which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy and Conservation Act to provide financial assistance to States to implement expanded energy savings performance contracting programs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD1E54C15EFEA4FC1A63F2B6C13E2DB7B"><section section-type="section-one" id="HC7B907CDA5264B508903DE00B0AF0C02"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Improving State and Local Government Access to Performance Contracting Act of 2024</short-title></quote>.</text></section><section id="HE4A53CAA56A04179BFF8BD83FFBE376C"><enum>2.</enum><header>State energy savings performance contracting program expansion</header><subsection id="H232A689655C8440F93B626E2426CC2DF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part D of title III of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HF88468C04E8245659AF2091DA3F29728"><section id="H963FD849D5004F7D8018EA7F4793073A"><enum>367.</enum><header>State energy savings performance contracting program expansion</header><subsection commented="no" id="H03DB6374280740E9880F441D4DA09F1D"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="H23D106EB8EC24925A36FBFD10F471646"><enum>(1)</enum><header>Energy savings performance contract</header><text display-inline="yes-display-inline">The term <term>energy savings performance contract</term> means a contract that provides for the performance of services for the design, acquisition, installation, testing, and, as appropriate, operation, maintenance, and repair, of an energy conservation measure, water conservation measure, resiliency-related measure, utility cost savings measure, or series of such measures at 1 or more locations. </text></paragraph><paragraph commented="no" id="H2E48767EB4C94A7CA3A18FB385CF32AB"><enum>(2)</enum><header>State energy savings performance contracting program</header><text display-inline="yes-display-inline">The term <term>State energy savings performance contracting program</term> means a State program—</text><subparagraph commented="no" id="HCF2202BF45524F7FBEDCA6E0519AE0D8"><enum>(A)</enum><text>to support the design and implementation of energy savings performance contracts, including, to the extent authorized by law, energy savings performance contracts entered into by State or local governments, public educational institutions, and other public, governmental, and quasigovernmental entities in the State; </text></subparagraph><subparagraph id="idb83432b8c0654c9fb3369a8783f14609"><enum>(B)</enum><text>part of which is to support efficiency improvements in rural and underserved communities; and</text></subparagraph><subparagraph commented="no" id="H706CB27E58AA49539C701E00C6570E44"><enum>(C)</enum><text>that may include—</text><clause commented="no" id="H1A1FAB61B744467CB1D7ABB2E91E547C"><enum>(i)</enum><text>the development and provision of model, template, or standardized contracts, guidelines, procedures, manuals, and other related documents;</text></clause><clause commented="no" id="H0975A5629B354A4E858C4B1E0A8797AA"><enum>(ii)</enum><text>a State program for prequalification and certification of energy savings performance contractors;</text></clause><clause commented="no" id="H91C264BEDCDB4E6FAD8DE534B56BF685"><enum>(iii)</enum><text>provision of technical and administrative assistance; and</text></clause><clause commented="no" id="HA83EE9FD977449B98B2C91B26088A435"><enum>(iv)</enum><text>monitoring, tracking, and reporting of energy savings performance contracts, including identifying the number and value of contracts, energy savings, water savings, and financial performance.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H163A3823410C49E19EAB86ECFBD43038"><enum>(3)</enum><header>Water conservation measure</header><text display-inline="yes-display-inline">The term <term>water conservation measure</term> means a measure that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6ffaaa2f7a0e466195b100ab8508ef1f"><enum>(A)</enum><text display-inline="yes-display-inline">improves the efficiency of water use;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida58e838c9245496a9e08942d67660c10"><enum>(B)</enum><text display-inline="yes-display-inline">is life-cycle cost-effective; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9c6baa55fb734f25850f19d05f5c9287"><enum>(C)</enum><text display-inline="yes-display-inline">involves water conservation, water recycling or reuse, more efficient treatment of wastewater or stormwater, improvements in operation or maintenance efficiencies, retrofit activities, or other related activities that do not occur at a Federal hydroelectric facility.</text></subparagraph></paragraph></subsection><subsection id="HE000A722ED2D4130B9549F0132D3FF23"><enum>(b)</enum><header>Financial assistance</header><text display-inline="yes-display-inline">On request of the Governor of a State by not later than 1 year after the date of enactment of this section, the Secretary shall provide, subject to the availability of funds, financial assistance to the State energy agency (as defined in section 391) for the implementation, improvement, or expansion of a State energy savings performance contracting program.</text></subsection><subsection commented="no" id="H3692214810EA42229EF33B278EADE148"><enum>(c)</enum><header>Use of funds</header><paragraph commented="no" id="H66F2836C8C1D441D92673520CF8B9C14"><enum>(1)</enum><header>Supplement</header><text>Financial assistance provided to a State under subsection (b) shall be used to supplement, not supplant, any other Federal, State, or other funds made available to that State under—</text><subparagraph id="H18AA09437E1A48CCA734C61D0EB4E1D9"><enum>(A)</enum><text>this part; or</text></subparagraph><subparagraph id="HF7B95091978F4F7FBE1F8D4491DD2D3E"><enum>(B)</enum><text>the weatherization assistance program established under part A of title IV of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6861">42 U.S.C. 6861 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idecdd47c9f05b4211ad2e239cd8fc3c9e"><enum>(2)</enum><header display-inline="yes-display-inline">Other sources</header><text>To the maximum extent practicable, a State receiving financial assistance under subsection (b) shall implement, improve, or expand a State energy savings performance contracting program by primarily using private financing, public financing, or any other source of Federal or non-Federal funds.