which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To support local governments for jurisdictions that elect or appoint a person with a disability in providing the accommodations needed for the elected or appointed official to carry out their official work duties, and to build the capacity of local governments to have consistent and adequate funding for accommodations.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accessibility and Inclusion to Diversify Local Government Leadership Act</short-title></quote> or the <quote><short-title>AID Local Government Leadership Act</short-title></quote>.</text></section><section id="idf38a1cab00894ce8b61fd7042a4ab02a"><enum>2.</enum><header>Findings and purposes</header><subsection id="id3f4211289e4e44ef87eba7ad4b150313"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="idbc8bcd10eb8645e0926aef1be3afd0fe"><enum>(1)</enum><text>The Centers for Disease Control and Prevention estimates approximately 1 in 4 adults in the United States has a disability.</text></paragraph><paragraph id="ida6dbd0248c54463991547b447b1695e8"><enum>(2)</enum><text>Data from the Bureau of Labor Statistics indicates that the labor force participation rate of people with disabilities is consistently half of that of people without disabilities.</text></paragraph><paragraph id="id7e0169dc6aa7469f8467562a45b0037b"><enum>(3)</enum><text>The National Council on Independent Living reports that people with disabilities are underrepresented in elected offices.</text></paragraph><paragraph id="id4D419DECEF334E5F8E2E7135D6D8F88E"><enum>(4)</enum><text>Local governments are required, under the Americans with Disabilities Act of 1990, to provide reasonable accommodations to enable individuals with disabilities to perform official work duties. </text></paragraph></subsection><subsection id="id470ef98579cd437aa6af70d4a12760a1"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text><paragraph id="id8664c31425ce4ddbb99350bb4b89c80f"><enum>(1)</enum><text>to support local governments for jurisdictions that elect or appoint a person with a disability, in providing the accommodations needed for the local elected or appointed official to carry out the official’s official work duties, to enable the governments to meet the requirement described in subsection (a)(4); and</text></paragraph><paragraph id="id08f1365353cd4a21af2084ee3a996a7d"><enum>(2)</enum><text>to build the capacity of local governments, who otherwise do not have adequate funding to provide the accommodations, to have adequate and consistent funding to provide the accommodations for such officials.</text></paragraph></subsection></section><section id="ida7b82f803eb74ef0bf347aed145bc386"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id1a6a763644684b1c9ed338ac1d0e2d1d"><enum>(1)</enum><header>Assistive technology</header><text>The term <term>assistive technology</term> means technology designed to be utilized in an assistive technology device or assistive technology service.</text></paragraph><paragraph id="id6a7766485a4e4a228ad38233329ba12c"><enum>(2)</enum><header>Assistive technology device; assistive technology service</header><text>The terms <term>assistive technology device</term> and <term>assistive technology service</term> have the meanings given the terms in section 3 of the Assistive Technology Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/3002">29 U.S.C. 3002</external-xref>).</text></paragraph><paragraph id="idd7d7d253bb6d46a7ae6d73626e018112"><enum>(3)</enum><header>Disability</header><text>The term <term>disability</term> has the meaning given the term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph><paragraph commented="no" id="id07a10fca27be4f9ab6d4c3a01656fa52"><enum>(4)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" id="id645B1B7FAE1E42DAB8CE90E2C342BED9"><enum>(5)</enum><header>Local appointed official</header><text>The term <term>local</term>, used with respect to an appointed official, means an individual who—</text><subparagraph id="id81947ca4e8ac424aacd9e7b2672ef592"><enum>(A)</enum><text>is appointed to a position on an advisory committee that makes recommendations to local government; and</text></subparagraph><subparagraph id="idb92c39a1c02645b28efdf168fba5e724"><enum>(B)</enum><text>is not paid for the individual's work in the position. </text></subparagraph></paragraph><paragraph id="ide8d3f5d968164491af353ef8c5e9eb92"><enum>(6)</enum><header>Local elected official</header><text>The term <term>local</term>, used with respect to an elected official, means an official who is elected for a position, from a village, town, county, or other municipality that is not national or statewide, via an election authorized by a local election board.