA6B8"><enum>(7)</enum><text>Congress has designated the Mississippi River System as a nationally significant ecosystem and a nationally significant navigation system, the only inland river system to receive both designations;</text></paragraph><paragraph id="HF0935E2BCD5249359371F1A553EAC2A3"><enum>(8)</enum><text>despite the critical value of the Mississippi River to the United States, the Mississippi River is in a severe state of ecological decline, as documented by the United States Geological Survey, the Corps of Engineers, and other Federal and State agencies;</text></paragraph><paragraph id="HA9DD14B619B446A9B688E809ED7B0798"><enum>(9)</enum><text>modifications to the Mississippi River have resulted in the extensive loss of wetlands and complex river habitats, causing profound harm to the treasured fish and wildlife resources in the United States and increasing flood risks to communities;</text></paragraph><paragraph id="H1B216DEB8D4F4586A63C40CEA163C4ED"><enum>(10)</enum><text>polluted runoff has drastically reduced water quality and created a massive dead zone in the Gulf of Mexico;</text></paragraph><paragraph id="HA394FA30862944319BA78E3BC5485B28"><enum>(11)</enum><text>invasive aquatic species threaten—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6b21c8f8d1c841638b58857727bced49"><enum>(A)</enum><text display-inline="yes-display-inline">the ecological integrity of the Mississippi River and Gulf of Mexico; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide45edec2cb264084ac1ca009873b9ab2"><enum>(B)</enum><text display-inline="yes-display-inline">the fisheries and recreation organizations in the Mississippi River and the Gulf of Mexico that rely on a healthy ecosystem;</text></subparagraph></paragraph><paragraph id="H61E0E3A466BC441AA490B439AE53EA99"><enum>(12)</enum><text display-inline="yes-display-inline">ecological degradation of the Mississippi River has resulted in—</text><subparagraph id="H4700A38C485540BC9C5D3746C394123A"><enum>(A)</enum><text>more flooding;</text></subparagraph><subparagraph id="H011D7CC2C0AF4CC2BC278FEA9FDFC5BF"><enum>(B)</enum><text>less wildlife;</text></subparagraph><subparagraph id="H2B35904496454A5C934A7F65E7966FE8"><enum>(C)</enum><text>fewer jobs;</text></subparagraph><subparagraph id="H7FDA564AF3B442429A0182AF71275958"><enum>(D)</enum><text>reduced recreational opportunities; and</text></subparagraph><subparagraph id="H4917946060CF41C0AB6262B79F233474"><enum>(E)</enum><text>higher costs for keeping communities safe and ensuring that communities have clean drinking water;</text></subparagraph></paragraph><paragraph id="HFE3A2FD62D7C442B8DF382698C474DCE"><enum>(13)</enum><text display-inline="yes-display-inline">the consequences of ecological degradation have disproportionately harmed rural communities, economically disadvantaged communities, and communities of color; and</text></paragraph><paragraph id="H9B42570B8B1D48A1A1B0BBD1B56EE2D1"><enum>(14)</enum><text>existing Federal programs lack sufficient coordination, funding, and participation with States, Indian Tribes, local governments, and nongovernmental organizations—</text><subparagraph commented="no" display-inline="no-display-inline" id="id06357bfc43f84fa68508fb76019c0d4e"><enum>(A)</enum><text display-inline="yes-display-inline">to address the challenges described in this subsection; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12ef3ef7335d469aadbd09cd428d8124"><enum>(B)</enum><text display-inline="yes-display-inline">to reverse the decline of the Mississippi River.</text></subparagraph></paragraph></subsection><subsection id="idb7ea9aa0435145f8b37a9f1b5a5b7d37"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act and the amendments made by this Act is to establish the Mississippi River Restoration and Resilience Initiative, a nonregulatory initiative—</text><paragraph id="idaa2be745a8544dea934b8de775b72f60"><enum>(1)</enum><text>to protect and restore the ecological health and resilience of the Mississippi River for—</text><subparagraph id="id6b1f15bba91e40fe97c022425dacd52a"><enum>(A)</enum><text>current and succeeding generations of people of the United States; and</text></subparagraph><subparagraph id="idcdde551f83094c338d4d8f860203cec9"><enum>(B)</enum><text>the fish and wildlife that rely on the Mississippi River and the floodplain of the Mississippi River; and</text></subparagraph></paragraph><paragraph id="id1ff4bd67e75e4ef584c25089f835a946"><enum>(2)</enum><text>to build on existing efforts and provide funding for projects and activities to protect and restore the nationally significant resources of the Mississippi River by—</text><subparagraph id="idac544e5bfbf546e6b168f4ba3e750513"><enum>(A)</enum><text>establishing the Mississippi River National Program Office;</text></subparagraph><subparagraph id="id97a8b93ff5c14005b58328e8cec1a79e"><enum>(B)</enum><text>establishing the focus areas for the Mississippi River Restoration and Resilience Initiative;</text></subparagraph><subparagraph id="idc3cea49d0bfe4fa5802e1edffee800ff"><enum>(C)</enum><text>identifying qualifying activities for the programs and projects of the Mississippi River Restoration and Resilience Initiative;</text></subparagraph><subparagraph id="id10774f9ca6a94936805b379f756cb66c"><enum>(D)</enum><text>to guide the Mississippi River Restoration and Resilience Initiative, directing the development of—</text><clause id="iddc50d0d5b1ee4b3c93ce8c7a33f0844e"><enum>(i)</enum><text>actionable goals;</text></clause><clause id="id2722d46b22e3412792a5d850b9ed1a87"><enum>(ii)</enum><text>an action plan;</text></clause><clause id="idcb01fa5d0d5d4dc5bf5c933837ac3d12"><enum>(iii)</enum><text>a science plan; and</text></clause><clause id="id72d9c3ed985e416ea80cfa8d6f741f42"><enum>(iv)</enum><text>updates to the goals and plans described in clauses (i) through (iii);</text></clause></subparagraph><subparagraph id="id03ccf4e5b5e84533b7dea47223c18644"><enum>(E)</enum><text>establishing criteria for measuring the success of the Mississippi River Restoration and Resilience Initiative in restoring the ecological health and resilience of the Mississippi River;</text></subparagraph><subparagraph id="id0c6aec53b5a14da6ae8180bb4d9ae090"><enum>(F)</enum><text>requiring the Administrator to coordinate and consult with Federal and non-Federal stakeholders to carry out the Mississippi River Restoration and Resilience Initiative; and</text></subparagraph><subparagraph id="ida615a9d7b9ae496da7c04a2a6e12b2c9"><enum>(G)</enum><text>establishing the Mississippi River Corridor Research Centers. </text></subparagraph></paragraph></subsection></section><section id="H522885B086AB4FEC8AFFDD037F7E0695"><enum>3.</enum><header>Mississippi River Restoration and Resilience Initiative</header><text display-inline="no-display-inline">Title I of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5B34D8F32566440198840E50829BDCF3"><section id="H2A352A0E10484A6392862C89A942FED3"><enum>127.</enum><header>Mississippi River Restoration and Resilience Initiative</header><subsection id="HCA8675FB0680403F8AFC0A8ADEB819EB"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id08329627d1644949a7d2380f435ba978"><enum>(1)</enum><header>Action plan</header><text>The term <term>action plan</term> means the action plan required under subsection (d)(2)(A), including any updates to that plan.