which was read twice and referred to the <committee-name committee-id="SSFR00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Foreign Relations</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20240507">May 7, 2024</action-date><action-desc>Reported by <sponsor name-id="S308">Mr. Cardin</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To require a strategy to counter the role of the People's Republic of China in evasion of sanctions imposed by the United States with respect to Iran, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Iranian Terrorism Act of 2023</short-title></quote>.</text></section><section id="id9f7d9ddb52f44ff5b5fcfed980c9ca73" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="ide381ac6b8f9f469d8ea467c7ff340461"><enum>(1)</enum><text>the Islamic Republic of Iran has long provided hundreds of millions of dollars in material support to Hamas and other terrorist groups, such as Palestinian Islamic Jihad, that directly threaten Israel;</text></paragraph><paragraph id="id38c21a522e3d4bd999f667f9ce5e6262"><enum>(2)</enum><text>Iran poses a threat to regional and global security and has earned approximately $80,000,000,000 in oil revenues since 2021;</text></paragraph><paragraph id="id3cfb8f2236b74633a6b966f8b6f943b7"><enum>(3)</enum><text>the People’s Republic of China, seeking to secure reliable sources of Middle Eastern energy, has purchased roughly $47,000,000,000 in Iranian petroleum products since 2021 and is undercutting the enforcement of sanctions imposed by the United States with respect to Iran;</text></paragraph><paragraph id="id2c57c9b86f2348ef8217031ae52e14ca"><enum>(4)</enum><text>illicit purchases of Iranian petroleum products by the People's Republic of China and other countries fund the Iranian regime’s suppression of human rights in Iran, provide valuable resources for Iran’s terrorist proxies, and provide additional resources for support by Iran for the Russian Federation in its unprovoked war in Ukraine, contrary to United States policy;</text></paragraph><paragraph id="id069109a4d5744b8a971b53a10704d05e"><enum>(5)</enum><text>lack of sanctions and sanctions enforcement directly undercuts United States policy objectives in the Indo-Pacific region, Europe, the Middle East, and beyond;</text></paragraph><paragraph id="id8f6fe775b3d846a4b21816b68a53d8a3"><enum>(6)</enum><text>increasing encroachment by the People's Republic of China in the Middle East and North Africa, include involvement of the People's Republic of China in illicit oil trade, runs counter to the national security interests of the United States; and</text></paragraph><paragraph id="id39c344aa8da94417a0447710e17e0c0b"><enum>(7)</enum><text>the United States should immediately enforce existing sanctions, including sanctions provided for in Executive Order 13846 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to reimposing certain sanctions with respect to Iran), and expand sanctions designations to include persons that store Iranian oil, ship-to-ship oil transfer operators, ports and port operators, refineries and refinery operators, and other individuals and entities, particularly in the People's Republic of China, dealing in Iranian-origin oil and petrochemicals.</text></paragraph></section><section id="id4e398dac37364f3bac0ea2cd79d8425a" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>3.</enum><header>Appropriate congressional committees defined</header><text display-inline="no-display-inline">In this Act, the term <term>appropriate congressional committees</term> means—</text><paragraph id="idaa286ce1469f4b8a81ede48ab4a1ce87"><enum>(1)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</text></paragraph><paragraph id="id74347ca79eb44241accd1c7ed0ce712e"><enum>(2)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives.</text></paragraph></section><section id="ida761c09f506c4bf8ab1a31364c5e19ad" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>4.</enum><header>Strategy to counter role of the People's Republic of China in evasion of sanctions with respect to Iran</header><subsection id="id2570e4ab54cf4d1892e3c01711b97bfa"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of State, in consultation with the heads of other appropriate Federal agencies, shall submit to the appropriate congressional committees a written strategy, and provide to those committees an accompanying briefing, on the role of the People's Republic of China in evasion of sanctions imposed by the United States with respect to Iranian-origin petroleum products that includes an assessment of options—</text><paragraph commented="no" display-inline="no-display-inline" id="id0bf0456ac89249f58a819a2a291656ea"><enum>(1)</enum><text display-inline="yes-display-inline">to strengthen the enforcement of such sanctions; and </text></paragraph><paragraph id="id22756899e6dd402aaee3a23f9b6d455c" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to expand sanctions designations targeting the involvement of the People's Republic of China in the production, transportation, storage, refining, and sale of Iranian-origin petroleum products.