which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of the Treasury to carry out a program under which all Federal funds for elementary and secondary education are provided directly to parents of eligible children or approved by parents for distribution to schools, and for other purposes.</official-title></form><legis-body id="H982DA466678A417D8DAB8350909B7FD3" style="OLC"><section id="HC917FA8AC23C4BAAB8FF8BE834BDB8AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>School Freedom Act of 2024</short-title></quote>.</text></section><section id="HE6B5AC93B71C41F099EC61AF7A814C33"><enum>2.</enum><header>Termination of Federal elementary and secondary education programs</header><subsection id="HDCEBCAA68E4043838C20991DEDCDD93C"><enum>(a)</enum><header>Termination</header><text>Each covered Federal education program shall terminate on a date determined by the Secretary of Education that is not later than June 30, 2025.</text></subsection><subsection id="HE01857A78FD944CFBC08750F64D4873E"><enum>(b)</enum><header>Wind-Down of programs</header><text>The Secretary of Education shall take such steps as may be necessary to provide for the orderly cessation of activities under each covered Federal education program by not later than the termination date specified in subsection (a).</text></subsection><subsection id="HB757A71882594603940BC631DCB6691F"><enum>(c)</enum><header>Reallocation of existing appropriations</header><text>Beginning on the date of the enactment of this Act, no Federal funds may be appropriated for a covered Federal education program.</text></subsection><subsection id="H8037ED39968D4E9E84C54DD2EBF1171E"><enum>(d)</enum><header>Allocation of unobligated amounts</header><text>Any amounts appropriated for a covered Federal education program that are unobligated as of the date such program terminates under subsection (a) shall be used to carry out the School Freedom Account program under section 3.</text></subsection></section><section id="H9F29FF58735246BDBB38396FED0DA095"><enum>3.</enum><header>School Freedom Account program</header><subsection id="HBA99DCFF92044F0292D9B66D013D1CF9"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, for each school year beginning on or after July 1, 2025, the Secretary of the Treasury shall carry out a program under which the Secretary shall—</text><paragraph id="HD0CCCEA1E7E44CD78417E46E8E1906DD"><enum>(1)</enum><text>establish an account on behalf of each eligible child (to be known as a <quote>School Freedom Account</quote>) into which the Secretary shall deposit funds in an amount determined under subsection (b); and</text></paragraph><paragraph id="HFF5DEF9EB49241A68444F350570060B1"><enum>(2)</enum><text>establish a procedure under which the parent of the child shall—</text><subparagraph id="H56BDF3FF18E847AB9A899D452087B189"><enum>(A)</enum><text>in the case of a parent who elects not to have their child attend a public elementary or secondary school for a school year, use funds in the account to pay for the educational expenses of the child in accordance with subsection (c)(1); or</text></subparagraph><subparagraph id="H334E7E12BFA54B9785BAEACDC07A644E"><enum>(B)</enum><text>in the case of a parent who elects to have their child attend a public elementary or secondary school for a school year, approve the disbursement of such funds to the local educational agency serving the school of the parent’s choice and attended by the child for use in accordance with subsection (c)(2).</text></subparagraph></paragraph></subsection><subsection id="H434F91FB5CED4929B0EF579D2E943FD9"><enum>(b)</enum><header>Deposit amount</header><paragraph id="H4DD593DCA75D43328966717F558B4607"><enum>(1)</enum><header>In general</header><text>The amount of funds deposited into each School Freedom Account for a school year shall be equal to the per-pupil Federal expenditure applicable to an eligible child for the school year, as determined under paragraph (2).