Removal of limitation on use of funds for participation of protection and advocacy systems in litigation related to election-related disability access.</toc-entry></toc></subsection></section><section id="idE3093B0766AE48EDB43E53544FCF8C98"><enum>2.</enum><header>Findings; purpose</header><subsection id="id8C1C0ABEEEDA4EAEA4DA29CF2DCB8B26"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="id8699721a43654becb5f99ad876240994"><enum>(1)</enum><text>Since its founding, America has steadily worked to ensure the right to vote for all through State law, Federal law, and constitutional amendments.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9383d0b8532a4ef1bcb58cbf22deb343"><enum>(2)</enum><text>By 2030, one in five Americans will be over 65.</text></paragraph><paragraph id="id33d57eb062744f4a9b416ec187b4ea0a"><enum>(3)</enum><text>Of the 28,720,000 voting age individuals with disabilities in 2020, an estimated 17,740,000 voted in the November 2020 election.</text></paragraph><paragraph id="id6771640a975343c4b445d030b5f7bf4a"><enum>(4)</enum><text>Older individuals who have been lifelong voters and who now find it difficult to leave their home often cannot vote in person.</text></paragraph><paragraph id="id20fb5b8bee0a42c4b57694cc245569da"><enum>(5)</enum><text>Despite Federal laws requiring fully accessible voting places, barriers to vote for people with disabilities and older individuals still exist.</text></paragraph><paragraph id="idb9d8048be94c46a8b1b98c68d1bee95f"><enum>(6)</enum><text>In 2016 only 40 percent of polling places were architecturally accessible and only 45 percent of voting booths were accessible.</text></paragraph><paragraph id="idaa79db3e98184cdf9c22239393c78516"><enum>(7)</enum><text>Combining deficiencies in architectural and voting booth access, only 17 percent of polling places could be considered fully accessible in 2016.</text></paragraph><paragraph id="idc5f53a17032643b884eaec8a13e0d63d"><enum>(8)</enum><text>People with disabilities voted at a rate 5.9 percent greater in 2020 than in 2016 (61.8 to 55.9 percent).</text></paragraph><paragraph id="id718590c8bc10421ca3157f473dabdcf9"><enum>(9)</enum><text>In 2017, the Native American Voting Rights Coalition found that the distance needed to travel to polling locations and drop off boxes for absentee ballots greatly affected the ability of Native Americans to cast ballots.</text></paragraph><paragraph id="id5c0b385f428e40149fddfd0d60b488ec"><enum>(10)</enum><text>The National Congress of American Indians found that the turnout rate for Native Americans and Alaska Native registered voters is between 5 to 14 percent lower than turnout rates of other racial and ethnic groups.</text></paragraph><paragraph id="ida2476ace656840ec91e26e97d09900df"><enum>(11)</enum><text>According to the United States Census Bureau, there are nearly 26,000,000 individuals in the United States with limited English proficiency and more than 66,000,000 who speak a language other than English at home. Americans with limited English proficiency can face challenges when attempting to register to vote and cast a ballot.</text></paragraph><paragraph id="idb1eb935889da42fb9e1da5cb8b6b1ddd"><enum>(12)</enum><text>A strong legislative focus on the needs of older individuals, individuals with disabilities, Native Americans, Alaska Natives, and individuals with limited proficiency in the English language is necessary to remove obstacles to vote and ensure they can exercise their right to vote.</text></paragraph></subsection><subsection id="id61D8DD1C394E4513A7CAAFAD8A39EBC6"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to improve access for older individuals, individuals with disabilities, Native Americans, Alaska Natives, and individuals with limited proficiency in the English language to register to vote and to cast a ballot by—</text><paragraph id="id2b056092b6c74ca187996d81868fc2ae"><enum>(1)</enum><text>providing States and local governments with resources to improve accessibility when registering to vote, voting by absentee, and casting a ballot in person; and</text></paragraph><paragraph id="id338cf77d82c24b9bbf07da8385c8c238"><enum>(2)</enum><text>expanding Federal oversight and support to ensure greater accessibility to State voting systems.</text></paragraph></subsection></section><title id="id23E8CD83720F4159A46ED3DBB74CD5DD" style="OLC"><enum>I</enum><header>Election Assistance Commission Office of Accessibility</header><section section-type="subsequent-section" id="id6F17F4518E0149C3A49BE3A1F5F37933"><enum>101.</enum><header>Establishment of the Election Assistance Commission Office of Accessibility</header><subsection id="id87250A6ADF6E4868937279E1A4E4417B"><enum>(a)</enum><header>In general</header><text>Subtitle A of title II of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/20921">52 U.S.C. 20921</external-xref>) is amended by adding at the end the following new part:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE53A212221524308AAE79D1D4C85EDB7"><part id="id0A96BB4A12284178A8EA6880D33A03AB" style="OLC"><enum>4</enum><header>Election Assistance Commission Office of Accessibility</header><section section-type="subsequent-section" id="id98EAD7068C0648C8B33CAF6948283C39"><enum>223.</enum><header>Election Assistance Commission Office of Accessibility</header><subsection id="idF2B1F4C5B57A4F938B01E725E27FEDE3"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Election Assistance Commission Office of Accessibility (hereinafter in this part referred to as the <quote>Office of Accessibility</quote>).</text></subsection><subsection id="idB385E62BB4A54D8EBBFA34EDD070077F"><enum>(b)</enum><header>Duties</header><text>The Office of Accessibility shall—</text><paragraph id="id612D990E11CA40948B5C2D5A3C557DF1"><enum>(1)</enum><text>serve as the effective and visible advocate on behalf of voters with access needs, including older individuals, individuals with disabilities, Native Americans, Alaska Native citizens, and individuals with limited proficiency in the English language—</text><subparagraph id="id1B1E19A164044816B101ECE04046C225"><enum>(A)</enum><text>within the Election Assistance Commission and with other departments and agencies of the Federal Government regarding all Federal policies affecting such individuals; and</text></subparagraph><subparagraph id="idA447B09DC00948DD8DD7CB06511CA2B3"><enum>(B)</enum><text>in the States to promote the enhanced accessibility of voting systems and compliance with this Act and other Federal law and regulations;</text></subparagraph></paragraph><paragraph id="id6C7EEEC05D774DEC86D58FFEB7A315D5"><enum>(2)</enum><text>ensure State and local election officials are taking steps to obtain, deploy, and maintain voting systems that meet Department of Justice accessibility standards;</text></paragraph><paragraph id="id27C79B0747FC4CB6BA3271DA04B284DE"><enum>(3)</enum><text>if the Director of the Office of Accessibility finds that a State has not taken steps to meet such standards, refer the finding to the Department of Justice for enforcement;</text></paragraph><paragraph id="idD78E0C8644554D1C8484ED78DF14D27B"><enum>(4)</enum><text>evaluate State proposals to expand voter accessibility in order to meet the requirements of sections 304 through 309;</text></paragraph><paragraph id="idC6F02A06F56140D484AA9E2F134A8A32"><enum>(5)</enum><text>ensure State and local governments meet the requirements of sections 304 through 309 (relating to accessible election websites and other accessibility requirements), including through referral to the Attorney General for action under section 401 as appropriate;</text></paragraph><paragraph id="idA8BE897B838C46C082279B898893DEC0"><enum>(6)</enum><text>administer and evaluate payments to States for the establishment and maintenance of accessible election websites under section 297;</text></paragraph><paragraph id="id8E3AFAA685B643CE9BED3DA3B1C11D48"><enum>(7)</enum><text>establish and operate the National Resource Center on Accessible Voting under section 224;</text></paragraph><paragraph id="idFD51DFDAF7B04FF9950EB74072B89735"><enum>(8)</enum><text>establish the national voter accessibility website under section 225;</text></paragraph><paragraph id="idE32B2FA9882441CA93821C72DEEAC0DE"><enum>(9)</enum><text>collect and disseminate information related to challenges experienced by older individuals, individuals with disabilities, Native Americans, Alaska Natives, and individuals with limited proficiency in the English language when registering to vote or casting a ballot; and</text></paragraph><paragraph id="id94386A6D45A24B88A69D0E1BF4101899"><enum>(10)</enum><text>recommend policies and priorities to improve the accessibility of State voter registration systems, voting systems, the casting of ballots, and the application for and casting of absentee, remote, and vote by mail ballots.</text></paragraph></subsection><subsection id="idf287439ee4a44b86a69ae15ae179ede7"><enum>(c)</enum><header>Objectives</header><text>The Office of Accessibility shall have the following primary objectives:</text><paragraph id="id21cea618303a4a0fbb02ecb8004cb645"><enum>(1)</enum><text>Educating State and local election officials on the challenges faced by older individuals, individuals with disabilities, Native Americans, Alaska Natives, and individuals with limited proficiency in the English language when voting, and teaching evidence-based strategies for overcoming those challenges.</text></paragraph><paragraph id="id350fe4dd04cb4733a146aa1f45210e80"><enum>(2)</enum><text>Educating State and local election officials regarding the needs of individuals with disabilities and older individuals.</text></paragraph><paragraph id="id6685ce4630904ccaa5b9a10ae1b9e06e"><enum>(3)</enum><text>Providing educational resources in plain language to older individuals and individuals with disabilities on their rights and resources when registering to vote and voting.</text></paragraph><paragraph id="idE0103C8B296D4F63AE6DE9B43893AD72"><enum>(4)</enum><text>Providing translated educational resources for Native Americans, Alaska Natives, and individuals with limited proficiency in the English language on their rights and resources when registering to vote and voting.</text></paragraph><paragraph id="id7b21fbd083d34fbeb9ed68176a7f1008"><enum>(5)</enum><text>Studying potential improvements and providing strategies that State and local election officials may implement, and encouraging the enactment of State or local laws as necessary for such implementation, with the goal of—</text><subparagraph id="idc6773f37f02c4bd6844af735c3d58224"><enum>(A)</enum><text>ensuring that individuals with disabilities and older individuals are provided the opportunity to cast a private and independent ballot in person in an election for Federal office, including—</text><clause id="idf89692e373894bd98b3c55a617087bf6"><enum>(i)</enum><text>identification of barriers to in-person voting and strategies for remediating architectural, attitudinal, transportation, technological, and other barriers to accessible in-person voting; </text></clause><clause id="id57d25149fdb64b048d64b50f4db5400a"><enum>(ii)</enum><text>strategies to reduce adversely long wait times for casting ballots;</text></clause><clause id="id3bca151ea1f448e780080743f0614957"><enum>(iii)</enum><text>alternative options to cast a ballot on the day of an election, such as providing the option to cast a ballot outside of the polling place or from a vehicle;</text></clause><clause id="idbae2de58fc004a7b888e2da665167344"><enum>(iv)</enum><text>strategies and criteria to create expedited voting lines for those needing such service; or</text></clause><clause id="idc6a774c8f0144c2da94207f8a242b86b"><enum>(v)</enum><text>the ability for an individual who cannot physically wait in line to exit the line without losing their place;</text></clause></subparagraph><subparagraph id="ida686946071824a5ba70faf1c4ea1f2e6"><enum>(B)</enum><text>ensuring that individuals with disabilities and older individuals are provided the opportunity to cast a private and independent absentee ballot, including—</text><clause id="id4b23b4888f344717959afe1993cde68b"><enum>(i)</enum><text>ensuring the process for requesting and securing an absentee ballot is accessible to individuals with disabilities and older individuals;</text></clause><clause id="idcdc9b949ca6a4b0586bab34cb6c2f05f"><enum>(ii)</enum><text>ensuring the process for submitting an absentee ballot is accessible to individuals with disabilities and older individuals; and</text></clause><clause id="id6b61f63d8846434f933c56cedbded97a"><enum>(iii)</enum><text>ensuring the process for marking an absentee ballot is accessible to individuals with disabilities and older individuals; and</text></clause></subparagraph><subparagraph id="id1cc7089633f84df68f1731a121230397"><enum>(C)</enum><text>implementing policies that encourage more individuals with disabilities and older individuals to serve as poll workers, including permitting shorter shifts to accommodate individuals who cannot work a full Election Day.