which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Credit Repair Organizations Act to add additional protections against harmful practices within the credit repair organization industry, and for other purposes.</official-title></form><legis-body id="H259CFAD36868488384B9EC90F13F6431" style="OLC"><section id="H5EF6EE51AC774B2594D1365A5FA3C341" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Scam Credit Repair Act</short-title></quote> or the <quote><short-title>ESCRA Act</short-title></quote>.</text></section><section id="H5A32788D45A047249676FA695DD29EEA" commented="no"><enum>2.</enum><header>Credit Repair Organization definition</header><text display-inline="no-display-inline">Section 403(3) of the Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679a">15 U.S.C. 1679a(3)</external-xref>)—</text><paragraph id="H03AEFC5C5BA7406C9D32C719B48AEBBA" commented="no"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>(not including anything received in return for representing a consumer in preparation for or during litigation)</quote> after <quote>consideration</quote>; and</text></paragraph><paragraph id="H25C863FF6DE24D2D81D2203EACE3457A" commented="no"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="HDAEC1A154980432AA51D6E5584FC079F" commented="no"><enum>(A)</enum><text>by inserting <quote>an entity or individual that is, in good faith and not for the purpose of evading this title</quote> after <quote>include</quote>;</text></subparagraph><subparagraph id="H846729E5B2B54E56862D87175B720E89" commented="no"><enum>(B)</enum><text>in clause (ii), by striking <quote>or</quote>;</text></subparagraph><subparagraph id="H306EA6D23D4A4440A1AEECC7EFD1BE2A" commented="no"><enum>(C)</enum><text>in clause (iii), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="HFDF63A6FBEBF41289B69326A53CF3A01" commented="no"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H24C04EB1E9314194B8CFF1770239A184" display-inline="no-display-inline"><clause id="H9618C9E50B5F41428BAD465C64A81C73" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">any attorney that provides legal services rendered or to be rendered to a consumer in contemplation of or in connection with a case filed, or to be filed within 12 months, under title 11 or title 15, United States Code, by an attorney within the same law firm.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="HD623365BF0C84CAE989587A1B6DC2515"><enum>3.</enum><header>Prohibited practices</header><subsection id="H609C57B803EA4DDE8E0D44CDE0821161"><enum>(a)</enum><header>Untrue or misleading statements</header><paragraph id="H05F8F3785A6F4CB0857B84EE7201920D"><enum>(1)</enum><header>In general</header><text>Section 404(a)(1) of the Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679b">15 U.S.C. 1679b(a)(1)</external-xref>) is amended—</text><subparagraph id="H068EBE1BEB544B91829E574B943D78D6" commented="no"><enum>(A)</enum><text>by inserting <quote>knowingly</quote> before <quote>make any statement, or</quote>;</text></subparagraph><subparagraph id="HBB8AAA8B21B74E36960243EDCA00DC60"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>or </quote>; and</text></subparagraph><subparagraph id="H3CFE039E6E1C42AB9FF4F5106FE4CD30"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H2BEE91DCB8A24E85BFF76ABFD9D7FF60" display-inline="no-display-inline"><subparagraph id="H2372FEB52505465F9A9EBE5AD98D36A1"><enum>(C)</enum><text display-inline="yes-display-inline">the Bureau of Consumer Financial Protection directly or through an online portal established to receive complaints, disputes, or reports of fraud;</text></subparagraph><subparagraph id="H3F6C2369474B4120B7BB4EA857E43577"><enum>(D)</enum><text display-inline="yes-display-inline">the Federal Trade Commission directly or through an online portal established to receive complaints, disputes, or reports of fraud; or</text></subparagraph><subparagraph id="HD17B313C967D4184B695C1C8A67716AE"><enum>(E)</enum><text display-inline="yes-display-inline">any Federal, State, local, or Tribal law enforcement agency, directly or through an online portal established to receive complaints, disputes, or reports of fraud;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H338247ACABEE4C31BFFEFC19A7BDD71A"><enum>(2)</enum><header>Finding</header><text>The Congress finds that it is already unlawful to make materially false, fictitious, or fraudulent statements or representations to the Bureau of Consumer Financial Protection. </text></paragraph></subsection><subsection id="HAF7E286C022D46BB9ED23652592714A2"><enum>(b)</enum><header>Additional prohibited practices</header><text display-inline="yes-display-inline">Section 404 of the Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679b">15 U.S.C. 1679b</external-xref>) is amended—</text><paragraph id="HB03C1A3A6C3B45119C2C595606B9F9BD"><enum>(1)</enum><text>in subsection (a)(2)—</text><subparagraph id="H6E8754A4564A4373A8AB4AED380D4C6C"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii), by inserting <quote>or</quote> after <quote>credit;</quote>; and</text></subparagraph><subparagraph id="HC6C21A2688B446A09717BB5554CBE28B"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H482823F04C1C4D1B96D7F18E0504BB71" display-inline="no-display-inline"><subparagraph id="HE85DC71036824EE0890E82C8FE55F0A6"><enum>(C)</enum><text display-inline="yes-display-inline">the Bureau of Consumer Financial Protection or the Federal Trade Commission;</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H07918CA068484ED1B4989B23612BC599"><enum>(2)</enum><text>by amending subsection (b) to read as follows:</text><quoted-block style="USC" id="HDD77DC7539324DA9B54AB841C00888D9" display-inline="no-display-inline"><subsection id="H7B64CACA7A42462D9F57033A5C58BD1A"><enum>(b)</enum><header>Payment in Advance</header><paragraph id="H953A12B754C747E9B6FAB383552779AD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No credit repair organization may request or receive payment of any fee or consideration from a consumer for services represented to remove derogatory or inaccurate information from, or improve, such consumer's credit history, credit record, or credit rating, or services related to such a representation, until the credit repair organization has provided such consumer with documentation in the form of a consumer report, issued not less than 6 months after such service, from a consumer reporting agency that demonstrates that such representation has been achieved.</text></paragraph><paragraph id="H3030D97004464CFEA2F787169284D592"><enum>(2)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to alter the permissible purposes of furnishing a consumer report described in section 604 of the Fair Credit Reporting Act.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H020C0020A0974305ACE98BA0ECBBCD54"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H87536CECF0DA48AA98011EAAB04AD65D" display-inline="no-display-inline"><subsection id="H48A761ED69B14D7CAFB93BA7104FD92B"><enum>(c)</enum><header>Jamming</header><text display-inline="yes-display-inline">A credit repair organization may not submit multiple disputes described in section 611 of the Fair Credit Reporting Act of the same information unless all of the following are true:</text><paragraph id="HFED2D42626CF4C7085C36A5152C5E7D0"><enum>(1)</enum><text display-inline="yes-display-inline">The consumer reporting agency or data furnisher has had the time permitted under the Fair Credit Reporting Act to conduct a reasonable investigation on the prior dispute.</text></paragraph><paragraph id="H5B2A39F7676946C6AA5E86DC066916FE"><enum>(2)</enum><text display-inline="yes-display-inline">The consumer reporting agency or data furnisher has returned the results of its investigation to the consumer with respect to such dispute, unless there are material changes to the information submitted with the dispute.</text></paragraph><paragraph id="H3266C03E00EC4093B52B744A592FEA82"><enum>(3)</enum><text display-inline="yes-display-inline">The credit repair organization includes with the resubmitted dispute a specific description of what information is inaccurate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H1C1C651DD8AA4D1085C2ADF541E8AA59"><enum>4.</enum><header>Disclosures</header><text display-inline="no-display-inline">Section 405 of the Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679c">15 U.S.C. 1679c</external-xref>) is amended—</text><paragraph id="HBF93903951A241B7A9A09213D3A32D82"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HE009DAFF6843487B8A9EE983626E757B"><enum>(A)</enum><text>by striking <quote>due to fraud.</quote> and inserting <quote>due to fraud. Credit repair organizations do not provide any services that you cannot do yourself for free.</quote>;</text></subparagraph><subparagraph id="H045A13C8C3A548EAA75CA62EAECA8690" commented="no"><enum>(B)</enum><text>by striking <quote>regulates</quote> and inserting <quote>and the Bureau of Consumer Financial Protection regulate</quote>; and</text></subparagraph><subparagraph id="H82DA66598AD34E4C82EA4C29524B18D6" commented="no"><enum>(C)</enum><text>by inserting <quote>The Bureau of Consumer Financial Protection 1700 G St. NW, Washington, DC, 20552 Tel: 855–411–2372 TTY/TTD: 855–729–2372</quote> after <quote>20580</quote>; and</text></subparagraph></paragraph><paragraph id="H6D65A4CCC392438A853B59212A9AED56"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="HEC8577E681C94307AE2C6B5710A87694"><enum>(A)</enum><text>in paragraph (1), by striking the period at the end and inserting <quote>and any recordings of telephone communications with the consumer.