</text></paragraph><paragraph id="idaa2b1c9cc83f4641a6e5dbdcd3da9d03"><enum>(7)</enum><header>Local government</header><text>The term <term>local government</term> means the government of any village, town, city, county, or other municipality that is not national or statewide.</text></paragraph><paragraph id="ida86959b80a3d429289fa2b3265b2c6c2"><enum>(8)</enum><header>Reasonable accommodation</header><text>The term <term>reasonable accommodation</term> has the meaning given the term in section 101 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111</external-xref>). </text></paragraph><paragraph id="id192791306dd743c283240aefe3083b19"><enum>(9)</enum><header>Rural</header><text>The term <term>rural</term>, used with respect to an area, means an area classified as a rural commuting area under the Rural-Urban Commuting Area Codes developed by the Secretary of Agriculture and the Secretary of Health and Human Services.</text></paragraph><paragraph id="id3c76ac2842c740b7b4a5312b0c4dacef"><enum>(10)</enum><header>Secretary</header><text>Except as otherwise specified, the term <term>Secretary</term> means the Secretary of Labor, acting through the Assistant Secretary for Disability Employment Policy.</text></paragraph><paragraph commented="no" id="id4a54faa359ec43888a0c459cddb8c4ee"><enum>(11)</enum><header>State</header><text>The term <term>State</term> means any of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Marianas.</text></paragraph><paragraph commented="no" id="idB33882B86AE34350A372F1075F8309A8"><enum>(12)</enum><header>Work duties</header><text>The term <term>work duties</term> means the essential functions of an employment position.</text></paragraph></section><section id="ide98c10b376e445098037d1b6824ad651"><enum>4.</enum><header>Community grant program</header><subsection id="id30bfbbc48ff9486d9d2c4d85253b58fe"><enum>(a)</enum><header>In general</header><text>From the amounts appropriated to carry out this Act, the Secretary shall award grants to eligible entities in any State or associated with any Indian tribe in order to provide, to local elected or appointed officials who have disabilities, reasonable accommodations needed to enable the officials to carry out their official work duties, which accommodations may include—</text><paragraph id="id14ee5a6c9d234bc78a9b0b8f3b867553"><enum>(1)</enum><text>physical adaptations of office space and other spaces used for public events;</text></paragraph><paragraph id="id8045038d540846f1a373fbbc19beb219"><enum>(2)</enum><text>specialized software;</text></paragraph><paragraph id="id3788177c69ca484fb5a7a1d67c4778ed"><enum>(3)</enum><text>communication supports, including sign language interpreters;</text></paragraph><paragraph id="idE0BC4953579143048ABBB704E0F1BCA8"><enum>(4)</enum><text>provision of transportation services for an official work event (excluding transportation for commuting); and </text></paragraph><paragraph id="idc8ab997f961043a3aaa77ce23ab8114e"><enum>(5)</enum><text>other assistive technology devices and assistive technology services needed to carry out official work duties. </text></paragraph></subsection><subsection id="id0542ce01d791430ba8c458b7f16e9291"><enum>(b)</enum><header>Awards</header><paragraph id="id3f78684e247543bda0c482a0dd0cfcfb"><enum>(1)</enum><header>Process</header><text>During a fiscal year, the Secretary shall award the grants on a first-come, first-served basis until the funds appropriated under this section for that year are exhausted. If funds appropriated under this section are not exhausted for a fiscal year, the Secretary may use the funds to award such grants during a subsequent fiscal year.</text></paragraph><paragraph id="id05cdbfabefe549d6943242568dbd0113"><enum>(2)</enum><header>Amounts</header><text>The Secretary shall award such a grant in an amount of not less than $3,000 and not more than $50,000, per year of the grant period. </text></paragraph></subsection><subsection id="id26f1698ef31c4d90b5eeef70b8ffdf08"><enum>(c)</enum><header>Grant period</header><text>The Secretary shall award such a grant for a period equal to—</text><paragraph id="id7ddd086cd0cc49e7bc6318ca81c86559"><enum>(1)</enum><text>the number of years the local elected or appointed official involved will be in office during the official’s first term; and</text></paragraph><paragraph id="id51604740108345d0aebfcdf5b0dedd80"><enum>(2)</enum><text>2 years.