</text></paragraph><paragraph id="H902D287FBBB1419E8DAB2481CF494E10"><enum>(2)</enum><header>Agency</header><text>The term <term>Agency</term> means the Environmental Protection Agency.</text></paragraph><paragraph id="HE720A1F6EB5F4F78B63CD2049D5B9EC5"><enum>(3)</enum><header>Community of color</header><text display-inline="yes-display-inline">The term <term>community of color</term> means a geographically distinct area in which the population of any of the following categories of individuals is higher than the average population of that category for the State in which the geographically distinct area is located: </text><subparagraph id="H2F75015EBD3A4A2DA3D7E6885FCAAF0B"><enum>(A)</enum><text>Black.</text></subparagraph><subparagraph id="H0A08D13AC1E040EC9EBB5DB66B4672A6"><enum>(B)</enum><text>African American.</text></subparagraph><subparagraph id="HFD37462A4FDC41A793DBC864FF0E9F90"><enum>(C)</enum><text>Asian.</text></subparagraph><subparagraph id="H8F66571286544B018BCEAE0EED0181FE"><enum>(D)</enum><text>Pacific Islander.</text></subparagraph><subparagraph id="HAD387303DF304FC0B58F6EC3FCA699B1"><enum>(E)</enum><text>Hispanic.</text></subparagraph><subparagraph id="H938685099DE143CAA70496ECC0A93F09"><enum>(F)</enum><text>Latino.</text></subparagraph><subparagraph id="H4F3FAC634D6348329828A0C233FA1D46"><enum>(G)</enum><text display-inline="yes-display-inline">Indian (as defined in section 202 of the Indian Land Consolidation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2201">25 U.S.C. 2201</external-xref>)). </text></subparagraph></paragraph><paragraph id="HB5F6D799F36A475CA6FE4D335C74F63A"><enum>(4)</enum><header>Economically disadvantaged community</header><text display-inline="yes-display-inline">The term <term>economically disadvantaged community</term> means any census block group in which 30 percent or more of the population are individuals with an annual household income that is not more than the greater of—</text><subparagraph id="H617418DBD4DB4D2B84296C75FC093665"><enum>(A)</enum><text>an amount equal to 80 percent of the median income of the area in which the household is located, as reported by the Department of Housing and Urban Development; and</text></subparagraph><subparagraph id="H022A127B0E1B4F53BA71361F83AB0ACE"><enum>(B)</enum><text>an amount equal to 200 percent of the Federal poverty line. </text></subparagraph></paragraph><paragraph id="H4230E77840974B19BB85AFA653DB60DA"><enum>(5)</enum><header>Mississippi River Restoration and Resilience Initiative; MRRRI</header><text>The terms <term>Mississippi River Restoration and Resilience Initiative</term> and <term>MRRRI</term> means the Mississippi River Restoration and Resilience Initiative established under subsection (c)(1).</text></paragraph><paragraph id="HB5C2C1870E554C25BADA65F333E5F502"><enum>(6)</enum><header>MRRRI Director</header><text>The term <term>MRRRI Director</term> means the Director of the Mississippi River National Program Office appointed by the Administrator under subsection (b)(3).</text></paragraph><paragraph id="H7BA833D428CB46D8BFBE97B32C00E178"><enum>(7)</enum><header>Mississippi River Corridor</header><text display-inline="yes-display-inline">The term <term>Mississippi River Corridor</term> means the portions of the Mississippi River watershed (including tributary watersheds) located in a Mississippi River State.</text></paragraph><paragraph id="HA5C886325DBB4C22B1BEB504B4D9EE18"><enum>(8)</enum><header>Mississippi River State</header><text>The term <term>Mississippi River State</term> means any of the States of Arkansas, Illinois, Iowa, Kentucky, Louisiana, Minnesota, Mississippi, Missouri, Tennessee, or Wisconsin.</text></paragraph><paragraph id="H204D9C568D5A409097282F6ED70E5DBA"><enum>(9)</enum><header>Program Office</header><text>The term <term>Program Office</term> means the Mississippi River National Program Office established by the Administrator under subsection (b)(1). </text></paragraph><paragraph id="HBCC0270C8ACA4E64A6C426BC5E81A106"><enum>(10)</enum><header>Relevant Federal agency</header><text>The term <term>relevant Federal agency</term> means any of the following Federal agencies: </text><subparagraph commented="no" id="H33E45439B117416CA0E575A2DF53A1E4"><enum>(A)</enum><text>The Department of Agriculture, including—</text><clause commented="no" id="HA25F414B25C54EE4A314C3368155298C"><enum>(i)</enum><text display-inline="yes-display-inline">the Natural Resources Conservation Service; and</text></clause><clause commented="no" id="HBFF0FAE4CC1B471C9DFC2F00D9191B03"><enum>(ii)</enum><text display-inline="yes-display-inline">the Forest Service.</text></clause></subparagraph><subparagraph commented="no" id="H998BD39851094DC1AAFCA82598BE25D4"><enum>(B)</enum><text>The Department of the Interior, including—</text><clause commented="no" id="H838A58C36D514AE09395CC3959E38C75"><enum>(i)</enum><text display-inline="yes-display-inline">the Bureau of Indian Affairs;</text></clause><clause commented="no" id="HFA4867E13B9E487487D41E2C1B4483F9"><enum>(ii)</enum><text>the United States Fish and Wildlife Service; </text></clause><clause commented="no" id="H7CDEA4D9CD1F4A7D93A15746B7686C63"><enum>(iii)</enum><text display-inline="yes-display-inline">the United States Geological Survey; and</text></clause><clause id="HBD3420EB84A74FE8B1D218B733A06C42"><enum>(iv)</enum><text display-inline="yes-display-inline">the National Park Service.</text></clause></subparagraph><subparagraph id="H567BA17C15D44DB7A60632BC5BD01564"><enum>(C)</enum><text>The Corps of Engineers.</text></subparagraph><subparagraph id="HE88884A6877D457D97BDD909D72CE112"><enum>(D)</enum><text>The Federal Emergency Management Agency.</text></subparagraph><subparagraph id="H91E64BE3B400444EACA1DA07222D56DF"><enum>(E)</enum><text>The National Oceanic and Atmospheric Administration.</text></subparagraph><subparagraph id="H52B7C45A2F714B1FB75B9EE26CB68A86"><enum>(F)</enum><text>The Coast Guard.</text></subparagraph><subparagraph id="HB7AF8E6EF48D40BE8ADCC47629EA446A"><enum>(G)</enum><text>Any other Federal agency the MRRRI Director determines to be relevant. </text></subparagraph></paragraph><paragraph id="H8F543A6C185C4DE39662ECB6E639BD1D"><enum>(11)</enum><header>Rural</header><text display-inline="yes-display-inline">The term <term>rural</term> means an area that is not delineated by the Bureau of the Census as an urbanized area or an urban cluster based on decennial census results. </text></paragraph><paragraph id="H8CFB582684F04EFEB1C4C386CDF35D57"><enum>(12)</enum><header>Tribal government</header><text display-inline="yes-display-inline">The term <term>Tribal government</term> means the recognized governing body of any Indian Tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) in the most recent list published pursuant to section 104(a) of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131(a)</external-xref>).