</text></subparagraph></paragraph><paragraph id="idbe9addfcac8043c88e5c112a4b8b1791"><enum>(6)</enum><text>Promoting research into the use of accessible ballot marking devices and educating State and local election officials on the secure use of accessible ballot marking devices.</text></paragraph></subsection><subsection id="idE3DC6EA528C84030B53314497530FDFC"><enum>(d)</enum><header>Director of accessibility</header><paragraph id="id105A2A2D71824905B0FF778A5575B706"><enum>(1)</enum><header>In general</header><text>The Office of Accessibility shall be headed by a Director of Accessibility (referred to in this part as the <quote>Director</quote>) who shall be appointed by the Executive Director of the Election Assistance Commission.</text></paragraph><paragraph id="id55A107EAFED24D64885AAB5567284784"><enum>(2)</enum><header>Term of service for the director</header><text>The Director shall serve for a term of 4 years. The term of the first individual appointed to the position of Director shall end on January 3, 2028, and the term of each individual appointed for a full term to the position of Director thereafter shall end on January 3 of each fourth year thereafter.</text></paragraph><paragraph id="id77EF919657D84F0EA7C57A3AFA154A94"><enum>(3)</enum><header>Procedure for appointment</header><subparagraph id="id2D5FB65FDA474AFB994C1E8B6B2D95AE"><enum>(A)</enum><header>In general</header><text>On the date that is 6 months prior to the date on which a vacancy is scheduled to occur in the position of the Director or the date on which the Director submits a Letter of Resignation, the Election Assistance Commission Standards Board and Election Assistance Commission Board of Advisors under part 2 of this subtitle (hereafter in this part referred to as the <quote>Standards Board</quote> and the <quote>Board of Advisors</quote>, respectively), shall each appoint a search committee to recommend at least three nominees for the position.</text></subparagraph><subparagraph id="idEB873D3F371B49C1A29B797C857174A7"><enum>(B)</enum><header>Requiring consideration of nominees</header><text>The Executive Director of the Election Assistance Commission shall consider the nominees recommended by the Standards Board and the Board of Advisors in appointing the Director.</text></subparagraph></paragraph><paragraph id="id4CB81FB039254CC6B5484E3FE9232773"><enum>(4)</enum><header>Procedure for reappointment</header><subparagraph id="idAE35B6DDFCE84FFC842FA46A05B6D96F"><enum>(A)</enum><header>In general</header><text>The Director may be reappointed for one or more additional full terms if the Standards Board and the Board of Advisors recommends such reappointment.</text></subparagraph><subparagraph id="id7020780B75744C0CB17D3AF573667C03"><enum>(B)</enum><header>Timing of recommendation</header><text>The Standards Board and the Board of Advisors may recommend such reappointment for an additional term before the date on which the current term of the Director expires, but not more than 3 months before such date.</text></subparagraph></paragraph><paragraph id="idE25F9F5324D04573B792D4A3C1D8D5C5"><enum>(5)</enum><header>Continuation in office</header><text>An individual serving in the position of Director at the end of the term of the individual as Director may continue to serve until a successor is appointed.</text></paragraph></subsection><subsection id="idA1E9177EF2FA45139AE4DBA6D041ECC4"><enum>(e)</enum><header>Deputy director</header><paragraph id="idDAAF3E80BD4B4DACA7FEF8E3B0476712"><enum>(1)</enum><header>In general</header><text>There shall be a Deputy Director of the Office who shall—</text><subparagraph id="idCA3897FAE5504BA2A088164264FEDF4C"><enum>(A)</enum><text>be appointed by the Director;</text></subparagraph><subparagraph id="id5A7C17C7CBA2429D882FE01E04ED4CBB"><enum>(B)</enum><text>perform such duties as may be assigned by the Director; and</text></subparagraph><subparagraph id="idAB10FC67AB424DB6AEA52B67EB29F573"><enum>(C)</enum><text>during the absence or incapacity of the Director or during a vacancy in that office, act as the Director.</text></subparagraph></paragraph><paragraph id="id2F854F9FCBA44D1396A10FAB91EA03ED"><enum>(2)</enum><header>Term</header><text>The term of an individual appointed to the position of Deputy Director shall end on the date on which the term of the Director appointing the Deputy Director ends.</text></paragraph><paragraph id="id65F646F91AB84591975A1E5F63D8422B"><enum>(3)</enum><header>Continuation in office</header><text>An individual serving in the position of Deputy Director at the end of the term of the individual as Deputy Director may continue to serve until a successor is appointed.</text></paragraph></subsection><subsection id="id9E6F1030E4C646E580FABEEBAD4AB6FA"><enum>(f)</enum><header>Other staff</header><text>Subject to rules prescribed by the Commission, the Director may appoint and fix the pay of such additional personnel as the Director considers appropriate.</text></subsection><subsection id="id0AF3F09529634B7BB940873D0B0BB88C"><enum>(g)</enum><header>Reports to Congress</header><text>Not later than 2 years after the date of enactment of this part, and every 2 years thereafter, the Director shall submit to Congress a report describing the activities carried out under this part during the period since the last report was submitted under this subsection.</text></subsection><subsection id="id8C0CB67258FE42FD857B8EB005A1070B"><enum>(h)</enum><header>Definitions</header><text>In this part, the term <term>accessible</term>, <term>individual with a disability</term>, <term>older individual</term>, and <term>State</term> have the meaning given those terms in section 304.</text></subsection><subsection id="idD7AD8F2236604A3BA2E63CDA854C20E2"><enum>(i)</enum><header>Authorization</header><text>There are authorized to be appropriated to the Office of Accessibility to carry out the provisions of this part $500,000 for each of fiscal years 2025 and 2026 and such sums as may be necessary for each succeeding year.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9E9652B78A8342FB92703E78BA2A6241"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="idABB56C186249473B818EAA367BD765ED"><enum>(1)</enum><header>Conforming amendment to duties of EAC</header><text>Section 202 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/20922">52 U.S.C. 20922</external-xref>) is amended—</text><subparagraph id="id52EDCFFB9EAB4A6D8BB1FA11E574C20E"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id11B205F2EDAC481C96B2446504AFB4A3"><enum>(B)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; Election Assistance Commission Office of Accessibility.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section section-type="subsequent-section" id="id1C5ACDD3B4814244923B86CA0A9327DD"><enum>102.</enum><header>National Resource Center on Accessible Voting</header><subsection id="id7B103AC2DAEE4757AE17C02F7FB5FB22"><enum>(a)</enum><header>In general</header><text>Part 4 of subtitle A of title II of the Help America Vote Act of 2002, as added by section 101, is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5380794F31F34C288C23335A4EE6057F"><section section-type="subsequent-section" id="id1378CE243B514851AEF37BC0D0A98AF1"><enum>224.</enum><header>National Resource Center on Accessible Voting</header><subsection id="id759D0E64DA3D4E568AE6819C4BBBBE90"><enum>(a)</enum><header>In general</header><text>Not later than January 1, 2025, the Office of Accessibility shall, directly or by grant or contract with eligible entities described in subsection (d), establish and operate a National Resource Center on Accessible Voting (in this section referred to as the <quote>Center</quote>).</text></subsection><subsection id="id938bdd95c7ad4d2690e1d618a96be8b1"><enum>(b)</enum><header>Activities</header><text>In order to address the unique challenges faced by older individuals, individuals with disabilities, Native Americans, Alaska Natives, and individuals with limited proficiency in the English language, the Center shall provide State and local election officials, poll workers, and volunteers with the information and technical assistance needed to effectively provide accessible voting, and ensure that older individuals, individuals with disabilities, Native Americans, Alaska Natives, and individuals with limited proficiency in the English language are given an equivalent opportunity to vote, including with privacy and independence. The Center shall also identify barriers to accessible voting among these populations and propose solutions that States and localities can adopt.</text></subsection><subsection commented="no" id="id76E3C9366B8F4DD99EBD3617E8957B59"><enum>(c)</enum><header>Objectives</header><text>The Center shall assist the Office of Accessibility in carrying out the primary objectives of the Office as described in section 223(c).</text></subsection><subsection id="id60e397a1bfd845148ab8cb7c4e571315"><enum>(d)</enum><header>Eligible entities</header><paragraph id="idC0F8D15412824E66AEF877512FF80D12"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant or contract under this subsection, an entity shall—</text><subparagraph id="idBC3BA03375754F32B1E1CD1F775B9230"><enum>(A)</enum><text>submit an application to the Office of Accessibility at such time, in such manner, and containing such information as the Office of Accessibility may reasonably require; and</text></subparagraph><subparagraph id="id4B552DFE7BC3455AAFD95606DC4E63E9"><enum>(B)</enum><text>meet the criteria described in paragraph (2).</text></subparagraph></paragraph><paragraph id="id76CC238653FC456587AE14C1EFF6058E"><enum>(2)</enum><header>Criteria described</header><text>The criteria described in this paragraph, with respect to an entity, are that the entity—</text><subparagraph id="idd666d6183744446dae7b489b2df74cc2"><enum>(A)</enum><text>has demonstrated expertise in working with organizations or individuals on issues affecting individuals with disabilities and older individuals;</text></subparagraph><subparagraph id="id107fc44670894896af6b7152c1985eb6"><enum>(B)</enum><text>has documented experience in providing training and technical assistance on a national basis or a formal relationship with an organization that has such experience;</text></subparagraph><subparagraph id="id0f9cefae231443e1b893dd8a9948fd86"><enum>(C)</enum><text>partners with an organization that has demonstrated expertise in election security; and</text></subparagraph><subparagraph id="idA53D63B8E9D24E4DBC2CFFCF0EDB8097"><enum>(D)</enum><text>meets such other criteria as determined appropriate by the Office of Accessibility.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id887a2a697beb4d65a1edad472b493b31"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section not less than $5,000,000 for fiscal year 2025 and each succeeding fiscal year. Amounts appropriated under the preceding sentence shall remain available until expended.</text></subsection><subsection id="ida3aad44b85024c8fbf289bd6629021b3"><enum>(f)</enum><header>Operating standards and reporting requirements</header><text>The Office of Accessibility shall develop and issue operating standards and reporting requirements for the Center.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8730C5EB362646F2982501D81F21AD84"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 223, as added by section 101(b)(2), the following new item:</text><quoted-block style="OLC" id="id9f8f18f7-4525-444a-bc4b-a187eea6b329"><toc><toc-entry idref="id1378CE243B514851AEF37BC0D0A98AF1" level="section">Sec. 224. National Resource Center on Accessible Voting.