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id47013283bc8c4095ad94d184ed159abc"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The strategy required by subsection (a) shall include—</text><paragraph id="idba128229b731457d91328224cd2adac3"><enum>(1)</enum><text>a description of the use of sanctions in effect before the date of the enactment of this Act to target individuals and entities of the People's Republic of China that are directly or indirectly associated with smuggling of Iranian-origin petroleum products;</text></paragraph><paragraph id="id8b39de0b36524edc97864485176f69af"><enum>(2)</enum><text>an assessment of—</text><subparagraph id="idd95c6fcf77b54b4c904e226752e1d94d"><enum>(A)</enum><text>the People's Republic of China’s petroleum refining capabilities;</text></subparagraph><subparagraph id="id9b6405bd8b3944e69ce3bf02dc9e5878"><enum>(B)</enum><text>which of the People's Republic of China's refineries are at high risk of processing Iranian-origin petroleum products and why;</text></subparagraph><subparagraph id="idaf26b2d4d5774faaa4a2b62d8aedd9e6"><enum>(C)</enum><text>Iranian-owned entities operating in the People's Republic of China and involved in petroleum refining supply chains;</text></subparagraph><subparagraph id="id2497507d9f704b22b5d690f443f6df65"><enum>(D)</enum><text>the People's Republic of China’s role in global petroleum refining supply chains;</text></subparagraph><subparagraph id="id36b82a13f37f4f2e901e615a1e2b8941"><enum>(E)</enum><text>how the People's Republic of China leverages its role in global petroleum supply chains to achieve political objectives;</text></subparagraph><subparagraph id="id8bf6308605f14f7d96d34875809612cd"><enum>(F)</enum><text>the People's Republic of China’s petroleum importing and exporting partners;</text></subparagraph><subparagraph id="id445181080a0442c99f3cab13d3711415"><enum>(G)</enum><text>what percent of the People's Republic of China’s energy consumption is linked to illegally imported Iranian-origin petroleum products;</text></subparagraph><subparagraph id="id61a33d3f1a65419f97b691150d47c73a"><enum>(H)</enum><text>the amount of money the People's Republic of China saves by illegally importing discounted Iranian-origin petroleum products rather than paying market price;</text></subparagraph><subparagraph id="id01b9fb412b5f401294d3093c86c4b562"><enum>(I)</enum><text>what level of influence the Chinese Communist Party holds over non-state, semi-independent <quote>teapot</quote> refineries; and</text></subparagraph><subparagraph id="id93b9b5270861497cb3226f8fdbf905fb"><enum>(J)</enum><text>the challenges limiting the ability of the United States to impose or enforce sanctions with respect to such refineries, including—</text><clause id="id812fb927c89244eb912bf1af469fcd72"><enum>(i)</enum><text>Lawen Namu Petroleum Trading Company;</text></clause><clause id="id1351953f647c4d809c1f5f01752b611a"><enum>(ii)</enum><text>Qihang Energy; and</text></clause><clause id="id1d023d3f421644b6b91ef4ce877cfc73"><enum>(iii)</enum><text>Shangang Guomao; </text></clause></subparagraph></paragraph><paragraph id="idb984b182743f469ea8611ddbfe2662fd"><enum>(3)</enum><text>a detailed plan for—</text><subparagraph id="id6568c9597de94eef89178692148138e9"><enum>(A)</enum><text>monitoring the maritime domain for smuggling of Iranian-origin petroleum products in violation of sanctions imposed by the United States, including through—</text><clause id="id63c4db8fcc954de59f6948d750128ad0"><enum>(i)</enum><text>automatic identification system monitoring;</text></clause><clause id="idc5892fa49e8e474481a289398188267f"><enum>(ii)</enum><text>satellite imagery;</text></clause><clause id="id2cb36a57e7d84211a5fafb21faf33e4e"><enum>(iii)</enum><text>vessel comparison and tanker classification;</text></clause><clause id="idde9932a52c124b05a894d893f5226d64"><enum>(iv)</enum><text>receiving tips from operators; and</text></clause><clause id="id6dd8caa8524b499e81ac6ef92a6c942c"><enum>(v)</enum><text>creating a database of reported potential sanctions violations;</text></clause></subparagraph><subparagraph id="id51908c5860c745128ff12ee0ed169f26"><enum>(B)</enum><text>identifying the individuals, entities, and vessels responsible for such smuggling, including—</text><clause id="id1d7e5607709642218d9a6dc64a2ca554"><enum>(i)</enum><text>vessels—</text><subclause commented="no" display-inline="no-display-inline" id="idfbe829bd8e4d4e1bb96eb7111d6264b7"><enum>(I)</enum><text display-inline="yes-display-inline">operated by the National Iranian Tanker Company or any other Chinese or Iranian entity subject to sanctions imposed by the United States;</text></subclause><subclause id="idf26c0c9f1921439486d34fa1ef3e6ca7"><enum>(II)</enum><text>transporting petrochemicals subject to sanctions;</text></subclause><subclause id="id9aa15263df1e4339ade8a5622404da57"><enum>(III)</enum><text>conducting ship-to-ship transfers of such petrochemicals;</text></subclause><subclause id="idef2eaaa96fb84c9bb5cc17f5ef76d2ab"><enum>(IV)</enum><text>with deactivated automatic identification systems; or</text></subclause><subclause id="id73406aef7d2b4a04a03cc8d8a7acafee"><enum>(V)</enum><text>that engage in <quote>flag hopping</quote> by changing national registries;</text></subclause></clause><clause id="id84251286275c4aa5a80cb2b7045bd337" commented="no"><enum>(ii)</enum><text>individuals