R. 9902</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241001">October 1, 2024</action-date><action-desc><sponsor name-id="L000578">Mr. LaMalfa</sponsor> (for himself and <cosponsor name-id="T000460">Mr. Thompson of California</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food Security Act of 1985 to allow for additional agricultural lands to be enrolled under the conservation reserve enhancement program, and for other purposes.</official-title></form><legis-body id="H5159D530E1B3408DBF22315F128F61FB" style="OLC"><section id="HF3F23415F28E4412B08D3F1B233FD679" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pacific Flyway Habitat Enhancement Act</short-title></quote>.</text></section><section id="H0978DE747040432199EF6C76A2F4CA5F"><enum>2.</enum><header>Conservation reserve enhancement program</header><text display-inline="no-display-inline">Section 1231A of the Food Security Act of 1985 is amended—</text><paragraph id="HFDFDA76C5B624EC68F7FFDD54DCA14CA"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (h); and</text></paragraph><paragraph id="H0551EA69561B43A5828384A6385936CC"><enum>(2)</enum><text>by inserting the following:</text><quoted-block style="OLC" id="H980624B0ABE24415B330CB72AAC3675A" display-inline="no-display-inline"><subsection id="HB7A9BE4DC23048A9B2283E033194A3CC"><enum>(f)</enum><header>Seasonally flooded working lands habitat conservation agreements</header><paragraph id="H19A54910A8C94499B8342C9896202B2E"><enum>(1)</enum><header>In general</header><text>In the case of an agreement under subsection (b)(1) that addresses diminished quantity and quality of wetland wildlife habitats, the Secretary, in consultation with the applicable State technical committee established under section 1261(a), may—</text><subparagraph id="H0544C6F6D7AA437491C5E23C299486B3"><enum>(A)</enum><text>enroll other agricultural land that is not eligible land on which the resource concerns identified in the agreement can be addressed if the enrollment of such other agricultural land is critical to the accomplishment of the purposes of the agreement;</text></subparagraph><subparagraph id="H703C0B054AB14EA4A3AC346D7E7D4716"><enum>(B)</enum><text>if the agreement involves the maintenance of habitat for one or more wetland-dependent species on working cropland, permit seasonally flooded agricultural uses on such working cropland with the adoption of at least one best management practice; and</text></subparagraph><subparagraph id="H58781E593463408BA478D94FE53240EE"><enum>(C)</enum><text>calculate annual rental payments in a manner that—</text><clause id="HC431100D53354B64B65B26FD7786E89E"><enum>(i)</enum><text>is comparable with annual costs to maintain other seasonally-flooded wetland wildlife habitats in the region; and</text></clause><clause id="HA1271A7D15BA4BBFA8E20C6A5E2E568B"><enum>(ii)</enum><text>ensures regional consistency in those rental payment rates.</text></clause></subparagraph></paragraph><paragraph id="H8F5CA04726804860A7938D02FE87155D"><enum>(2)</enum><header>Matching requirement waiver</header><text>In the case of an agreement described in paragraph (1), the Secretary may waive the matching requirement described in subsection (c)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
