which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prescribe requirements with respect to plants detained by the Secretary of the Interior on suspicion of a violation of the Lacey Act Amendments of 1981, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthen Wood Products Supply Chain Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id73d3ecad558d4bd0867fe37aa7aa339b"><enum>2.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="id4ad829c7b1144630add84cf36545f7d4"><enum/><text>In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="ide11ee38bbf02409fad5ea160f66bf76a"><enum>(1)</enum><header>Importer</header><text>The term <term>importer</term> means any person that seeks to import (as defined in section 2 of the Lacey Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371</external-xref>)) plants.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb5c0bb26c26d4e8fa9cf4e7a6e38340b"><enum>(2)</enum><header>Lacey Act</header><text>The term <term>Lacey Act</term> means the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb77cf939e8b148d08f2dd80639a1bcd5"><enum>(3)</enum><header>Plant</header><text>The term <term>plant</term> has the meaning given the term in section 2 of the Lacey Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7127102939b644989f25f7ace95a1e0a"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id666588d7c05a4582b29ab8deb4f35a63"><enum>3.</enum><header>Detention of plants under the Lacey Act</header><subsection commented="no" display-inline="no-display-inline" id="idb6cbc18f8f1a43d19bcde32566cea396"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, not later than 5 days (excluding weekends and Federal holidays) after the date on which plants are presented by the U.S. Customs and Border Protection to the Secretary for physical examination on suspicion of a violation of the Lacey Act, the Secretary shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idfbeaf375752740cdb412b0dde0b0f8c6"><enum>(1)</enum><text>release the plants; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id85a6cfcd08e143f59055a1d7fd3eda22"><enum>(2)</enum><text>issue to the importer a notice of detention in accordance with subsection (b).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide1d63df93e2d47eca0b716c9ea52b207"><enum>(b)</enum><header>Notice of detention</header><text>A notice of detention issued by the Secretary under subsection (a)(2) shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="id0b33c7f094ff437d9da5d07fd76195c2"><enum>(1)</enum><text>the specific reasons for which the detention of the applicable plants was initiated, including the date on which the plants were presented to the Secretary for examination;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide8baf2ee701d41a4a8ac17b47047d2d8"><enum>(2)</enum><text>the anticipated length of detention;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2416421d53654a2f8a4f6b24065fd4ac"><enum>(3)</enum><text>the nature of the tests or inquiries to be conducted on the applicable plants;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3176e944321b4df08117ed2c453bc43e"><enum>(4)</enum><text>the nature of any information that, if supplied to the Secretary, would accelerate the disposition of the detention; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida4d15a926b5e49fcb682bb037a47b05d"><enum>(5)</enum><text>a notice to inform the importer that the importer may apply to the Secretary and the U.S. Customs and Border Protection to transport the plants under bond to be examined at a location other than a location under the control of the Secretary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4907ae0156c94122bed02c12f23d2ffe"><enum>(c)</enum><header>Administrative and physical inspections</header><text>If the Secretary conducts any tests of plants presented for physical examination under subsection (a) for appraisement, classification, or other official purposes, the Secretary shall provide to the importer—</text><paragraph commented="no" display-inline="no-display-inline" id="idb78b3a797426420aabd10ee0a592c5c3"><enum>(1)</enum><text display-inline="yes-display-inline">the results of that testing;</text></paragraph><paragraph id="id46fc304ec33040e091225a30e75f7f35"><enum>(2)</enum><text>sufficient information about the testing conducted so that the importer has the ability to replicate the test; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id383a067f0a2d4c4a8071252a59fc63f8"><enum>(3)</enum><text>any applicable accompanying documentation relating to that testing.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id700b4ba4122047cfa6cc474810473252"><enum>(d)</enum><header>Transport of plants</header><text>Not later than 10 days after the date on which a notice of detention is issued to an importer by the Secretary under subsection (a)(2), the Secretary shall allow the applicable plants to be transported outside the custody of the U.S. Customs and Border Protection for purposes of storage if—</text><paragraph commented="no" display-inline="no-display-inline" id="id08dbc75261734819bbe66a621cb95166"><enum>(1)</enum><text>the importer requests the transfer;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb216eff2ec704254b72be1753800548a"><enum>(2)</enum><text>the importer—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida9f80b710fd74da6b103eb03a8975159"><enum>(A)</enum><text>pays any required demurrage and storage fees with respect to those plants;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22512e065a0c46249479dd793958d03e"><enum>(B)</enum><text>provides a bond for removal of the plants from facilities of the U.S. Customs and Border Protection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9695a90d09264d6198d4fd7fdc1cdf9e"><enum>(C)</enum><text>complies with sections 151.7 through 151.11 of title 19, Code of Federal Regulations (or successor regulations); and</text></subparagraph></paragraph><paragraph id="id27be5d847b16499c9d7a819365b6d77b"><enum>(3)</enum><text>the intent of the Lacey Act would not be frustrated by moving the plants outside the control of the U.S. Customs and Border Protection, as determined by the Secretary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf118cb68112149709fac97ed3a3bfd2f"><enum>(e)</enum><header>Final determinations</header><paragraph commented="no" display-inline="no-display-inline" id="id301cf2cfecf54faebf4b40b9ddb3964b"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date on which plants are presented to the Secretary for examination under subsection (a), the Secretary shall make a final determination with respect to the admissibility of the detained plants.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id977ede5c74d24d9cb9cc48f6a970f784"><enum>(2)</enum><header>Failure to make final determination</header><text>If the Secretary fails to make a final determination with respect to detained plants in accordance with the timeline described in paragraph (1), the failure shall be treated as a decision by the Secretary to exclude the plants from entry or delivery, or a demand for redelivery to the custody of the U.S. Customs and Border Protection, under the customs laws.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf3672622bf2040f98cb08fb8fa7d7b97"><enum>(3)</enum><header>Protests</header><subparagraph commented="no" display-inline="no-display-inline" id="id5723ac73d1ee4dc3be09a716929b7c5d"><enum>(A)</enum><header>In general</header><text>An importer may submit to the Secretary a protest of the decision of the Secretary to exclude a plant pursuant to this subsection.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id060bf1b4231140439739fa2e375736c9"><enum>(B)</enum><header>Decision by Secretary</header><text>Not later than 30 days after the date on which an importer submits a protest under subparagraph (A), the Secretary shall—</text><clause commented="no" display-inline="no-display-inline" id="id0a59a7d5052d423fb1e9e770a57aeef2"><enum>(i)</enum><text>allow the protest and release to the importer each plant subject to the protest; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ide3554ebaf45e4858b40856e736b32a76"><enum>(ii)</enum><text>deny the protest.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c17404ba42942a4802a0dc65774958c"><enum>(C)</enum><header>Court action</header><text>In accordance with part 12 of subchapter B of chapter I of title 50, Code of Federal Regulations (or successor regulations), an importer may petition a court of competent jurisdiction to seek an order with respect to plants—</text><clause commented="no" display-inline="no-display-inline" id="id06e4089a352d49d883d3d32637251d76"><enum>(i)</enum><text display-inline="yes-display-inline">detained by the Secretary; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id60ed729eaeb84ea6933cfdaae762872f"><enum>(ii)</enum><text>excluded by the Secretary pursuant to this subsection.</text></clause></subparagraph></paragraph></subsection><subsection id="idd59e96ef36564ee9b3eacf4c93227dea"><enum>(f)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall promulgate regulations to carry out this section.</text></subsection></section></legis-body></bill>
