which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of the Treasury and the Director of the Bureau of Consumer Financial Protection to establish the Interagency Task Force on Coerced Debt, and for other purposes.</official-title></form><legis-body id="H8227305DE61D451F91B683BA1EFEE042" style="OLC"><section id="H6BC01ED40718499C8E36B1BC7BB80684" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Task Force to End Financial Abuse Act of 2024</short-title></quote>.</text></section><section id="H119180E6E83648919D8BE0F30686D32B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H1A83810DD19741C08AB0ADE75C12C3EE"><enum>(1)</enum><text>Economic abuse is a serious issue impacting vulnerable populations.</text></paragraph><paragraph id="H0A932B73C1A647B3AF1EDF23A56F116C"><enum>(2)</enum><text>Economic abuse occurs in 99 percent of abusive relationships and is the number 1 reason victims of abuse stay in or return to abusive relationships.</text></paragraph><paragraph id="HC1065A0C3EBD4287A73865F335020152"><enum>(3)</enum><text>Coerced debt is a form of economic abuse and an avenue for abusers to limit the economic independence of an individual.</text></paragraph><paragraph id="H938069341F45416DADF050FCA0D10FB0"><enum>(4)</enum><text>Coerced debt occurs when an abuser utilizes coercive control or identity theft to incur debt in the name of an individual.</text></paragraph><paragraph id="H0579AD41C41B44509F58929C809B93E3"><enum>(5)</enum><text>Coerced debt can occur via threat, force, or fraud in the context of ongoing domestic abuse, which can be physical, emotional, or financial.</text></paragraph><paragraph id="H18CA57DD9CFC4A3D9F6BF5E0FE7FE46E"><enum>(6)</enum><text>Coerced debt can subject a survivor to destroyed credit, substantial payment expectations, debt collection, and even bankruptcy.</text></paragraph><paragraph id="H0A924F6B7E174563B778DDA0A43CD9CD"><enum>(7)</enum><text>Addressing coerced debt requires a coordinated approach across Federal, State, and local agencies to ensure comprehensive support and protection for survivors.</text></paragraph><paragraph id="HDC3489E897A344CB87AC1912B00B4D6A"><enum>(8)</enum><text>There is a need for an interagency task force to develop and implement strategies to address coerced debt and its impact on survivors.</text></paragraph></section><section id="H2274F0D6BFB04B70803F32BFC491BCEB"><enum>3.</enum><header>Interagency Task Force on Coerced Debt</header><subsection id="H3ECDD254A3594FAB835423E6E41D210F"><enum>(a)</enum><header>Establishment</header><text>Not later than 90 days after the date of the enactment of this section, the Secretary of the Treasury and the Director of the Bureau of Consumer Financial Protection shall establish a task force to be known as the Interagency Task Force on Coerced Debt (in this section referred to as the <quote>Task Force</quote>).</text></subsection><subsection id="H76CBEEA749F347F2BA64456DCAF5D968"><enum>(b)</enum><header>Composition of the task force</header><paragraph id="H3D8A581824224DFE8FD1EF10DE02EF78" commented="no"><enum>(1)</enum><header>Co-Chairs</header><text display-inline="yes-display-inline">The Secretary of the Treasury and the Director of the Bureau of Consumer Financial Protection, or designees, shall serve as co-chairs of the Task Force.