which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Demanding that the Government of the People’s Republic of China and the Chinese Communist Party immediately release Kai Li.</official-title></form><preamble><whereas><text>Whereas Kai Li is being unjustly and arbitrarily detained by the Government of the People’s Republic of China, according to the United States Government;</text></whereas><whereas><text>Whereas Kai Li is a United States citizen from Long Island and is a resident of New York;</text></whereas><whereas><text>Whereas, on September 9, 2016, Kai Li was whisked away by agents from the Shanghai State Security Bureau;</text></whereas><whereas><text>Whereas he was not allowed to have access to legal counsel while being harshly interrogated every single day at an unknown location for almost 3 months by state security agents;</text></whereas><whereas><text>Whereas, on November 25, 2016, Chinese agents moved Kai to the Shanghai No. 1 Detention Center, where he would end up spending 28 months;</text></whereas><whereas><text>Whereas, despite being informed that Kai’s case had been escalated for prosecution, officials still refused him access to legal counsel on the grounds that it would <quote>endanger national security</quote>, even though Article 33 of China’s Criminal Procedure Law ostensibly allows defendants to <quote>entrust a defender after he/she is interrogated for the first time</quote>;</text></whereas><whereas><text>Whereas, on February 24, 2017, the procuratorate finally accepted Kai’s case nearly 6 months after his initial arrest, which enabled him to finally meet with his attorney;</text></whereas><whereas><text>Whereas, on August 10, 2017, Kai’s trial was held by the Shanghai No. 1 Intermediate People’s Court after 2 unexplained adjournments, with United States diplomats prevented from attending, in apparent violation of Article 35 of the United States-China bilateral consular convention;</text></whereas><whereas><text>Whereas, on his 55th birthday, Kai and his attorney were notified that following the trial, the case had been returned to the procuratorate for <quote>supplemental investigation</quote> on September 30, 2017, before being returned to the Court on October 29;</text></whereas><whereas><text>Whereas, on July 25, 2018, Kai was concurrently sentenced to 10 years in prison, a 50,000 renminbi (RMB) fine, and deportation;</text></whereas><whereas><text>Whereas Kai’s crime was deemed <quote>serious</quote>, and thus punishable by anywhere from 10 years fixed imprisonment to life imprisonment;</text></whereas><whereas><text>Whereas, on February 22, 2019, Kai was transferred from the center to Qingpu Prison just over a month after his appeal hearing, which enabled him to receive semi-monthly visits from family in China, and to make 2 7-and-a-half minute phone calls a month to his wife and son in the United States; and</text></whereas><whereas><text>Whereas, during his time in prison, Kai has suffered a stroke and other health related issues: Now, therefore, be it</text></whereas></preamble><resolution-body style="traditional" id="H63C0E77794C14DC487F108CF1E4755A6"><section id="H84F58EBD8DE84D3BB2D355D7113306ED" section-type="undesignated-section" display-inline="yes-display-inline"><enum/><text display-inline="yes-display-inline">That the House of Representatives—</text><paragraph id="HFD111693D8EC425BAE001798A2431533"><enum>(1)</enum><text>demands that the Government of the People’s Republic of China and the Chinese Communist Party immediately release Kai Li;</text></paragraph><paragraph id="H05445735B4F14C23B0BB7859B0913EE1"><enum>(2)</enum><text>condemns the Government of the People’s Republic of China and the Chinese Communist Party for refusing to provide Kai Li with—</text><subparagraph id="H0172118BBD994C14BBA63A7353B9E73C"><enum>(A)</enum><text>regular unmonitored communication with his family;</text></subparagraph><subparagraph id="H1536B0F3D0BC4298AF0F103D5BC88CEA"><enum>(B)</enum><text>access to United States diplomats; and</text></subparagraph><subparagraph id="HF21091E369584F3FAC61BC2508EDDCC2"><enum>(C)</enum><text>independent and competent medical care and evaluation; and</text></subparagraph></paragraph><paragraph id="H305F54B7FB064840AC00AEEA9BE1EC9D"><enum>(3)</enum><text>calls for the United States Government to deepen and prioritize efforts to secure the release of Kai Li, including by—</text><subparagraph id="H31B40578F5B44841B5F156A8AC69C07C"><enum>(A)</enum><text display-inline="yes-display-inline">urging counterparts of the People’s Republic of China at every level of engagement to release Kai Li; and</text></subparagraph><subparagraph id="H0270F74A0F324CA781998099E29AA32A"><enum>(B)</enum><text>using the voice and vote of United States diplomats in international forums to highlight Kai Li’s case.</text></subparagraph></paragraph></section></resolution-body></resolution>