</text></paragraph><paragraph id="H4D7C50AC5D5742E09F20C1BDA86A91E3"><enum>(2)</enum><header>Per-pupil Federal expenditure</header><subparagraph id="HD8D83754256442FE808778F9AB466BED"><enum>(A)</enum><header>First year of program</header><text>The per-pupil Federal expenditure applicable to an eligible child for the first school year that begins on or after July 1, 2025 shall be equal to—</text><clause id="HE14693D0590A4EE491E4336A39550410"><enum>(i)</enum><text>the sum of the total amount appropriated to carry out this section for fiscal year 2025 and any amounts made available under section 2(d); divided by</text></clause><clause id="H4008695EA8834F90A4FEC1FDCAA742FE"><enum>(ii)</enum><text>the total number of eligible children counted for such school year.</text></clause></subparagraph><subparagraph id="HE9F1E69C565041B0A533390B29EF5BE7"><enum>(B)</enum><header>Subsequent years</header><text>The per-pupil Federal expenditure applicable to an eligible child for any school year after the year described in subparagraph (A) shall be equal to—</text><clause id="H818F13488978499699323C29578F481A"><enum>(i)</enum><text>the total amount of Federal funds appropriated to carry out this section for the fiscal year that corresponds to such school year; divided by</text></clause><clause id="HA3E98C4F471C45109858510A4D3D387F"><enum>(ii)</enum><text>the total number of eligible children counted for such school year.</text></clause></subparagraph></paragraph></subsection><subsection id="H17B0ABA4A0D94EC69A3C6A3CB5B3F1CF"><enum>(c)</enum><header>Uses of funds</header><paragraph id="HA17EABF1227A4A2084311D8021454586"><enum>(1)</enum><header>Non-public school funds</header><text>Funds deposited into a School Freedom Account on behalf of child who does not attend a public elementary or secondary school for a school year may be used to pay for—</text><subparagraph id="HA432747942CA4CAFBDAFFDA297DE3119"><enum>(A)</enum><text>curriculum and curricular materials;</text></subparagraph><subparagraph id="H52615B35859F41CE9C6CC2288DDD3998"><enum>(B)</enum><text>books or other instructional materials;</text></subparagraph><subparagraph id="HEE02A95A07FF4F9F8D6EBDA2DC819708"><enum>(C)</enum><text>technological educational materials;</text></subparagraph><subparagraph id="H5FFB50C8BE794E88BC567B23A9757929"><enum>(D)</enum><text>online educational materials;</text></subparagraph><subparagraph id="HE0F7277F9A4B449CAEE6B1D25E89C143"><enum>(E)</enum><text>tutoring or educational classes outside the home, including micro school or learning pod;</text></subparagraph><subparagraph id="H66FDFFEE9768497593D6E660DC605EDD"><enum>(F)</enum><text>private school tuition;</text></subparagraph><subparagraph id="H192CEC6D993B4AFA8EE3ACD8B9EEE655"><enum>(G)</enum><text>public charter schools;</text></subparagraph><subparagraph id="H8FEDEC0C805F44E794A05C84E563961F"><enum>(H)</enum><text>extracurricular activities;</text></subparagraph><subparagraph id="H2E08C1AFB6A147D792F22A3F4216E4A6"><enum>(I)</enum><text>testing fees;</text></subparagraph><subparagraph id="H85E296D217A94B0D924A26802A237DEB"><enum>(J)</enum><text>diagnostic tools; or</text></subparagraph><subparagraph id="H8B43CD1C240A4FC6A368638213AEB8FB"><enum>(K)</enum><text>educational therapies for students with disabilities.</text></subparagraph></paragraph><paragraph id="H8005D9C3996A4DDBBEBC7561F281DF3B"><enum>(2)</enum><header>Public school funds</header><text>Funds disbursed from a School Freedom Account to a local educational agency for a school year may be used by the agency for any educational purpose authorized under the laws of the State in which such agency is located.</text></paragraph></subsection><subsection id="H18ED4140E9324B70883A0D1C5B6FCA75"><enum>(d)</enum><header>Rollover, conversion, and termination</header><paragraph id="HD65B0BC2F3B749D7910E0F4043C183C9"><enum>(1)</enum><header>Rollover</header><text>Amounts remaining in the School Freedom Account of an eligible child at the end of a school year shall remain available for expenditure in accordance with subsection (c) in subsequent school years until the earlier of—</text><subparagraph id="HB8FD1F63602D42F695EDB7B4C0CB82F6"><enum>(A)</enum><text>the date on which the child completes secondary school; or</text></subparagraph><subparagraph id="HB52820B5ABB547E9BEEED139067C17A7"><enum>(B)</enum><text>the date on which the child is no longer eligible to attend a public elementary or secondary school.