or entities—</text><subclause commented="no" display-inline="no-display-inline" id="id0fa2c5648f3c47f6b9b3068ff72eb00e"><enum>(I)</enum><text display-inline="yes-display-inline">storing petrochemicals subject to sanctions; or</text></subclause><subclause id="idb44771b0edc3477fa74ad9265be7a44c" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>refining or otherwise processing such petrochemicals; and</text></subclause></clause><clause id="id81a9abb88549409cb9b79c9b5791f6c8" commented="no"><enum>(iii)</enum><text>through the use of port entry and docking permission of vessels subject to sanctions;</text></clause></subparagraph><subparagraph id="id4a99b0b725b64ca6b82904fd34c7fd8c"><enum>(C)</enum><text>assessing the viability of seizing targets identified as belonging to entities smuggling Iranian-origin petroleum products in violation of sanctions imposed by the United States, including—</text><clause id="idd5ea9f271f464cfd97755b9073b83f2b"><enum>(i)</enum><text>location;</text></clause><clause id="id45ad9d2d698b488da255a3a30c8d5da2"><enum>(ii)</enum><text>origin and destination;</text></clause><clause id="id571a69395ab44e818cdfad15311a4062"><enum>(iii)</enum><text>seaworthiness; and</text></clause><clause id="idffef9951e09f4734b67e19f83068cada"><enum>(iv)</enum><text>asset value;</text></clause></subparagraph><subparagraph id="ida7407f13d6b54258be41c3608f6d4c32"><enum>(D)</enum><text>seizing, prosecuting, and, if appropriate, liquidating viable targets identified as belonging to entities involved in such smuggling;</text></subparagraph><subparagraph id="id3d2289545d8540ab900c59605759afb8"><enum>(E)</enum><text>deterring individuals and entities from violating sanctions by educating and engaging—</text><clause id="id410cec975c164457b495cfc8ff97a60c"><enum>(i)</enum><text>insurance providers;</text></clause><clause id="id08ac5f76ce8244fc940a805a5cc77b36"><enum>(ii)</enum><text>parent companies; and</text></clause><clause id="id697ccb948f574ee285ae90bf2302a0fc"><enum>(iii)</enum><text>vessel operators;</text></clause></subparagraph><subparagraph id="idb54b71203133406094cd17062567a622"><enum>(F)</enum><text>collaborating with allies and partners of the United States engaged in the Arabian Peninsula, including through standing or new maritime task forces, to build sanctions enforcement capacity through assistance and training to defense and law enforcement services; and</text></subparagraph><subparagraph id="id3a60341cf0a848178a83b2312614af65"><enum>(G)</enum><text>using public communications and global diplomatic engagements to highlight the role of petroleum product smuggling in supporting Iran’s human rights abuses and destabilizing terrorism activities; and</text></subparagraph></paragraph><paragraph id="id1e32578b3ac342d4b3a1265c718b52ce"><enum>(4)</enum><text>an assessment of—</text><subparagraph id="id7a2e1aba71d94efc949b7dd233792463"><enum>(A)</enum><text>the total number of vessels smuggling Iranian-origin petroleum products;</text></subparagraph><subparagraph id="ide5be8a4785a74047ba86224b51f8fba6"><enum>(B)</enum><text>the total number of vessels smuggling such petroleum products destined for the People's Republic of China;</text></subparagraph><subparagraph id="idb79d2ec4c41e4692a4f9bce69d4b2851"><enum>(C)</enum><text>the number of vessels smuggling such petroleum products specifically from the Islamic Revolutionary Guard Corps;</text></subparagraph><subparagraph id="ide921b62ac4ba4ed09622e48cb44eeefb"><enum>(D)</enum><text>the most strategic locations for intercepting smuggled Iranian-origin petroleum products destined for the People's Republic of China;</text></subparagraph><subparagraph id="idb8ef02d039d54209a06ecfac3da55ad2"><enum>(E)</enum><text>interference from the People's Republic of China in attempts by the United States to investigate or enforce sanctions on Iranian petroleum product exports;</text></subparagraph><subparagraph id="id997718919ddb4722873951edcf73043a"><enum>(F)</enum><text>the effectiveness of the use of sanctions with respect to insurers of entities that own or operate vessels involved in smuggling Iranian-origin petroleum products;</text></subparagraph><subparagraph id="id662960c269fe47359fec4402074aba69"><enum>(G)</enum><text>the distinction between the total number of suspected violations of sanctions related to smuggling of Iranian-origin petroleum products and the number of vessels legally viable to seize and prosecute in litigation, if any, and an accompanying explanation for each;</text></subparagraph><subparagraph id="id607dac35d8f540dbac9847c5c8f2772a"><enum>(H)</enum><text>the personnel and resources needed to enforce sanctions with respect to Iranian-origin petroleum products; and</text></subparagraph><subparagraph id="idfe35769f981f42a08763a319bc8dce36"><enum>(I)</enum><text>the impact of smuggled Iranian-origin petroleum products on global energy markets.</text></subparagraph></paragraph></subsection><subsection id="id28dc61919f574142a5997d83c36a560f"><enum>(c)</enum><header>Form</header><text>The strategy required by subsection (a) shall be submitted in unclassified form, but may include a classified index.