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e65be7087294807994ada9eac182ee8"><enum>(3)</enum><header>Return of unused funds</header><text>A State that receives financial assistance under subsection (b) but does not expend those funds within 5 years of receipt of the funds shall return the unexpended funds to the Secretary.</text></paragraph></subsection><subsection commented="no" id="H850FF3025A024CEDAC2FC7B981FC9031"><enum>(d)</enum><header>Allocation</header><text display-inline="yes-display-inline">In providing financial assistance to States under subsection (b), the Secretary shall—</text><paragraph id="HB41E87A8EA514E018427AC47FFEDC303"><enum>(1)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, allocate funds made available for that purpose—</text><subparagraph id="H3171C4550A404DB5B652E5B3C76F6824"><enum>(A)</enum><text>in accordance with the formula described in section 420.11 of title 10, Code of Federal Regulations (as in effect on January 1, 2021); and</text></subparagraph><subparagraph id="HC7D08032A0DF430FA1877941FC90908A"><enum>(B)</enum><text display-inline="yes-display-inline">during the fiscal year for which the allocation is made; and</text></subparagraph></paragraph><paragraph id="H9B87EFBD4051499F94976D0278098ACB"><enum>(2)</enum><text>reallocate, to the maximum extent practicable, any funds returned under subsection (c)(3) in accordance with the formula described in paragraph (1)(A).</text></paragraph></subsection><subsection id="HAE941452C8634D8FA00A962F89C207E6"><enum>(e)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">On request of a State agency, the Secretary shall provide information and technical assistance in the development and implementation of a State energy savings performance contracting program. </text></subsection><subsection id="H44E9B39ED3624851A46B6485CCE0B095"><enum>(f)</enum><header>Project facilitator certification program</header><paragraph id="H8BB788DC0A19430B81439E3DF5570E71"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with States and the private sector, shall establish a national project facilitator certification program to expand the availability of individuals, including State and local government employees and independent private sector professionals, who are trained and certified to work on behalf of a State or local government to be project facilitators who will—</text><subparagraph id="HDFB704EDE14348548A5EEE39239BBAFD"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that a project carried out under an energy savings performance contract under a State energy savings performance contracting program achieves the energy cost savings and performance requirements set forth in the contract; and</text></subparagraph><subparagraph id="H07A2B9038FD54F8586EDBDB651C0AB41"><enum>(B)</enum><text>otherwise assist with the oversight of projects described in subparagraph (A). </text></subparagraph></paragraph><paragraph id="H70EDB18AF17B4E978F1A8777C657BDBE"><enum>(2)</enum><header>Activities</header><text>In carrying out the program established under paragraph (1), the Secretary may—</text><subparagraph id="H4BE61AEE80F8404690F8BC8A0ABA5736"><enum>(A)</enum><text>train and certify individuals as project facilitators described in paragraph (1); </text></subparagraph><subparagraph id="H50188D7D6DE94D80814EB70169E1140D"><enum>(B)</enum><text>develop model criteria for the certification and training of individuals to become project facilitators described in paragraph (1); and</text></subparagraph><subparagraph id="H19AABDAD35934E60A62189C7D3B25219" commented="no"><enum>(C)</enum><text>transition, over a 4-year period, the training and certification activities of the Secretary described in subparagraph (A) to a nonprofit entity funded with fees generated through the certification process. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1421fef3a3934e57b6b8a2f9a2f583e4"><enum>(g)</enum><header>Funding</header><paragraph commented="no" display-inline="no-display-inline" id="id18a2e43bd5964df0b0251fb047b111a2"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to funds authorized to be appropriated under section 365(f), there is authorized to be appropriated to the Secretary to carry out this section (except for subsections (e) and (f)) $35,000,000 for each of fiscal years 2024 through 2028.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb2a99d5b96434c0fbdbfe4ed3f68e3da"><enum>(2)</enum><header>Available amounts</header><text display-inline="yes-display-inline">Of amounts made available to carry out the programs and activities of the Federal Energy Management Program of the Department of Energy each fiscal year, the Secretary shall use not more than $2,000,000 each fiscal year to carry out subsections (e) and (f).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7D4D432D5C5B42EA89B345175FF034B0"><enum>(b)</enum><header>Conforming amendment</header><text>Section 362(d)(5)(A) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322(d)(5)(A)</external-xref>) is amended by inserting <quote>, including State energy savings performance contracting programs under section 367,</quote> after <quote>performance contracting programs</quote>.</text></subsection><subsection id="H9594C4FAC92A40D19019447C90A6C28A"><enum>(c)</enum><header>Technical amendment</header><text>The table of contents for the Energy Policy and Conservation Act (<external-xref legal-doc="public-law" parsable-cite="pl/94/163">Public Law 94–163</external-xref>; 89 Stat. 872) is amended by inserting after the item relating to section 366 the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H40D1983D97EE49EE8C0D0BE8BD1BABC5"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 367. State energy savings performance contracting program expansion.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