</text></paragraph></subsection><subsection id="id1e60a49c9a344e22b541c359360476cf"><enum>(d)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall be a local government—</text><paragraph id="id8ab22835f2bc47b8a13f0e27a0c4ead7"><enum>(1)</enum><text>that has a local elected or appointed official who has a disability and needs a reasonable accommodation to carry out the official’s official work duties; and</text></paragraph><paragraph id="id3cac5d9728e8498d9a74bae0701563bd"><enum>(2)</enum><text>for a jurisdiction that—</text><subparagraph id="ida87bbcd17ddf4a10afbfde7e1f415ccb"><enum>(A)</enum><text>is in a rural area;</text></subparagraph><subparagraph id="ida8f68cb194464ac9860f538a3978fe56"><enum>(B)</enum><text>has a population of less than 10,000; or</text></subparagraph><subparagraph id="id2cf9fa6d0de84fe38015c63135c93bdf"><enum>(C)</enum><text>has a population of 10,000 to less than 200,000, and a poverty rate of 18 percent or greater, according to the most recent data available from the Bureau of the Census.</text></subparagraph></paragraph></subsection><subsection id="id448f53ec27534fc1813b3b4f4cd0132e"><enum>(e)</enum><header>Application and selection</header><paragraph id="id98ee9efc011643aaa21a56f8f6195db6"><enum>(1)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an entity shall submit an application to the Secretary, in accordance with a process prescribed by the Secretary, that shall include, at a minimum—</text><subparagraph id="id94e6ef0ffd034699b2bab81fd30b3433"><enum>(A)</enum><text>a description of—</text><clause id="idDB630F17CA084B8D94F81934468F6DB9"><enum>(i)</enum><text>the position, including the official work duties of the position, held by the local elected or appointed official involved;</text></clause><clause id="id780b750801f643a996f6ba7cf30fd330"><enum>(ii)</enum><text>the needed reasonable accommodations for the local elected or appointed official; and</text></clause><clause id="idbbecc6bc83914cc1b388dd525e10ab4d"><enum>(iii)</enum><text>a budget to cover those accommodations; and</text></clause></subparagraph><subparagraph id="id2808f2da67cb46eeb90d913c203a4a80"><enum>(B)</enum><text>assurances that the eligible entity will—</text><clause id="id03200c5f7332483f9162470a2af6ce60"><enum>(i)</enum><text>use the grant funds only for reasonable accommodations needed for the local elected or appointed official involved to carry out their official work duties;</text></clause><clause id="id9f0f973760b242f5a147b3356c9cc530"><enum>(ii)</enum><text>provide, for each fiscal year, non-Federal matching funds equal to not less than 25 percent of the amount provided through the grant for that fiscal year;</text></clause><clause id="id1190656EF08D4F98A1ED1613D80E3907"><enum>(iii)</enum><text>use the non-Federal matching funds to fund a reasonable accommodations funding account;</text></clause><clause id="ide44db3cc4c2f45cba99ef9633f5e260e"><enum>(iv)</enum><text>continue the funding of that account for at least 4 years after the end of the grant period, maintaining a balance in the account equal to the total amount of non-Federal matching funds provided by the entity during the grant period; </text></clause><clause id="id9C293494856C4864A5696BA9BD3CA7F7"><enum>(v)</enum><text>use the account solely for the purposes of assisting local elected and appointed officials who have disabilities, by providing reasonable accommodations needed to carry out their official work duties; and</text></clause><clause id="ida4e20b249df4462aa6348c41f435b495"><enum>(vi)</enum><text>submit annual reports on the grant activities as required by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id833109a2f56045f489e31f8e11c7ee68"><enum>(2)</enum><header>Selection process</header><text>The Secretary shall award grants in accordance with a process prescribed by the Secretary. </text></paragraph></subsection><subsection id="idf049da91a3fd476bad6336213461b00b"><enum>(f)</enum><header>Allowable use</header><text>An eligible entity that receives a grant under this Act may use the grant funds for reasonable accommodations needed to enable a local elected or appointed official who has a disability to carry out the official work duties of the local elected or appointed official. The reasonable accommodations may include the physical adaptations, specialized software, communication supports, and devices and services, described in subsection (a). </text></subsection><subsection