</text></subsection></section><section id="id7aee85b947a54b7aacd8c66fa5b35655" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>5.</enum><header>Imposition of sanctions</header><subsection id="iddee5309b35ea4edd9ac0a5bc0b916bd2"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id9f5d27795b724a71bcadd693075399b2"><enum>(1)</enum><text display-inline="yes-display-inline">identify each foreign entity, including any member of the Chinese Communist Party or an entity organized under the laws of the People's Republic of China or otherwise subject to the jurisdiction of the People's Republic of China, that the President determines meets the criteria for the imposition of sanctions under—</text><subparagraph id="id42dcbe217b954dfe8fc598305a303bd6"><enum>(A)</enum><text>the Iran Sanctions Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/172">Public Law 104–172</external-xref>;<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note); </text></subparagraph><subparagraph id="id1325381e0c034bfa98708265a3d1c2c0"><enum>(B)</enum><text>the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/22/8501">22 U.S.C. 8501 et seq.</external-xref>);</text></subparagraph><subparagraph id="id62619fb73f9d4a0cb7a48e6d3713d242"><enum>(C)</enum><text>section 1245 of the National Defense Authorization Act for Fiscal Year 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/8513a">22 U.S.C. 8513a</external-xref>); </text></subparagraph><subparagraph id="id5db756f0901440e48e62d2609d64ad46"><enum>(D)</enum><text>the Iran Threat Reduction and Syria Human Rights Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/8701">22 U.S.C. 8701 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc2160d24118d42139ab3bfa83ddb3c02"><enum>(E)</enum><text>the Iran Freedom and Counter-Proliferation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/8801">22 U.S.C. 8801 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ca6967c25c9489e92058c7aa4f4c743"><enum>(F)</enum><text>title I of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9401">22 U.S.C. 9401 et seq.</external-xref>);</text></subparagraph><subparagraph id="idca39fb6fef194179bbee043abcead414"><enum>(G)</enum><text>any Executive order imposing sanctions with respect to Iran issued under the authority provided by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>); or </text></subparagraph><subparagraph id="idc49c65a4cd074e3186b7063ea36e6d52"><enum>(H)</enum><text>any other provision of law imposing sanctions with respect to Iran; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd652acdb0aba48e383a69f295812decb"><enum>(2)</enum><text>impose sanctions applicable under existing law with respect to each such entity. </text></paragraph></subsection><subsection id="idfbd203fe7da34d4ba35e0776b05a5607"><enum>(b)</enum><header>Report required</header><text>Not later than 30 days after the imposition of sanctions under subsection (a) with respect to a foreign entity, the President shall submit to the appropriate congressional committees a report on the sanctions imposed. </text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id2ab8ee86-e43e-4b35-bc4c-ab478b4e2dfd" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Iranian Terrorism Act of 2024</short-title></quote>.</text></section><section id="idfce70fc7-475d-4a71-b3f1-4b98f44423ad" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="ide97497d9-c201-4493-b4f3-7c4b12beaf01"><enum>(1)</enum><text>the Islamic Republic of Iran has long provided hundreds of millions of dollars in material support to Hamas and other terrorist groups, such as Palestinian Islamic Jihad, that directly threaten Israel;</text></paragraph><paragraph id="id7c9ac647-436a-4cee-97dc-34f89e9dccce"><enum>(2)</enum><text>Iran poses a threat to regional and global security and has earned approximately $80,000,000,000 in oil revenues since 2021;</text></paragraph><paragraph id="id08a8c920-6dce-4c25-abe2-9e8eef511d25"><enum>(3)</enum><text>the People’s Republic of China, seeking to secure reliable sources of Middle Eastern energy, has purchased roughly $47,000,000,000 in Iranian petroleum products since 2021 and is undercutting the enforcement of sanctions imposed by the United States with respect to Iran;</text></paragraph><paragraph id="id9f1c8260-9570-4698-b50c-1519a49b69d9"><enum>(4)</enum><text>illicit purchases of Iranian petroleum products by the People's Republic of China and other countries fund the Iranian regime’s suppression of human rights in Iran, provide valuable resources for Iran’s terrorist proxies, and provide additional resources for support by Iran for the Russian Federation in its unprovoked war in Ukraine, contrary to United States policy;</text></paragraph><paragraph id="id08b30df1-cadb-4526-852c-5d8eddc60ed7"><enum>(5)</enum><text>lack of sanctions and sanctions enforcement directly undercuts United States policy objectives in the Indo-Pacific region, Europe, the Middle East, and beyond;</text></paragraph><paragraph id="id778d42e8-3f06-4b34-985a-d7713a56f9ca"><enum>(6)</enum><text>increasing encroachment by the People's Republic of China in the Middle East and North Africa, including involvement of the People's Republic of China in illicit oil trade, runs counter to the national security interests of the United States; and</text></paragraph><paragraph id="id05420e50-4e0e-4aeb-8e19-dfc8e488e308"><enum>(7)</enum><text>the United States should immediately enforce existing sanctions, including sanctions provided for in Executive Order 13846 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to reimposing certain sanctions with respect to Iran), and expand sanctions designations to include persons that store Iranian oil, ship-to-ship oil transfer operators, ports and port operators, refineries and refinery operators, and other individuals and entities, particularly in the People's Republic of China, dealing in Iranian-origin oil and petrochemicals.