</text></subparagraph></paragraph><paragraph id="HDFCFC3494782462F8188AAF38050CDA3"><enum>(2)</enum><header>Conversion</header><text>If amounts remain in a School Freedom Account as of the date described in paragraph (1), such account shall be redesignated as a <quote>Higher Education and Skills Obtainment Fund</quote>. No further deposits shall be made in the fund by the Secretary of the Treasury, but any amounts remaining in the fund may be used by the individual on whose behalf the fund was established to pay for postsecondary educational expenses, including—</text><subparagraph id="H21CF52CD8A124AC48402A072AE2390DE"><enum>(A)</enum><text>costs of attendance at an institution of higher education;</text></subparagraph><subparagraph id="HD0F730EDBEA74C37B55EE1711E80C071"><enum>(B)</enum><text>costs associated with career and technical education; and</text></subparagraph><subparagraph id="H9DD8DF1EFCB54D82A1B6009B5B0EBD16"><enum>(C)</enum><text>such other postsecondary educational expenses as may be approved by the Secretary for purposes of this paragraph.</text></subparagraph></paragraph><paragraph id="H4306C471FE014C049CC7828032B8A588"><enum>(3)</enum><header>Termination and return of funds</header><subparagraph id="HD948BBA9A9484AA79CD043A7969155FA"><enum>(A)</enum><header>Termination</header><text>The Higher Education and Skills Obtainment Fund of a student shall terminate on the date on which the student attains the age of 30 years.</text></subparagraph><subparagraph id="H6687A54EC72C4D07A335DCF5A594DD04"><enum>(B)</enum><header>Return of funds</header><text>Any funds remaining in a Higher Education and Skills Obtainment Fund on the date such fund terminates under paragraph (1) shall be returned to the Treasury of the United States.</text></subparagraph></paragraph></subsection><subsection id="HFCC6BF5CA4D84C59AB854E297891B706"><enum>(e)</enum><header>Limitation</header><text>The Secretary of the Treasury may not require that—</text><paragraph id="H1DA74F1F99CB4DEF876C4DB6DDADA0E2"><enum>(1)</enum><text>individuals obtain preapproval prior to the expenditure of amounts from a School Freedom Account or Higher Education and Skills Obtainment Fund; or</text></paragraph><paragraph id="H220FF56D01D34F77AC953AE18C129B40"><enum>(2)</enum><text>the expenditure of amounts from a School Freedom Account or Higher Education and Skills Obtainment Fund be through a specific marketplace or portal.</text></paragraph></subsection><subsection id="HD4D36B5B9433487AAE754EF397711EAB"><enum>(f)</enum><header>Exclusion from taxable income</header><text>Amounts in a School Freedom Account or Higher Education and Skills Obtainment Fund under this section shall not be included in the gross income of a parent or student for purposes of the Internal Revenue Code of 1986.</text></subsection></section><section id="HAEC32AD212044BDA9FE8C9AF07101410"><enum>4.</enum><header>Tracking of Federal education funds</header><text display-inline="no-display-inline"> Before the end of each school year, the Secretary of the Treasury shall determine—</text><paragraph id="H66B660A2C3A748DEBBEDF5F89D24CFB8"><enum>(1)</enum><text>the aggregate amount of deposits made to School Freedom Accounts under section 3 for such school year, stated separately for each local educational agency (based on the residence of the eligible child) and identifying the State in which the local educational agency is located; and</text></paragraph><paragraph id="H23B318C5C4F6443DAB9547DD61B0A3E3"><enum>(2)</enum><text>of the amount determined under paragraph (1) with respect to each local educational agency—</text><subparagraph id="HADFC454D2EEC46A1B911ED77302D2951"><enum>(A)</enum><text>the amount of funds distributed directly to parents in accordance with subparagraph (A) of section 3(a)(2); and</text></subparagraph><subparagraph id="H9B01DC1D43B14E63934279D527A2E354"><enum>(B)</enum><text>the amount of funds approved by parents for disbursement to the agency in accordance with subparagraph (B) of such section.