</text></paragraph><paragraph id="HBCA16B4087D64570839C7B1D2E1A4C3C"><enum>(13)</enum><header>Tribal organization</header><text display-inline="yes-display-inline">The term <term>Tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></subsection><subsection id="H09D8B2D175C14B3F8AE9BF7536DDBEDC"><enum>(b)</enum><header>Mississippi River National Program Office</header><paragraph id="H43778C212E5A4B9A91CDA63BA862C563"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall establish a Mississippi River National Program Office within the Agency to carry out the Mississippi River Restoration and Resilience Initiative.</text></paragraph><paragraph id="HE2F4B5C1335648A38BEB6E8B559CF18B"><enum>(2)</enum><header>Location</header><text>The Program Office shall be located in a Mississippi River State.</text></paragraph><paragraph id="HFD8B40CDE8D446A7BDCD2E5E323C3EBE"><enum>(3)</enum><header>Director</header><text display-inline="yes-display-inline">The Program Office shall be headed by a Director, appointed by the Administrator, who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id638c7ba926884e34b389bceb75601128"><enum>(A)</enum><text display-inline="yes-display-inline">has management experience and technical expertise relating to the Mississippi River; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf85a1d9c49694d128244f62353f64316"><enum>(B)</enum><text display-inline="yes-display-inline">is highly qualified to direct the development of programs and plans on a variety of issues related to restoration of the Mississippi River. </text></subparagraph></paragraph><paragraph id="HA320E5ACC63B4E58BCDC89C0D7242B7B"><enum>(4)</enum><header>Functions</header><text>The MRRRI Director shall—</text><subparagraph id="H7CACDDD63BBC4E82BC08FA8547CE421D"><enum>(A)</enum><text>coordinate actions of the Agency that seek to protect and restore the Mississippi River Corridor;</text></subparagraph><subparagraph id="HA1C815772AD84F3FA9D84BF9A3548660"><enum>(B)</enum><text display-inline="yes-display-inline">develop, implement, and update the MRRRI, the actionable goals under subsection (d)(1), and the action plan, in coordination with relevant Federal agencies and non-Federal entities;</text></subparagraph><subparagraph id="H632E8306175743E3991B6AC84B0724D0"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id65b1b5de56994a65abe8aacc5a19bfb6"><enum>(i)</enum><text>document information and updates related to the development and implementation of the MRRRI, the actionable goals under subsection (d)(1) and the action plan; and </text></clause><clause commented="no" display-inline="no-display-inline" id="ide646af85307744d2998f20b247881913" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">make that information and those updates available to the public, including on a public website;</text></clause></subparagraph><subparagraph id="id79ea6c11c121423585391f13c65e1ec6"><enum>(D)</enum><text>facilitate engagement and consultation with Tribal governments and Tribal organizations to ensure Tribal needs and priorities are solicited early and throughout the development of the actionable goals under subsection (d)(1) and the action plan;</text></subparagraph><subparagraph id="HF7F15839DE3F4A4CA88FE6B89061BC39"><enum>(E)</enum><text>work cooperatively with the Bureau of Indian Affairs and other relevant Federal agencies to carry out subparagraph (D); and</text></subparagraph><subparagraph id="H6B0DA7410E1E4AC2809428ECB4F89A58"><enum>(F)</enum><text>submit to Congress, and make available on a public website, an annual report describing—</text><clause id="H4ADB4AF9CB1A4800B18ADC66903F64BA"><enum>(i)</enum><text>progress made in implementing the MRRRI;</text></clause><clause id="H2703306E68544BE89D497BB796EA1238"><enum>(ii)</enum><text display-inline="yes-display-inline">the coordination of the MRRRI with other Federal, State, Tribal, and local programs;</text></clause><clause id="H771BE6DB50DF44B5B3B1D90213CFBEAE"><enum>(iii)</enum><text>any funds transferred to relevant Federal agencies under this section;</text></clause><clause id="H1EEA03F03EE7461F819EF80098643A63"><enum>(iv)</enum><text>any grants awarded under subsection (c)(3)(B); and</text></clause><clause id="HE1E0927EDEA443B79A6870EBB3181C14"><enum>(v)</enum><text>specific projects and activities carried out pursuant to this section.</text></clause></subparagraph></paragraph><paragraph id="H05FBE6FCD13346AB9D46967B62DE929B"><enum>(5)</enum><header>Agreements</header><text display-inline="yes-display-inline">In carrying out paragraph (4), the MRRRI Director may enter into agreements, as applicable, with relevant Federal agencies and non-Federal entities.</text></paragraph><paragraph id="H800EA323E1A342E7B41110AE4F2922A3"><enum>(6)</enum><header>Tribal liaison</header><text display-inline="yes-display-inline">The MRRRI Director shall appoint a Tribal Liaison within the Program Office—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddff8c328dfb141cd8235203147416bc8"><enum>(A)</enum><text display-inline="yes-display-inline">to ensure enhanced interagency technical support, communication, and coordination with Tribal governments, Tribal organizations, and Tribal stakeholders; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7b92318db4414d49bb87de62ab44397b"><enum>(B)</enum><text display-inline="yes-display-inline">to carry out other duties as determined necessary to meet the needs of Indian Tribes.</text></subparagraph></paragraph></subsection><subsection id="H0287AD271D144420B35DC30A95861D60"><enum>(c)</enum><header>Mississippi River Restoration and Resilience Initiative</header><paragraph id="H62301FAB4CD846CEB46EF91BBFB14622"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Agency the Mississippi River Restoration and Resilience Initiative to implement projects and activities for systemic, large-scale restoration of the Mississippi River Corridor.</text></paragraph><paragraph id="H7B9E31643763406695D8C9D10E93DE50"><enum>(2)</enum><header>Focus areas</header><text display-inline="yes-display-inline">Any project or activity carried out under this section shall address at least 1 of the following focus areas:</text><subparagraph display-inline="no-display-inline" id="H4A176333A16649A69180BFF8459E62B7"><enum>(A)</enum><text display-inline="yes-display-inline">The improvement of water quality in the Mississippi River Corridor and drinking water quality in the Mississippi River States by—</text><clause id="HCDB7C3BA0DE14A0F8CB5E45425B61552"><enum>(i)</enum><text display-inline="yes-display-inline">reducing the amount of polluted runoff, excess agricultural nutrients, and sediment in the Mississippi River Corridor; and</text></clause><clause id="H0B8E6813DE2E4F06AC927A6E090FD76A"><enum>(ii)</enum><text>improving source water protections. </text></clause></subparagraph><subparagraph id="HEF3965EABE954F279A288EC9905BAD31"><enum>(B)</enum><text display-inline="yes-display-inline">The improvement of community resilience throughout the Mississippi River Corridor by restoring the ability of the Mississippi River floodplain, riverine wetlands, delta and coastal wetlands, and backwaters to minimize and ameliorate flood and storm risks.</text></subparagraph><subparagraph id="HAD673DD602E740D59423FA44C3C3EA4F"><enum>(C)</enum><text>The protection and restoration of fish and wildlife habitat in and along the Mississippi River Corridor.</text></subparagraph><subparagraph id="HD10DC064BDE04F5680EF821C8D5568CD"><enum>(D)</enum><text>The prevention of the spread of aquatic invasive species in the Mississippi River Corridor.