</text></paragraph></section><section id="id6f3173d6-cfd1-44cf-bc29-09cce52953f9" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>3.</enum><header>Appropriate congressional committees defined</header><text display-inline="no-display-inline">In this Act, the term <term>appropriate congressional committees</term> means—</text><paragraph id="id2a61495c-149b-4dee-80eb-2f5167fe7ff9"><enum>(1)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</text></paragraph><paragraph id="id4fa36c64-7c12-41f2-84f1-396fdd6ad246"><enum>(2)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives.</text></paragraph></section><section id="id3de534a7bb8148f494efac9ad838bfff" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>4.</enum><header>Strategy to counter role of the People’s Republic of China in evasion of sanctions with respect to Iran</header><subsection id="idc54fecc2878d4e67a55ccecb0fbeccd5"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of State, in consultation with the heads of other appropriate Federal agencies, shall submit to the appropriate congressional committees a written strategy, and provide to those committees an accompanying briefing, on the role of the People’s Republic of China in evasion of sanctions imposed by the United States with respect to Iranian-origin petroleum products that includes an assessment of options—</text><paragraph id="id8f930cf00d0f4395bbc407cc48507faa"><enum>(1)</enum><text>to strengthen the enforcement of such sanctions; and</text></paragraph><paragraph id="id774bbab18df94d55abe8a3a182ed83ac"><enum>(2)</enum><text>to expand sanctions designations targeting the involvement of the People’s Republic of China in the production, transportation, storage, refining, and sale of Iranian-origin petroleum products.</text></paragraph></subsection><subsection id="id22ec069734754569a1e00e9c0d3d44a1"><enum>(b)</enum><header>Elements</header><text>The strategy required by subsection (a) shall include—</text><paragraph id="id6f5526117e0e45bfa69be80a136904a6"><enum>(1)</enum><text>a description and assessment of the use of sanctions in effect before the date of the enactment of this Act to target individuals and entities of the People’s Republic of China that are directly or indirectly associated with smuggling of Iranian-origin petroleum products;</text></paragraph><paragraph id="ide2ddf0d0b7da4469ae2525d12ea73869"><enum>(2)</enum><text>an assessment of—</text><subparagraph id="id39272c657d7f420c9205bf48279fc418"><enum>(A)</enum><text>Iranian-owned entities operating in the People’s Republic of China and involved in petroleum refining supply chains;</text></subparagraph><subparagraph id="id6e489e1e9f8449b8bee7e29a224244ef"><enum>(B)</enum><text>the People’s Republic of China’s role in global petroleum refining supply chains;</text></subparagraph><subparagraph id="idccca16567b774bbfb9fe7bf2e2a7b32d"><enum>(C)</enum><text>how the People’s Republic of China leverages its role in global petroleum supply chains to achieve political objectives;</text></subparagraph><subparagraph id="id8178037d90c4444297e234cda57191c4"><enum>(D)</enum><text>the People’s Republic of China’s petroleum importing and exporting partners;</text></subparagraph><subparagraph id="id5a31ddd4e95842c5a75963593c54d6b4"><enum>(E)</enum><text>what percent of the People’s Republic of China’s energy consumption is linked to illegally imported Iranian-origin petroleum products; and</text></subparagraph><subparagraph id="ided65cdb968824656bba33d0fe39db753"><enum>(F)</enum><text>what level of influence the Chinese Communist Party holds over non-state, semi-independent <quote>teapot</quote> refineries;</text></subparagraph></paragraph><paragraph id="id0a41b3463af9494186b096a2c16a872f"><enum>(3)</enum><text>a detailed plan for—</text><subparagraph id="idfc194cf0d22141c089eee0b90fc3d791"><enum>(A)</enum><text>monitoring the maritime domain for sanctionable activity related to smuggling of Iranian-origin petroleum products;</text></subparagraph><subparagraph id="id3c60bab40d17475294d26bd56f24b3bf"><enum>(B)</enum><text>identifying the individuals, entities, and vessels engaging in sanctionable activity related to Iranian-origin petroleum products, including—</text><clause id="idefe3b87f1a394bba8e2d494e330fe7a3"><enum>(i)</enum><text>vessels—</text><subclause id="idc7263bdba9484a22afb32384f04ab538"><enum>(I)</enum><text>transporting petrochemicals subject to sanctions;</text></subclause><subclause id="id4937a49bccf84dda9d0da254f6e0f46f"><enum>(II)</enum><text>conducting ship-to-ship transfers of such petrochemicals;</text></subclause><subclause