which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the Earthquake Hazards Reduction Act of 1977, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Earthquake Hazards Reduction Program Reauthorization Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idd4606b687c8d4eb18b05f61897603a7c"><enum>2.</enum><header>Modification of findings</header><text display-inline="no-display-inline">Section 2 of the Earthquake Hazards Reduction Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/42/7701">42 U.S.C. 7701</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id088042942e0b4d8899c14e988e1296c5"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf94305d53c8a4dcf8fd2b7ce5f84d52a"><enum>(A)</enum><text>by striking <quote>50 States, and the Commonwealth of Puerto Rico,</quote> and inserting <quote>States and Tribal jurisdictions</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id02c82d6fc0fc4c70ac5f127c646abe2e"><enum>(B)</enum><text>by striking <quote>of them</quote> and inserting <quote>States</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30f559d1cf774c239e204bf763ce1bbb"><enum>(C)</enum><text>by adding at the end the following: <quote>Almost half of the United States population resides in areas that are at risk or experiencing a damaging earthquake during the 50-year period beginning on the date of the enactment of the <short-title>National Earthquake Hazards Reduction Program Reauthorization Act of 2024</short-title></quote>;</text></subparagraph></paragraph><paragraph id="id2d3f7b5290dc4f7394ee228f3422ed9c"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd5af272f0b534db997672a99cdb7b29e"><enum>(A)</enum><text>by inserting after the first sentence the following: <quote>A 2023 report by the Federal Emergency Management Agency and the United States Geological Survey (FEMA P–366) estimates the annualized earthquake losses to the national building stock is $14,700,000,000 per year and the total economic exposure to earthquake losses (buildings and contents) across the nation is $107,800,000,000,000.</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb4d385ff70ca43d7b38275af02a4e4ed"><enum>(B)</enum><text>in the third sentence—</text><clause commented="no" display-inline="no-display-inline" id="id52c96e3242b94ca392d3853e10b3a4ab"><enum>(i)</enum><text>by striking <quote>and construction</quote> and inserting <quote>, construction, evaluation, and retrofitting</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1a4213f40c2c44a3846b24de8dd16a8e"><enum>(ii)</enum><text>by striking <quote>and (E)</quote> and inserting the following: <quote>(E) inventories of buildings and infrastructure with high seismic risk, especially those that are critical to community resilience, (F) programs that require or incentivize replacement or retrofit of existing buildings and infrastructure with high seismic risk, especially those that are critical to community resilience, and (G)</quote>;</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2f39db31db1f42cba51915bc85e064ac"><enum>(3)</enum><text>in paragraph (3), by inserting <quote>Tribal,</quote> after <quote>local,</quote>;</text></paragraph><paragraph id="id0400681097f149be891d08c9a9460b8f"><enum>(4)</enum><text>in paragraph (4), by striking <quote>could provide</quote> and all that follows through the period at the end and inserting <quote>is necessary to provide the scientific understanding needed to improve and expand the earthquake early warning system.</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided375356629641b18bbc72df3a96e6a1"><enum>(5)</enum><text>in paragraph (8), by striking <quote>cave-ins</quote> and inserting <quote>collapse</quote>;</text></paragraph><paragraph id="id6b0fdfcb566c490c83c44ad03f4ca410"><enum>(6)</enum><text>in paragraph (9)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2d75b95f82ec4c8ea8fdcf3737c12f8e"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>and local</quote> and inserting <quote>local, and Tribal government</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id47966bd183984ca9a8ee5a7d775f8d51"><enum>(B)</enum><text>by adding at the end the following: <quote>In addition, buildings and infrastructure built to older codes and standards may pose significant risk of injury, loss of life, or irreparable damage. A 2021 report submitted to Congress pursuant to section 8(b), as amended by section 5 of the National Earthquake Hazards Reduction Program Reauthorization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/307">Public Law 115–307</external-xref>), by the Federal Emergency Management Agency and the National Institute of Standards and Technology (FEMA P2090/NST SP–1254) provides recommendations for improving post-earthquake functional recovery time of the built environment to support community resilience goals and many of these recommendations still need to be implemented.