</text></subparagraph><subparagraph commented="no" id="HEE156B9F9D50402684291ECCC8E9C555"><enum>(E)</enum><text display-inline="yes-display-inline">The improvement of communication and partnership activities related to the focus areas described in subparagraphs (A) through (D). </text></subparagraph><subparagraph id="HB754C7A0A6CB4CFCBB52760BCABB6318"><enum>(F)</enum><text display-inline="yes-display-inline">Monitoring, collecting, and evaluating scientific data to assess the focus areas described in subparagraphs (A) through (D). </text></subparagraph></paragraph><paragraph id="HFCFE0C0E56A14094A924F6F2AC50703F"><enum>(3)</enum><header>Project and activity implementation</header><subparagraph id="HDD503D5BEC2848EE8C76B277E922D674"><enum>(A)</enum><header>In general</header><text>Funds made available to carry out the MRRRI may be used to implement eligible projects and activities described in paragraph (5) that are carried out by a relevant Federal agency or a non-Federal entity.</text></subparagraph><subparagraph id="H52A68CB78D3E413A96364B146470ED48"><enum>(B)</enum><header>Grant authority</header><text display-inline="yes-display-inline">The MRRRI Director, or the head of any other relevant Federal agency receiving funds under this section, may make a grant to, or otherwise enter into an agreement with, any non-Federal entity (including any State, local, or Tribal governmental entity, nonprofit organization, institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)), or individual) that the MRRRI Director or agency head determines is qualified to carry out an eligible project or activity described in paragraph (5).</text></subparagraph></paragraph><paragraph id="HDD3CB8C90EB940508E2FCB8CF3CAAD58"><enum>(4)</enum><header>Project and activity selection</header><subparagraph id="H046E680B4C374568B678511BE6D33B62"><enum>(A)</enum><header>In general</header><text>In carrying out the MRRRI, the MRRRI Director shall collaborate with relevant Federal agencies to select projects and activities to be implemented pursuant to this section using appropriate principles and criteria, including—</text><clause id="H9F60251ECA534589A2C1BAABA6225FAE"><enum>(i)</enum><text display-inline="yes-display-inline">the selection of an equitable distribution of projects and activities along the entire Mississippi River Corridor;</text></clause><clause id="HFCD34F4601BF4680AFCC2DB64FE20AFA"><enum>(ii)</enum><text>the ability of a project to achieve strategic and measurable environmental outcomes;</text></clause><clause id="H2B95B4D6E45349CCA85F0FBB947001BF"><enum>(iii)</enum><text>the recognition that projects and activities may provide benefits to local or regional communities or to the entire Mississippi River Corridor;</text></clause><clause id="HCA73FC96FD6F4E88A023D293733C1E5F"><enum>(iv)</enum><text>the feasibility of prompt implementation, timely achievement of measurable results, and resource leveraging; and</text></clause><clause id="H05A7CC872BA8470F8C4427FDEFCD9A1E"><enum>(v)</enum><text>the opportunity to improve interagency, intergovernmental, and interorganizational coordination and collaboration to reduce duplication and improve measurable environmental outcomes.</text></clause></subparagraph><subparagraph id="H67B9839DE49F42A4929CEDF0D2B02C6B"><enum>(B)</enum><header>Priority</header><text display-inline="yes-display-inline">In selecting projects and activities under subparagraph (A), the MRRRI Director shall give priority to projects or activities that carry out actions described in paragraph (5)(B)(xi).</text></subparagraph><subparagraph commented="no" id="H8A94819685E54488B4499606975F7AAA"><enum>(C)</enum><header>Compatibility</header><text>The MRRRI Director shall ensure that projects and activities carried out under this section are compatible with—</text><clause commented="no" id="HB5B4DF750F49446387D035BD864C4811"><enum>(i)</enum><text display-inline="yes-display-inline">the ability of the Corps of Engineers to maintain navigation in the Mississippi River; and</text></clause><clause commented="no" id="H139BFB43EAE24428ABF1AB587F3461D5"><enum>(ii)</enum><text>the structural integrity or effectiveness of Federal, State, local, or Tribal disaster risk reduction infrastructure.</text></clause></subparagraph></paragraph><paragraph id="H3D84373657974D6184A43E88D7341C25"><enum>(5)</enum><header>Eligible projects and activities</header><subparagraph id="H3107E8596DBE48BDBDA62AC9668F7BDC"><enum>(A)</enum><header>In general</header><text>Funds made available to carry out this section may only be used to implement a project or activity that—</text><clause commented="no" display-inline="no-display-inline" id="idcc927f69d908472aac00b84c0055290e"><enum>(i)</enum><text display-inline="yes-display-inline">addresses at least 1 of the focus areas described in paragraph (2); and </text></clause><clause commented="no" display-inline="no-display-inline" id="id9dd5aa1a986a4b3280f14fc14c4c0810"><enum>(ii)</enum><text display-inline="yes-display-inline">carries out at least 1 of the actions described in subparagraph (B).</text></clause></subparagraph><subparagraph id="H32725DE450C04295BAE7974A18E57842"><enum>(B)</enum><header>Actions described</header><text>The actions referred to in subparagraph (A)(ii) are actions that—</text><clause id="HC332AF63512142D9B1B7DBB1EB5DADFE"><enum>(i)</enum><text display-inline="yes-display-inline">protect or restore naturally occurring hydrologic, geomorphic, and ecological functions and processes, including the restoration or rehabilitation of wetlands, in-stream habitats (including through reconnection of side channels and backwaters), living shorelines, or upland habitats;</text></clause><clause id="H234C11A892594B0BBB637ED2B2DE633A"><enum>(ii)</enum><text display-inline="yes-display-inline">remove or modify structures, including culverts, levees, and dams, to restore—</text><subclause id="H4AB06880586F4108B89376EB2FFD40AA"><enum>(I)</enum><text>natural hydrology of rivers, streams, floodplains, wetlands, or coasts; or</text></subclause><subclause id="H5975701AE5F54FAC8FACA4CAB4946B0F"><enum>(II)</enum><text>the form, function, or processes of rivers, streams, floodplains, wetlands, or coasts;</text></subclause></clause><clause id="H6408CD1504C44D40ABCA50B5BEC438F1"><enum>(iii)</enum><text>permanently protect privately owned lands through fee title acquisition or enrollment into voluntary permanent wetland, flooding, or other conservation easements;</text></clause><clause commented="no" id="H087AAAC6AE524EE38DC40705087F0BFA"><enum>(iv)</enum><text display-inline="yes-display-inline">facilitate habitat restoration using responsibly sourced and clean dredged sediment material by covering the cost differential between the Federal standard for dredge disposal and the cost of transportation;</text></clause><clause id="H08783FAE94564832938FFB2369024748"><enum>(v)</enum><text>relocate, elevate, or demolish and clean up flood-prone structures and carry out any related floodplain restoration;</text></clause><clause id="HE75A9047E4B84FDCAE6D12EA91AC81ED"><enum>(vi)</enum><text display-inline="yes-display-inline">increase water retention and infiltration through actions that promote a healthy soil ecosystem, including maximizing soil cover, maximizing