which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Transportation to issue a final rule setting minimum structural standards for railroad bridges, and for other purposes.</official-title></form><legis-body id="HB751794B37554836B8D0A30931A6BAAE" style="OLC"><section id="H197F360CCCE04D309F36E4A499EB741B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rail Bridge Safety and Transparency Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HDA41027B0C1345CDA0CE8ADC8BE32BB2"><enum>2.</enum><header>Railroad bridge safety</header><subsection commented="no" display-inline="no-display-inline" id="H2501F80636E94D2986FE00E829EF0310"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Section 20145 of title 49, United States Code is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H1E4783BD82E140C0972111AEAD00320A"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HC46C6ED081A349EDAF3A00480C5556E5"><enum>20145.</enum><header display-inline="yes-display-inline">Railroad bridge safety</header><subsection commented="no" display-inline="no-display-inline" id="HD9F552368CA24AB580C01047E2908AE9"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H25C8BA55E46C4B9CA52C49AC95849A8B"><enum>(1)</enum><header>Class I railroad; Class II railroad; Class III railroad; railroad; railroad carrier</header><text>The terms <term>Class I railroad</term>, <term>Class II railroad</term>, <term>Class III railroad</term>, <term>railroad</term>, and <term>railroad carrier</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7C4E011B06D548C691850D54893A3D20"><enum>(A)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B), have the meanings given such terms in section 20102; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H950A919363034FF0B539BD7712303932"><enum>(B)</enum><text>do not include—</text><clause commented="no" display-inline="no-display-inline" id="H0E701E0E2FF84A90BEB3C37FF0F1737E"><enum>(i)</enum><text display-inline="yes-display-inline">the National Railroad Passenger Corporation (commonly referred to as <quote>Amtrak</quote>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="H44EC79AD67084BD38B1936E37F339FF1"><enum>(ii)</enum><text display-inline="yes-display-inline">rail carriers that have the principal purpose of providing commuter rail passenger transportation (as defined in section 24102). </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H416672F9B51E4DBD9DD199203257F543"><enum>(2)</enum><header>Component part</header><text>The term <term>component part</term>, with respect to a railroad bridge, includes the substructure, superstructure, deck, bearings, railings, joints, and the rails on the track of such bridge.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H782687DF35A843A38819B65244369986"><enum>(3)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Transportation.</text></paragraph><paragraph id="H8F216BFDD69D439D9A0EB8AB6682737A"><enum>(4)</enum><header>Eligible requesting party</header><text>The term <term>eligible requesting party</term> means a party authorized to request a bridge inspection report in accordance with section 417(d)(2)(A) of the Rail Safety Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/49/20103">49 U.S.C. 20103</external-xref> note). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE5D4A06798A949D2B14797486DFB6A1A"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H68486B6603C74B029DB816B72E65EE5C"><enum>(b)</enum><header display-inline="yes-display-inline">Strengthening standards for railroad bridges</header><paragraph commented="no" display-inline="no-display-inline" id="H29A826759C31446A837553477A91912D"><enum>(1)</enum><header display-inline="yes-display-inline">Rulemaking</header><text>Not later than 2 years after the date of the enactment of the <short-title>Rail Bridge Safety and Transparency Act</short-title>, the Secretary, using other standards within the Department as models, shall issue a final rule establishing minimum structural and safety standards for railroad bridges and their component parts, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF11E620AA3D740EEA45832FE755A94FC"><enum>(A)</enum><text display-inline="yes-display-inline">minimum requirements for a railroad bridge and its component parts to be classified in poor, fair, or good condition; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8A1DE2D1825847F89B56AF81402FC2C5"><enum>(B)</enum><text>the amount of corrosion, cracking, spalling, and rusting permissible for each such condition.