<congress display="yes">118th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 3648</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Post-Katrina Management Reform Act of 2006 to repeal certain obsolete requirements, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="idcb9d6870-0ec9-48be-99c7-73149bbf5060" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Eliminate Limitations for Prompt Response and Recovery Act</short-title></quote> or the <quote><short-title>HELP Response and Recovery Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id42f8ff18-b88b-4209-89f2-a0fbc0ac2dcb" section-type="subsequent-section" changed="not-changed"><enum>2.</enum><header display-inline="yes-display-inline">Repeal of obsolete DHS contracting requirements</header><text display-inline="no-display-inline">The Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/295">Public Law 109–295</external-xref>; 120 Stat. 1394) is amended by striking section 695 (<external-xref legal-doc="usc" parsable-cite="usc/6/794">6 U.S.C. 794</external-xref>). </text></section><section id="idb6dde90229714cc18dc62902348942bb" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Reports</header><subsection commented="no" display-inline="no-display-inline" id="id66a65914d01140c1b13d1313691ee4c9" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Covered period defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered period</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="idcd3be67749554a0aa351d2daa5823ec3" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to an initial report required under subsection (b), the period between the date of enactment of this Act and the date of the report; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc9dfcfe9e54348ea8992fb2c28e8427c" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to any succeeding report required under subsection (b), the period between the date of the most recent report and the succeeding report.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id897ae0be4df44f2498a2e1673ae488c1" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">Not later than 540 days after the date of enactment of this Act, and annually thereafter until the date that is 5 years thereafter, the Secretary of Homeland Security shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that—</text><paragraph commented="no" display-inline="no-display-inline" id="idba9bd3d2609641dba8963466f322bdb8" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">reviews how the repeal under section 2 has—</text><subparagraph id="id7689ff5cbc8b4a0ba010b3fbb1193b9d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">prevented waste, fraud, and abuse; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbf5b87ae65024cd293a841504da4ea8f" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">promoted taxpayer savings; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5c3ab6e0396a4ef8b93790cd65c10898" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">includes, with respect to a contract entered into or extended by the Administrator of the Federal Emergency Management Agency under urgent and compelling circumstances during the covered period for which the Administrator did not solicit bids—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide049b936dec044d7bb3f5df185e681f9" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the number of those contracts;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id589f37f9251f420f95d0e0b616cdca49" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the subject of each contract;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id13d8c2a7fbb9411e98a3676082ab1c6f" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">the amounts obligated by the Administrator for each contract;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0fbdd5cc7988417ea1c4b1fd8e089b59" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">if applicable, the State benefitted by each contract; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5f29f7ab058f48629180ebd90322fa00" changed="not-changed"><enum>(E)</enum><text display-inline="yes-display-inline">if applicable, the name of the major disaster or emergency for which each contract was entered into or extended.</text></subparagraph></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20240320" chamber="Senate">Passed the Senate March 20, 2024.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