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idD244F9831803435E9157074EF74F9DD7"><enum>103.</enum><header>Establishment of national voter accessibility website</header><subsection id="idFF92A65F39084466BAD1090764ADF695"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to create an accessible national website to provide support and information to State and local election officials, individuals with disabilities, and older individuals.</text></subsection><subsection id="id243C4654DCBA49A198707FA4C09C9AE1"><enum>(b)</enum><header>Establishment</header><text>Part 4 of subtitle A of title II of the Help America Vote Act of 2002, as added by section 101 and amended by section 102, is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE6FC85D0E8DC400ABD7839EB971B4AFF"><section id="id1AEF82EBB01240B895F5DE5F8843CFDE"><enum>225.</enum><header>Establishment of national voter accessibility website</header><subsection id="id7B65533F40AE4E67AD7A32C21BA1CA91"><enum>(a)</enum><header>In general</header><text>The Office of Accessibility shall work with State and local election officials to collect data and administer a public national voter accessibility website to—</text><paragraph id="id2BCB37433E2248BC973123EEF7EA3E22"><enum>(1)</enum><text>ensure individuals with disabilities and older individuals are provided easy access to clear and understandable voter information for each State, including—</text><subparagraph id="idf1f896e3aa334af1b2d79116171e151b"><enum>(A)</enum><text>a link to each State accessible election website as described in section 304;</text></subparagraph><subparagraph id="id7ee44032621b48f8acf533d4e7a0f6d2"><enum>(B)</enum><text>information on voting timelines for each State, including deadlines to—</text><clause id="id5d02f1a4cedf4bb9b6dd804c314c4bb4"><enum>(i)</enum><text>register to vote;</text></clause><clause id="id6914956f928f4cad81c6e77b865caa3b"><enum>(ii)</enum><text>update voter registration information;</text></clause><clause id="id91b5e3627ac1496b88e44fad3db15de1"><enum>(iii)</enum><text>submit an application to run for elected office;</text></clause><clause id="ided0e6bb57a554ceea7c86b11dedaafb0"><enum>(iv)</enum><text>apply for an absentee ballot; and</text></clause><clause id="id6950a180368a43e6acbbcc82da827418"><enum>(v)</enum><text>submit an absentee ballot; and</text></clause></subparagraph><subparagraph id="ide4950c8d126645a18d17c65b4b8ccb29"><enum>(C)</enum><text>a plain language description of the voting laws of each State, including information on—</text><clause id="id8493e7e475c543ea93836042c04ac505"><enum>(i)</enum><text>voter identification requirements;</text></clause><clause id="id66bfa10c4f1243e5b8ca261cb32accf5"><enum>(ii)</enum><text>how to register to vote, update registration info, and confirm an individual is registered to vote in the State;</text></clause><clause id="idc831298eadab42d18b37d3b51fd6d659"><enum>(iii)</enum><text>the location and operating hours of polling places and the accessibility of polling places;</text></clause><clause id="id6b8c952a23964a0393f2fdc5d8518fdd"><enum>(iv)</enum><text>the availability of aid or assistance for individuals with disabilities and older individuals to cast their vote in a manner that provides the same opportunity for access and participation (including privacy and independence) as for other voters at polling places;</text></clause><clause id="id2c2a5e17e23f4c328ed08c4b6295dd37"><enum>(v)</enum><text>the availability of aid or assistance from State and local agencies for individuals with disabilities or older individuals who are not able to travel to the polling place;</text></clause><clause id="id88e35d2a20dc4b8f85275c7f13083b9b"><enum>(vi)</enum><text>how to contact State, local, and Federal officials with complaints or grievances if individuals with disabilities and older individuals feel their ability to register to vote or vote has been blocked or delayed; and</text></clause><clause id="id777b8a0f1c214611bf292c5243b0c322"><enum>(vii)</enum><text>access to aging and disability support resources in the State, including—</text><subclause id="id48ff7c94818f4948b8adb15686d5eb39"><enum>(I)</enum><text>protection and advocacy systems (as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>)); and</text></subclause><subclause id="id8237155db29842a08db94bb20b8ab8d9"><enum>(II)</enum><text>information on how to obtain transportation to the polls from State or local agencies; and</text></subclause></clause></subparagraph></paragraph><paragraph id="id9d56db0d88c44bf295f5072417d33a55"><enum>(2)</enum><text>provide a description of resources for local election officials to use in providing guidance to poll workers in order to ensure that polling places are accessible for individuals with disabilities and older individuals in a manner that provides the same opportunity for access and participation (including privacy and independence) as for other voters.</text></paragraph></subsection><subsection id="id41716624ac154f3294e96a8a45d1264a"><enum>(b)</enum><header>Database</header><paragraph id="id4B24C1DA01944B27BCF81A3A1B9219D1"><enum>(1)</enum><header>In general</header><text>The Office of Accessibility shall maintain a database of complaints or grievances from individuals who feel their ability to register to vote or vote has been blocked or delayed, and the outcome of their complaints (as reported by States pursuant to section 297(d)).</text></paragraph><paragraph id="id9f8ceee8cb034ff8b17f7b24a8aebbee"><enum>(2)</enum><header>Public availability</header><text>The Office of Accessibility shall make such complaints and a description of the outcomes of such complaints available to the public, while maintaining the anonymity of any individual who submits a complaint.</text></paragraph><paragraph id="idcb3da71dda31414bbbefc33c0bfbe301"><enum>(3)</enum><header>Referral of complaints to Department of Justice</header><text>The Office of Accessibility shall refer any complaints or grievances which violate Federal law to the Department of Justice.</text></paragraph></subsection><subsection id="id8D1A15B1FCBA444B9A03812BF801CC19"><enum>(c)</enum><header>Definitions</header><text>In this section, the terms <term>accessible</term>, <term>individual with a disability</term>, <term>older individual</term>, and <term>State</term> have the meaning given those terms in section 304.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection display-inline="no-display-inline" id="id8B73CD34FEEF4E00971E80DDAF223397"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 224, as added by section 102(b), the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id549826F2340D4438ACC658B2AE62BA02"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 225. Establishment of national voter accessibility website.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="id7177AE2056A344ECA9DFBC00ED0E2F0F" style="OLC"><enum>II</enum><header>State requirements and payments</header><section id="idF750B25CAC954A1DB41BE8DBE51E3B3A"><enum>201.</enum><header>Establishment and maintenance of State accessible election websites</header><subsection id="id1CB2659CCBAA408DAFA9409987D21FD4"><enum>(a)</enum><header>In general</header><text>Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21018">52 U.S.C. 21018 et seq.</external-xref>) is amended—</text><paragraph id="idE4D42B3D201441C9A72CB346088DE119"><enum>(1)</enum><text>by redesignating sections 304 and 305 as sections 305 and 306; and</text></paragraph><paragraph id="id8F6DC418E420480299168C4CB40D9660"><enum>(2)</enum><text>by inserting after section 303 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA44AAFD84CB04CF99087F3A00D3EFF7C"><section id="id7AC2D206141E40E59A924F0AD662D3DF"><enum>304.</enum><header>Establishment and maintenance of accessible election websites</header><subsection id="idDFF6A119D0A64F12AF5F1709A7BA013E"><enum>(a)</enum><header>In general</header><text>Each State shall ensure their election websites are accessible and meet the following requirements:</text><paragraph id="id0E11669F1A894D0FA431FC8683F52E3D"><enum>(1)</enum><header>Local election officials</header><text>The website shall provide local election officials, poll workers, and volunteers with—</text><subparagraph id="idCA8BFA75B28F4C8E8701BEBB7AA1DD58"><enum>(A)</enum><text>guidance to ensure that polling places are accessible for individuals with disabilities and older individuals in a manner that provides the same opportunity for access and participation (including privacy and independence) as for other voters; and</text></subparagraph><subparagraph id="idb9cd1c0426f64213a0749aa7fc4629df"><enum>(B)</enum><text>online training and resources on—</text><clause id="idE08FBB19D2A640E89891E6E73BD846DD"><enum>(i)</enum><text>how best to promote the access and participation of individuals with disabilities and older individuals in elections for public office; and</text></clause><clause id="id443648843d91491ba48a19e9ca8c3a89"><enum>(ii)</enum><text>the voting rights and protections for individuals with disabilities and older individuals under State and Federal law.</text></clause></subparagraph></paragraph><paragraph id="ida9df963b81c44b5d9e69acce443edd5c"><enum>(2)</enum><header>Voters</header><text>The website shall provide information about voting, including—</text><subparagraph id="idb5ee123990b2431a861e63b8dc044224"><enum>(A)</enum><text>the accessibility of all polling places within the State, including outreach programs to inform individuals about the availability of accessible polling places;</text></subparagraph><subparagraph id="id3763699b2ff749408d476c75b613eda9"><enum>(B)</enum><text>how to register to vote and confirm voter registration in the State;</text></subparagraph><subparagraph id="idb2793ea8464349029c29d353f9f2960a"><enum>(C)</enum><text>the location and operating hours of all polling places in the State;</text></subparagraph><subparagraph id="id3d60715c79ed41628211a1a298a2b518"><enum>(D)</enum><text>the availability of aid or assistance for individuals with disabilities and older individuals to cast their vote in a manner that provides the same opportunity for access and participation (including privacy and independence) as for other voters at polling places;</text></subparagraph><subparagraph id="id82fbffebd74e4bd89635b4e383c60be6"><enum>(E)</enum><text>the availability of transportation aid or assistance to the polling place for individuals with disabilities or older individuals;</text></subparagraph><subparagraph id="idb7bae2f2199e4d5ca5f3d003845f435c"><enum>(F)</enum><text>recent changes in State and Federal voting procedures that impact individuals with disabilities or older individuals; </text></subparagraph><subparagraph id="iddb300d596ce24229a40b4bab3ede2cbe"><enum>(G)</enum><text>the rights and protections under State and Federal law for individuals with disabilities and older individuals to participate in elections; and</text></subparagraph><subparagraph id="ida1e31564f4ef48df825f712861d5e840"><enum>(H)</enum><text>how to contact State, local, and Federal officials with complaints or grievances if individuals with disabilities, older individuals, Native Americans, Alaska Natives, and individuals with limited proficiency in the English language feel their ability to register to vote or vote has been blocked or delayed.</text></subparagraph></paragraph></subsection><subsection id="id7ce1a053ae084802b78b8c2aa5b28bd6"><enum>(b)</enum><header>Partnership with outside technical organization</header><paragraph id="id1041AEC99859458DABCC6D8EEB9F1653"><enum>(1)</enum><header>In general</header><text>The chief State election official of each State, through the committee of appropriate individuals under subsection (c)(2), shall partner with an outside technical organization with demonstrated experience in establishing accessible and easy to use accessible election websites to—</text><subparagraph id="id224E9B3A39534354B3356C5B681CB0A6"><enum>(A)</enum><text>update an existing election website to make it fully accessible in accordance with this section; or</text></subparagraph><subparagraph id="idD4B3DDEC13014F8880157693F2E6F346"><enum>(B)</enum><text>develop an election website that is fully accessible in accordance with this section.