soil biodiversity, and maximizing the presence of living roots;</text></clause><clause id="HD817C7FBD1874A1A9E6C1F36CC3A5E6F"><enum>(vii)</enum><text display-inline="yes-display-inline">reduce nonpoint sources of pollution and promote landscape-scale vegetative cover (including perennial grains, perennial woody crops, winter annual cover crops, perennial pasture, and other approaches to maintain year-round vegetative cover) through the implementation of voluntary initiatives developed with the support of market research;</text></clause><clause id="H7F9F3119741D438FA66E01C126830A59"><enum>(viii)</enum><text display-inline="yes-display-inline">reduce stormwater flows and inflows that contribute to combined sewer overflow events, and accelerate the adoption of urban stormwater pollution prevention minimum control measures through municipal separate storm sewer system permits issued under section 402(p);</text></clause><clause commented="no" id="H6E349FDC50AD49D9BF657C5711996B43"><enum>(ix)</enum><text display-inline="yes-display-inline">facilitate the cleanup of legacy contaminants that are not hazardous substances (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)); </text></clause><clause id="HD11AE18A2B0F4DC0B5E07769B4D69BEE"><enum>(x)</enum><text display-inline="yes-display-inline">control, manage, or eradicate nonnative aquatic invasive species or reintroduce native aquatic species, including through—</text><subclause id="HADA38DA59D9B4EF2A8F57F7A0724ACC0"><enum>(I)</enum><text>investments in technology and research to combat the spread of aquatic invasive species; </text></subclause><subclause id="H076604D71A6941B7BD4EDF661A22376E"><enum>(II)</enum><text>the use of in-river physical deterrents or controls; or</text></subclause><subclause id="H264C897157F4409AA0F7A9A1512B140E"><enum>(III)</enum><text>the promotion of commercial harvesting of nonnative aquatic species;</text></subclause></clause><clause id="H5D7CB76FD1824BC7BDE842B6F4CBBC56"><enum>(xi)</enum><text display-inline="yes-display-inline">address the disproportionate effects of the ecological degradation of the Mississippi River Corridor on economically disadvantaged communities in rural and urban areas and on communities of color, including through—</text><subclause id="H570693C23D3748ADA3F2C003BAE421B9"><enum>(I)</enum><text display-inline="yes-display-inline">community based participatory research;</text></subclause><subclause id="H4CA94DA0D05C4CA0A8E97E73AB5A6972"><enum>(II)</enum><text>project or community-wide planning;</text></subclause><subclause id="H4B0A1DB366924651AB70532410FF2451"><enum>(III)</enum><text>outreach and community engagement; or</text></subclause><subclause id="H10F419617E4D4B2C9ADF3D63485F19A6"><enum>(IV)</enum><text>restoration-related job training and workforce development; or</text></subclause></clause><clause id="H75E71BD1A919484DACC2D1C17482CF45"><enum>(xii)</enum><text display-inline="yes-display-inline">additional actions determined to be eligible pursuant to subsection (d)(2)(B)(v).</text></clause></subparagraph><subparagraph commented="no" id="H75050311EFD8407DB5699C636FA4D922"><enum>(C)</enum><header>Protection against invasive plant species</header><text display-inline="yes-display-inline">Funds made available to carry out this section may not be used for a project or activity that proposes to use a plant that has an elevated risk of becoming invasive, as determined by the MRRRI Director through the use of a credible weed risk assessment tool.</text></subparagraph></paragraph><paragraph commented="no" id="H60EB1D0C66DE4A6280F13363844C9697"><enum>(6)</enum><header>Monitoring plan</header><text display-inline="yes-display-inline">A relevant Federal agency or non-Federal entity receiving funds to carry out a project or activity under this section shall develop a detailed plan for monitoring the implementation and ecological success of that project or activity, as applicable, that—</text><subparagraph commented="no" id="HCB1B62597C2E411BB84D5C1D1EE53C0C"><enum>(A)</enum><text>describes criteria for ecological success by which the project or activity will be evaluated based on replacement of lost functions and values of the Mississippi River Corridor habitat, including hydrologic and vegetative characteristics;</text></subparagraph><subparagraph commented="no" id="H566F526D9FD94CB7B0A15CDE8894C460"><enum>(B)</enum><text>identifies an entity responsible for the monitoring; and</text></subparagraph><subparagraph commented="no" id="HFBB0AD9D7C5F41AE9C09B71C978923AC"><enum>(C)</enum><text>includes continuation of the monitoring until the project or activity is determined to be successful based on documented achievement of the ecological success criteria described under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="HA086FD72DC304705A0E0C82DABD750F0"><enum>(d)</enum><header>Actionable goals; action plans</header><paragraph id="H624AC59C32FA464789C77A784EC827A2"><enum>(1)</enum><header>Actionable goals</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the MRRRI Director shall develop measurable goals for the MRRRI, including establishing criteria for measuring the success of the MRRRI in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id388eaee1b26b41e991ffa10a7166ccb6"><enum>(A)</enum><text display-inline="yes-display-inline">addressing the focus areas described in subsection (c)(2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee7ac86205374fa6a54e01e0bd32d306"><enum>(B)</enum><text display-inline="yes-display-inline">restoring the overall ecological health and resilience of the Mississippi River Corridor.</text></subparagraph></paragraph><paragraph id="H9CB9681D6B1A417D9FA3EEC30BC480D8"><enum>(2)</enum><header>Action plan</header><subparagraph id="HEB21808FA48D48738C53943FD95F2165"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, the MRRRI Director shall develop an action plan to make progress on the MRRRI through the implementation of MRRRI projects and activities under subsection (c). </text></subparagraph><subparagraph id="HA84AD7CA053A4540BF6190535C126E7D"><enum>(B)</enum><header>Contents</header><text>The MRRRI Director shall include in the action plan—</text><clause id="H01589F18AF854A89AAC97D117D2F4B98"><enum>(i)</enum><text display-inline="yes-display-inline">a description of existing Federal, State, Tribal, and regional plans, programs, and activities affecting the Mississippi River Corridor that may be used to advance the MRRRI;</text></clause><clause id="H37A921F21E5A4B31BD18EBAAC92D6800"><enum>(ii)</enum><text>recommendations for a comprehensive approach to advancing systemic, large-scale restoration of the Mississippi River Corridor that, where appropriate, leverages existing Federal and State programs;</text></clause><clause commented="no" id="H96E4B27DA0C04DBFB7446E45391AA95A"><enum>(iii)</enum><text>a multi-year plan that identifies objectives within each of the focus areas described in subsection (c)(2), with corresponding commitments for activities, research, and measures for progress to meet those objectives;</text></clause><clause id="HC82028A96EA64B7BB0E2BAF7C226F537"><enum>(iv)</enum><text>a plan to monitor the implementation of any recommendations developed under clause (ii); and</text></clause><clause id="H80F9D7F948B74439AA7C71210ED7BB65"><enum>(v)</enum><text display-inline="yes-display-inline">a description of any additional actions the MRRI Director determines are eligible under this section. </text></clause></subparagraph><subparagraph id="HDB925A74DD3D4F38B839DF4985E1D369"><enum>(C)</enum><header>Project recommendations</header><text display-inline="yes-display-inline">The action plan may include recommendations for specific projects or activities that advance the objectives developed under subparagraph (B)(iii), including timelines, budgets, and the identification of entities responsible for the implementation of those projects or activities.