</text></subparagraph></paragraph></section><section id="H51FDE68B5ABB454CB785BD999A153E8A"><enum>5.</enum><header>Rules of construction</header><text display-inline="no-display-inline"> Nothing in this Act shall be construed to—</text><paragraph id="H2205A9F57ECC49DAB7B0E3DA369DDA32"><enum>(1)</enum><text>affect any aspect of private, religious, or home education providers;</text></paragraph><paragraph id="H0A8E514139244FBCA5DF84D04686B156"><enum>(2)</enum><text>exclude private, religious, or home education providers from receiving funds from a School Freedom Account; or</text></paragraph><paragraph id="HA7CD3AE0FF084D008F4ECBCE3D80A95B"><enum>(3)</enum><text>require an educational service provider to alter any creed, practice, admissions policy, or curriculum in order to receive funds from a School Freedom Account.</text></paragraph></section><section id="H31E1EF6105A84D7A8DBC7C3C5790D587"><enum>6.</enum><header>Prohibition on new regulation</header><text display-inline="no-display-inline">The Secretary of the Treasury may not issue any rule, promulgate any regulation, or take any other action which imposes any limitation or requirement on the use of a School Freedom Account or Higher Education and Skills Obtainment Fund by a parent or eligible child.</text></section><section id="H512CB381CA7147C19A8EBFA468200EE2"><enum>7.</enum><header>GAO reporting on School Freedom Account and Higher Education and Skills Obtainment Fund</header><subsection id="HE7914249436B498E89B905C6E361B439"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of enactment of this Act, and annually thereafter, the Comptroller General of the United States shall submit a report to the Congress that—</text><paragraph id="H87C107A8BCF941FBA468F8B65E087385"><enum>(1)</enum><text>reviews the wind-down and termination of covered Federal education programs by the Secretary of Education;</text></paragraph><paragraph id="HB4F030E895684ADB861A153AE43AC8D8"><enum>(2)</enum><text>reviews the reallocation of existing appropriations and the allocation of unobligated amounts appropriated for covered Federal education programs to carry out section 3 of this Act;</text></paragraph><paragraph id="H284D1D6A78E14D2F82BFA8B1339DC6C6"><enum>(3)</enum><text>reviews the procedures established by the Secretary of the Treasury to allow parents to use funds to pay for educational expenses in accordance with section 3(c)(1);</text></paragraph><paragraph id="HFB15FD62D135439D85FAFA25AC3FF37B"><enum>(4)</enum><text>identifies the aggregate amount of deposits made to School Freedom Accounts under section 3 for the school year, stated separately for each local educational agency (based on the residence of the eligible child) and identifying the State in which the local educational agency is located;</text></paragraph><paragraph id="HB84E2D1434B5472DB82D464401E250F5"><enum>(5)</enum><text>identifies additional uses of funds in a School Freedom Account or Higher Education and Skills Obtainment Fund that could benefit an eligible child;</text></paragraph><paragraph id="H4BF80101AC644AEBBAAC0713E42E8D4A"><enum>(6)</enum><text>identifies the aggregate number of students who expend funds from a School Freedom Account to—</text><subparagraph id="H5F6FAC9BEBBE4482983908669E7C6632"><enum>(A)</enum><text>attend a private school;</text></subparagraph><subparagraph id="H02E463F8FF4C4A5883BCFC94BBFFEA1C"><enum>(B)</enum><text>attend a public charter school;</text></subparagraph><subparagraph id="H21C6C5CCE62C484AAA88232987ED46BF"><enum>(C)</enum><text>homeschool; and</text></subparagraph><subparagraph id="H940865E9FFE74B1E9881EA07F5968E25"><enum>(D)</enum><text>attend educational classes outside the home, including a micro school or learning