id="id0acdbef05ee74ef4909fb521ae8fff8c"><enum>(g)</enum><header>Annual report</header><paragraph id="ide901573190e642edbd7dca30d34e932f"><enum>(1)</enum><header>In general</header><text>The Secretary shall annually prepare a report regarding the impact of the grant program carried out under this section, which report shall include—</text><subparagraph id="iddcdb3da527fb43fb9817278fcf51baba"><enum>(A)</enum><text>the number of applications received under the program;</text></subparagraph><subparagraph id="id86927d7a01994cab910047d7aa1c10e1"><enum>(B)</enum><text>the number of eligible entities that received a grant;</text></subparagraph><subparagraph id="id0b8faa3d1fed4d4495bb9b213d349efd"><enum>(C)</enum><text>a description of the communities receiving the grant funding, such as—</text><clause id="id6EF7146300AA4917A8D69590C9AC06FF"><enum>(i)</enum><text>information on whether the communities are—</text><subclause id="id2C038D30414A4462BEF315FCBDF0A7A2"><enum>(I)</enum><text>rural areas or jurisdictions described in subsection (d)(2); or</text></subclause><subclause id="idA1165316221E462D84F9ECD57F9F6665"><enum>(II)</enum><text>other types of communities;</text></subclause></clause><clause id="id4C52D6927007482D8618CEE64A9F7F45"><enum>(ii)</enum><text>race and ethnicity data for the communities; </text></clause><clause id="idD7059361921B476D817FEF0CB5535385"><enum>(iii)</enum><text>information on the percentage of the population of the communities that is living in poverty; and </text></clause><clause id="id6FCBBC0070DA4272B9E8B3D53308A409"><enum>(iv)</enum><text>related community demographics;</text></clause></subparagraph><subparagraph id="ide888a07dfb8444f386e1a9f4974cc6cb"><enum>(D)</enum><text>a description of the types of positions held by the local elected or appointed officials supported; and</text></subparagraph><subparagraph id="idc5cc18561d1146b9a078f7a2ad18d080"><enum>(E)</enum><text>a description of the types of adaptations, services, assistive technology, technology, communication services, and other reasonable accommodations funded through the grants in order for the local elected or appointed officials to carry out their official responsibilities.</text></subparagraph></paragraph><paragraph id="id5590b1457ce642c08e2d76500035756e"><enum>(2)</enum><header>Information added after second year</header><text>Beginning with the third year of the program and for each subsequent year, in addition to the information specified in paragraph (1), the report shall include—</text><subparagraph id="id76571549a5a6430eb4fef851d02e14e8"><enum>(A)</enum><text>the total amount of funds eligible entities receiving the grants invested in reasonable accommodations funding accounts; and</text></subparagraph><subparagraph id="id0579d84a984a4901930c3392a7d7cbd4"><enum>(B)</enum><text>aggregate data on the age, sex, gender identity, race and ethnicity, and disability of the local elected or appointed officials the grant program is supporting.</text></subparagraph></paragraph><paragraph id="id85ba3fefe7014b4e9b9d670c972ff9e6"><enum>(3)</enum><header>Submission</header><text>The Secretary shall annually submit the report prepared under this subsection to—</text><subparagraph id="id14e1892e14174c99a1d231d24016c2ff"><enum>(A)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subparagraph><subparagraph id="id6e1a7cae16d84e5386006ab3703b1090"><enum>(B)</enum><text>the Committee on Education and the Workforce of the House of Representatives; and</text></subparagraph><subparagraph id="idf4d49258e65449529cb4b60a01564d0d"><enum>(C)</enum><text>the Special Committee on Aging of the Senate.</text></subparagraph></paragraph></subsection><subsection id="id2fb0f317f31a44e1af601f147c288e2b"><enum>(h)</enum><header>Administration</header><text>From the amounts made available under subsection (i) for a fiscal year, the Secretary may reserve and use not more than 1 percent for administration of the grant program carried out under this section.</text></subsection><subsection id="idc8950ad7c8ac4cdc9c06fd1ba85931bd"><enum>(i)</enum><header>Authorization of appropriations</header><paragraph id="id436802a9c16e46bb94ca5cbb85686015"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this Act, $5,000,000 for each of fiscal years 2025 through 2031.</text></paragraph><paragraph commented="no" id="idaa42fe433031475898f2f64d903c13f7"><enum>(2)</enum><header>Availability</header><text>Funds appropriated under paragraph (1) shall remain available until expended. </text></paragraph></subsection></section></legis-body></bill>