</text></subparagraph></paragraph><paragraph id="H5FC8E680E44547CC801D2143C3A432FF"><enum>(3)</enum><header>Updates</header><subparagraph id="HDEEA8856B1FB4B66ABDCB955EE55065D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not less frequently than once every 5 years, the MRRRI Director shall review and update the actionable goals developed under paragraph (1) and the action plan.</text></subparagraph><subparagraph id="H51212AEDC6A04B36A8ED568D2190F76E"><enum>(B)</enum><header>Integration with science plan</header><text display-inline="yes-display-inline">In updating the action plan under subparagraph (A), the MRRRI Director shall incorporate any relevant information contained in the science plan developed pursuant to section 4(c) of the <short-title>MRRRI Act</short-title>.</text></subparagraph></paragraph><paragraph commented="no" id="H172DD53972D7425DBACDF305322E0AA5"><enum>(4)</enum><header>Coordination and consultation</header><text display-inline="yes-display-inline">In developing and updating the actionable goals developed under paragraph (1) and the action plan, the MRRRI Director shall—</text><subparagraph commented="no" id="H40C864FDDA7248A9825E4A02C58C0C5F"><enum>(A)</enum><text display-inline="yes-display-inline">consult with Mississippi River States, Tribal governments within Mississippi River States, the Secretary of the Interior, the Chief of Engineers, and the Secretary of Agriculture; </text></subparagraph><subparagraph commented="no" id="H4456E5016B7E449EAFFAF750429DCCC3"><enum>(B)</enum><text display-inline="yes-display-inline">engage with relevant Federal agencies, units of local government, nongovernmental organizations, institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)), and members of the public; and</text></subparagraph><subparagraph commented="no" id="H85BE4EA9E96246E1AF20511026E95955"><enum>(C)</enum><text display-inline="yes-display-inline">solicit input from the entities described in subparagraph (B) through a formal public notice and comment period. </text></subparagraph></paragraph></subsection><subsection id="H42D540A6110E43A9AEF693A9C84DCC51"><enum>(e)</enum><header>Funding</header><paragraph id="H8310F130C46F4519ACFB2F5B7A763C68"><enum>(1)</enum><header>Transfer of funds to Federal entities</header><text>The MRRRI Director may use funds made available to carry out this section for each fiscal year—</text><subparagraph id="HD3D8EEAC5F614CC289821FC1951790F5"><enum>(A)</enum><text display-inline="yes-display-inline">to transfer funds to the head of any relevant Federal agency, with the concurrence of the head of the relevant Federal agency, to carry out activities in accordance with this section; </text></subparagraph><subparagraph id="H6C5276DD06C84E3AA204103A71CE6B5C"><enum>(B)</enum><text>to transfer funds to other Federal programs to be used for achieving specifically targeted and measurable environmental outcomes that advance the actionable goals developed and updated under subsection (d); and </text></subparagraph><subparagraph id="HEC41D9060B7E4D9796F65C014FD2521C"><enum>(C)</enum><text>to enter into an interagency agreement with the head of any relevant Federal agency to carry out projects and activities in accordance with this section.</text></subparagraph></paragraph><paragraph id="H682C575562C34DE3A936B16C59FC2687"><enum>(2)</enum><header>Transfer of funds to Bureau of Indian Affairs</header><text display-inline="yes-display-inline">The MRRRI Director shall transfer not less than 5 percent of the funds made available to carry out this section for each fiscal year to the Director of the Bureau of Indian Affairs, with the concurrence of the Director of the Bureau of Indian Affairs, to make grants or otherwise enter into agreements with Tribal governments or Tribal organizations to carry out projects or activities under this section.</text></paragraph><paragraph commented="no" id="H8A48B6E013B7456099F1103F87579ABE"><enum>(3)</enum><header>Availability of funds to implement projects prior to completion of the first action plan</header><text display-inline="yes-display-inline">Before the date on which the first action plan is developed under subsection (d)(2), the MRRRI Director may transfer funds to a relevant Federal agency or another Federal entity, or award a grant or otherwise enter into an agreement with a non-Federal entity—</text><subparagraph commented="no" id="HF74B2430961B45BD92F9CB3B1E0B79C1"><enum>(A)</enum><text>to carry out projects or activities that meet the requirements of subsection (c)(5); or</text></subparagraph><subparagraph commented="no" id="HBC679EA677784FED83B7CAD18010ECAE"><enum>(B)</enum><text>to establish the Mississippi River Corridor Research Centers required under section 4(b) of the <short-title>MRRRI Act</short-title>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6AD456E646C446028795A29FA6240430"><enum>(4)</enum><header>Cost share</header><subparagraph commented="no" id="HAE49C69DAFCB4431AB12B279BEB8769C"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Federal share of the cost of a project or activity carried out by a non-Federal entity under this section shall not exceed 80 percent of the total cost of the project or activity.</text></subparagraph><subparagraph commented="no" id="H46F8BF52F55E4A68B761A317898D5C26"><enum>(B)</enum><header>Exceptions</header><clause commented="no" display-inline="no-display-inline" id="idd6a5dc451b4b4245aa8cd39d85e11522"><enum>(i)</enum><header>Indian Tribes</header><text display-inline="yes-display-inline">The Federal share of the cost of a project or activity carried out by a Tribal government or Tribal organization under this section shall be 100 percent.</text></clause><clause commented="no" display-inline="no-display-inline" id="id279be518f1be4bd287cd8fc1b0fa501f"><enum>(ii)</enum><header>Priority projects and activities</header><text display-inline="yes-display-inline">The Federal share of the cost of a project or activity described in subsection (c)(5)(B)(xi) carried out by a non-Federal entity shall be 100 percent.</text></clause></subparagraph><subparagraph id="HF352AEEAE4B14C8DAE507E2D86F7CD19"><enum>(C)</enum><header>In-kind contribution</header><text display-inline="yes-display-inline">The non-Federal share of the cost of a project or activity carried out under this section may include the value of an in-kind contribution provided by a non-Federal entity.