<section display-inline="yes-display-inline" section-type="undesignated-section" id="H7c9e9cab-fd31-408e-9b16-7cef388934aa"><enum/><text display-inline="yes-display-inline">That at any time after adoption of this resolution the Speaker may, pursuant to clause 2(b) of rule XVIII, declare the House resolved into the Committee of the Whole House on the state of the Union for consideration of the bill (H.R. 8774) making appropriations for the Department of Defense for the fiscal year ending September 30, 2025, and for other purposes. The first reading of the bill shall be dispensed with. All points of order against consideration of the bill are waived. General debate shall be confined to the bill and shall not exceed one hour equally divided and controlled by the chair and ranking minority member of the Committee on Appropriations or their respective designees. After general debate the bill shall be considered for amendment under the five-minute rule. An amendment in the nature of a substitute consisting of the text of Rules Committee Print 118–40 shall be considered as adopted in the House and in the Committee of the Whole. The bill, as amended, shall be considered as the original bill for the purpose of further amendment under the five-minute rule and shall be considered as read. All points of order against provisions in the bill, as amended, are waived.</text></section> <section id="H598C007757F3405B8574F047062B4D35"><enum>2.</enum> <subsection commented="no" display-inline="yes-display-inline" id="H01DA0761BCBE49A08E7A3F85BF940AE7"><enum>(a)</enum><text>No further amendment to H.R. 8774, as amended, shall be in order except those printed in part A of the report of the Committee on Rules accompanying this resolution, amendments en bloc described in section 3 of this resolution, and pro forma amendments described in section 4 of this resolution.</text></subsection>

The previous question shall be considered as ordered on the bill, as amended, and on any further amendment thereto to final passage without intervening motion except one motion to recommit.</text></section> <section id="H1FCC833B9C0E4364BDFF4B2C115B2BCB"><enum>16.</enum><text display-inline="yes-display-inline">The Clerk shall not transmit to the Senate a message that the House has passed H.R. 8752 until notified by the Speaker that H.R. 2, as passed by the House on May 11, 2023, has been enacted into law.</text></section>
<section id="H7A4413324E884A4BB015237E39FC76F3"><enum>17.</enum><text display-inline="yes-display-inline">The amendment referred to in section 11 of this resolution is as follows:</text> <paragraph id="HEA47085A0BAD4C5A91EEE1BA3A4B6E62"><enum/><text><quote>Strike section 406 and strike section 413 and insert SEC.___. Notwithstanding the numerical limitation set forth in section 214(g)(1)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(1)(B)</external-xref>), the Secretary of Homeland Security, after consultation with the Secretary of Labor, and upon determining that the needs of American businesses cannot be satisfied during fiscal year 2025 with United States workers who are willing, qualified, and able to perform temporary nonagricultural labor, may increase the total number of aliens who may receive a visa under section 101(a)(15)(H)(ii)(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(ii)(b)</external-xref>) in such fiscal year above such limitation by not more than the highest number of H–2B nonimmigrants who participated in the H–2B returning worker program in any fiscal year in which returning workers were exempt from such numerical limitation.</quote>.</text></paragraph></section>