</text></subparagraph></paragraph><paragraph id="id4FE6FFF880B84BE287715B8A72350536"><enum>(2)</enum><header>In-house training</header><text>Under such partnership, the outside technical organization shall also be required to provide training to in-house personnel of the State or units of local government to maintain and update election websites in an accessible manner.</text></paragraph></subsection><subsection id="id4f6eb1033de0412caffa8a249c6ea2e4"><enum>(c)</enum><header>State plan</header><paragraph id="id25AA6BE059BE40D988D6481FE0C4EA05"><enum>(1)</enum><header>Development</header><text>The chief State election official of each State shall, through a committee of appropriate individuals as described in paragraph (2), develop a State plan that describes how the State and local governments will meet the requirements under this section.</text></paragraph><paragraph id="ida6cb96cbdffc4dc5a7468c1d669b4196"><enum>(2)</enum><header>Committee membership</header><text>The committee shall comprise at least the following individuals:</text><subparagraph id="id2e9f3cc992a9480ba86a2867a30ba645"><enum>(A)</enum><text>The chief election officials of the four most populous jurisdictions within the State.</text></subparagraph><subparagraph id="id6af5ee7e0c664134a68ff90990db29ca"><enum>(B)</enum><text>The chief election officials of the four least populous jurisdictions within the State.</text></subparagraph><subparagraph id="id815557060e8249ae89571c37b9ea2e72"><enum>(C)</enum><text>Representatives from two disability advocacy groups, including at least one such representative who is an individual with a disability.</text></subparagraph><subparagraph id="idf595068554c249c781dba93769c336d7"><enum>(D)</enum><text>Representatives from two older individual advocacy groups, including at least one such representative who is an older individual.</text></subparagraph><subparagraph id="idc938bc981ac74fc79b30e204de0d1084"><enum>(E)</enum><text>Representatives from two independent non-governmental organizations with expertise in establishing and maintaining accessible websites.</text></subparagraph><subparagraph id="idcbef74ca6a3a482f9f4a640a692615aa"><enum>(F)</enum><text>Representatives from two independent non-governmental voting rights organizations.</text></subparagraph><subparagraph id="idE75F90FF5D4F4F93A6532199385D136A"><enum>(G)</enum><text>Representatives from State protection and advocacy systems as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="id5e4da4fb830448d4ac223a473d108d9a"><enum>(d)</enum><header>Partnership To monitor and verify accessibility</header><text>The chief State election official of each eligible State, through the committee of appropriate individuals under subsection (c)(2), shall partner with at least two of the following organizations to monitor and verify the accessibility of the election website and the completeness of the election information and the accuracy of the disability information provided on such website:</text><paragraph id="id4e70e62b189648aeb1244eb1408ee3ee"><enum>(1)</enum><text>University Centers for Excellence in Developmental Disabilities Education, Research, and Services designated under section 151(a) of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15061">42 U.S.C. 15061(a)</external-xref>).</text></paragraph><paragraph id="idfe0aed6575c8415daa2770ecb1b87300"><enum>(2)</enum><text>Centers for Independent Living, as described in part C of title VII of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C. 796f et seq.</external-xref>).</text></paragraph><paragraph id="idf71d95f69ffa4de58f3044688512e83f"><enum>(3)</enum><text>A State Council on Developmental Disabilities described in section 125 of the Developmental Disabilities Assistance and Bill of Rights Act id="id481670765E3A4CE985E09945AAAC3184"><enum>(e)</enum><header>Definitions</header><text>In this subtitle:</text><paragraph id="id3B350ED0C36340C680D7A42A62CF6D87"><enum>(1)</enum><header>Accessible</header><text>The term <term>accessible</term> means—</text><subparagraph id="id713C4C197ACB42D6B36EE73A24BA76D0"><enum>(A)</enum><text>in the case of the election website under subsection (a) or section 225, or an electronic communication under section 307—</text><clause id="idEAFD1B0FA8AE43089A034D8C6A1776F5"><enum>(i)</enum><text>that the functions and content of the website or electronic communication, including all text, visual, and aural content, are as accessible to people with disabilities as to those without disabilities;</text></clause><clause id="idf0f4c134f2f24109bb76e402941ffa17"><enum>(ii)</enum><text>that the functions and content of the website or electronic communication are accessible to individuals with limited proficiency in the English language; and</text></clause><clause id="idEBE39EC599FE465FB88E4F6A751D37D3"><enum>(iii)</enum><text>that the website or electronic communication meets, at a minimum, conformance to Level AA of the Web Content Accessibility Guidelines 2.0 of the Web Accessibility Initiative (or any successor guidelines); and</text></clause></subparagraph><subparagraph id="idF4BF5B87990347E8878AF549FC1D7CCD"><enum>(B)</enum><text>in the case of a facility (including a polling place), that the facility is readily accessible to and usable by individuals with disabilities and older individuals, as determined under the 2010 ADA Standards for Accessible Design adopted by the Department of Justice (or any successor standards).</text></subparagraph></paragraph><paragraph commented="no" id="id4B8E20986EFD4973BA2B97A7C159CA27"><enum>(2)</enum><header>Individual with a disability</header><text>The term <quote>individual with a disability</quote> means an individual with a disability, as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>), and who is otherwise qualified to vote in elections for Federal office.</text></paragraph><paragraph commented="no" id="id00E03FD890BA43D6B6B905B87259CF64"><enum>(3)</enum><header>Older individual</header><text>The term <quote>older individual</quote> means an individual who is 60 years of age or older and who is otherwise qualified to vote in elections for Federal office.</text></paragraph><paragraph commented="no" id="id87EFE5ACD4394F0195097461CC09851F"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States.</text></paragraph></subsection><subsection commented="no" id="idDBBF09C2971D4ED7ACD5309F39FA973B"><enum>(f)</enum><header>Effective date</header><text>This section shall apply on or after January 1, 2025.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id93D637CFCC034B93A10526E61C236B23"><enum>(b)</enum><header>Clerical amendments</header><text>The table of contents of such Act is amended—</text><paragraph id="id553DA162482542D4ACF14B65D9A62710"><enum>(1)</enum><text>by redesignating the items relating to sections 304 and 305 as relating to sections 305 and 306, respectively; Establishment and maintenance of accessible election websites.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section section-type="subsequent-section" id="id4C2F9B960A254EAC8D8FA4AF48CF1E79"><enum>202.</enum><header>Designation of single State office</header><subsection id="idDC58656C8A2E4EF89BA81DE3663BC645"><enum>(a)</enum><header>In general</header><text>Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21018">52 U.S.C. 21018 et seq.</external-xref>), as amended by section 201, is amended—</text><paragraph id="id1156BAF3CCDE4A3A97BC10CDAC80E6A3"><enum>(1)</enum><text>by redesignating sections 305 and 306 as sections 306 and 307; and</text></paragraph><paragraph id="idC4D0EBE6B0A44475A5A0B34CCF68F842"><enum>(2)</enum><text>by inserting after section 304 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id81322DE1B8CA4D8EBEE6924F7E4B6D6E"><section id="id4139201DDDD24F0DA14EE19FF3C63B8B"><enum>305.</enum><header>Designation of single State office to provide information for all individuals with disabilities and older individuals in the State</header><subsection id="idF85BB86D56164BF4A8BABB9A4CE20660"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each State shall designate a single office which shall be responsible for providing information with respect to Federal elections to all individuals with disabilities or older individuals.</text></subsection><subsection id="id44457A7BDE6940DD8693F4DBB4ECE8C2"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">Such office shall be responsible for the following:</text><paragraph id="idb335bc2590ac4c7b8a44e080d26a7d79"><enum>(1)</enum><text>Maintaining the accessible State election website as described in section 304.</text></paragraph><paragraph id="id743950BB0CE240F4A9263C3276FBF328"><enum>(2)</enum><text>Providing information regarding voter registration, absentee ballots, and in-person voting procedures to be used by individuals with disabilities and older individuals with respect to elections for Federal office.</text></paragraph><paragraph id="id5746196306C849AEB372D7C7585CD125"><enum>(3)</enum><text>Regularly auditing polling places to ensure they are accessible, as defined in section 304, and publicly posting the results of such audits no later than 6 months after the completion of the audit.</text></paragraph><paragraph id="id58737316236a4893a56c20924d859227"><enum>(4)</enum><text>Providing information to State and local election officials on how to set up and operate accessible voting systems and information regarding the accessibility of voting procedures, including guidance on compatibility with assistive technologies such as screen readers and ballot marking devices.</text></paragraph><paragraph id="idE8634F672889403AAE8649739A444919"><enum>(5)</enum><text>Working with—</text><subparagraph id="idB81AFD91E8584314865F0B22E7F55377"><enum>(A)</enum><text>community members with disabilities and disability advocacy groups year round; and</text></subparagraph><subparagraph id="id16802BCEB14D45FDB30A112BB5E3363F"><enum>(B)</enum><text>older individuals and advocacy groups for older individuals year round.</text></subparagraph></paragraph><paragraph id="idF40D03170C8545B7BD1778E63AAA9763"><enum>(6)</enum><text>Integrating information on accessibility, accommodations, disability, and older individuals into regular training materials for poll workers and election administration officials.</text></paragraph><paragraph id="id2C28039E9AC9441299DE8A3979E70BB3"><enum>(7)</enum><text>Training poll workers on how to make polling places accessible for individuals with disabilities and older individuals.</text></paragraph><paragraph id="id07CBDB365CD6411A9F28E13826FC6933"><enum>(8)</enum><text>Promoting the hiring of individuals with disabilities and older individuals as poll workers and election staff.</text></paragraph></subsection><subsection id="id4B4C1C55D82C4FE192073C44F4E318CD"><enum>(c)</enum><header>Effective date</header><text>This section shall apply on or after January 1, 2025.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id137B5F2C87DD422B8C018F0E37D60C3A"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 304, as added by section 201(b), the following:</text><quoted-block style="OLC" id="id3b3efee9-1b77-452e-a193-52663b013e05"><toc><toc-entry idref="id4139201DDDD24F0DA14EE19FF3C63B8B" level="section">Sec. 305. redesignating sections 306 and 307 as sections 307 and 308; and</text></paragraph><paragraph id="idFA680D197BDF4033B007A4D41B873B81"><enum>(2)</enum><text>by inserting after section 305 the id="idd19fc59f2deb44aa981318471092b9da"><enum>306.</enum><header>Transparency regarding changes</header><subsection id="id5B5A3831107E4121B34A924048394461"><enum>(a)</enum><header>Notice of enacted changes</header><paragraph id="id29b21d5f47944288beb227f7731b12b0"><enum>(1)</enum><header>In general</header><text>If a State or political subdivision makes any change in any prerequisite to voting or standard, practice, or procedure with respect to voting in any election for Federal office that will result in the prerequisite, standard, practice, or procedure being different from that which was in effect as of the date that is 180 days before the election, the State or political subdivision must provide reasonable public notice in such State or political subdivision and on the accessible State election website as described in section 304, containing a concise description of the change, including the difference between the changed prerequisite, standard, practice, or procedure and the prerequisite, standard, practice, or procedure which was previously in effect.