</text></subparagraph></paragraph><paragraph id="HAB037842AF4A454BAFCF0A2ED4EBA405"><enum>(2)</enum><header>Bridge inspection reports</header><subparagraph commented="no" display-inline="no-display-inline" id="H0554350DC83B491CB95482FFC7027269"><enum>(A)</enum><header>Inclusion of certain information</header><text display-inline="yes-display-inline">Not later than 2 years after the initial publication of the standards described in paragraph (1), all railroads carriers shall—</text><clause commented="no" display-inline="no-display-inline" id="H71C368E5540741A5BAA88ED85DC67BBD"><enum>(i)</enum><text display-inline="yes-display-inline">include information in their bridge inspection reports indicating whether each bridge for which such railroad carrier is responsible—</text><subclause commented="no" display-inline="no-display-inline" id="H84ACB5B9C39B44A484F59D5D25CBDB3C"><enum>(I)</enum><text display-inline="yes-display-inline">meets minimum structural and safety standards; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="H91E1787BA6FF4869B557362C14B49A40"><enum>(II)</enum><text display-inline="yes-display-inline">is in poor, fair, or good condition; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H0FADEE6377674149A46F93E6EC41893A"><enum>(III)</enum><text>has component parts in poor, fair, or good condition; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HE73860B3F67841EC9690AB51DAB1B0BD"><enum>(ii)</enum><text>for each bridge in poor condition, include—</text><subclause commented="no" display-inline="no-display-inline" id="H18ED246DFC304EFE9F3F646AAE776B63"><enum>(I)</enum><text display-inline="yes-display-inline">an estimate of how long the bridge can remain in service; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="H701EC5BD9EE144FF82C9C71CE521A922"><enum>(II)</enum><text display-inline="yes-display-inline">a timeline for planned repairs, rehabilitation, or replacement of the bridge; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H3EA1C34904044F72B02C94D650A18401"><enum>(III)</enum><text display-inline="yes-display-inline">an estimate of the cost to perform such actions. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCD5FB69A33FD4472A98488E80C3EB9B9"><enum>(B)</enum><header>Bridge inspection report database</header><clause commented="no" display-inline="no-display-inline" id="H053963D60A3944FB8D6A3F20D693F16D"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date of the enactment of the <short-title>Rail Bridge Safety and Transparency Act</short-title>, the Secretary shall develop, populate, and manage a database of all bridge inspection reports received from railroad carriers, which shall be continuously updated with the most recent bridge conditions as indicated in bridge inspection reports provided to the Department.</text></clause><clause commented="no" display-inline="no-display-inline" id="H3C28F2A1122E45AABA0D1065CBBEB399"><enum>(ii)</enum><header>Public availability</header><text>The Secretary shall make available to the public a version of the database described in clause (i) that includes for each bridge inspection report only the following information:</text><subclause id="H18DA9E97D5114A59B80C68AD5C666AD0"><enum>(I)</enum><text>The date of last inspection of the bridge.</text></subclause><subclause id="HFD332B8BEC0541BC8DB7FA8A92AD4943"><enum>(II)</enum><text>The location of the bridge.</text></subclause><subclause id="H907E24B895C84E9290F104C86C0C9157"><enum>(III)</enum><text>The owner of the bridge.</text></subclause><subclause id="H169111A623B34908AFF4E0F1FFC0AFBC"><enum>(IV)</enum><text>A determination of whether the bridge is in poor, fair, or good condition.