which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a Gun Safety Board, and for other purposes.</official-title></form><legis-body id="H9500012B2982446BA3A42449F7ABED42" style="OLC"><section id="HC062BFE55EF843E193B0301B4DB8DCF0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gun Safety Board and Research Act</short-title></quote>.</text></section><section id="H192A68B0251D4EEFA84A0A77D24F6F7C"><enum>2.</enum><header>Gun Safety Board</header><subsection id="H5ACFDC4A93EA4B8FAE2CA88EEEF9F79E"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall, not later than 1 year after the date of enactment of this Act, establish a board to be known as the Gun Safety Board.</text></subsection><subsection id="HCBE3A767EB4B46D597A354721160AAE1"><enum>(b)</enum><header>Duties</header><text>The Gun Safety Board shall—</text><paragraph id="HB2F7F7580BDE46FE95C12F36AE5E9C21"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 2 years after the date of enactment of this Act, establish a program that uses not less than half of the amounts appropriated under this Act to provide grants that recipients shall use to—</text><subparagraph id="HEC10B59FC858453995A652D5A495A859"><enum>(A)</enum><text>conduct original research about firearm violence reduction (including research about topics identified for additional research by the Gun Safety Board under paragraph (3)); and</text></subparagraph><subparagraph id="H95EA67EC557342A3B2DEFEBF7E51ED9E"><enum>(B)</enum><text>to educate members of the public about—</text><clause id="HD960CE0357A046EC9D05220DA77AEE01"><enum>(i)</enum><text>causes and effects of firearm violence; and</text></clause><clause id="HA036DD48C63C47F9AEBE483B4DD0776D"><enum>(ii)</enum><text>ways to reduce firearm violence;</text></clause></subparagraph></paragraph><paragraph id="H9281041E58614BDF868326211DB1CA15"><enum>(2)</enum><text display-inline="yes-display-inline">conduct original research about firearm violence reduction; and</text></paragraph><paragraph id="H75034A2297C743219161EF80DA76D241"><enum>(3)</enum><text>publish in the Federal Register and on a public website of the Department of Health and Human Services, not less frequently than annually—</text><subparagraph id="H4F9266AC94A745E5BD56E5F31951FADB"><enum>(A)</enum><text display-inline="yes-display-inline">policy and funding recommendations for potential Federal, State, and local action based on available scientific research about firearm violence reduction;</text></subparagraph><subparagraph id="H7935D6D9B03942199CD341E45FE9A7BE"><enum>(B)</enum><text>a list of subject areas related to firearm violence reduction that the Gun Safety Board finds would benefit from additional scientific research; and</text></subparagraph><subparagraph id="H3A2AEA59FCEF45D19B4B19E81E5E9E63"><enum>(C)</enum><text display-inline="yes-display-inline">the Gun Safety Board’s findings about the efficacy of existing State and Federal laws intended to reduce firearm violence, and the expected efficacy of proposed State and Federal legislation intended to reduce firearm violence, in reducing—</text><clause id="H50459D1FD77C4DF69E43D0BC5F841506"><enum>(i)</enum><text>domestic violence;</text></clause><clause id="H0B81EEB86567480FB3DDD500BFB6A442"><enum>(ii)</enum><text>suicide and attempted suicide;</text></clause><clause id="H85DD10ADD3C54D5EB611F08AFF044E15"><enum>(iii)</enum><text>chronic community violence;</text></clause><clause id="H8E842A4FF5024D519EFF6C4C17FB209F"><enum>(iv)</enum><text>police violence;</text></clause><clause id="H2297C8CDE98D4CE9BE6C4189D245632F"><enum>(v)</enum><text>mass shootings;</text></clause><clause id="H1517E7240BC542E887452790C6A90AA7"><enum>(vi)</enum><text>hate crimes;</text></clause><clause id="H930D4438770341AF867568D773002EC5"><enum>(vii)</enum><text>school shootings;</text></clause><clause id="HFA827A512B7940D285DC18E51EDD9201"><enum>(viii)</enum><text>health care-related expenditures (including lost days of work and other indirect expenditures) for victims of firearm-caused injuries;</text></clause><clause id="H57D541C2B0C64BB69C7B3B41D2F9F5CE"><enum>(ix)</enum><text display-inline="yes-display-inline">hospital interventions;</text></clause><clause id="H67AFA71214FA41DBA4ACCC356595E9EA"><enum>(x)</enum><text>broader socioeconomic impacts of chronic gun violence;</text></clause><clause id="H663CAE2D231F476580DA24BEAAD8CEB6"><enum>(xi)</enum><text>diversions of firearms, including straw purchasing and gun trafficking; and</text></clause><clause id="H7B5868987E00494B9F94D93C2D54BA30"><enum>(xii)</enum><text>unintentional shootings.