</text></paragraph><paragraph id="id46b4d2b7fa04406ba816eb07a9b41085"><enum>(2)</enum><header>Format</header><text>The public notice described in paragraph (1) shall be provided in a format that is convenient and accessible to individuals with disabilities and older individuals.</text></paragraph><paragraph id="idaf544af224fb4c40b7aa864f69975ba8"><enum>(3)</enum><header>Accessible email and mail notices</header><subparagraph id="id04ED6E6104744819912EA03B326AD706"><enum>(A)</enum><header>In general</header><text>A State or political subdivision shall send out an accessible electronic mail or mail notice to any voter who request to be notified of any changes described in paragraph (1).</text></subparagraph><subparagraph id="id723C7185AB3041748FA802D2C5EEC2CB"><enum>(B)</enum><header>Establishment of process</header><text>A State or political subdivision shall establish a process under which a voter may request to be notified of any such changes.</text></subparagraph></paragraph><paragraph id="id90e553a3b5aa4ea58a6be253ab15bca8"><enum>(4)</enum><header>Deadline for notice</header><text>A State or political subdivision shall provide the public notice required under paragraph (1) not later than 7 days after making the change involved.</text></paragraph></subsection><subsection id="id55fbdd41c03047d3a68cc26dbbf9f8b9"><enum>(b)</enum><header>Transparency regarding polling place resources</header><paragraph id="idbe459caafade4933bec1b67e0783b860"><enum>(1)</enum><header>In general</header><text>In order to identify any changes that may impact the right to vote of any individual, prior to the 30th day before the date of an election, each State or political subdivision with responsibility for allocating registered voters, voting machines, and official poll workers to particular precincts and polling places shall provide reasonable public notice in such State or political subdivision and on the accessible State election website as described in section 304, of the information described in paragraph (2) for precincts and polling places within such State or political subdivision.</text></paragraph><paragraph id="id5dc324feafa74ea9859c6b9a535da46d"><enum>(2)</enum><header>Information described</header><text>The information described in this paragraph with respect to a precinct or polling place is each of the following:</text><subparagraph id="id9900c1961c5c49559316a5f789cbb1a4"><enum>(A)</enum><text>The name or number of the precinct or polling place.</text></subparagraph><subparagraph id="idb017369181c747809d80a35af1fc87f3"><enum>(B)</enum><text>In the case of a polling place, the location, including the street address, and confirmation that the polling place is accessible to individuals with disabilities and older individuals.</text></subparagraph><subparagraph id="idf831e98c29364056bf3bc6459c7f090b"><enum>(C)</enum><text>The number of voting machines assigned, including the number of voting machines accessible to individuals with disabilities and older individuals and the number of poll workers who have received training on how to set up and operate the accessible voting systems.</text></subparagraph><subparagraph id="id98abca8b8e7c4442b8c32e6c98c8e1dd"><enum>(D)</enum><text>The total number of poll workers officially assigned to the polling place, including the number of such poll workers who have received training to assist individuals with disabilities and older individuals.</text></subparagraph><subparagraph id="id931e0d81f2cb45388aa2f2c16f19c7b3"><enum>(E)</enum><text>The number of official volunteer poll workers assigned who have received training to assist individuals with disabilities and older individuals.</text></subparagraph><subparagraph id="id28aca6840ef24cdb95b4f2be7b226bac"><enum>(F)</enum><text>In the case of a polling place, the dates and hours of operation.</text></subparagraph></paragraph><paragraph id="ideb0e67f2ab424ac5833beadbd036762a"><enum>(3)</enum><header>Updates in information reported</header><text>If a State or political subdivision makes any change in any of the information described in paragraph (2) with respect to which a notice is provided pursuant to paragraph (1), the State or political subdivision shall provide reasonable public notice in such State or political subdivision and on the accessible State election website as described in section 304, of the change in the information not later than 48 hours after the change occurs or, if the change occurs fewer than 48 hours before the date of the election for Federal office, as soon as practicable after the change occurs.</text></paragraph><paragraph id="id6873a6cf0e2940a5865f7f75238f35bb"><enum>(4)</enum><header>Format</header><text>The public notice described in paragraph (1) or (3) shall be provided in a format that is reasonably convenient and accessible to individuals with disabilities and older individuals.</text></paragraph><paragraph id="id1d31364b2d8644d2a014abd57be6f8de"><enum>(5)</enum><header>Accessible email and mail notices</header><subparagraph id="id7FCCE2C18E8F4E0B8F8B919E0B7F3860"><enum>(A)</enum><header>In general</header><text>A State or political subdivision shall send out an accessible electronic mail and mail notice to any voter who requests to be notified of any changes described in paragraph (1) and to the State protection and advocacy systems (as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>)).</text></subparagraph><subparagraph id="idE13CC81757034CB58F5D4B409008DB8F"><enum>(B)</enum><header>Establishment of process</header><text>A State or political subdivision shall establish a process under which a voter may request to be notified of any such changes.</text></subparagraph></paragraph></subsection><subsection id="id509DD367AFCD4A87BF4DCD9DCA5393A3"><enum>(c)</enum><header>Effective date</header><text>This section shall apply with respect to elections for Federal office held on or after January 1, 2025.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1A3271A436A94C94B33C802AE6C9A8CA"><enum>(b)</enum><header>Clerical amendments</header><text>The table of contents of such Act is amended by inserting after the item relating to section 305, as Transparency regarding changes.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HF0F521B1DB0D4581AF7B77ED2BD88521"><enum>204.</enum><header>Access to absentee voter registration procedures and no-excuse absentee voting for all voters</header><subsection id="idE00FA4BAB8B1417AB5261DF905BD78D6"><enum>(a)</enum><header>In general</header><text>Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21018">52 U.S.C. 21018 et seq.</external-xref>), as amended by sections 201, 202, and 203, is amended—</text><paragraph id="id784B41E8440544CEA7908BCDB792EE3D"><enum>(1)</enum><text>by redesignating sections 307 and 308 as sections 308 and 309; and</text></paragraph><paragraph id="idD4B5D0DAAEB44FCC95BA8A8E26061FF8"><enum>(2)</enum><text>by inserting after section 306 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H719FAB289A2442A8B49028E301C03DC8"><section commented="no" id="H711D110D60704AB6813310A26ABEC0F3"><enum>307.</enum><header>Access to absentee voter registration procedures and no-excuse absentee voting for all voters</header><subsection commented="no" id="HA0836A52146345A4AFFE836B9DEE7F80"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 6(c) and subparagraph (B) or (D) of section 8(a)(1) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20505">52 U.S.C. 20505(c)</external-xref>; 20507(a)(1)), each State shall—</text><paragraph commented="no" id="H0AC4C57978124983BB4A2E16635FE707"><enum>(1)</enum><text>permit any eligible voter to—</text><subparagraph id="id63fd559ac072416d9272ed0692a99888"><enum>(A)</enum><text>request and utilize absentee ballot procedures for elections for Federal office; and </text></subparagraph><subparagraph commented="no" id="idFDC59BF35D844A9DA4161A2791914D4B"><enum>(B)</enum><text>vote by absentee ballot in elections for Federal office;</text></subparagraph></paragraph><paragraph commented="no" id="H8F28982E87514CCC876472ED7971385C"><enum>(2)</enum><text>accept and process, with respect to any election for Federal office, any otherwise valid voter registration application from any eligible voter if the application is received by the appropriate State election official not less than 21 days before the election;</text></paragraph><paragraph commented="no" id="idAD222019CA144DC9BC2C63B45A156096"><enum>(3)</enum><text>accept and process, with respect to any election for Federal office, any otherwise valid absentee ballot application from any eligible voter if the application is received by the appropriate State election official not less than 7 days before the election;</text></paragraph><paragraph id="id309a6c561f0547ca8546c446894a6fbe"><enum>(4)</enum><text>in addition to any other method of registering to vote in the State, establish procedures—</text><subparagraph id="id5478e6365372451abe330ec5a8db7947"><enum>(A)</enum><text>for States to send voter registration applications to eligible voters in accordance with the eligible voter's preferred method of transmission as designated under subparagraph (B);</text></subparagraph><subparagraph id="idba887066084f4ea1a5bb79dca963b5f0"><enum>(B)</enum><text>by which an eligible voter may designate whether the eligible voter prefers that such voter registration applications be transmitted by mail or electronically; and</text></subparagraph><subparagraph id="idcc678aa4282b4b74a91d7b036500b866"><enum>(C)</enum><text>to allow eligible voters to electronically submit the mail voter registration application form prescribed under section 9(a)(2) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20508">52 U.S.C. 20508(a)(2)</external-xref>);</text></subparagraph></paragraph><paragraph id="idd6b63f445fae49638cfe529660fdab2a"><enum>(5)</enum><text>in addition to any other method of applying for an absentee ballot in the State, establish procedures—</text><subparagraph id="idcf22696b47134026b9d7a17d60924ac4"><enum>(A)</enum><text>for States to send absentee ballot applications to eligible voters in accordance with the eligible voter’s preferred method of transmission as designated under subparagraph (B); </text></subparagraph><subparagraph id="idf25dca7a9a9c40ef8d534195371cf446"><enum>(B)</enum><text>by which an eligible voter may designate whether the eligible voter prefers that such absentee ballot requests be transmitted and submitted by mail or electronically; and</text></subparagraph><subparagraph id="id9165e8c478ac49299c05160305515a54"><enum>(C)</enum><text>under which, not later than 7 days after the appropriate State or local election official has approved or rejected an absentee ballot application, the official shall provide the individual a notice of the disposition of the application, and in the case of rejection of the application provide the individual with the reason for rejection and options to correct or update their application;</text></subparagraph></paragraph><paragraph id="id0e53915de5bc4f149be38572deee7215"><enum>(6)</enum><text>establish procedures to allow eligible voters to establish a permanent absentee voter status until the voter submits an application to terminate their permanent absentee voter status;</text></paragraph><paragraph commented="no" id="H675898625C794496BE100DF609DCD581"><enum>(7)</enum><text>transmit a validly requested absentee ballot to any eligible voter—</text><subparagraph commented="no" id="HE1E4AE95B1C74BCE925A74E603CFF9AC"><enum>(A)</enum><text>in the case in which the request is received at least 45 days before an election for Federal office, not later than 45 days before the election; and</text></subparagraph><subparagraph commented="no" id="H7E40B05B5AA644DEBDBF5808A9A13778"><enum>(B)</enum><text>in the case in which the request is received less than 45 days before an election for Federal office—</text><clause commented="no" id="H9B738356DB9E45FEB563AF6517A84010"><enum>(i)</enum><text>in accordance with State law; and</text></clause><clause commented="no" id="H0234186294514DF59D3C334FD260BF84"><enum>(ii)</enum><text>if practicable and as determined appropriate by the State, in a manner that expedites the transmission of such absentee ballot; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1F8EC8E12CDF4C0A8CE3D043B3AFF098"><enum>(8)</enum><text>if the State declares or otherwise holds a runoff election for Federal office, establish a written plan which provides that absentee ballots are made available to eligible voters in a manner that gives them sufficient time to vote in the runoff election.