</text></subclause><subclause id="HAFC46CD1364E4F7EBC66302150BB6968"><enum>(V)</enum><text>Any other comments on the condition of the bridge disclosed by the owner, as indicated in the bridge inspection report. </text></subclause></clause></subparagraph><subparagraph id="H9941D1A10AD24A44B924BEAAF71CD916"><enum>(C)</enum><header>Submission deadlines</header><clause commented="no" display-inline="no-display-inline" id="HACCE8EA67765430CA6D9AF73B494D550"><enum>(i)</enum><header>Initial reports</header><text display-inline="yes-display-inline">During the period beginning on the date of the enactment of the <short-title>Rail Bridge Safety and Transparency Act</short-title> and ending on the date on which the database required under subparagraph (B) is first established—</text><subclause commented="no" display-inline="no-display-inline" id="HE2CB7A646CF941E0B573EAA3D9BB5A58"><enum>(I)</enum><text display-inline="yes-display-inline">not later than 30 days after the receipt of a bridge inspection report request from an eligible requesting party, the Secretary shall request a bridge inspection report from the railroad carrier concerned, and—</text><item commented="no" display-inline="no-display-inline" id="H10E81E33343E4CD093EB1B1C8F9261C6"><enum>(aa)</enum><text display-inline="yes-display-inline">if the request is for 5 or fewer railroad bridges, the railroad carrier concerned shall, not later than 30 days after the receipt of such request from the Secretary, submit the bridge inspection report to the Department; or </text></item><item commented="no" display-inline="no-display-inline" id="HA09F472A43924E8C80E092A781D9E405"><enum>(bb)</enum><text display-inline="yes-display-inline">if the request is between 6 and 50 railroad bridges, the railroad carrier concerned shall, not later than 90 days after the receipt of such request from the Secretary, submit the bridge inspection report to the Department; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="HCFD51F3E47F84ECC8469DC8851723A5C"><enum>(II)</enum><text display-inline="yes-display-inline">not later than 14 days after the receipt of a bridge inspection report submitted in accordance with item (aa) or (bb) of subclause (I), the Secretary shall submit such bridge inspection report to the eligible requesting party. </text></subclause></clause><clause id="H6006218185BE495095BFA190E0B0BB30"><enum>(ii)</enum><header>Future reports</header><text>After the date on which the database required under subparagraph (B) is first established, the Secretary shall—</text><subclause commented="no" display-inline="no-display-inline" id="H4C6DAFD8CBDB4674BF212BCE6018FC46"><enum>(I)</enum><text display-inline="yes-display-inline">not later than 30 days after the receipt of a bridge inspection report request from an eligible requesting party—</text><item commented="no" display-inline="no-display-inline" id="HCAB8FE8F4BF845DDBB713FDA530D3ABB"><enum>(aa)</enum><text display-inline="yes-display-inline">if the requested bridge inspection report is available in the database, submit such report to the eligible requesting party; and</text></item><item commented="no" display-inline="no-display-inline" id="HD563B3BB005744CFB74481C7AEA6CFD2"><enum>(bb)</enum><text display-inline="yes-display-inline">if the requested information is not available in the database, request a bridge inspection report from the railroad carrier concerned; and—</text><subitem commented="no" display-inline="no-display-inline" id="H9EDF00DE8A36460BB4DB2C794B1B0B1C"><enum>(AA)</enum><text display-inline="yes-display-inline">if the request is for 5 or fewer railroad bridges, the railroad carrier concerned shall, not later than 30 days after the receipt of such request from the Secretary, submit the bridge inspection report to the Department; or </text></subitem><subitem commented="no" display-inline="no-display-inline" id="HC91AB7D1564B4C3CB95E3AC84EEF2C0F"><enum>(BB)</enum><text display-inline="yes-display-inline">if the request is between 6 and 50 railroad bridges, the railroad carrier concerned shall, not later than 90 days after the receipt of such request from the Secretary, submit the bridge inspection report to the Department; and</text></subitem></item></subclause><subclause id="HEA3F269DAA874F5C926027BA2D01E798" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">not later than 14 days after the receipt of a bridge inspection report submitted by a railroad carrier