</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4d333e4ed6ae4eaeac1747cae5705a6f"><enum>(8)</enum><text>in paragraph (13)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id633038b076154679a03e69359fb6b2c7"><enum>(A)</enum><text>in the first sentence, by inserting <quote>in 2011</quote> after <quote>a study</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd92522b46d4446a78a9826d210996167"><enum>(B)</enum><text>in the second sentence, by inserting <quote>(in 2011 dollars)</quote> after <quote>$300,000,000</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id357de6a3a1634e1ea1240b7743a2f74e"><enum>(C)</enum><text>by adding at the end the following: <quote>The cost of actual seismic retrofits to reduce known risks is not included in such valuation.</quote>.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idda9c011e6ffa4365bc7175c76262b811"><enum>3.</enum><header>Modification of purpose</header><text display-inline="no-display-inline">Section 3 of the Earthquake Hazards Reduction Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/42/7702">42 U.S.C. 7702</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf4b105b8139c4438952d84d005d4e5a0"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idce0b1b923ca7488b9f7c3691c884ebef"><enum>(A)</enum><text>by striking <quote>and local</quote> and inserting <quote>, local, and Tribal government</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9be7bff62f7642cb9e0a25ad7533c428"><enum>(B)</enum><text>by striking <quote>locations and structures</quote> and inserting <quote>buildings and infrastructure</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4792d96f9dfb44d682a4181ece3234e9"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id856f13e34f9a499385ba0a2e745e9670"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>and construction</quote> and inserting <quote>, construction, evaluation, and retrofitting</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbaf4c7a6972e4b34805d7e399fdf9919"><enum>(B)</enum><text>by striking <quote>encourage consideration of</quote> and inserting <quote>incorporate</quote>.</text></subparagraph></paragraph></section><section id="idc2cae6013a124cbebab13d5ebb019159"><enum>4.</enum><header>Modification of definitions</header><text display-inline="no-display-inline">Section 4 of the Earthquake Hazards Reduction Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/42/7703">42 U.S.C. 7703</external-xref>) is amended—</text><paragraph id="idbd997e1b3c3e4131bbdf51ee84c1124e"><enum>(1)</enum><text>in paragraph (3), by inserting <quote>, including secondary effects such as earthquake-caused tsunamis</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23758de41062462c94cc2d39baa683f2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4ee5f4b4269c4de4b6c9b6e701fa8bd2"><paragraph id="idad203956db9d4e13b9e97be7ae859fae"><enum>(11)</enum><text>The term <term>Tribal government</term> has the meaning given the term <quote>tribal government</quote> in section in section 421 of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/658">2 U.S.C. 658</external-xref>).</text></paragraph><paragraph id="id381360e8ad9542d784edaae87a2daba2"><enum>(12)</enum><text>The term <term>functional recovery</term> means a post-earthquake performance state in which a building or lifeline infrastructure system is maintained, or restored, to safely and adequately support the basic intended functions associated with the pre-earthquake use or occupancy of a building, or the pre-earthquake service level of a lifeline infrastructure system. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="id099df85681ca4e5d84541ee35826b51c"><enum>5.</enum><header>Improvements to National Earthquake Hazards Reduction Program</header><subsection commented="no" display-inline="no-display-inline" id="id788515a3bb8e4bb2928f35f907b70e48"><enum>(a)</enum><header>Program activities</header><text display-inline="yes-display-inline">Subsection (a)(2) of section 5 of the Earthquake Hazards Reduction Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/42/7704">42 U.S.C. 7704</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id27aaeae770c24e61882395d8800e7784"><enum>(1)</enum><text>in subparagraph (B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id09e1c5390ae3419c95a5aab565efaf52"><enum>(A)</enum><text>in the matter before clause (i)—</text><clause commented="no" display-inline="no-display-inline" id="id440ff8c5c54544e2b8fa71090a741c64"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>and local</quote> and inserting <quote>, local, and Tribal</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb0b302ad9d4d41be97447d3782d143d6"><enum>(ii)</enum><text>by striking <quote>and constructing</quote> and inserting <quote>, designing, constructing, evaluating, and retrofitting</quote>;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida00546ec0a3f479fb273b65cca5c5fc7"><enum>(B)</enum><text>in clause (ii), by striking <quote>voluntary consensus codes for earthquake hazards reduction</quote> and inserting <quote>consensus codes for earthquake hazards reduction, including improved post-earthquake functional recovery,</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63413de52d1b42709ca8ad149dcc53f3"><enum>(C)</enum><text>in clause (iii), by striking <quote>and