id="id1a31c4751af44b7986b4ec7dbcee0684"><enum>(III)</enum><text>with deactivated automatic identification systems; or</text></subclause><subclause id="idaa90cc580e3745708db479ccb36dc3c1"><enum>(IV)</enum><text>that engage in <quote>flag hopping</quote> by changing national registries;</text></subclause></clause><clause id="id7d720a75c11a4d759ed0d049fa2f9969"><enum>(ii)</enum><text>individuals or entities—</text><subclause id="id32dae17ed08046ae82f8a94be80c7512"><enum>(I)</enum><text>storing petrochemicals subject to sanctions; or</text></subclause><subclause id="id186506cb9cb34acaaaba1880920a2b0f"><enum>(II)</enum><text>refining or otherwise processing such petrochemicals; and</text></subclause></clause><clause id="id7b53bb48d9a442adbaa40171a42b2722"><enum>(iii)</enum><text>through the use of port entry and docking permission of vessels subject to sanctions;</text></clause></subparagraph><subparagraph id="id1457987ce0af421587857d74f9202f94"><enum>(C)</enum><text>deterring individuals and entities from violating sanctions by educating and engaging—</text><clause id="id7c400b91e85346ec9b0ee68fa8df1437"><enum>(i)</enum><text>insurance providers;</text></clause><clause id="id9946ef8cfdb546e7beddf6a04fc0bd47"><enum>(ii)</enum><text>parent companies; and</text></clause><clause id="id1bd2a50fae6847c1977588e1665c5821"><enum>(iii)</enum><text>vessel operators;</text></clause></subparagraph><subparagraph id="id46cc668092ce45ec9390afd2c536970e"><enum>(D)</enum><text>collaborating with allies and partners of the United States engaged in the Arabian Peninsula, including through standing or new maritime task forces, to build sanctions enforcement capacity through assistance and training to defense and law enforcement services; and</text></subparagraph><subparagraph id="id83161dd15be54fb083c3f338991577f4"><enum>(E)</enum><text>using public communications and global diplomatic engagements to highlight the role of illicit petroleum product smuggling in bolstering Iran’s support for terrorism and its nuclear program; and</text></subparagraph></paragraph><paragraph id="idca58daa99cc7458bb7a555f8a2135f78"><enum>(4)</enum><text>an assessment of—</text><subparagraph id="id9f91376ca1d0467bbc3beaa71ecf6325"><enum>(A)</enum><text>the total number of vessels smuggling Iranian-origin petroleum products;</text></subparagraph><subparagraph id="idc9fd448fa9064e2fba1595a79488d05b"><enum>(B)</enum><text>the total number of vessels smuggling such petroleum products destined for the People’s Republic of China;</text></subparagraph><subparagraph id="idece73ba5246443bd96f16f4a813577cd"><enum>(C)</enum><text>the number of vessels smuggling such petroleum products specifically from the Islamic Revolutionary Guard Corps;</text></subparagraph><subparagraph id="id70de529e1ba646bdb7d001182890cd38"><enum>(D)</enum><text>interference by the People’s Republic of China with attempts by the United States to investigate or enforce sanctions on illicit Iranian petroleum product exports;</text></subparagraph><subparagraph id="id84ade7cc83d4454d882bb8957a543f0a"><enum>(E)</enum><text>the effectiveness of the use of sanctions with respect to insurers of entities that own or operate vessels involved in smuggling Iranian-origin petroleum products;</text></subparagraph><subparagraph id="idfac58fece7584741aa0aa7cd6a45eb13"><enum>(F)</enum><text>the personnel and resources needed to enforce sanctions with respect to Iranian-origin petroleum products; and</text></subparagraph><subparagraph id="id9976c915e1f94361ac45670fa6ba74b1"><enum>(G)</enum><text>the impact of smuggled illicit Iranian-origin petroleum products on global energy markets.</text></subparagraph></paragraph></subsection><subsection id="id1cefcf0702f34bb79505b56779747a2c"><enum>(c)</enum><header>Form</header><text>The strategy required by subsection (a) shall be submitted in unclassified form, but may include a classified index. </text></subsection></section><section id="id4d8030ba-4c25-4b4d-8ac1-948ec621e17a" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>5.</enum><header>Imposition of sanctions</header><subsection id="id6a4dce1a-d8bf-4da0-9142-082717124ad3"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id0a543ed7-a05a-456c-ac9c-cbc396b88847"><enum>(1)</enum><text display-inline="yes-display-inline">identify each foreign entity, including any member of the Chinese Communist Party or any entity organized under the laws of the People's Republic of China or otherwise subject to the jurisdiction of the People's Republic of China, that the President determines meets the criteria for the imposition of sanctions under—</text><subparagraph id="idb7aff99c-9d51-4482-9942-c7ae6f07e101"><enum>(A)</enum><text>the Iran Sanctions Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/172">Public Law 104–172</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note); </text></subparagraph><subparagraph id="id2b51f555-4865-4344-ab8c-79218e6ed7f5"><enum>(B)</enum><text>the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/22/8501">22 U.S.C. 8501 et seq.