in accordance with subitem (AA) or (BB) of item (bb), submit such bridge inspection report to the eligible requesting party. </text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H087696B5E2254C84B8C3688671496130"><enum>(c)</enum><header>Coordination of oversight of coastal railroad bridges</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Commandant of the Coast Guard, shall issue a final rule establishing minimum structural and safety standards for movable railroad bridges and railroad drawbridges spanning the navigable waters of the United States, including—</text><paragraph id="H2F24114179E444748E292F8E7E4EA8AE"><enum>(1)</enum><text>the minimum structural and safety requirements for each such bridge and its component parts, including movable parts;</text></paragraph><paragraph id="H616A8D8DE880433695F41E04DA8EB557"><enum>(2)</enum><text>the requirements that each such bridge and its component parts shall meet in order to be considered to be in poor, fair, or good condition;</text></paragraph><paragraph id="H12549F5BE7644CC682618E2457B84F3D"><enum>(3)</enum><text>the requirement that each such bridge be inspected at the same frequency as railroad bridges that are not located above navigable waters; and</text></paragraph><paragraph id="H6118082C7E8749F8BA7BC6802DC09C0D"><enum>(4)</enum><text>requirements for safety inspections that are required if a railroad carrier shifts from in-person to remote operation of such a bridge.</text></paragraph></subsection><subsection id="H15195CAE559D4F26AD646CBFB5B39FCB"><enum>(d)</enum><header>Flagging ownership of railroad bridges</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the <short-title>Rail Bridge Safety and Transparency Act</short-title>, each railroad carrier that owns 1 or more railroad bridges shall post a placard or sign in area that is visible to oncoming traffic on (or adjacent to) both ends of each such bridge that identifies—</text><paragraph id="H3AACD2B8B5D44C06AF0ECB1B09104AEE"><enum>(1)</enum><text>the railroad carrier that owns the bridge; and</text></paragraph><paragraph id="HCE9D57FC8F4C45CAAFC3BFE21D75F78F"><enum>(2)</enum><text>a phone number through which a member of the public can report visible hazards or concerns with respect to such bridge.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H159F177CF1D74155A9152F363E5456D3"><enum>(e)</enum><header>Rail Bridge Safety Concern Reporting System</header><paragraph commented="no" display-inline="no-display-inline" id="H67E3FE6BAEF14EB6AE01471679CFF435"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of the <short-title>Rail Bridge Safety and Transparency Act</short-title>, the Secretary shall establish a system, to be known as the Rail Bridge Safety Concern Reporting System (referred to in this subsection as the <quote>System</quote>), to report safety concerns regarding the condition of railroad bridges. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDB0925276F14372B3AD6DECE8202761"><enum>(2)</enum><header>Development</header><text>In developing the System, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H9D6FD7BD5C0247D681B15103AC3754B7"><enum>(A)</enum><text display-inline="yes-display-inline">streamline and simplify the data management process within the Department; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H236A9DBB246049B7AA9C27045A29FE43"><enum>(B)</enum><text display-inline="yes-display-inline">reduce duplicative efforts and maximize available resources, including by integrating the Alleged Violation Reporting Form of the Federal Railroad Administration into the System. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD1D75441D4734CCB9DF24AB4EB98E27A"><enum>(3)</enum><header>System functions</header><subparagraph commented="no" display-inline="no-display-inline" id="HE442CFCD893142FBAF6206EA879D830A"><enum>(A)</enum><header>Reporting safety concerns</header><text display-inline="yes-display-inline">The Secretary shall use the System to permit any State, political subdivision of a State, or Tribe to report to the Secretary safety concerns regarding the condition of a railroad bridge based on certain factors, including—</text><clause commented="no" display-inline="no-display-inline" id="HA80200FD2A9E4A5B8458E06072DDE13B"><enum>(i)</enum><text display-inline="yes-display-inline">physical appearance; </text></clause><clause commented="no" display-inline="no-display-inline" id="H375DFDCEBACF40ABA173126CFCE5DD07"><enum>(ii)</enum><text display-inline="yes-display-inline">extreme shaking or excess movement during the passage of a train or an extreme weather event; </text></clause><clause commented="no" display-inline="no-display-inline" id="H89C6689C85AC44C98DFAA8E8ABEEFD31"><enum>(iii)</enum><text display-inline="yes-display-inline">components of the railroad bridge falling onto surrounding areas; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HB35187EC5C464AC5B049299A35AFF14F"><enum>(iv)</enum><text>any other concern that the Secretary determines to be significant to the structural or operational safety of the bridge; </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H84855E874C024DDDA48741A3E38C2B51"><enum>(B)</enum><header>Investigations</header><text>If the Secretary determines a report submitted pursuant to subparagraph (A) includes a reasonable safety concern regarding the structural or operational safety of a bridge, the Secretary shall investigate such safety concern to determine the risk posed by the railroad bridge to—</text><clause commented="no" display-inline="no-display-inline" id="H6F315BA93AB04C8EB07B4611BE385436"><enum>(i)</enum><text display-inline="yes-display-inline">the operation of the railroad concerned;</text></clause><clause commented="no" display-inline="no-display-inline" id="H79497041E4F14ABFB684C58C8AAB81D6"><enum>(ii)</enum><text display-inline="yes-display-inline">the safety of railroad workers;</text></clause><clause commented="no" display-inline="no-display-inline" id="H70CE108DC430421F92A2BBA085462198"><enum>(iii)</enum><text display-inline="yes-display-inline">the safety the general public; and </text></clause><clause commented="no" display-inline="no-display-inline" id="H8E19717CC979422D83BD5F2C4F4FFBE3"><enum>(iv)</enum><text display-inline="yes-display-inline">the safety of individuals who traverse on, under, or near the railroad bridge, including pedestrians, cyclists, and individuals traveling by motor vehicle or boat.</text></clause></subparagraph><subparagraph id="HE14C60A455604D9E8E5EA1354FD9B35A"><enum>(C)</enum><header>Repair or suspension of use</header><text>If the Secretary determines that a safety concern investigated pursuant to subparagraph (B) poses a significant threat to the structural or operational safety of the bridge or the safety of any of the parties described in clauses (i) through (iv) of subparagraph (B), the Secretary shall direct the Administrator of the Federal Railroad Administration to coordinate with the railroad concerned to establish a plan that addresses the safety concern, which may include—</text><clause id="H9D26413D307C4EFF951C126072E04DFC"><enum>(i)</enum><text>requiring the immediate repair of the railroad bridge;</text></clause><clause id="H7DEB86DE56FC476685A1A6CC99D17050"><enum>(ii)</enum><text>imposing weight or speed restrictions on the bridge; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H58B23CC86A694718B5ED298512963041"><enum>(iii)</enum><text>any action required by the Secretary pursuant to section 20104(a) if the Secretary determines that such safety concern—</text><subclause commented="no" display-inline="no-display-inline" id="HC4EB59C3C97A494CA5416071CEF3D14E"><enum>(I)</enum><text display-inline="yes-display-inline">involves an unsafe condition or practice or a combination of unsafe conditions and practices; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H9B4D88635B3B4836B573AD9C126C5344"><enum>(II)</enum><text display-inline="yes-display-inline">causes an emergency situation involving an imminent hazard of death, personal injury, or significant harm to the environment. </text></subclause></clause></subparagraph><subparagraph id="H7B7FA086CA414CC6B0D42379888FFF2A"><enum>(D)</enum><header>Civil penalties</header><clause id="H7CEDB6B7A80E4A389E857A2C9E9B6C9F"><enum>(i)</enum><header>Failure to finalize plan</header><text>If a plan required under subparagraph (C) is not finalized within 90 days after a determination by the Secretary pursuant to such subparagraph and the relevant railroad bridge remains in operation, the Secretary shall impose a civil penalty to the railroad concerned in an amount equal to $1,000 per week until such plan is finalized.