<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3638</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240123">January 23, 2024</action-date><action-desc><sponsor name-id="S421">Mr. Vance</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow health plan policyholders to obtain information about controlled substances prescribed to adult children enrolled in such plan.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dependent Controlled Substance Transparency Act</short-title></quote>.</text></section><section id="id43ece761175b4335bbc4a43c9c7707d6"><enum>2.</enum><header>Privacy exception with respect to controlled substances prescribed to dependents</header><subsection commented="no" display-inline="no-display-inline" id="id079b0d29a9734c4f9810393616188080"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding the privacy regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/191">Public Law 104–191</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note) or any other provision of law, in the case of an adult child enrolled in a group health plan or in group or individual health insurance coverage as a dependent of the policyholder of such plan or coverage, a covered entity shall make available to such policyholder, upon request, information relating to any controlled substance prescribed to such adult child.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id370a581076764fefb6fcb3bade399fa2"><enum>(b)</enum><header>Exception</header><text>Subsection (a) shall not apply in the case of a controlled substance prescribed to an adult child as medication-assisted treatment for a substance use disorder.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id10ffd1e9f30945faaca4312382da19bd"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id78d793750ed9407cae6ead3275bea774"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>controlled substance</term> has the meaning given such term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4acb3c324eff4fe180976d498e3c47b2"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered entity</term> has the meaning given such term in section 160.103 of title 45, Code of Federal Regulations (or any successor regulations)); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b6c73077b844f658570e517e0ac5167"><enum>(3)</enum><text display-inline="yes-display-inline">the terms <term>group health plan</term> and <term>health insurance issuer</term> have the meanings given such terms in section 2791 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