</text></paragraph></subsection><subsection commented="no" id="H041D7531B6734A38BBCE560B1C602EFE"><enum>(b)</enum><header>Designation of Means of Electronic Communication for eligible voters To Request and for States To Send Voter Registration Applications and Absentee Ballot Applications, and for Other Purposes Related to Voting Information</header><paragraph commented="no" id="H03FD21E51FA347DFB090538F408AFC81"><enum>(1)</enum><header>In general</header><text>Each State shall, in addition to the designation of a single State office under section 305, designate not less than 1 means of electronic communication—</text><subparagraph commented="no" id="H32E0550449314CCFB9B75918C32C80EC"><enum>(A)</enum><text>for use by eligible voters who wish to register to vote or vote in any jurisdiction in the State to request voter registration applications and absentee ballot applications under paragraphs (3) and (4), respectively, of subsection (a);</text></subparagraph><subparagraph commented="no" id="H6F3C1B018DDE46AA98E2DCCF0CC1EF71"><enum>(B)</enum><text>for use by States to send voter registration applications and absentee ballot applications requested under such paragraphs;</text></subparagraph><subparagraph commented="no" id="HFBFAFFA36D0D42C080BE5C4B21339D58"><enum>(C)</enum><text>for the purpose of providing related voting, balloting, and election information to eligible voters; and</text></subparagraph><subparagraph commented="no" id="idE1E80182EAB54848882E2085630C3DEF"><enum>(D)</enum><text>that meets the accessibility requirement as described in subsection (d).</text></subparagraph></paragraph><paragraph commented="no" id="H21FBA2DDE7B84809A3325027E362ED43"><enum>(2)</enum><header>Clarification regarding provision of multiple means of electronic communication</header><text>A State may, in addition to the means of electronic communication so designated, provide multiple means of electronic communication to eligible voters, including a means of electronic communication for the appropriate jurisdiction of the State.</text></paragraph><paragraph commented="no" id="H9A67C67A77DD4780A0E69A0A3DAE67D5"><enum>(3)</enum><header>Inclusion of designated means of electronic communication with informational and instructional materials that accompany balloting materials</header><text>Each State shall include a means of electronic communication so designated with all informational and instructional materials that accompany balloting materials sent by the State to eligible voters.</text></paragraph><paragraph commented="no" id="H830A9BD8C2FF4B6E904E3DBA7DFA4660"><enum>(4)</enum><header>Transmission if no preference indicated</header><text>In the case where an eligible voter does not designate a preference under paragraph (3)(B) or (4)(B), respectively, of subsection (a), the State shall transmit the voter registration application or absentee ballot application by any delivery method allowable in accordance with applicable State law, or if there is no applicable State law, by mail.</text></paragraph><paragraph id="id16bc3870862d419f8a1b324a53b13d2c"><enum>(5)</enum><header>Coordination with States</header><text>The Election Assistance Commission shall work with States to ensure the mail voter registration application form prescribed under section 9(a)(2) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20508">52 U.S.C. 20508(a)(2)</external-xref>) is accessible as defined in section 304 and capable of being submitted electronically to State election offices by individuals.</text></paragraph></subsection><subsection commented="no" id="HE424BC4994514DB8876584E430E878B0"><enum>(c)</enum><header>Transmission and marking of blank absentee ballots by mail and electronically</header><paragraph commented="no" id="H7AA28738553F4ECCA5E24E8F9C7FED53"><enum>(1)</enum><header>In general</header><text>Each State shall establish procedures—</text><subparagraph commented="no" id="H193F9349271642C7AEA7D5B922BD8BD6"><enum>(A)</enum><text>to securely transmit blank absentee ballots by mail and electronically (in accordance with the preferred method of transmission designated by the eligible voter under subparagraph (B)) to eligible voters for an election for Federal office; and</text></subparagraph><subparagraph commented="no" id="H1E1070B2D1604B8DA8401A034AE1C6AD"><enum>(B)</enum><text>by which the eligible voter may designate whether the individual prefers that such blank absentee ballot be transmitted by mail or electronically.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1652ED7AC4564BE5BBCF2A9141F25A60"><enum>(2)</enum><header>Transmission if no preference indicated</header><text>In the case where an eligible voter does not designate a preference under paragraph (1)(B), the State shall transmit the ballot by any delivery method allowable in accordance with applicable State law, or if there is no applicable State law, by mail.</text></paragraph><paragraph id="id8497acda54d145d0b3f2161fb100c11e"><enum>(3)</enum><header>Marking of blank absentee ballots</header><text>Each State shall establish procedures to allow voters to securely mark blank absentee ballots through assistive technology for an election for Federal office.</text></paragraph><paragraph id="H20CE4E70BC8B4CF9AFEEC249465727A7"><enum>(4)</enum><header>Application of methods to track delivery to and return of ballot by individual requesting ballot</header><subparagraph id="id49A100C8BFCB421E90BD4AD605C95B94"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), under the procedures established under paragraph (1), the State may apply such methods as the State considers appropriate which are in accordance with paragraph (1), such as assigning a unique identifier to the ballot, to ensure that if an eligible voter requests the State to transmit a blank absentee ballot to the individual in accordance with this subsection, the voted absentee ballot which is returned by the individual is the same blank absentee ballot which the State transmitted to the individual.</text></subparagraph><subparagraph id="id61E22D3B233A46EF8185C45F13832FEE"><enum>(B)</enum><header>Limitation</header><text>In carrying out this paragraph, a State may not adopt a method of tracking absentee ballots which would violate the right of an individual to a private ballot. If a unique identifier is assigned to an absentee ballot, the State must adopt procedures to ensure the identity of the individual remains secret.</text></subparagraph></paragraph></subsection><subsection id="idCA334FA81401474491CB51FA6775B2D9"><enum>(d)</enum><header>Accessibility requirement for electronic communications</header><text>Any electronic communication under this section, including any application, ballot, or instructional material sent electronically, shall be accessible as defined in section 304.</text></subsection><subsection id="H0CDABC46ED4F4184B08DDCF4A5A6C150"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to allow the casting of ballots over the internet.</text></subsection><subsection commented="no" id="HDB4004C70C5C4858B95AB1224E886F92"><enum>(f)</enum><header>Effective date</header><text>This section shall apply with respect to elections for Federal office held on or after January 1, 2025.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id249F50CD3314456197B1B3D38716895A"><enum>(b)</enum><header>Conforming amendments</header><paragraph commented="no" id="idBA9EAC26151D4BF1A39CFB74B5DD4E1C"><enum>(1)</enum><header>Technical amendment</header><text>Section 906(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21145">52 U.S.C. 21145(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>section 303(b)</quote> and inserting <quote>sections 303(b) and 307(a)</quote>.</text></paragraph><paragraph display-inline="no-display-inline" id="H5EF4EB48AFD845F6B2C09700DFA2D217"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 306, as added by section 203(b), the following:</text><quoted-block style="OLC" id="id8a19e023-b923-45aa-847d-8a3842583628"><toc><toc-entry idref="H711D110D60704AB6813310A26ABEC0F3" level="section">Sec. 307. and</text></clause><clause id="id0fa30229366a404191b05892db41087f"><enum>(iii)</enum><text>by homeless individuals (as defined in section 103 of the McKinney–Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11302">42 U.S.C. 11302</external-xref>)) of the State;</text></clause></subparagraph><subparagraph commented="no" id="idCB656FC361324BDE8A03F68E49C67C64"><enum>(C)</enum><text>consider procedures to address long wait times at polling places that allow individuals with disabilities and older individuals alternate options to cast a ballot in person in an election for Federal office, such as the option to cast a ballot outside of the polling place or from a vehicle, or providing an expedited voting line; and</text></subparagraph><subparagraph commented="no" id="idcb0499050eb9460d854709c3c80e13ff"><enum>(D)</enum><text>consider options to establish <quote>mobile polling sites</quote> to allow election officials or volunteers to travel to long-term care facilities and assist residents who request assistance in casting a ballot in order to maintain the privacy and independence of voters in these facilities.</text></subparagraph></paragraph><paragraph commented="no" id="id9e276a1070e74fd0a0ca8754a410a313"><enum>(2)</enum><header>Rule of construction</header><text>If a State provides a drop box under this section on the grounds of or inside of a building or facility which serves as a polling place for an election for Federal office, nothing in this subsection may be construed to waive any requirements regarding the accessibility of such polling place for the use of individuals with disabilities or individuals with limited proficiency in the English language.</text></paragraph></subsection><subsection commented="no" id="id3F69062AC68F4A95946C89DA69711B68"><enum>(b)</enum><header>Clarification</header><text>Nothing in this section may be construed to alter the requirements under Federal law that all polling places for Federal elections are accessible to individuals with disabilities and older individuals.</text></subsection><subsection commented="no" id="id360CCB0BDAB94F389379072F9E21922A"><enum>(c)</enum><header>Effective date</header><text>This section shall apply with respect to elections for Federal office held on or after January 1, 2025.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="id367019DDD019417A9CC1DFFF80BEC25A"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 307, as added by section 204(b), the following:</text><quoted-block style="OLC" id="idee124b66-a6f5-4874-bd99-53c815ac8494"><toc><toc-entry idref="idF64B826333E54CDAA28E89A46410EED3" level="section">Sec. 308. Protections for individuals subject to guardianship.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section display-inline="no-display-inline" id="idED02816933D84A35B93D9BF05105AC5C"><enum>207.</enum><header>Payments to States for implementation of accessibility requirements</header><subsection display-inline="no-display-inline" id="idCCD1046619D74D47A077DC94A46CA00D"><enum>(a)</enum><header>In general</header><text>Subtitle D of title II of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21001">52 U.S.C. 21001</external-xref>) is amended by adding at the end the following new part:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3D1115A0BC1E4AB79B7C32D997A229B0"><part id="idF57C81535B084A0E9B0E75A54010D846" style="OLC"><enum>7</enum><header>Payments to States for implementation of accessibility requirements</header><section section-type="subsequent-section" id="idA0D43DCF8C4D454DB388A9E0B0172A56"><enum>297.