</text></clause></subparagraph></paragraph></subsection><subsection id="H05B2C06BAB464BD6BF7540C594ED927C"><enum>(c)</enum><header>Membership</header><paragraph id="H9575EE1ADF4E478B8EEB7C9C4590014D"><enum>(1)</enum><header>Number and appointment</header><text>The Gun Safety Board shall be composed of 22 members appointed by the Secretary of Health and Human Services.</text></paragraph><paragraph display-inline="no-display-inline" id="H675A348E252749B4A21CDD736FCFAE6D"><enum>(2)</enum><header>Composition</header><text>The members shall include—</text><subparagraph id="HFADEBA9E5F0B487CA0D80C31278B6765"><enum>(A)</enum><text>1 member with expertise in public health;</text></subparagraph><subparagraph id="H52869C7C9772407990710163ABB6E75D"><enum>(B)</enum><text>1 member with expertise in mental health care;</text></subparagraph><subparagraph id="H49B5D09AA3EE4A6E9FC03712FFDC22F9"><enum>(C)</enum><text>1 member with expertise in firearm violence reduction research;</text></subparagraph><subparagraph id="H3DD56DD196F944578229134C285568E8"><enum>(D)</enum><text>1 member with expertise in trauma surgery;</text></subparagraph><subparagraph id="H5E1C6D2DF51A4595AF16351E936FF75A"><enum>(E)</enum><text>1 member with expertise in law enforcement;</text></subparagraph><subparagraph id="H48B3ECD2E8494A828F6702D65572CA4C"><enum>(F)</enum><text>1 member with a background in firearm manufacturing, firearm sales, professional firearm use, or recreational firearm use;</text></subparagraph><subparagraph id="HCAF653A62DE54B99AB71CEA9764AD496"><enum>(G)</enum><text>2 members representing victims of firearm violence;</text></subparagraph><subparagraph id="H0957A1B65F8E471DBD4E776E257B1847"><enum>(H)</enum><text>1 member representing a nonprofit organization that advocates for racial justice;</text></subparagraph><subparagraph id="H512D501C2BFB48AA98124972DD9267E4"><enum>(I)</enum><text display-inline="yes-display-inline">1 member representing a nonprofit organization that advocates or engages in firearm violence intervention or prevention; and</text></subparagraph><subparagraph id="H61F44BA5448442B6B21BC1A138FD4573"><enum>(J)</enum><text>1 member from each of—</text><clause id="H627816E7AFE046EBB4EB3CCBAD80CDEF"><enum>(i)</enum><text display-inline="yes-display-inline">the National Institutes of Health;</text></clause><clause id="H9BC20CE5CD3E46CCBAD7EB1337F0925A"><enum>(ii)</enum><text>the Centers for Disease Control and Prevention;</text></clause><clause id="HFF0B5CF8030B4DF48244EE13955D906E"><enum>(iii)</enum><text>the Substance Abuse and Mental Health Services Administration;</text></clause><clause id="H9F1141614A48448A8FC90A1DEBB2F1C0"><enum>(iv)</enum><text>the United States Consumer Product Safety Commission;</text></clause><clause id="H5732BCEB749549D68AC78D9687D55D37"><enum>(v)</enum><text>the Federal Bureau of Investigation;</text></clause><clause id="H91FAFE30038B41E3941F5916A6247182"><enum>(vi)</enum><text>the Department of Health and Human Services;</text></clause><clause id="H1FA8C0A699704FC1B3CC2A495F47D04D"><enum>(vii)</enum><text>the Bureau of Alcohol, Tobacco, Firearms, and Explosives within the Department of Justice;</text></clause><clause id="H1B87639D11C74561AA2B0E46ACA82E9B"><enum>(viii)</enum><text>the Office of Juvenile Justice and Delinquency Prevention within the Department of Justice;</text></clause><clause id="HE295AF4F79F1492C932E0491855DB12C"><enum>(ix)</enum><text>the Bureau of Justice Assistance within the Department of Justice;</text></clause><clause id="H6CF0BC557D9E4B449A2FB01F209EB38F"><enum>(x)</enum><text>the Office for Victims of Crime within the Department of Justice;</text></clause><clause id="HF4843C2E016A4B09BE79A19605E2F95F"><enum>(xi)</enum><text>the Office on Violence Against Women within the Department of Justice; and</text></clause><clause id="H512E7B50A29446A5B9DEAF1E254FC09C"><enum>(xii)</enum><text display-inline="yes-display-inline">the National Institute of Justice within the Department of Justice.