pod;</text></subparagraph></paragraph><paragraph id="H039A2D3F30F244ACA9738A21A009985D"><enum>(7)</enum><text>identifies the aggregate amount expended from School Freedom Accounts, other than for eligible uses in section 3(c)(1);</text></paragraph><paragraph id="H217153E6479B406EB712735910BE08CF"><enum>(8)</enum><text>identifies the aggregate amount in School Freedom Accounts that rollover to the next school year;</text></paragraph><paragraph id="H17DC5229C59442659402193E46C32FD3"><enum>(9)</enum><text>identifies the aggregate number of School Freedom Accounts that convert to Higher Education and Skills Obtainment Funds, and the aggregate amount in accounts that are converted;</text></paragraph><paragraph id="H232FEA3CB9BF4E18A5F0569B4103A1E1"><enum>(10)</enum><text>identifies the aggregate number of students that expend amounts from a Higher Education and Skills Obtainment Fund to pay costs associated with attendance of an institution of higher education or with career and technical education;</text></paragraph><paragraph id="HBE39EACC6BA74F769CAB131CD5BD7770"><enum>(11)</enum><text>reviews the Secretary of the Treasury’s efforts to track Federal funds deposited into School Freedom Accounts;</text></paragraph><paragraph id="H31133471DF6B4F37857F0C7492C63193"><enum>(12)</enum><text>identifies the aggregate amount returned to the Treasury in the fiscal year following the termination of Higher Education and Skills Obtainment Funds; and</text></paragraph><paragraph id="H200B2C3D68424E01BAAB2FF82FA0EDEC"><enum>(13)</enum><text>includes any other matter the Comptroller General of the United States determines important to assessing and improving the implementation or administration of the School Freedom Account or Higher Education and Skills Obtainment Fund.</text></paragraph></subsection></section><section id="HD6A19EAF7B094EAE9D07D18A6205057E"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H4BA6FAFEC07B4DF9B579919F1200C3DF"><enum>(1)</enum><text>The term <term>career and technical education</term> has the meaning given that term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text></paragraph><paragraph id="HE8FE7907BAF44CBDB4A3214197721871"><enum>(2)</enum><text>The terms <term>child</term>, <term>elementary school</term>, <term>local educational agency</term>, <term>parent</term>, <term>secondary school</term>, and <term>State</term> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H4650B02F55CC4475853D84E53B70081D"><enum>(3)</enum><text>The term <term>cost of attendance</term> has the meaning given that term in section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>).</text></paragraph><paragraph id="H08EE52662E994DA0AE16CB377E795448"><enum>(4)</enum><text>The term <term>covered Federal education program</term> means an applicable program (as defined in section 400 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1221">20 U.S.C. 1221</external-xref>)) the primary purpose of which is to support elementary or secondary education, except such term does not include the School Freedom Account program authorized under this Act.</text></paragraph><paragraph id="HAED57234CC5C4962A9DB3AD63AAFDB6D"><enum>(5)</enum><text>The term <term>eligible child</term> means a child—</text><subparagraph id="HAE33A6A18EFD41308A78D1E07387CFB8"><enum>(A)</enum><text>who is eligible to enroll in a public elementary or secondary school for a school year;</text></subparagraph><subparagraph id="HDD585038C2FF4190AD1B2A5E73D52323"><enum>(B)</enum><text>who has been issued a social security number by the Social Security Administration; and</text></subparagraph><subparagraph id="HCFF81D11041A4F429F1481B7BC6D0784"><enum>(C)</enum><text>whose parent or guardian has been issued a social security number by the Social Security Administration.</text></subparagraph></paragraph><paragraph id="H312DFBDDC8F74DEFB3F092567E50256D"><enum>(6)</enum><text>The term <term>institution of higher education</term> has the meaning given that term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph></section></legis-body></bill>