</enum><header>Payments to States for implementation of accessibility requirements</header><subsection id="id54FB4036969946D9BF10A8D0357C53A3"><enum>(a)</enum><header>Payments</header><paragraph id="idB78BD84537754B299D49E5066675942A"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Accessibility (hereinafter in this section referred to as the <quote>Director</quote>) shall make payments to each eligible State (as described in subsection (c)) in an amount determined under paragraph (2) for each applicable period (as defined in paragraph (3)) beginning on or after October 1, 2025.</text></paragraph><paragraph id="idB14B001F9275429D8834DFCCA642C8B7"><enum>(2)</enum><header>Allocation of funds</header><subparagraph id="id0F3EBC172F8641A6B5EE19298077583B"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (C), the amount of a payment made to a State for an applicable period shall be equal to the product of—</text><clause id="PFD83EBDF4D35E8C32985168FE9D37C1"><enum>(i)</enum><text>the total amount appropriated for requirements payments for the applicable period pursuant to the authorization under subsection (g); and</text></clause><clause id="PA09C2DCA4E30BD29BCD1B6AA1FCE0B9"><enum>(ii)</enum><text>the State allocation percentage for the State (as determined under subparagraph (B)).</text></clause></subparagraph><subparagraph id="id07022E2E5D2945518817EFF1CE32BC66"><enum>(B)</enum><header>State allocation percentage defined</header><text>The <quote>State allocation percentage</quote> for a State is the amount (expressed as a percentage) equal to the quotient of—</text><clause id="PE652DB644390ADBB657A36B2276FAC4"><enum>(i)</enum><text>the voting age population of the State (as reported in the most recent decennial census); and</text></clause><clause id="P10B6D64544B218AFAE2FA0A2F670C5A"><enum>(ii)</enum><text>the total voting age population of all States (as reported in the most recent decennial census).</text></clause></subparagraph><subparagraph id="id342aa4f7abfd41adb13d9b29ff161378"><enum>(C)</enum><header>Minimum payment</header><text>The amount of any payment made to an eligible State under this section shall not be less than $1,000,000.</text></subparagraph><subparagraph id="idF77B371518D1442DA51D375FF1644D60"><enum>(D)</enum><header>Pro rata reductions</header><text>The Director shall make such pro rata reductions to the allocations determined under subparagraph (A) as are necessary to comply with the requirements of subparagraph (C).</text></subparagraph><subparagraph id="id23F52671E5264051A0FFA8FB4D73845F"><enum>(E)</enum><header>Continuing availability of funds after appropriation</header><text>A payment made to a State under this section shall be available to the State without fiscal year limitation.</text></subparagraph></paragraph><paragraph id="idACACA634BE2D49958057BEB3E3A71CD2"><enum>(3)</enum><header>Applicable period defined</header><text>The <term>applicable period</term>, with respect to a payment under this section, is a period of 2 fiscal years.</text></paragraph><paragraph id="idB4D57CFA7F7747EAB1CAE7C2A91E9F30"><enum>(4)</enum><header>Distribution of funds to units of local government</header><text>At least 10 percent of funds allocated to a State under this section shall be distributed to units of local government to develop or upgrade accessible election websites and to share information with the statewide accessible election website as described in section 304.</text></paragraph></subsection><subsection id="id00091C2B5BCF4442980906B4AD5EA6BF"><enum>(b)</enum><header>Use of funds</header><paragraph id="idB1F3772DB0EB4BF4B0ECEF20B9348047"><enum>(1)</enum><header>In general</header><text>An eligible State shall use a payment under this section to meet the requirements of sections 304 through 309.</text></paragraph><paragraph id="idB0B815BCD7C24A2199A5FAB3C21DF54B"><enum>(2)</enum><header>Prohibition on use of funds for separate accessible election websites</header><text>Funds under this section may not be used to establish accessible election websites for individuals with disabilities and older individuals under section 304 that are separate from the election websites for the general population. Funds must be used to make existing election websites accessible, or to develop accessible election websites where one does not already exist.</text></paragraph></subsection><subsection id="iddf38e6400f1e404e9691071f9bce58e5"><enum>(c)</enum><header>Requirements for eligibility</header><paragraph id="id35B54DFBAD6C4BCF97FA6E5ABB5EF4FC"><enum>(1)</enum><header>In general</header><text>Each State that desires to receive a payment under this section for an applicable period shall submit an application for such payment to the Director at such time and in such manner and containing such information as the Director shall require.</text></paragraph><paragraph id="idf71f1dae236f45ca86a9ddb9d2ec60c5"><enum>(2)</enum><header>Contents of application</header><text>Each application submitted under paragraph (1) shall include—</text><subparagraph id="iddffcb419839d42bf9283759165bb506b"><enum>(A)</enum><text>with respect to the requirements under section 304 (relating to accessible election websites)—</text><clause id="idC6B74C607FB44A19847C83F1A577C549"><enum>(i)</enum><text>a description of the State plan as developed by the committee of appropriate individuals under subsection (c) of such section;</text></clause><clause id="id9ACB0156ED9847A1B618B1BAD41624CC"><enum>(ii)</enum><text>an assurance that the State will work with State and local disability and aging advocates to ensure the election website is accessible to individuals with disabilities and older individuals;</text></clause><clause id="idb1d77ccf3d644ec2a74ad2ae0fc37dcb"><enum>(iii)</enum><text>a description of how the State will ensure the election website maintains accessibility;</text></clause><clause id="ida1ab581a7f254d329d12186a6c2abe42"><enum>(iv)</enum><text>a description of how the State will ensure information on the election website is accessible to local election officials; and</text></clause><clause id="idee3ebf70f0c74d57aebe5bd7975b77f9"><enum>(v)</enum><text>identification of each organization the State is partnering with pursuant to subsection (d) of such section in order to monitor and verify the accessibility of the State election website, including the written support of each such organization;</text></clause></subparagraph><subparagraph id="idD5187498C931404482BA6ECCC0A106E4"><enum>(B)</enum><text>with respect to the requirements under sections 305 through 309, a description of how the State will meet such requirements; and</text></subparagraph><subparagraph id="id0BD74EFCB22D47A199EFA8BA40DE2C43"><enum>(C)</enum><text>such other information as the Director determines appropriate to ensure compliance with the requirements of such sections 304 through 309.</text></subparagraph></paragraph></subsection><subsection id="id2a02cdfb03be4c3694b1a9c08d21d401"><enum>(d)</enum><header>Reports</header><paragraph id="id31a4e57f21d84de8a06a663d66ffa671"><enum>(1)</enum><header>Reports by recipients</header><subparagraph id="id23F614B98BA9452996CAF809FD34CE95"><enum>(A)</enum><header>In general</header><text>Not later than the 6 months after the end of each applicable period for which an eligible State received a payment under this section, the State shall submit a report to the Director on the activities conducted using such payments during the applicable period, and shall include in the report a list of expenditures during such applicable period.</text></subparagraph><subparagraph id="id157b7589f48a404a9e995daea82ec5d0"><enum>(B)</enum><header>Inclusion</header><text>Each report submitted under subparagraph (A) shall include the number and description of complaints and grievances by individuals alleging their ability to register to vote or vote was unfairly blocked or delayed.</text></subparagraph></paragraph><paragraph id="id746bab03d1904dc5b4882e40ebefe5e2"><enum>(2)</enum><header>Report by Director to committees</header><text>With respect to each applicable period for which the Director makes payments under this section, the Director shall submit a report on the activities carried out under this section to the Committee on House Administration of the House of Representatives and the Committee on Rules and Administration and the Special Committee on Aging of the Senate.</text></paragraph></subsection><subsection id="idd5b7c39ffef641f3bda75d17aeaf43d4"><enum>(e)</enum><header>Standards and guidelines</header><text>The Director shall establish standards and guidelines for approved activities supported by payments under this section. Such standards and guidelines shall permit eligible States receiving such a payment to refine or adapt the standards and guidelines for an individual project, where such a refinement or adaptation is made necessary by a local circumstance.</text></subsection><subsection id="id05FD3E5BDDA4477EB4E2403831A0A433"><enum>(f)</enum><header>Definitions</header><text>In this section, the terms <term>accessible</term>, <term>individual with a disability</term>, <term>older individual</term>, and <term>State</term> have the meaning given those terms in section 304.</text></subsection><subsection id="id2717a26e602a45bca87e32456e958936"><enum>(g)</enum><header>Authorization of appropriations</header><paragraph id="id874bf1a341f847df9dfe73e192b7dd5d"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to carry out the provisions of this section—</text><subparagraph id="id8A48A2674F1F44959802784724069A83"><enum>(A)</enum><text>$100,000,000 for fiscal years 2025 and 2026;</text></subparagraph><subparagraph id="idE43C601CA79547C3B8C12CD9740A104F"><enum>(B)</enum><text>$100,000,000 for fiscal years 2027 and 2028; and</text></subparagraph><subparagraph id="idF07CB6F73C0A414BA95563C8A08AE94B"><enum>(C)</enum><text>$100,000,000 for fiscal years 2029 and 2030.</text></subparagraph></paragraph><paragraph id="id868dd58f88ca4c1db05f06f7cf646daf"><enum>(2)</enum><header>Continuing availability of funds after appropriation</header><text>A payment made to an eligible State under this section shall be available to the State without fiscal year limitation, but shall only be used for the purposes of this section.</text></paragraph></subsection><subsection commented="no" id="idF137A9479F8E446ABCE330C978F941F4"><enum>(h)</enum><header>Relationship to requirements payments</header><text>Any payment to a State under this section shall be in addition to any requirements payment under section 251 and shall not be taken into account in determining the amount of such payment under section 252.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection display-inline="no-display-inline" id="id7A02B7B40A554256B880FE61172E3306"><enum>(b)</enum><header>Clerical amendments</header><text>The table of contents of such Act is amended by inserting after the item relating to section 296 the following new item:</text><quoted-block style="OLC" id="id363dadfd-41f0-4f8f-8c94-3a8dbf0c2cb3"><toc><toc-entry idref="idF57C81535B084A0E9B0E75A54010D846" level="part">PART 7—Payments to States for implementation of accessibility requirements </toc-entry><toc-entry idref="idA0D43DCF8C4D454DB388A9E0B0172A56" level="section">Sec. 297. Payments to States for implementation of accessibility requirements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section display-inline="no-display-inline" id="idBA8676B5EF96402090C642FE6BE82805"><enum>208.</enum><header>Technical and conforming amendments relating to issuance of voluntary guidance and enforcement</header><subsection id="id9BB9B850C0D14023A3F393A8BA254D76"><enum>(a)</enum><header>Issuance of voluntary guidance by election assistance commission</header><text display-inline="yes-display-inline">Section 311 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21101">52 U.S.C. 21101</external-xref>) is amended—</text><paragraph id="id791D2E7E4E9B421FBDDF31973A738625"><enum>(1)</enum><text>in subsection (a), by striking <quote>subtitle A</quote> and inserting <quote>subtitles A and B</quote>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idCA80193EBA54473AA828745406C8B7D6"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id352B962DFD464B48A239898BA919CBEE"><subsection id="id05C4DF8F0EF84A0CB4734D9CABF75D38"><enum>(d)</enum><header>Coordination with Office of Accessibility</header><text>The Commission shall coordinate with the Election Assistance Commission Office of Accessibility established under section 223 in adopting recommendations with respect to sections 304 through 309.