</text></subparagraph></paragraph><paragraph id="H6F60304A66184F8BAE3747D259E9D4D3"><enum>(5)</enum><header>Limitations</header><text display-inline="yes-display-inline">No funds made available to carry out this section may be used for any water infrastructure project or activity for which financial assistance is received under—</text><subparagraph id="HC36F7E1913124EB28DCE48B9FBD7F6A6"><enum>(A)</enum><text>a State water pollution control revolving fund established under section 603;</text></subparagraph><subparagraph id="H6974C4BC96E34B70AD9D629F3575E72D"><enum>(B)</enum><text display-inline="yes-display-inline">a State drinking water treatment revolving loan fund established under section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>); or</text></subparagraph><subparagraph id="HCEEC7B7847BD46C292097A252190BA65"><enum>(C)</enum><text>the Water Infrastructure Finance and Innovation Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3901">33 U.S.C. 3901 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" id="HB57686A37A3742F39B049D76FBCB1964"><enum>(6)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section waives any requirement under any applicable Federal environmental law, including—</text><subparagraph id="HBBEDF5025F014206A488D11F724A6D62"><enum>(A)</enum><text>this Act;</text></subparagraph><subparagraph id="HD8F6A627CDBF48E08BBCDD4E63F1BFC0"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph><subparagraph id="H031A0D7F05B54C12A234930F2939C914"><enum>(C)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></subparagraph><subparagraph id="H55D956B52E8348C7834AE41BD80BD3A9"><enum>(D)</enum><text display-inline="yes-display-inline">the Fish and Wildlife Coordination Act (<external-xref legal-doc="usc" parsable-cite="usc/16/661">16 U.S.C. 661 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="HF1FB0A92D4134A34BD1AA2093E557A05"><enum>(f)</enum><header>Set-Aside</header><paragraph id="H69B0D50D2A824B228DCFF8BE6291471E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Of the total amount made available to carry out the MRRRI for each fiscal year—</text><subparagraph id="HA251844814E44CF9A70221B40105A2A0"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 25 percent shall be used for projects or activities that carry out actions described in subsection (c)(5)(B)(xi); and</text></subparagraph><subparagraph id="H60582046FA98422C82FE712FC226CBC9"><enum>(B)</enum><text display-inline="yes-display-inline">not less than 10 percent shall be used for projects or activities carried out in a persistent poverty county that has had poverty rates of 20 percent or greater, as determined by the Bureau of the Census, for at least 30 consecutive years preceding the fiscal year.</text></subparagraph></paragraph><paragraph id="H379B29A0D84F4C5983A4983581AF7AF8"><enum>(2)</enum><header>Action plan</header><subparagraph id="H592B7F9C3C8C4958BF67BA0693970333"><enum>(A)</enum><header>In general</header><text>Of the total amount made available to carry out the MRRRI for each fiscal year beginning with the first fiscal year after which the action plan is first developed, not more than 5 percent may be used for projects and activities that are eligible under subsection (c)(5) but that do not address an objective identified in the action plan under subsection (d)(2)(B)(iii). </text></subparagraph><subparagraph id="HECFB9D6CD4674440B56E29F5605D3E8F"><enum>(B)</enum><header>Priority</header><text display-inline="yes-display-inline">In carrying out subparagraph (A), the MRRRI Director shall prioritize projects or activities that reduce the effects of natural disasters or respond to emerging threats from natural disasters.</text></subparagraph></paragraph></subsection><subsection id="HAC4945F1666243A2AEADDCF5A1F55887"><enum>(g)</enum><header>Activities by other relevant Federal Agencies</header><paragraph id="H8886AF4352C04EF09435E83E7A11C9C2"><enum>(1)</enum><header>In general</header><text>The head of a relevant Federal agency that is engaged in, or has authority over, a program relating to research, monitoring, and planning to maintain, enhance, preserve, or rehabilitate the environmental quality and natural resources of the Mississippi River shall—</text><subparagraph id="H65C48FBC83994B3C8C5BD016895E809E"><enum>(A)</enum><text>submit to the Administrator an annual report describing the activities of the agency relating to the MRRRI;</text></subparagraph><subparagraph id="H1D6A34B8F5004D9086F1DB78FDC81459"><enum>(B)</enum><text>strive to identify new projects and activities to support the goals of the MRRRI;</text></subparagraph><subparagraph id="H0FC2E5967DF14F889B3F831F5CBD431B"><enum>(C)</enum><text>ensure that any funding provided through the MRRRI supplements, and not supplants, funding obtained through other agency budgets or other sources of funds for activities relating to the Mississippi River; and</text></subparagraph><subparagraph id="H7D2287A7415243A8BFA9994C5BC379DE"><enum>(D)</enum><text>strive to maintain, and where possible increase, the base level of funding for activities of the relevant Federal agency related to the Mississippi River, without regard to funding under the MRRRI.</text></subparagraph></paragraph></subsection><subsection id="H6DC4E3A4EF894A4BBDE9E474D8D4B85B"><enum>(h)</enum><header>Budget item</header><paragraph id="HDC538FA8FC604ACBBFC640492CB55FA8"><enum>(1)</enum><header>In general</header><text>The Administrator shall, in the annual budget submission of the Agency to Congress, include a funding request for the MRRRI as a separate budget line item. </text></paragraph><paragraph id="H9864C316F1264A638FC5AD23243553C3"><enum>(2)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The budget justification for the budget line item described in paragraph (1) shall include the amount to support the operation and activities of the Program Office.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H699BB7B4E1234F86963CA780ECC7F031"><enum>4.</enum><header>Mississippi River Corridor research centers and science plan</header><subsection id="HEB690DFB1DDC49C5A7940B6622894EA5"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idb5b1804214104d919218dcac93041f81"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the United States Geological Survey.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23f6d819834e40a8a13bc62428eed389"><enum>(2)</enum><header>FWPCA terms</header><text display-inline="yes-display-inline">The terms <term>MRRRI</term>, <term>MRRRI Director</term>, <term>Mississippi River Corridor</term>, <term>Mississippi River State</term>, <term>relevant Federal agency</term>, <term>Tribal government</term>, and <term>Tribal organization</term> have the meanings given those terms in section 127(a) of the Federal Water Pollution Control Act. </text></paragraph></subsection><subsection id="HDD447C6044E24DCA9D1B6C377A74AD64"><enum>(b)</enum><header>Mississippi River Corridor Research Centers</header><paragraph id="H2A2D404EF6954A19B1FC5F27587134C8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Interior shall coordinate with the MRRRI Director to establish a network of 4 Mississippi River Corridor Research Centers within the United States Geological Survey.