</quote>; and</text></subparagraph><subparagraph id="HF02D73BF2D974B3A8BC4FE8D4458F17C"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H6D96292D78DB48DF84343AE1D06248AA"><enum>(i)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">2</header-in-text></quote> in the heading and inserting <quote><header-in-text level="paragraph" style="OLC">5</header-in-text></quote>; </text></clause><clause id="H6E2E219386D44F92A134717F84503716"><enum>(ii)</enum><text>by inserting <quote>and any telephone recordings with the consumer</quote> after <quote>consumer’s statement</quote>;</text></clause><clause id="H8821E5D3382644AE893417B2167D2094"><enum>(iii)</enum><text>by striking <quote>2</quote> and inserting <quote>5</quote>; and</text></clause><clause id="H5F36AD8F82554EF5B57A9F1040FB61BF"><enum>(iv)</enum><text>by striking <quote>statement is signed by the consumer</quote> and inserting <quote>statement or the telephone recordings are created</quote>.</text></clause></subparagraph></paragraph></section><section id="H9559CCE79E3C4CEFB75B1F08F000FB51"><enum>5.</enum><header>Consumer contract required</header><subsection id="H48C0D1D2EB2F42EC8D07D280484CCC7F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 407(c) of the Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679e">15 U.S.C. 1679e(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="USC" id="H2585C64CA5824089965A1E369392C916" display-inline="no-display-inline"><paragraph id="H66307FAB34414CB8BB57D661963952FF"><enum>(3)</enum><text display-inline="yes-display-inline">copies of all communications sent on behalf of the consumer, at the time the communication is sent.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF72B212A3F3045FA83698B4213A3C7BC" commented="no"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 407(c) of the Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679e">15 U.S.C. 1679e(c)</external-xref>) is amended—</text><paragraph id="H113F76CE4DA94BD2BE9F90D5E19DA553"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>at the time the contract or the other document is signed.</quote>;</text></paragraph><paragraph id="HE274F9F949F645EFA672F7366D0827E6" commented="no"><enum>(2)</enum><text>in paragraph (1), by striking <quote>; and</quote> inserting <quote>, at the time the contract or the other document is signed;</quote>; and</text></paragraph><paragraph id="H29E80B721919413C81A7132787DE0F28" commented="no"><enum>(3)</enum><text>in paragraph (2), by adding at the end <quote>at the time the contract or the other document is signed; and</quote>.</text></paragraph></subsection></section><section id="HA6AFD6A873CC4B5CB6E42A470DFE157D"><enum>6.</enum><header>Noncompliance</header><text display-inline="no-display-inline">Section 408 of the Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679f">15 U.S.C. 1679f</external-xref>) is amended by adding at the end following:</text><quoted-block style="USC" id="H885A175342074693A57A6E126CCEC544" display-inline="no-display-inline"><subsection id="H165E6A13F33C4695B64968CD282C0575" commented="no"><enum>(d)</enum><header>Legal services within credit repair organizations</header><text>A credit repair organization shall be subject to this title regardless of whether the organization is, or employs, an attorney who also provides legal services to a consumer, except if such attorney is an attorney described in section 403(3)(B)(iv).</text></subsection><subsection id="H95B4255C3916405E961345319C160FAC"><enum>(e)</enum><header>Credit repair organizations without a State license</header><text display-inline="yes-display-inline">On or after January 1, 2026, no person may act as a credit repair organization unless such person is licensed by a State.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H589152EDFE6F49EC962A1AD750F514CE"><enum>7.</enum><header>Credit repair organization communications with furnishers of information</header><subsection id="HECD2D1E84339436680F435BC635DC738"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679">15 U.S.C. 1679 et seq.</external-xref>) is amended by inserting after section 408 the following new section:</text><quoted-block style="USC" id="HDD4C0D08008C4EF188D0F49C4A009B5E" display-inline="no-display-inline"><section id="HD38D63D7F55D4B9B955689F630845EF0"><enum>408A.</enum><header>Credit repair organization communications with furnishers of information</header><text display-inline="no-display-inline">Disputes submitted to a person who furnishes information to a consumer reporting agency by or on behalf of a credit repair organization shall meet the following requirements:</text><paragraph id="H0C7E424423584838BC538E12B968B5C4"><enum>(1)</enum><text display-inline="yes-display-inline">If sent by mail, the dispute shall be transmitted by first class mail and list on the envelope the—</text><subparagraph id="H5EAE290731FE4426A065AB92864BE15A"><enum>(A)</enum><text>name of the credit repair organization; and</text></subparagraph><subparagraph id="H6515C7CF62524123A50FE1F5F07E8C35"><enum>(B)</enum><text>State license number of the credit repair organization, if applicable.