hazards reduction; and</quote> and inserting <quote>functional recovery, and other hazards reduction topics;</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf190f981d4144089ab3f81dcdd6af701"><enum>(D)</enum><text>in clause (iv)—</text><clause commented="no" display-inline="no-display-inline" id="id457eb28ce91c4d9491089e99821249a3"><enum>(i)</enum><text>by inserting <quote>and maintaining</quote> after <quote>publishing</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id50ead66fa12d4c3f9a6c06c62be7c81c"><enum>(ii)</enum><text>by inserting <quote>tsunami susceptibility,</quote> after <quote>liquefaction susceptibility,</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc72f4a366ef042088ad26ca913500894"><enum>(iii)</enum><text>by striking <quote>; and</quote> and inserting a semicolon; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80b8d208ea7942b78adf25e375f32504"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8AAD20645C0249028B210C41DBD6393A"><clause id="iddd398411d5c044f58c11ebeef79b0e03"><enum>(v)</enum><text>development of best practices and guidelines to create an inventory of and conduct seismic performance evaluations of buildings, structures, and lifeline infrastructure with high seismic risk, especially those that are critical to community resilience; and</text></clause><clause id="idc1ba56ed0d7e4073a90e74067e7995fe"><enum>(vi)</enum><text>the provision of technical assistance upon request by a State, local, or Tribal government regarding—</text><subclause id="id1e5dfbe5604d4d9c97053eb8cea1a21e"><enum>(I)</enum><text>the creation of an inventory of buildings, structures, and lifeline infrastructure;</text></subclause><subclause id="id2bd75e416e0d438fa843d956e6456061"><enum>(II)</enum><text>the performance of seismic performance evaluations; and</text></subclause><subclause id="id9f2eb6affb574ddebcbd2dbe069d1a40"><enum>(III)</enum><text>cost-effective best practices for retrofitting existing buildings, structures, and lifeline infrastructure.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34c2a393b5384ad6bba888c0efb1ca55"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id29201fd022694c63b51b9c8ab4f356e5"><enum>(3)</enum><text>by redesignating subparagraph (D) as subparagraph (E); and</text></paragraph><paragraph id="id4195d9b40c8e4813ae6b4d1842d14a9a"><enum>(4)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA0533114B3724BC6BFBA6345B29F380D"><subparagraph id="id658b5b6c62024573928568e9299a5e75"><enum>(D)</enum><text>improve the understanding of—</text><clause id="idc251976e38444c7b8da7a190b80e2771"><enum>(i)</enum><text>the multiple hazards associated with earthquakes, including liquefaction, tsunamis, landslides, structural fires, and the compounding effects of climate on these hazards; and</text></clause><clause id="id17041613f0d8449b895ae56fb2939ccf"><enum>(ii)</enum><text>potential mitigation measures for such hazards; and </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7b99b656f8094fdaa4f65e06ff4d4a52"><enum>(b)</enum><header>Duties of Interagency Coordinating Committee on Earthquake Hazards Reduction</header><text>Subsection (a)(3)(D)(ii) of such section is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id783df3101dfe46a6bcf515fe4fa78b08"><enum>(1)</enum><text>in subclause (V), by inserting <quote>and associated secondary hazards</quote> before the period at the end; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27dd352ad1c74cf195d5b5f28bb8d53d"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCA7A7EF81BDA413999F0E2DA8495F91A"><subclause id="id2d777f4b635c407b81306599b38715c1"><enum>(VIII)</enum><text>Coordinating with the Chair of the Federal Communications Commission on the timely broadcasting of emergency alerts generated by the earthquake early warning system.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide709fc4993084d9f86db9762712ad192"><enum>(c)</enum><header>Biennial report</header><text>Subsection (a)(4)(A) of such section is amended by striking <quote>under paragraph (3)(D)(i)(I)</quote> each place it appears and inserting <quote>under paragraph (3)(D)(ii)(I)</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id171d56b4ed42474caf475a99669f0f43"><enum>(d)</enum><header>Advisory committee</header><text>Subsection (a)(5)(A) of such section is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id0e03c4cf4eda45258c145d98a54e3104"><enum>(1)</enum><text>by striking <quote>and local government</quote> and inserting <quote>, local, and Tribal governments</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f53b843025347e280ea5e86686c6499"><enum>(2)</enum><text>by inserting <quote>social,</quote> after <quote>scientific,</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf7a2add821784f2dafd4a039e219c99d"><enum>(e)</enum><header>Lead agency for responsibilities of Program agencies</header><text>Subsection (b)(1) of such section is amended—</text><paragraph id="id5c7ab7f84fcc40f286d413021b3b0389"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd78036c27dbe42ff871c88005cb5c921"><enum>(A)</enum><text>by striking <quote>and