</external-xref>);</text></subparagraph><subparagraph id="id16b85752-a517-42da-811c-a16b49bd6d9f"><enum>(C)</enum><text>section 1245 of the National Defense Authorization Act for Fiscal Year 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/8513a">22 U.S.C. 8513a</external-xref>); </text></subparagraph><subparagraph id="idbc2e0fd3-4573-4645-a2e9-5a0e5fda7524"><enum>(D)</enum><text>the Iran Threat Reduction and Syria Human Rights Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/8701">22 U.S.C. 8701 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8f1bb7c6-b622-45cd-9799-905e3c70c7c9"><enum>(E)</enum><text>the Iran Freedom and Counter-Proliferation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/8801">22 U.S.C. 8801 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf099f92f-29f2-4198-a2cf-cf3f0dd93307"><enum>(F)</enum><text>title I of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9401">22 U.S.C. 9401 et seq.</external-xref>);</text></subparagraph><subparagraph id="id69c0e638-396d-40f6-865f-fd5df86c2ba2"><enum>(G)</enum><text>any Executive order imposing sanctions with respect to Iran issued under the authority provided by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>); or </text></subparagraph><subparagraph id="idff746aa7-4f13-4319-adcd-45bb395a9f7c"><enum>(H)</enum><text>any other provision of law imposing sanctions with respect to Iran; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf4b465c3-57be-4df3-9123-bf1c886036d0"><enum>(2)</enum><text>impose sanctions applicable under existing law with respect to each such entity. </text></paragraph></subsection><subsection id="idcddf97be-d607-4036-8ad9-edc5e529019d" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report required</header><text>Not later than 30 days after the imposition of sanctions under subsection (a) with respect to a foreign entity, the President shall submit to the appropriate congressional committees a report on the sanctions imposed. </text></subsection><subsection id="idd1c14086017444a698fb89767bee2af4"><enum>(c)</enum><header>Waiver</header><paragraph id="idc002dcbe70a649299266e85dd55c7bdf"><enum>(1)</enum><header>In general</header><text>The President may waive the application of sanctions under this section for renewable periods not to exceed 180 days if the President—</text><subparagraph id="id02e537bfe8334e3dba251ded7cbb023c"><enum>(A)</enum><text>determines that such a waiver is in the national security interests of the United States; and</text></subparagraph><subparagraph id="id4521efb082394c62b3c69e69b8e9560c"><enum>(B)</enum><text>not less than 15 days before the granting of the waiver, submits to the appropriate congressional committees a notice of and justification for the waiver.</text></subparagraph></paragraph><paragraph id="id8ea0f85899ed42eba110d791789ca7fc"><enum>(2)</enum><header>Form</header><text>A notice described in paragraph (1)(B) may be submitted in classified form. </text></paragraph></subsection></section><section id="id65a1830bf0e94de4902efaee2ac7207f" changed="added" reported-display-style="italic"><enum>6.</enum><header>Report on impacts on the Islamic Republic of Iran of sanctions imposed by the United States</header><subsection id="id157477a6d52c489fbd71000aefb1ed08"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment this Act, the Secretary of State, in consultation with the Secretary of the Treasury and drawing on subject-matter experts including economists and statisticians from the Department of State and the Department of the Treasury, shall submit to the appropriate congressional committees a report on the impacts on the Islamic Republic of Iran of sanctions imposed by the United States. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="iddff3ad25e7944fab94c80ca7f41b2ce7"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The report required by subsection (a) shall include an assessment of the following:</text><paragraph id="idc8eeb49f05cc4ba891b0c444311a16fb"><enum>(1)</enum><text>The impact of sanctions imposed by the United States on the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id369e24cee12e463882fa5f8acb2c57f4"><enum>(A)</enum><text display-inline="yes-display-inline">Problematic activities and policies of the Islamic Republic of Iran, including ballistic missile development, proliferation of Iranian drones and missiles to state and non-state actors, uranium enrichment, and funding of terrorist groups in the <quote>Axis of Resistance</quote>, and how sanctions have meaningfully impacted the ability of such groups to operate.</text></subparagraph><subparagraph id="iddc9f6e5961de41778a2fea8c53b090cb"><enum>(B)</enum><text>Key officials of the Iranian regime, including their access to alternative financial markets, their standard of living, and impacts to their personal wealth.</text></subparagraph><subparagraph id="ided7096af5df245af8cd9ce093018d0ce"><enum>(C)</enum><text>The operations of independent civil society organizations in Iran, including the ability of such organizations to access products that would allow them to document and share human rights abuses, promote democratic norms, and engage in political dissent.