</text></subparagraph></paragraph><paragraph id="H4787A9616E184DC3B2EDECBF4C303B9D"><enum>(2)</enum><text display-inline="yes-display-inline">The dispute shall list the—</text><subparagraph id="HE68C87DA37604B65A4D8F85AD37DE3F5"><enum>(A)</enum><text>name of the credit repair organization;</text></subparagraph><subparagraph id="H29AC93FA6EAB43AF86ABA0E86FA8AFEE"><enum>(B)</enum><text>State license number of the credit repair organization, if applicable; and</text></subparagraph><subparagraph id="H9E60CA0B28974DCF93F39F978CA1FC18"><enum>(C)</enum><text>name of the consumer on whose behalf the dispute is submitted.</text></subparagraph></paragraph><paragraph id="H495107752D974C1CAF92F4B92DADD1AE"><enum>(3)</enum><text display-inline="yes-display-inline">In the case of any additional communication after an initial dispute, the additional communication shall clearly and conspicuously identify any material changes to the information provided in the initial written dispute and include the information described in paragraphs (1) and (2).</text></paragraph><paragraph id="H37B19CA27FC548739C174F9FF6D61557"><enum>(4)</enum><text display-inline="yes-display-inline">In the case where a credit repair organization sells or otherwise provides an online or paper blank dispute form to be completed and filed by the consumer, such form must contain the—</text><subparagraph id="HE379E379846A485E85B3AC7950C97463"><enum>(A)</enum><text>name and address of such credit repair organization; and</text></subparagraph><subparagraph id="H4B8D6F64E1FD44F78B4DEC52C4032784"><enum>(B)</enum><text>State license number of such credit repair organization, if applicable.</text></subparagraph></paragraph><paragraph id="H3C55C25BCE8E4FEF8FEB1A21E1C77313"><enum>(5)</enum><text display-inline="yes-display-inline">In the case where the person responds to a dispute submitted by a credit repair organization seeking clarifying information, verifying if the customer has actually engaged with the credit repair organization, or denying the accuracy of the underlying claim, the credit repair organization shall respond in writing within 15 business days.</text></paragraph><paragraph id="HA111F2A8791E44159CAC796E0D514926"><enum>(6)</enum><text display-inline="yes-display-inline">In the case where the credit repair organization is an attorney, the attorney shall certify that any communication is consistent with any information or documentation provided by the consumer, confirmed based upon methods or means proven to be historically reliable and accurate.</text></paragraph><paragraph id="H981F77E777494C88B50960E12078E268" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">A credit repair organization, when sending a dispute, shall disclose the fact that it is a credit repair organization by placing the following disclosure on the dispute letter: <quote>This communication was submitted or prepared on behalf of the consumer by a credit repair organization, as defined in section 403 of the Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679a">15 U.S.C. 1679a</external-xref>).</quote></text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H615D3524B8DA46B09308463D9798C3C0"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Credit Repair Organizations Act is amended by inserting after the item relating to section 408 the following: </text><quoted-block style="USC" id="H58C779574DBA4C16B66466D77AD68FAB" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">408A. Credit repair organization communications with furnishers of information.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H41EB1D904F084309A6ED67972F4C536D"><enum>8.</enum><header>Civil liability</header><text display-inline="no-display-inline">Section 409(a)(1) of the Credit Repair Organizations Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1679g">15 U.S.C. 1679g(a)(1)</external-xref>) is amended—</text><paragraph id="HEA95D0FD3D9743D18C34881B00C173A0"><enum>(1)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">Actual damages</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Damages</header-in-text></quote>;</text></paragraph><paragraph id="H009D28CB778A4F1E82476B7F69754486"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>or</quote>;</text></paragraph><paragraph id="H7E76F93E11B843779A32287D74CFEDBD"><enum>(3)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and </text></paragraph><paragraph id="HD55E9D4F06C948A9AA1ABBE727BE1ADC"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H7C0C67A75DAD4D88AC6C24057559FBA9" display-inline="no-display-inline"><subparagraph id="H379561A6DBF84E21B7B0914FFD16BEBC"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of $500 in damages for each violation of this title.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