</text></paragraph><paragraph id="HE0169C8E04D044C3BAA1C4C5987F361A"><enum>(2)</enum><header>Members</header><text>The Task Force shall be composed of—</text><subparagraph id="HE9B05B0262294BCE8815B6DFE3360646"><enum>(A)</enum><text>the Secretary of Health and Human Services, or a designee;</text></subparagraph><subparagraph id="H4CF5DD6932FE4BFB8581DD197FEAF9CB"><enum>(B)</enum><text>the Director of the Office of Family Violence Prevention and Services, or a designee;</text></subparagraph><subparagraph id="H3BA1D675F0A94EF79015802CC5352E55"><enum>(C)</enum><text>the Director of the Office on Women’s Health, or a designee;</text></subparagraph><subparagraph id="HA998360F796E4F3EBDF2F7BC2FCDCE18"><enum>(D)</enum><text>the Secretary of Housing and Urban Development, or a designee;</text></subparagraph><subparagraph id="H9DC8829092654994BAF1790B11D4D11E"><enum>(E)</enum><text>the Attorney General, or a designee;</text></subparagraph><subparagraph id="H3D7C1B059C044AFF824E5771310ABDFD"><enum>(F)</enum><text>the Director of the Office on Violence Against Women, or a designee;</text></subparagraph><subparagraph id="HD6327DD94BD24B5CB1E331DA9DA81281"><enum>(G)</enum><text>the Chairperson of the Federal Trade Commission, or a designee; and</text></subparagraph><subparagraph id="H1188DDA1E4924B44B0017103041DCD7D"><enum>(H)</enum><text>representatives, appointed by the President, from—</text><clause id="H2E06BB95EF734BE2A27E7830AB405FD4"><enum>(i)</enum><text>a national domestic violence advocacy organization;</text></clause><clause id="H6BF22FD24412407494876B45DB3614CD"><enum>(ii)</enum><text>a financial institution; </text></clause><clause id="HF350FF76326D4B709E1065F4C4DEBDC3"><enum>(iii)</enum><text>a credit reporting agency; and </text></clause><clause id="H4D94BCC6FD89410A8AAFD2FAEC81C2CE"><enum>(iv)</enum><text>a nonprofit organization that provides financial literacy and credit counseling services.</text></clause></subparagraph></paragraph></subsection><subsection id="HF7C3BA4E6D164142929012BE6E7975D4"><enum>(c)</enum><header>Duties</header><text>The Task Force shall—</text><paragraph id="HD8D059DBCA984B09AFDD6A823589A1F3"><enum>(1)</enum><text>define the term <quote>coerced debt</quote>; </text></paragraph><paragraph id="H994A9A1FB81548669395D93BD9BD5FF1"><enum>(2)</enum><text>identify the scope and impact of coerced debt on domestic violence survivors, including the prevalence of coerced debt and the financial, legal, and social consequences of coerced debt for domestic violence survivors;</text></paragraph><paragraph id="HFD056202BC9B4D9389E406A90AFCC22B"><enum>(3)</enum><text>facilitate interagency collaboration and information sharing to ensure a coordinated response to coerced debt, including training for law enforcement, social service providers, and financial institutions with respect to identifying and addressing coerced debt;</text></paragraph><paragraph id="H51FA5AA8C3144C50A6BC8BC7AA28BF40"><enum>(4)</enum><text>engage with stakeholders, including domestic violence survivors, advocacy organizations, and financial institutions to inform the development of policies and practices to address coerced debt; and</text></paragraph><paragraph id="HD945DF9693654C44B475CFAA4FA9A4BD"><enum>(5)</enum><text>provide recommendations for legislative and regulatory changes to address coerced debt, including Federal legislative proposals to protect domestic violence survivors from coerced debt.</text></paragraph></subsection><subsection id="H1680BD81264642E3A8537EF6DD04CCD6"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date on which all the members of the Task Force have been appointed, the Task Force shall publish on a public website and submit to the Committee on Financial Services of the House of Representatives, the Committee on Banking, Housing, and Urban Affairs of the Senate, the Committee on the Judiciary of the House of Representatives, the Committee on the Judiciary of the Senate, and any other committee of the Congress that the Task Force determines appropriate a report that contains the findings and recommendations required under subsection (c).</text></subsection><subsection id="HC0C2C0FDB9024C2A9C5132721EDAB726"><enum>(e)</enum><header>Sunset</header><text>The Task Force shall terminate on the date that is 60 days after the date of the submission to the Congress of the report required under subsection (d).</text></subsection></section></legis-body></bill>
