<congress display="yes">118th CONGRESS</congress><session display="yes">2nd Session</session><legis-num display="yes">S. 2116</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To require the Secretary of Commerce to produce a report that provides recommendations to improve the effectiveness, efficiency, and impact of Department of Commerce programs related to supply chain resilience and manufacturing and industrial innovation, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="id92927c15-b662-4c9e-8369-125028cf0e60" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Support for American Manufacturing Act</short-title></quote>.</text></section><section id="id2d072bf5-25fa-4640-b8f8-dedfb6aed42e" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idd9cc311e-f011-4fda-a0e4-4ea408e7bb83" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <quote>appropriate committees of Congress</quote> means—</text><subparagraph id="idbbc675b4-b168-4b6a-b8ef-c7ba83f52b17" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph><subparagraph id="ida7f4f154-8e68-439a-b6ed-03892814f7f5" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idc209dedf-54fb-420b-ac89-b704101e60e7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Covered offices and bureaus</header><text display-inline="yes-display-inline">The term <quote>covered offices and bureaus</quote> means offices and bureaus of the Department of Commerce identified under section 3(a)(1). </text></paragraph><paragraph id="idcd8364c4be42486cbc96115851b4c768" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Critical supply chain</header><text display-inline="yes-display-inline">The term <term>critical supply chain</term> means an end-to-end system that converts raw materials into finished products in critical sectors, including in—</text><subparagraph id="id4ad9bbb0eaac44c8b283deb4c07cf058" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the defense industrial base;</text></subparagraph><subparagraph id="idacaf3efebdf14ec49b80aa4dd37aa10e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the public health and biological preparedness industrial base;</text></subparagraph><subparagraph id="id1fd9697a1311495b8d8dbb6dbe7f3986" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the information and communications technology industrial base;</text></subparagraph><subparagraph id="ida2a5920152fe461a83e17e390bfb4ebe" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the energy sector industrial base;</text></subparagraph><subparagraph id="id77af7662f8944bf293512854fffcc66d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the transportation industrial base; and</text></subparagraph><subparagraph id="id0425efe400834a5f843685322e844616" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">agricultural supply chains.</text></subparagraph></paragraph><paragraph id="id59a20b0922a049438f7d478d0c864b69" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Critical supply chain resilience</header><text display-inline="yes-display-inline">The term <term>critical supply chain resilience</term> means mitigating gaps and vulnerabilities in critical supply chains, including by—</text><subparagraph id="id5b0be62a5fdd49598bee9a1cc0d1c222" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">reducing risk of malicious sabotage or external or internal manipulation; and</text></subparagraph><subparagraph id="idf2117cdbcd1048229359ab135cda3530" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">improving the ability to withstand supply chain interruptions such as logistical challenges and workforce, materials, equipment, or product shortages. </text></subparagraph></paragraph><paragraph id="ide22a92e8522b4262bf3e7b65864b8593" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Manufacturing and industrial innovation</header><text display-inline="yes-display-inline">The term <term>manufacturing and industrial innovation</term> means—</text><subparagraph id="id800a0a9d533b4fbb8bbc03b02742ec7e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">providing assistance, resources, or services to manufacturers or manufacturing workers in the United States;</text></subparagraph><subparagraph id="id3703233a670142a983ac5aef97402078" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">offering expertise, improvements, research, and development or other assistance in technological innovations or advanced manufacturing in partnership with or for use by manufacturers in the United States; or</text></subparagraph><subparagraph id="id4b536b33d21e48079ea43564af9b50e7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">developing policy that substantially impacts the manufacturing sector in the United States. </text></subparagraph></paragraph><paragraph id="id932cae42-410b-492a-9802-18dee10066d9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of Commerce.</text></paragraph></section><section id="id86a6a9d2-4122-40e7-9ede-eb2f16bef9b7" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Study relating to manufacturing programs of the Department of Commerce</header><subsection id="id470bbf8e-c0d5-443e-964d-5af022c42fbb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Assessment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall produce a report that—</text><paragraph id="id6dd3f6b6-621a-4251-ac56-2ed89afdfda1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">identifies offices and bureaus of the Department of Commerce with responsibilities related to— </text><subparagraph id="iddbd764d9-d055-42e2-aee1-c4f9c6272df8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">critical supply chain resilience; and</text></subparagraph><subparagraph id="ide610bf77-363b-4fc0-afc1-cfeeda29efd9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">manufacturing and industrial innovation;</text></subparagraph></paragraph><paragraph id="id824a1bf8-3493-4841-9eaa-96dc6c487b28" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">identifies the duties, responsibilities, programs, and expertise relevant to critical supply chain resilience and manufacturing and industrial innovation of each covered office and bureau; </text></paragraph><paragraph id="ida1a5eef4-de74-41e2-ac37-563e41a69fa7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">identifies and assesses the purpose, statutory authority, effectiveness, efficiency, and limitations of each covered office and bureau; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfb9692dfbb604646a48673206e12d9af" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">identifies gaps between offices with duplicative duties responsibilities, programs, and expertise within the Department of Commerce that are implementing activities related to critical supply chain resilience and manufacturing and industrial innovation; and </text></paragraph><paragraph id="id6a449e47-1d2e-4239-9c52-e581eefa83fb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">provides recommendations to improve the effectiveness, efficiency, and impact of each covered office and bureau, including recommendations to—</text><subparagraph id="ide7379f05-758b-4238-a6e7-33438fcb6157" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">optimize operations within or across covered offices and bureaus;</text></subparagraph><subparagraph id="id7f8a3031-8629-4a51-8098-08a722ff7df6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">improve coordination across covered offices and bureaus; and</text></subparagraph><subparagraph id="id60bc5ff1-b1cb-4e82-a728-a85ff1554017" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">improve coordination with Federal agencies implementing similar activities related to critical supply chain resilience and manufacturing and industrial innovation.</text></subparagraph></paragraph></subsection><subsection id="id8b8239b8-67e0-4f9b-800e-235082daf3dc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">National Academy of Public Administration</header><text display-inline="yes-display-inline">The Secretary shall contract with the National Academy of Public Administration in producing the report under subsection (a).</text></subsection><subsection id="id7a5b747b-bd0c-465c-8f47-c3e534afa9c1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Secretary produces the report under subsection (a), the Secretary shall submit to the appropriate committees of Congress— </text><paragraph id="id51164843-3d06-48f4-a376-03274e6db6eb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the report produced under subsection (a); </text></paragraph><paragraph id="id8fb35f2d-2f1a-49ed-b75e-8dba51e36694" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations for potential legislative action addressing recommendations in the report produced under subsection (a); and</text></paragraph><paragraph id="id3e3aea10-f347-47ae-9dd7-960393dcfbcc" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">a response from the Secretary to the recommendations included in the report produced under subsection (a). </text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20240430" chamber="Senate">Passed the Senate April 30, 2024.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