local</quote> and inserting <quote>local, and Tribal governments</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf28b2f3bfeb149c3adc4316a871c35d0"><enum>(B)</enum><text>by striking <quote>plan and constructing</quote> and inserting <quote>planning, designing, constructing, evaluating, and retrofitting</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86c34ae3a58245df9c08acc3c11bde25"><enum>(2)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (F) and (G), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idababb9ae8ce5455080b718641154c29a"><enum>(3)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA1CA4FEFAE81474CA53A03790A0F6473"><subparagraph id="id575ae020723444028b6c426aacb547b6"><enum>(C)</enum><text>improve the understanding of earthquake-caused fires and support the development of engineering tools and construction methods that mitigate the risk of fire following earthquakes;</text></subparagraph><subparagraph id="id95528957f8ea47afb9c0b7550c048dd2"><enum>(D)</enum><text>develop, in coordination with the Administrator of the Federal Emergency Management Agency, best practices and guidelines for a State, local, or Tribal government to create an inventory of buildings, structures, or lifeline infrastructure that are critical to community resilience or otherwise have high seismic risk;</text></subparagraph><subparagraph id="id489faf3576a74621a1b8f7d9045c65d5"><enum>(E)</enum><text>provide, in coordination with the Administrator of the Federal Emergency Management Agency, technical assistance to a State, local, or Tribal government requesting such assistance with respect to the creation of an inventory of buildings, structures, or lifeline infrastructure; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f9f00ea634a420a88deec82d3cce3c1"><enum>(2)</enum><text>in subsection (b), by striking <quote>shake-related property damage</quote> and inserting <quote>seismic-related property damage to improve the post-earthquake functional recovery time</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="ida84c9fd9159a4d828da47516e8f09d38"><enum>7.</enum><header>Seismic standards</header><text display-inline="no-display-inline">Section 8 of the Earthquake Hazards Reduction Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/42/7705b">42 U.S.C. 7705b</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8103de0ac492470490654febada92e38"><enum>(1)</enum><text>in subsection (b), by striking <quote>under paragraph (1)</quote> and inserting <quote>under subsection (a)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida29d87a5b488419aa8c8ca6f21600147"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCB7F508C655B4714B9AECA4082CDF7BA"><subsection id="id95445b97b78740269b98c9301460087c"><enum>(c)</enum><header>Implementation of recommendations</header><text>Each Program agency, as part of their Program responsibilities, shall execute research, projects, grants, and other activities that support, promote, advance, or otherwise implement the recommendations in the report submitted pursuant to subsection (b) to improve the performance of the built environment in terms of post-earthquake reoccupancy and functional recovery time.</text></subsection><subsection id="idc04b7c11db59490496fd62ee9c7e7da4"><enum>(d)</enum><header>Biennial reports</header><paragraph commented="no" display-inline="no-display-inline" id="id3a3c8bd2cab54601aa90411b827aeab8"><enum>(1)</enum><header>Biennial reports to Interagency Coordinating Committee</header><text display-inline="yes-display-inline">No later than June 30, 2025, and not less frequently than once every 2 years thereafter, each Program agency shall submit to the Interagency Coordinating Committee a report on activities and progress made to support, promote, or advance the implementation of the recommendations included in the report submitted pursuant to subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f48f1f772e143268b73c57c03b60ed9"><enum>(2)</enum><header>Inclusion in biennial reports of Interagency Coordinating Committee</header><text display-inline="yes-display-inline">The Interagency Coordinating Committee shall include the information received under paragraph (1) in each biennial report submitted under section 5(a)(4), including consideration of a prioritized work plan to coordinate activities among the Program agencies and the necessary Program budget to fully implement the recommendations described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="id1439383400394355840481dd35ffb6e5"><enum>8.</enum><header>Improvements to post-earthquake investigations program</header><text display-inline="no-display-inline">Section 11 of the Earthquake Hazards Reduction Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/42/7705e">42 U.S.C. 7705e</external-xref>) is amended, in the matter before paragraph (1)—</text><paragraph commented="no" display-inline="no-display-inline" id="id72474eacce3c43edb14b7a58742b0d1b"><enum>(1)</enum><text>in the first sentence, by inserting <quote>domestic and international</quote> after <quote>investigate major</quote>;