</text></subparagraph><subparagraph id="id6f8b264b12f34058855c8ed5970d4609"><enum>(D)</enum><text>The efficacy of licensing actions aimed at ensuring the people of Iran have access to circumvention technologies around Iranian regime firewalls and censors to promote internet freedom, including General License D-2 of the Department of the Treasury. </text></subparagraph><subparagraph id="id2339bc9572ac48af9225dc2c8347cf5f"><enum>(E)</enum><text>The standard of living of the people of Iran, including—</text><clause commented="no" display-inline="no-display-inline" id="iddffd64e7adf54ee4b39f9ab606a29709"><enum>(i)</enum><text display-inline="yes-display-inline">the impact on the purchasing power of the people of Iran and their ability to afford and acquire food and medicine; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id1ace8e6dec844653a55f0d0db6a28457"><enum>(ii)</enum><text display-inline="yes-display-inline">changes in the size of the working and middle classes in Iran, including impacts to the poverty rate in Iran.</text></clause></subparagraph><subparagraph id="id64a0433f912749dd97b001420795666e"><enum>(F)</enum><text>The growth of unofficial economies controlled by officials of the Iranian regime and members of the Islamic Revolutionary Guard Corps.</text></subparagraph></paragraph><paragraph id="idf654014b153b45449b63c37cf6b731f3"><enum>(2)</enum><text>What industries in Iran remain unaffected by such sanctions. </text></paragraph></subsection></section><section id="id74c1c014dbad4a049c827baa4da17529" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>7.</enum><header>Exceptions</header><subsection id="id6b9a1e49009e4e32be90566e54625c2a"><enum>(a)</enum><header>Exception relating to importation of goods</header><paragraph id="idf87d68ae3f484c2a874aa17a68d556d3"><enum>(1)</enum><header>In general</header><text>A requirement to block and prohibit all transactions in all property and interests in property under this Act shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></paragraph><paragraph id="idd904639a0da64c9493fe5ab5450b390f"><enum>(2)</enum><header>Good</header><text>In this subsection, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data.</text></paragraph></subsection><subsection id="idc5a9b4ce18144ba7b14cd0cb76ea8088"><enum>(b)</enum><header>Exception to comply with united nations headquarters agreement and law enforcement activities</header><text>Sanctions under this Act shall not apply with respect to the admission of an alien to the United States if admitting or paroling the alien into the United States is necessary—</text><paragraph id="id540c180629c24a5ea990e7fcb0fd7cf4"><enum>(1)</enum><text>to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States; or</text></paragraph><paragraph id="id703734f9581b405396bc19fcc36f0f6b"><enum>(2)</enum><text>to carry out or assist authorized law enforcement activity in the United States.</text></paragraph></subsection><subsection id="id028ef1e6ce504ebc90f04cc9983e28d6"><enum>(c)</enum><header>Exception to comply with intelligence activities</header><text>Sanctions under this Act shall not apply to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or any authorized intelligence activities of the United States.</text></subsection><subsection id="id878df079c1a1492abbedcade8d08c436"><enum>(d)</enum><header>Humanitarian assistance</header><paragraph commented="no" display-inline="no-display-inline" id="id04df6e01205a4ba8b9755030a33dc2f3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Sanctions under this Act shall not apply to—</text><subparagraph id="ida314a9122dbc4a20a1e156976d521509"><enum>(A)</enum><text>the conduct or facilitation of a transaction for the provision of agricultural commodities, food, medicine, medical devices, humanitarian assistance, or for humanitarian purposes; or</text></subparagraph><subparagraph id="idee160e0e376841eebe274d3dc196dc1e"><enum>(B)</enum><text>transactions that are necessary for or related to the activities described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id8a3b4bd99d874d81a89ae1c695eb1ed5"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id0b1e7ec1c66d4317aa0f6a2dc808509f"><enum>(A)</enum><header>Agricultural commodity</header><text>The term <term>agricultural commodity</term> has the meaning given that term in section 102 of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5602">7 U.S.C. 5602</external-xref>).</text></subparagraph><subparagraph id="id40df72e3c8374653b6c53c0c4df751e0"><enum>(B)</enum><header>Medical device</header><text>The term <term>medical device</term> has the meaning given the term <term>device</term> in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text></subparagraph><subparagraph id="idc1079da210b04b38bd5f4080b4de016e"><enum>(C)</enum><header>Medicine</header><text>The term <term>medicine</term> has the meaning given the term <term>drug</term> in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="idb467e2d461d843419070d1c2e00e1361"><enum>(e)</enum><header>Report on exceptions</header><text>Not later than one year after the date of the enactment of this Act, and annually thereafter, the President shall submit to the appropriate congressional committees a report that describes each activity that would be subject to sanctions under this Act if not excepted pursuant to subsection (b) or (c). </text></subsection></section></legis-body><endorsement><action-date date="20240507">May 7, 2024</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
