which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to require local educational agencies to develop emergency response and parental notification procedures for certain threats and emergencies, and for other purposes.</official-title></form><legis-body id="H9344363E453F44E282E9EFAD0902EE50" style="OLC"><section id="H9758159724F749EDA2F46DAB613B18DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>School Safety Notification System Act</short-title></quote>. </text></section><section id="HD07327F5AA87426084D5115664A56A73"><enum>2.</enum><header>Emergency response and parental notification procedures</header><text display-inline="no-display-inline">Title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H3CCAD8A97B65436392BC86C1E7E963C1" display-inline="no-display-inline"><part id="H7ACCF812DFE64235A82886B4CD8DA948"><enum>H</enum><header>Emergency response and parental notification procedures</header><section id="HC3405C93054E4D34841BE2FE1B0057D0"><enum>8701.</enum><header>Emergency response and parental notification procedures</header><subsection id="HFE40EA5DF8514C64A17217EE67FE8FE0"><enum>(a)</enum><header>Policies and notification required</header><text display-inline="yes-display-inline">As a condition of receiving funds under this Act, each local educational agency shall—</text><paragraph id="H5F49807A664C478EB384CA599DEECC2C"><enum>(1)</enum><text display-inline="yes-display-inline">develop and implement emergency response procedures covering all students, faculty, and staff at public elementary and secondary schools under the jurisdiction of the agency; and</text></paragraph><paragraph id="HFBA3CC67AC2A455F9985DF3AA65F10FD"><enum>(2)</enum><text display-inline="yes-display-inline">pursuant to such procedures, ensure that parents and guardians receive timely notification of covered threats and emergencies that occur on school grounds, during school transportation, or during school-sponsored activities.</text></paragraph></subsection><subsection id="H0C46FD7B8C534D7A8FA1C3DFFE4C26DB"><enum>(b)</enum><header>Additional requirements</header><text display-inline="yes-display-inline">The emergency response and notification procedures developed under subsection (a) shall meet the following criteria:</text><paragraph id="H22750C655E0E46C0ADF03AFF196E3B12"><enum>(1)</enum><text display-inline="yes-display-inline">The procedures shall be developed in consultation with appropriate public safety agencies.</text></paragraph><paragraph id="H3DD67D94098548919838565CE1A1C19C"><enum>(2)</enum><text>Commonly used alarm system responses for specific types of emergencies shall be implemented.</text></paragraph><paragraph id="H2486909A31714D6F9513E89AD9B105D4"><enum>(3)</enum><text>The procedures shall identify—</text><subparagraph id="H61A6B2B50AE64A908305F818EFBD3C50"><enum>(A)</enum><text>the primary emergency response agency that is responsible for each type of covered threat or emergency; and</text></subparagraph><subparagraph id="H676966AFFBD34FF9B8BC132BE041C0E9"><enum>(B)</enum><text>the individuals within each school who are responsible for contacting the primary emergency response agency in the event of such a threat or emergency.</text></subparagraph></paragraph></subsection><subsection id="H95D951E2C9FB403DA948E8A91FDEE8F6"><enum>(c)</enum><header>Covered threats and emergencies defined</header><text>In this section, the term <term>covered threats and emergencies</term> means—</text><paragraph id="H8CB05567180946A2A0422EADCE715032"><enum>(1)</enum><text>weapons possession or use when there is intended harm toward another person;</text></paragraph><paragraph id="H22766E07D797444D8297F49AC6061815"><enum>(2)</enum><text>active shooter or hostage situations;</text></paragraph><paragraph id="H079652BFFDCB41E292A84A1FA415E2AA"><enum>(3)</enum><text>bomb threats;</text></paragraph><paragraph id="HD5D4DC2B71994A7686DF11E1AD5AA252"><enum>(4)</enum><text>murder, homicide, or manslaughter;</text></paragraph><paragraph id="H51167BF6A47F4928A6DEC0DF7FEC6E49"><enum>(5)</enum><text>sex offenses, including rape, sexual assault, or sexual misconduct involving a student and school personnel;</text></paragraph><paragraph id="HB056772CFC684D8BA6117EB8C8D54CE4"><enum>(6)</enum><text>trespassing;</text></paragraph><paragraph id="HBC40338EB2E642869891535961BB9DA0"><enum>(7)</enum><text>fires;</text></paragraph><paragraph id="H48507FF25F0C484C97708B0B2C11E157"><enum>(8)</enum><text>natural weather emergencies, including hurricanes, tornadoes, and severe storms;</text></paragraph><paragraph id="H9279D113BD34467E85BBA350A55EF6FC"><enum>(9)</enum><text>natural disasters;</text></paragraph><paragraph id="HA776E4406A634941B10160DE6F14552B"><enum>(10)</enum><text>exposure to harmful substances or conditions as a result of a manmade emergency; and</text></paragraph><paragraph id="HA925386D5A5A41DAB7D57F072CC14D40"><enum>(11)</enum><text>such other threats and emergencies as a local educational agency determines appropriate to address through the procedures required under subsection (a).</text></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
