which was read twice and referred to the <committee-name committee-id="SSEV00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Environment and Public Works</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20240522">May 22, 2024</action-date><action-desc>Reported by <sponsor name-id="S277">Mr. Carper</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 40, United States Code, to include Indian Tribes among entities that may receive Federal surplus real property for certain purposes, and for other purposes.</official-title></form><legis-body><section id="id3E21D9C72DF64BD4AAADE81D91699250" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>GSA Disposal Process Tribal Parity Act of 2024</short-title></quote>.</text></section><section id="id0b120cac4a464c6e92ca42ac1e9208b6"><enum>2.</enum><header>Inclusion of Indian Tribes in GSA disposal processes</header><subsection commented="no" display-inline="no-display-inline" id="id620c7fefa0d04c7ca218fa9ce1b8df65"><enum>(a)</enum><header>Disposal of real property for certain purposes</header><text>Section 550 of title 40, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idb92dee42bde44473aec52df5cff04d83"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id69b5994b2fc24ae1bc7c53fd8422370d"><enum>(A)</enum><text display-inline="yes-display-inline">by striking the subsection designation and heading and all that follows through <quote>includes the</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id77335A90F63C4751B0B31FC67B69F7FD"><subsection commented="no" display-inline="no-display-inline" id="id121fb5a619534dbcbf97d770fe903265"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id7e82c4b1df9d4a9293ad0d263bedbdf3"><enum>(2)</enum><header>State</header><text>The term <term>State</term> includes the</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbd43cd18d020413d8b2ae98747aca118"><enum>(B)</enum><text>by inserting before paragraph (2) (as so designated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA0ABDEDF2FD2432F96398F8E4A7F2E4C"><paragraph commented="no" display-inline="no-display-inline" id="id6b2e8d110c1148468fba5bbc8c005c98"><enum>(1)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77ab12b7790f404f9c02fbc3786c994b"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>to a State</quote> each place it appears and inserting <quote>to an Indian Tribe, a State</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ffa3cb43ace442ba088c8c4cad9d55c"><enum>(3)</enum><text>by striking <quote>the State</quote> each place it appears and inserting <quote>the Indian Tribe, State</quote>.</text></paragraph></subsection><subsection id="idb6e20c3190bf454ab7f748f53fa8604d"><enum>(b)</enum><header>Property for correctional facility, law enforcement, and emergency management response purposes</header><text>Section 553 of title 40, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idff3be18b7d334fb7931bd6cd35cfd72b"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id422afb1bcb234fe28bff09d67c9873be"><enum>(A)</enum><text display-inline="yes-display-inline">by striking the subsection designation and heading and all that follows through <quote>includes the</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1918944A6AB14761A878E3E0F9673793"><subsection commented="no" display-inline="no-display-inline" id="idde7cbc3bf1694514b5fb012ba63ac8c9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idd8579315c83b436c8904c22becde8c2b"><enum>(2)</enum><header>State</header><text>The term <term>State</term> includes the</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba0d9e234a5d4e238c7df9a06a640cc4"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), in the matter preceding paragraph (1), by striking <quote>a State, or political subdivision or instrumentality of a State,</quote> and inserting <quote>an Indian Tribe, a State, or a political subdivision or instrumentality of a State</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6690efe76aac4c0a9bede9f7ce334394"><enum>(c)</enum><header>Property for development or operation of a port facility</header><text>Section 554 of title 40, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id30873bbb21e5464399f30943f940b7ba"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfaf1b52890aa4b37a9f8256b785701ea"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb4dfb99fc4784b619ca41c291f2967eb"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6AD0EB02B2B14283989032CC1E6348FF"><paragraph commented="no" display-inline="no-display-inline" id="idbc1087e02fda430cbded28af139b67ba"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e9f537044754cf08844142d86672f9d"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(1), by striking <quote>a State or</quote> and inserting <quote>an Indian Tribe, a State, or</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd3dd500dc39e4abfb97b03ba57ccfd17"><enum>(d)</enum><header>Use of unutilized and underutilized public buildings and real property To assist the homeless</header><text>Section 501 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11411">42 U.S.C. 11411</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9ae47d209149458089068d5a55d395a2"><enum>(1)</enum><text>in subsection (c)(2)(A), in the second sentence, by striking <quote>State and</quote> and inserting <quote>Tribal, State, and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id037f226c32f440128c5b4680e85e4133"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (i)(4), by striking <quote>State or local government agency, or private nonprofit organization, which</quote> and inserting <quote>Tribal government, agency of a Tribal government, State or local government agency, or private nonprofit organization that</quote>.</text></paragraph></subsection><subsection id="id38c927c7570143ff9a6bc5aa143e2f6d" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Authority To transfer an interest in surplus property for public airports</header><text>Section 47151(a) of title 49, United States Code, is amended, in the matter preceding paragraph (1), by striking <quote>to a State</quote> and inserting <quote>to an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)), a State</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id91393b75d86a4dec9fa663c0ef128f7e"><enum>(f)</enum><header>Transfer of certain real property for wildlife conservation purposes</header><text>The first section of the Act of May 19, 1948 (<external-xref legal-doc="usc" parsable-cite="usc/16/667b">16 U.S.C. 667b</external-xref>), is amended, in the first sentence—</text><paragraph id="idbaced6dd5cbe42f9b4ffd648b31e5902"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id8b153bf5745a4a2396c97060c4882a84"><enum>(A)</enum><text>by inserting <quote>Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) or</quote> before <quote>agency of the State</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcad9248133042f8a775d1df65ce8777"><enum>(B)</enum><text>by inserting <quote>jurisdiction of the Indian Tribe (as so defined) or</quote> before <quote>wildlife resources of the State</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7b5c259cc082447198570ac345fe08a4"><enum>(2)</enum><text>in paragraph (2)(a), by striking <quote>such State agency</quote> and inserting <quote>such Indian Tribe (as so defined) or State agency</quote>.</text></paragraph></subsection></section><section id="idfe2d7be01eda494db9c35d26b6a78da1"><enum>3.</enum><header>Annual report on outreach to Indian Tribes; competing applications</header><subsection commented="no" display-inline="no-display-inline" id="id23e11cf84b49466f82888e16e675e862"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idcf0ae1ef238c4d8182f24669ff17508d"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82b10181fdbf45968ad7e9f32bb6b533"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idda62c4750e5e45058b3cf09fe31e0067"><enum>(b)</enum><header>Annual report on outreach to Indian Tribes</header><paragraph commented="no" display-inline="no-display-inline" id="ide8df2f9c515f4805b7c1c13a681e713d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator shall submit to Congress a report on the outreach conducted by the Administrator to Indian Tribes for purposes of notifying Indian Tribes on the availability of surplus Federal real property available for disposal.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d0abeb6f1a142aeabbf224c7ddf8a09"><enum>(2)</enum><header>Requirement</header><text>Each report submitted under paragraph (1) shall include a list of any surplus Federal real property conveyed to Indian Tribes in the year covered by the report.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida4bcd1b9925c48e399d37fa73afa7228"><enum>(c)</enum><header>Competing applications process</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator, in coordination with other heads of Federal agencies, as determined necessary by the Administrator, shall establish a process by which the Administrator will manage competing applications for Federal surplus real property made by States, political subdivisions or instrumentalities of States, municipalities, and Indian Tribes.</text></subsection></section></legis-body><endorsement><action-date date="20240522">May 22, 2024</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