</text></clause><clause id="HA656301C9E514BE78089891686F0683E"><enum>(ii)</enum><header>Completion of repairs</header><text>If a safety concern determined by the Secretary pursuant to subparagraph (C)(iii)(II) to pose an imminent hazard of death, personal injury, or significant harm to the environment is not repaired within 1 year after such determination and the relevant railroad bridge remains in operation, the Secretary shall impose a civil penalty to the railroad concerned in an amount equal to $20,000 per week until such bridge is repaired.</text></clause></subparagraph></paragraph><paragraph id="H69CA1356D7204084BB6937D7EE1069D5"><enum>(4)</enum><header>Disclosure of reported safety concerns</header><text>The Secretary shall publish, on a publicly available website of the Department of Transportation, a notice of each safety concern involving a railroad bridge that the Secretary determines, pursuant to paragraph (3)(C)(iii)(II) to pose an imminent hazard of death, personal injury, or significant harm to the environment, which shall include—</text><subparagraph id="HF992CA932FC2468BA68CAAC876345397"><enum>(A)</enum><text>the location of the bridge;</text></subparagraph><subparagraph id="HDCC830D561C1434C854CC3CCE8821036"><enum>(B)</enum><text>the owner of the bridge;</text></subparagraph><subparagraph id="H71D458EAF6494B458D1C46075CF89B0E"><enum>(C)</enum><text>whether the bridge is in active use; and</text></subparagraph><subparagraph id="HD4A4227B947544D68817D92F8A2373AA"><enum>(D)</enum><text>whether the railroad that owns the bridge has submitted a plan to address such safety concern.</text></subparagraph></paragraph><paragraph id="HB6E1ACEF07EE4EFC802BD7D4BC167943"><enum>(5)</enum><header>Funds for bridge safety personnel</header><subparagraph id="HDB626598433447A9AB48EF5267839370"><enum>(A)</enum><header>Authorization of appropriations</header><text>In addition to the amounts referred to in subparagraph (B), there are authorized to be appropriated to the Department such additional sums as may be necessary to hire additional bridge safety personnel to carry out this subsection.</text></subparagraph><subparagraph id="HC5A34A259C5A42D484AFC76219956773"><enum>(B)</enum><header>Use of civil penalties</header><text>All amounts collected from the civil penalties imposed pursuant to paragraph (3)(D) and section 1327(c) shall be reserved for hiring additional bridge safety personnel to carry out this section.</text></subparagraph></paragraph></subsection><subsection id="H16E6ACDFDED74E13A1A66FF1F7F49E30"><enum>(f)</enum><header>Randomized observation of railroad bridges</header><paragraph id="H3B66C985D8EF4A37923B0E354DEC0599"><enum>(1)</enum><header>In general</header><subparagraph id="H96CA51E89BEB4876A5B2C81DD555ACCC"><enum>(A)</enum><header>Number of annual observations</header><text>The Secretary shall annually conduct at least 1 randomized bridge observation for every 500 railroad bridges owned by a railroad carrier.</text></subparagraph><subparagraph id="H20B44173752D41FB9287EEFCCAEEE340"><enum>(B)</enum><header>Application of standards</header><text>For each observation conducted pursuant to this subsection, the Secretary shall inspect the condition of each bridge and its component parts in accordance with the standards established pursuant to subsection (c)(1).</text></subparagraph><subparagraph id="H298E43483A0C456D9E03B2411DFAB21C"><enum>(C)</enum><header>Small railroad observation pool</header><text>If a railroad carrier owns fewer than 500 railroad bridges, such railroad carrier shall be included in a pool of railroad carriers. Not fewer than 5 railroad carriers in such pool shall be selected annually for a randomized observation of at least 1 railroad bridge owned by each selected railroad carrier.