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id20550C39FF4C4D4CA4993E1D0C162BCA"><enum>(b)</enum><header>Enforcement</header><text>Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>) is amended by striking <quote>sections 301, 302, and 303</quote> and inserting <quote>subtitle A of title III</quote>.</text></subsection></section></title><title id="id2F99800E9A1E4DE2A0566C4F76B4E13E" style="OLC"><enum>III</enum><header>Federal assistance</header><section display-inline="no-display-inline" id="HC53486BD9AB44575AFD7C48F709B6FAC"><enum>301.</enum><header>Expansion and reauthorization of grant program to assure voting access for individuals with disabilities and older individuals</header><subsection id="H87DBDF69AC234F4899EDCA26A75FA3FF"><enum>(a)</enum><header>Purposes of payments</header><text display-inline="yes-display-inline">Section 261(b) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21021">52 U.S.C. 21021(b)</external-xref>) is amended by striking paragraphs (1) and (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAD46F65A907C4DB9A366D1A7F7C140BD"><paragraph id="HCBFE194D79B048B6A2BA229C2EFCB863"><enum>(1)</enum><text display-inline="yes-display-inline">making absentee voting and voting in an individual's place of residence accessible to individuals with the full range of disabilities (including impairments involving vision, hearing, mobility, cognition, or dexterity) through the implementation of accessible absentee voting systems that work in conjunction with assistive technologies for which individuals have access at their homes, independent living centers, long-term care facilities, or other facilities in a manner that provides the same opportunity for access and participation (including privacy and independence) as for other voters;</text></paragraph><paragraph id="H2A4D2501CD06463AAF9BE1AF637FC408"><enum>(2)</enum><text>making polling places, including the path of travel, entrances, exits, and voting areas of each polling facility, accessible to individuals with disabilities, including the blind and visually impaired, in a manner that provides the same opportunity for access and participation (including privacy and independence) as for other voters; and</text></paragraph><paragraph id="H9EC4A27C7B724EAFA459ACE4E5375344"><enum>(3)</enum><text>providing solutions to problems of access to voting and elections for individuals with disabilities that are universally designed and provide the same opportunities for individuals with and without disabilities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9138AEAAA8A644449ECDC4233615FF8C"><enum>(b)</enum><header>Reauthorization</header><text>Section 264(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21024">52 U.S.C. 21024(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4DF3E70F85D34E6CADFED1D34488421D"><paragraph id="H447119B3463D49408FB1D646B98EAB46"><enum>(4)</enum><text display-inline="yes-display-inline">For fiscal year 2025 and each succeeding fiscal year, such sums as may be necessary to carry out this part.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCA304650FEEC4D96A4E30B04A914C30E"><enum>(c)</enum><header>Period of availability of funds</header><text>Section 264 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21024">52 U.S.C. 21024</external-xref>) is amended—</text><paragraph id="H8EF83EAA94754120BBC8AC114CEDA9D0"><enum>(1)</enum><text>in subsection (b), by striking <quote>Any amounts</quote> and inserting <quote>Except as provided in subsection (b), any amounts</quote>; and</text></paragraph><paragraph id="H41B69F516D1C435FB21240585905A8F2"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2295C14DE4404574AD906DBF1168514C"><subsection id="H07B9011B8148405087FF8940093BF575"><enum>(c)</enum><header>Return and transfer of certain funds</header><paragraph id="HA970CCF17FB74029BD48ADF7B2DE467E"><enum>(1)</enum><header>Deadline for obligation and expenditure</header><text display-inline="yes-display-inline">In the case of any amounts appropriated pursuant to the authority of subsection (a) for a payment to a State or unit of local government for fiscal year 2025 or any succeeding fiscal year, any portion of such amounts which have not been obligated or expended by the State or unit of local government prior to the expiration of the 4-year period which begins on the date the State or unit of local government first received the amounts shall be transferred to the Commission.</text></paragraph><paragraph id="H2E41AD3AF5A74DA19EAFFC2E236BE5C7"><enum>(2)</enum><header>Reallocation of transferred amounts</header><subparagraph id="H5CC427F050D24F2AB501E93A16112966"><enum>(A)</enum><header>In general</header><text>The Commission shall use the amounts transferred under paragraph (1) to make payments on a pro rata basis to each covered payment recipient described in subparagraph (B), which may obligate and expend such payment for the purposes described in section 261(b) during the 1-year period which begins on the date of receipt.</text></subparagraph><subparagraph id="H08FCA2B9F9D24EDC975FE6F937D48452"><enum>(B)</enum><header>Covered payment recipients described</header><text>In subparagraph (A), a <quote>covered payment recipient</quote> is a State or unit of local government with respect to which—</text><clause id="H7ADFE13C3641442087F431424ABEDD14"><enum>(i)</enum><text>amounts were appropriated pursuant to the authority of subsection (a); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H795E65E59A354C1F82D6599B6F4D00CA"><enum>(ii)</enum><text>no amounts were transferred to the Commission under paragraph (1).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id5f7e7bd53f3e4182958c28f65dcc50f2"><enum>302.</enum><header>Study and report on accessible voting options</header><subsection id="id209b9f9e9f2041a5a2122602b170b132"><enum>(a)</enum><header>Study and report</header><text>The Election Assistance Commission (in this section referred to as the <quote>Commission</quote>), in coordination with the Access Board and the Cybersecurity and Infrastructure Security Agency, shall make grants to not fewer than 3 eligible entities to study, test, and develop accessible and secure remote voting systems and voting, verification, and casting devices to enhance the accessibility of voting and verification for individuals with disabilities.</text></subsection><subsection id="id015398db627d496fa20abcc6b5783530"><enum>(b)</enum><header>Eligibility</header><text>An entity is eligible to receive a grant under this section if it submits to the Commission (at such time and in such form as the Commission may require) an application containing—</text><paragraph id="id219ea2151fd84dd091d350b81168bdff"><enum>(1)</enum><text>certifications that the entity shall specifically investigate enhanced methods or devices, including nonelectronic devices, that will assist such individuals and voters in marking voter-verified paper ballots and presenting or transmitting the information printed or marked on such ballots back to such individuals and voters, and casting such ballots;</text></paragraph><paragraph id="id60969f4360d14e5aa80f17a09857b1b6"><enum>(2)</enum><text>a certification that the entity shall complete the activities carried out with the grant not later than January 1, 2026; and</text></paragraph><paragraph id="id6983228eb1a74eecba28a55993eb32b9"><enum>(3)</enum><text>such other information and certifications as the Commission may require.</text></paragraph></subsection><subsection id="id56c10e7b45494eea8bcfc9940c5484d8"><enum>(c)</enum><header>Availability of technology</header><text>Any technology developed with the grants made under this section shall be treated as non-proprietary and shall be made available to the public, including to manufacturers of voting systems.</text></subsection><subsection id="idbd3e773ff6e64460958a33df599986bb"><enum>(d)</enum><header>Coordination with grants for technology improvements</header><text>The Commission shall carry out this section so that the activities carried out with the grants made under subsection (a) are coordinated with the research conducted under the grant program carried out by the Commission under section 271 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21041">52 U.S.C. 21041</external-xref>), to the extent that the Director and Commission determine necessary to provide for the advancement of accessible voting technology.</text></subsection><subsection id="idc648b27fcdcb4773bc7e23f8259e6811"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out subsection (a) $30,000,000, to remain available until expended.</text></subsection></section><section id="idECB5DD6A3CAB4FA789FDE00E4A2DF637"><enum>303.</enum><header>Appointments to EAC Board of Advisors</header><subsection id="idCA4955BE19704A288E60B57B190D0E93"><enum>(a)</enum><header>In general</header><text>Section 214(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/20944">52 U.S.C. 20944(a)</external-xref>) is amended—</text><paragraph id="id1F63D090E2D241EE8E8A7B7DAD9E5925"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>37</quote> and inserting <quote>49</quote>; and</text></paragraph><paragraph id="idE241E1A0AED544338D45728AA5F54C58"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6079BE45D34F48B684E409F5E508F486"><paragraph id="id385361cf31374bf492a18d98e256ed9b"><enum>(17)</enum><text>Two members appointed by the National Council on Disability.</text></paragraph><paragraph id="id26de57839396412aa1048730f256ef9c"><enum>(18)</enum><text>Two members appointed by the Assistant Secretary of Health and Human Services for Aging.</text></paragraph><paragraph id="id62a02bc2a6064317aa5dac6ef63ce240"><enum>(19)</enum><text>Four members from organizations, whose executive leadership team consists of fifty-one percent of individuals with disabilities, representing the interests of voters with disabilities, of whom—</text><subparagraph id="id39f2af1ccce3405487eedf7c8117d259"><enum>(A)</enum><text>two members shall be appointed by the Committee on Education and the Workforce of the House of Representatives, of whom one shall be appointed by the chair and one shall be appointed by the ranking minority member; and</text></subparagraph><subparagraph id="id60fc1574132444049accbba3a68a0923"><enum>(B)</enum><text>two members shall be appointed by the Committee on Health, Education, Labor, and Pensions of the Senate, of whom one shall be appointed by the chair and one shall be appointed by the ranking minority member.</text></subparagraph></paragraph><paragraph id="idd12d9eb714ca49fcb5ba56d815238906"><enum>(20)</enum><text>Four members from organizations representing the interests of older voters, of whom—</text><subparagraph id="ide1b2021a2ef24a6c8eabaf6e5a9070c4"><enum>(A)</enum><text>two members shall be appointed by the Committee on Education and the Workforce of the House of Representatives, of whom one shall be appointed by the chair and one shall be appointed by the ranking minority member; and</text></subparagraph><subparagraph id="id9e08d71863ce4934a1afd6e44ed33f69"><enum>(B)</enum><text>two members shall be appointed by the Special Committee on Aging of the Senate, of whom one shall be appointed by the chair and one shall be appointed by the ranking minority member.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id798CA1FD672B48508C57D14A6F928F67"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on January 1, 2025.</text></subsection></section><section id="id385436dab3f147a8b628419ba86e85c9"><enum>304.</enum><header>Removal of limitation on use of funds for participation of protection and advocacy systems in litigation related to election-related disability access</header><text display-inline="no-display-inline">Section 292(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21062">52 U.S.C. 21062(a)</external-xref>) is amended by striking <quote>;