</text></paragraph><paragraph id="H947E45FD08704DC0B5F7C5026ED2C657"><enum>(2)</enum><header>Location</header><text>The network of research centers established under paragraph (1) shall consist of—</text><subparagraph id="H124C458CE0F34AA98AC655F51EB37D64"><enum>(A)</enum><text>a National Mississippi River Corridor Research Center located at an office of the United States Geological Survey; and</text></subparagraph><subparagraph id="H3A27BA1972614C8A88C9134B4C8D2A39"><enum>(B)</enum><text>3 regional research centers, each of which shall be based out of a host institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)), of which—</text><clause id="HF6455ED564B646C1997A2F68848FF7E9"><enum>(i)</enum><text display-inline="yes-display-inline">1 shall be an Upper Mississippi River Research Center located in the region from the headwaters of the Mississippi River to the confluence of the Mississippi River with the Missouri River;</text></clause><clause id="H653AEECDDB254AB59738753979D9E344"><enum>(ii)</enum><text>1 shall be a Middle Mississippi River Research Center located in the region downriver from the confluence of the Missouri River to the confluence of the Ohio River; and</text></clause><clause id="HE8919EFBD8724E8EA4ED65C7402B7C7E"><enum>(iii)</enum><text>1 shall be a Lower Mississippi River Research Center located in the region downriver from the confluence of the Ohio River to the Gulf of Mexico.</text></clause></subparagraph></paragraph><paragraph id="H8AE15F74B698464CB84DBC43D4CA7DDC"><enum>(3)</enum><header>Functions</header><text>The functions of the research centers established under paragraph (1) shall be—</text><subparagraph id="H213C19AD54D74327963404B6AF0AA17F"><enum>(A)</enum><text>to conduct scientific research on the MRRRI focus areas described in section 127(c)(2) of the Federal Water Pollution Control Act;</text></subparagraph><subparagraph id="HECAF5F0E701F486CB642E12986F90F16"><enum>(B)</enum><text>to consult with and advise relevant Federal agencies on—</text><clause id="H5B1F594741264451809A26429C8B1596"><enum>(i)</enum><text display-inline="yes-display-inline">the improvement of programs that monitor water quality in the Mississippi River Corridor and the health of the Mississippi River Corridor habitat or the establishment of such programs, where necessary;</text></clause><clause id="H2C0AA114C8B9473EB51367D955C6574B"><enum>(ii)</enum><text>the impact of projects and activities carried out under the MRRRI; and </text></clause><clause id="H5CE25CD969D2493EB99AFD94308511C3"><enum>(iii)</enum><text>any additional goals, priorities, metrics, and research objectives proposed as part of the science plan described in subsection (c)(2); and</text></clause></subparagraph><subparagraph id="H65B31F38F73B40EAB7FEF6FEEE297EE8"><enum>(C)</enum><text>to consult, and, to the extent practicable, collaborate, with relevant Federal agencies and non-Federal entities with respect to research, monitoring, and other efforts to promote the restoration and resiliency of the Mississippi River Corridor.</text></subparagraph></paragraph><paragraph commented="no" id="H35D2775503924558BF12CC31169AFFA2"><enum>(4)</enum><header>Integration with other Federal activities</header><text display-inline="yes-display-inline">The Secretary of the Interior shall ensure that research and other activities carried out at a research center established under paragraph (1) are carried out in coordination with other Federal research and monitoring activities related to efforts to promote the restoration and resiliency of the Mississippi River Corridor.</text></paragraph></subsection><subsection id="H6567625D35EB4D2F9BC5BCD267990AEA"><enum>(c)</enum><header>Science plan</header><paragraph id="HCB567A75D03E439790395EB43BE9986C"><enum>(1)</enum><header>Mississippi River science forum</header><subparagraph id="HBB8456BB84524ADBB85BB34731F6DD94"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall host a Mississippi River science forum with relevant Federal agencies, Mississippi River States, Tribal governments, Tribal organizations, academia, and other non-Federal entities—</text><clause id="H0E9F87EDF46F422EA940EDE2727E722E"><enum>(i)</enum><text>to share current science and identify data gaps and areas of concern relating to the ecological health of the Mississippi River Corridor; and </text></clause><clause id="H3AA3721AB9D04EDEA1463AFF2CF35240"><enum>(ii)</enum><text display-inline="yes-display-inline">to determine the resources that are necessary—</text><subclause id="HA1851EE3F644401D867D9C6C53AE3BFB"><enum>(I)</enum><text>to address any data gaps and areas of concern identified under clause (i); and</text></subclause><subclause id="HB5B15F5065C44042AA6453F41A9F52A0"><enum>(II)</enum><text>to develop an integrated science plan under paragraph (2).</text></subclause></clause></subparagraph><subparagraph id="HEBBACB09A54D47DAA5225404F68917F7"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 270 days after the date on which the Director hosts the Mississippi River science forum under subparagraph (A), the Director shall submit a report on the findings from that forum to—</text><clause id="H64D3935477934909A8CDFA1099C98843"><enum>(i)</enum><text>the Administrator of the Environmental Protection Agency;</text></clause><clause id="HABF39B1ECFDE48D8ADF60166FB052EDE"><enum>(ii)</enum><text display-inline="yes-display-inline">the MRRRI Director;</text></clause><clause id="H540C13ED625B4F619337A3080CA79F7A"><enum>(iii)</enum><text>the Committees on Appropriations, Natural Resources, and Transportation and Infrastructure of the House of Representatives; and</text></clause><clause id="H29E05201DC5147A283347F14B3A8C098"><enum>(iv)</enum><text>the Committees on Appropriations, Energy and Natural Resources, and Environment and Public Works of the Senate.</text></clause></subparagraph></paragraph><paragraph id="H397975A181954B38944C7C6996100536"><enum>(2)</enum><header>Science plan development</header><subparagraph id="H2D40AD34A64548CD95B0D10C565AAFDC"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date on which the Mississippi River science forum required by paragraph (1)(A) concludes, the Director shall develop a science plan that establishes priorities, metrics, and research proposals for the MRRRI.</text></subparagraph><subparagraph id="H0B2300E084B4473088FB90B796367EF2"><enum>(B)</enum><header>Submission</header><text display-inline="yes-display-inline">On completion of the science plan developed under subparagraph (A), the Director shall make the plan available on a public website and submit the plan to the MRRRI Director to inform the implementation of the actionable goals and action plans developed for the MRRRI under section 127(d) of the Federal Water Pollution Control Act.</text></subparagraph><subparagraph id="HEB730312D44341F5B7C08F8DD6A24A4B"><enum>(C)</enum><header>Updates</header><text display-inline="yes-display-inline">Not less frequently than once every 5 years, the Director shall coordinate with the MRRRI Director and the research centers established under subsection (b)(1) to review and update the science plan developed under subparagraph (A).</text></subparagraph><subparagraph id="HE93DBCADE57642309736140BEA9D565B"><enum>(D)</enum><header>Coordination</header><text display-inline="yes-display-inline">In developing and updating the science plan under this paragraph, the Director shall solicit input and comment from the public through a formal public notice and comment period.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