</text></subparagraph><subparagraph id="H08AE930E738146D49CF8FAEF25E3DBB9"><enum>(D)</enum><header>Advance notice</header><text>In carrying out randomized bridge observations under this section, the Secretary shall not give a railroad carrier more than 3 days of advance notice of the timing of an observation. </text></subparagraph></paragraph><paragraph id="HE1E9717D08D34C1AA2AE1D46F2F6743A"><enum>(2)</enum><header>Review</header><subparagraph id="H888B2B8F409D42EE863AA635EE6C6CD6"><enum>(A)</enum><header>In general</header><text>The Secretary shall compare the result of each bridge observation to the reported conditions of the applicable bridge in the bridge inspection report provided by the railroad carrier.</text></subparagraph><subparagraph id="HEC9BC28BC472464BB45D02D77A3CECD6"><enum>(B)</enum><header>Discrepancies</header><text>In the event of a discrepancy between the result of a bridge observation and the conditions of such railroad bridge documented in the most recent bridge inspection report, the Secretary shall work with the railroad carrier concerned to address deficiencies in the inspection system of such railroad carrier, including by—</text><clause id="H96B459566E7C429582141E8F599D9CAF"><enum>(i)</enum><text>improving the training of inspectors;</text></clause><clause id="HEF84439CA6094E45A287DCF7418EA8D4"><enum>(ii)</enum><text>increasing the frequency of inspections;</text></clause><clause id="H070850F1B8DF4C1A86EEF9F47E44FB94"><enum>(iii)</enum><text>addressing inspector staffing shortages; and</text></clause><clause id="HFE943420E7C54D1D8E7816287FE2EC5F"><enum>(iv)</enum><text>revising inspection criteria.</text></clause></subparagraph><subparagraph id="HFA2F773E799D4A5EAA1623B4A26AA6F9"><enum>(C)</enum><header>Additional inspections</header><text>For railroad carriers that the Secretary has found to have a pattern of discrepancies under subparagraph (D), the Secretary shall—</text><clause id="H8B9723488E3A4590BF2BE463A6DE901D"><enum>(i)</enum><text>increase the number of randomized observations from the baseline set in paragraph (1);</text></clause><clause id="HADE652956CD64FCCBB182C11CF542979"><enum>(ii)</enum><text>establish a priority list of railroad bridges to be subject to additional observations, based on factors such as the condition of the bridge, the bridge length, the location of the bridge, the safety risk to the community should the bridge fail, the type of freight carried over the bridge, and the frequency of service over the bridge;</text></clause><clause id="HDE972890961A4BCCA88590C38B7CC9B2"><enum>(iii)</enum><text>carry out such additional observations with not more than 3 days of advance notice provided to the railroad carrier; and</text></clause><clause id="HD70EA44E53D144BD87DAA7E8FA6034FC"><enum>(iv)</enum><text>ensure that such additional observations examine the condition of the bridge and are additive to, not a replacement of, the normal track inspections, including visual track inspections, required by the Department. </text></clause></subparagraph><subparagraph id="H6C406912C7CC4CF4A43E89103DAF4B74"><enum>(D)</enum><header>Pattern of discrepancies</header><clause id="HB2B089DDA34A4A289F951762EBA721E3"><enum>(i)</enum><header>Defined term</header><text>In this subparagraph, the term <term>pattern of discrepancies</term>, with respect to a railroad carrier—</text><subclause commented="no" display-inline="no-display-inline" id="HF86D311A6EDF46B8896C8FD83D7801A0"><enum>(I)</enum><text display-inline="yes-display-inline">means the Secretary has identified 5 or more instances in which conditions reported on the bridge inspection report of such railroad carrier differed from the results of an observation conducted by the Secretary pursuant to this subsection; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H1726F3E4E76046ADA88AFDAA9B6BC3DC"><enum>(II)</enum><text display-inline="yes-display-inline">does not include sudden changes in the condition of a railroad bridge due to a significant event, such as an earthquake or other natural disaster.