</text></clause></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H9D75376247354C72A7639E6137DF9F09"><enum>(d)</enum><header>Terms</header><paragraph id="HEE1B48BBBF794401B7877A955C27609D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), each member shall be appointed for a term of 4 years.</text></paragraph><paragraph id="H7D8C0F3408664464BA45F491862F2C73"><enum>(2)</enum><header>Terms of initial appointees</header><text>As designated by the Secretary of Health and Human Services at the time of appointment, of the members first appointed—</text><subparagraph id="H70DE58AD48584BDB97F2127971BE8F9F"><enum>(A)</enum><text display-inline="yes-display-inline">3 shall be appointed for a term of 4 years;</text></subparagraph><subparagraph id="H7D29A24FA1AE46FCB1B3A320F745D3F0"><enum>(B)</enum><text>2 shall be appointed for a term of 3 years;</text></subparagraph><subparagraph id="HAE593CB4FE85435E96CCA7A0DF3AEEA2"><enum>(C)</enum><text>2 shall be appointed for a term of 2 years; and</text></subparagraph><subparagraph id="H64427579A88B47558213FA80FDF8AE36"><enum>(D)</enum><text>2 shall be appointed for a term of 1 year.</text></subparagraph></paragraph><paragraph id="H9A525DE59F13469B98EE3F9BEC09E747"><enum>(3)</enum><header>Vacancies</header><text>Any member appointed to fill a vacancy occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed only for the remainder of that term. A vacancy shall be filled in the manner in which the original appointment was made.</text></paragraph></subsection><subsection id="H4283CF27AEE2497386AB4CB14ECB105C"><enum>(e)</enum><header>Basic pay</header><text display-inline="yes-display-inline">Members shall be paid at a rate set by the Secretary of Health and Human Services that is consistent with title 5, United States Code.</text></subsection><subsection id="H477F8260B003447692E074AA8CFE1F40"><enum>(f)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">Each member shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subsection><subsection id="HDCF860AF582E4D02A4729CB0A1470417"><enum>(g)</enum><header>Chair</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall designate 1 member to serve as chair of the Gun Safety Board.</text></subsection><subsection id="HF3D44356817849EFA1ADE5D4B56502FD"><enum>(h)</enum><header>Vice Chair</header><text>The members of the Gun Safety Board shall elect 1 member to serve as vice chair of the Gun Safety Board.</text></subsection><subsection id="H13675D8AFFE943589AF9749C03D92ADE"><enum>(i)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Board shall meet at least once each month at the call of the chair.</text></subsection><subsection id="HE38C328D3FD049B29F0804120B7ECD55"><enum>(j)</enum><header>Staff</header><text display-inline="yes-display-inline"><italic></italic>The chair may appoint and, consistent with title 5, United States Code, fix the pay of additional personnel as the chair considers appropriate.</text></subsection><subsection id="H718E42C9EA02439EB16186A4B0C9519B"><enum>(k)</enum><header>Firearm</header><text>For the purposes of this Act, the term <term>firearm</term> shall have the meaning given the term in section 921 of title 18, United States Code.</text></subsection><subsection id="H4343D2A3D83F41E0833A11258B7C13B2"><enum>(l)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this Act $5,000,000 for each of the first 2 fiscal years beginning after the date of the enactment of this Act, and $25,000,000 for each fiscal year thereafter.</text></subsection><subsection id="H3EB74960743D45CBB78F4D8D1D38FEBD"><enum>(m)</enum><header>Prohibition on diversion of other Federal gun violence research funds</header><text>The amounts made available for Federal gun violence research other than under this Act shall not be reduced in order to provide funds to carry out this Act.</text></subsection></section></legis-body></bill>
