Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; 136 Stat. 2727; <external-xref legal-doc="usc" parsable-cite="usc/10/4811">10 U.S.C. 4811</external-xref> note) is amended—</text><paragraph id="HD0D34F6963F641148A5E9CC1C79B8B69"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H00A7D8164F6E4DD697DC467CA0205197"><enum>(A)</enum><text>in paragraph (1)(A)—</text><clause id="H58334E14729541BFAF7F07593B1E3048"><enum>(i)</enum><text>by striking <quote>permanent magnet</quote> and inserting <quote>permanent magnet, or an advanced battery or advanced battery component (as those terms are defined, respectively, in section 40207(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18741">42 U.S.C. 18741(a)</external-xref>)),</quote>; and</text></clause><clause id="H1157960036B3439AB27CCDB009951FA5"><enum>(ii)</enum><text>by striking <quote>of the magnet</quote> and inserting <quote>of the magnet, the advanced battery, or the advanced battery component (as applicable)</quote>; and</text></clause></subparagraph><subparagraph id="HA33F93B58F5B48B1845B4E12FC512F30"><enum>(B)</enum><text>in paragraph (2), by amending to read as follows:</text><quoted-block id="H9ADAA82AFA6C4CFD9CA36F872E32232D" style="OLC"><paragraph id="HADA5DFFBFDAC4FF1BD31756E5CCFA637"><enum>(2)</enum><header>Elements</header><text>A disclosure under paragraph (1) with respect to a system described in that paragraph shall include—</text><subparagraph id="HB2EFA1E3BFFE4278A4FCE5CF9FD17343"><enum>(A)</enum><text>if the system includes a permanent magnet, an identification of the country or countries in which—</text><clause id="H4EEA08FD49354CDFB623D4141022868C"><enum>(i)</enum><text>any rare earth elements and strategic and critical materials used in the magnet were mined;</text></clause><clause id="HC66332F674CC49708CDCDC5615413ABE"><enum>(ii)</enum><text>such elements and materials were refined into oxides;</text></clause><clause id="H17901580BE05403D931F31DB3A280A23"><enum>(iii)</enum><text>such elements and materials were made into metals and alloys; and</text></clause><clause id="H562D3E3889DC44BB80D79CC60D3C466F"><enum>(iv)</enum><text>the magnet was sintered or bonded and magnetized; and</text></clause></subparagraph><subparagraph id="H3D456C68DCE5492199A48CDD15E6665D"><enum>(B)</enum><text>if the system includes an advanced battery or an advanced battery component, an identification of the country or countries in which—</text><clause id="HF8BF4634AB534A2E9312CC650B04F39F"><enum>(i)</enum><text>any strategic and critical materials that are covered minerals used in the battery or component were refined, processed, or reprocessed;</text></clause><clause id="H3722C1C34D8B47328C0BDBAD7DB0E843"><enum>(ii)</enum><text>any strategic and critical materials that are covered minerals and that were manufactured into the battery or component; and</text></clause><clause id="HBDA459C1A1B24B49A0B797CAF0F62730"><enum>(iii)</enum><text>the battery cell, module, and pack of the battery or component were manufactured and assembled.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5A9222B2C0324248944CD61DA883206F"><enum>(2)</enum><text>by amending subsection (d) to read as follows:</text><quoted-block id="H098256E15AA8437F9146CCAE7C32A607" style="OLC"><subsection id="H5C576BE98672492B81D0AC6911D75172"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3CC0EFB05C234D6281A18114AADFC9A9"><enum>(1)</enum><text>The term <term>strategic and critical materials</term> means materials designated as strategic and critical under section 3(a) of the Strategic and Critical Materials Stock Piling Act (<external-xref legal-doc="usc" parsable-cite="usc/50/98b">50 U.S.C. 98b(a)</external-xref>).</text></paragraph><paragraph id="H6B25CB5FA7544A03A83062C23BD2AC25"><enum>(2)</enum><text>The term <term>covered minerals</term> means lithium, nickel, cobalt, manganese, and graphite.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H18C4963E67864A7FB79C826CAA4D9AD8"><enum>(b)</enum><header>Technical amendments</header><text>Subsection (a) of such section 857 is further amended—</text><paragraph id="H654471041E00412B93ACA7BE7F345221"><enum>(1)</enum><text>in paragraph (3), by striking <quote>provides the system</quote> and inserting <quote>provides the system as described in paragraph (1)</quote>; and</text></paragraph><paragraph id="H3FE438AF1B164D329C554846DC1739C3"><enum>(2)</enum><text>in paragraph (4)(C), by striking <quote>a senior acquisition executive</quote> and inserting <quote>a service acquisition executive</quote>.</text></paragraph></subsection></section></legis-body></bill>