</text></subclause></clause><clause id="H2229BF53F4804743A6EEB5BE85BD6D98"><enum>(ii)</enum><header>Effect</header><text>If the Secretary identifies, through randomized observations of railroad bridges of a railroad carrier, a pattern of discrepancies between the railroad carrier's bridge inspection report and multiple observations—</text><subclause commented="no" display-inline="no-display-inline" id="H323A09AFCCDE495083D8D4F2D529BCEE"><enum>(I)</enum><text display-inline="yes-display-inline">such railroad carrier—</text><item commented="no" display-inline="no-display-inline" id="HA2A80D65159F4BA8AACCE4D7D22D6348"><enum>(aa)</enum><text display-inline="yes-display-inline">shall be considered to be in violation of this chapter; and</text></item><item commented="no" display-inline="no-display-inline" id="H78A30C9709654FB3A4BB660241E40F76"><enum>(bb)</enum><text display-inline="yes-display-inline">shall be subject to the civil penalties set forth in section 21301; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H540801E4515645D6AA7BA898A287C6AA"><enum>(II)</enum><text>not later than 90 days after such identification, the Secretary shall submit a written report to Congress that describes such discrepancies.</text></subclause></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HBF509E65050245F8AA27BAB25388917C"><enum>(b)</enum><header>Clerical amendment</header><text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, is amended by striking the item relating to section 20145 and inserting the following:</text><quoted-block style="USC" id="HFD06959BDEF645F99C097DB22D4CE37E"><toc><toc-entry level="section" idref="HC46C6ED081A349EDAF3A00480C5556E5">20145. Railroad bridge safety.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H0B8D661BF504427F8451E25A5B90EA5E"><enum>3.</enum><header>Conforming amendments to the Rail Safety Improvement Act of 2008</header><text display-inline="no-display-inline">Section 417(d)(2) of the Rail Safety Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/49/20103">49 U.S.C. 20103</external-xref> note) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H08C40EFDC54B44CE9F888BE07E81F095"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE8E9ECE0C7BE45D18D3366C26EBF056F"><subparagraph commented="no" display-inline="no-display-inline" id="H223F83332670468D906CDE65E75BC1E6"><enum>(A)</enum><header>In general</header><clause commented="no" display-inline="no-display-inline" id="H875C9FCCB7504F5AA2E40E5FCE498F01"><enum>(i)</enum><header>Jurisdictional requests</header><text display-inline="yes-display-inline">A Member of Congress, a State, or political subdivision of a State may file a request with the Secretary for a public version of the bridge inspection report or reports generated under subsection (b)(5) for bridges located in the congressional district or State of such Member of Congress or in the jurisdiction of such State or political subdivision.</text></clause><clause commented="no" display-inline="no-display-inline" id="HCC5398F50255413B9DDA523E3E9E1A09"><enum>(ii)</enum><header>Requests from committees</header><text display-inline="yes-display-inline">The Chair or Ranking Member of the Committee on Transportation and Infrastructure of the House of Representatives or the Chair or Ranking Member of Committee on Commerce, Science, and Transportation of the Senate may file a request with the Secretary for a public version of the bridge inspection report or reports generated under subsection (b)(5) for any bridge in the United States.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4AB04826E0C342EDBEB1D36B2AFFB73F"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (B), (C), and (D) as subparagraphs (C), (D), and (E), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1D58937E3664F75BB993BB16FAD0BB6"><enum>(3)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3A1E441CCA1F4273AD91BCFFCF3AFFD7"><subparagraph id="H49435FB6E1AD483CB8943C15AB6A477A"><enum>(B)</enum><header>Limitation</header><text>A State or political subdivision of a State may request not more than 50 bridge inspection reports under subparagraph (A)(i) during any 6-month period.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HB6207270F6D14693895FD0FE473317C7" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (C), as redesignated, by striking <quote>If the Secretary determines that the request is reasonable, the Secretary</quote> and inserting <quote>The Secretary</quote>. </text></paragraph></section></legis-body></bill>
