which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 46, United States Code, to assign specified liability to a person who transfers title of a commercial vessel, or former commercial vessel, to a transferee for use as a recreational vessel if the transferee does not have applicable insurance at the time of the transfer and the vessel sinks, and for other purposes.</official-title></form><legis-body id="HA14CA8E7E1444FA6B4452585EA06C0D9" style="OLC"><section id="H9DF1DAD3EE634EFD86C239A1129F4682" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abandoned Vessel Prevention Act</short-title></quote>.</text></section><section id="HAE5CD47331E047F8AE146DE5B0DB01AF"><enum>2.</enum><header>Liability for specified expenses resulting from sinking of certain decommissioned commercial vessels</header><subsection id="H10AB9E3130094522BB90F324648B338B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/301">Chapter 301</external-xref> of title 46, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H2B183396C7A04B76B358C0AFA62DCF00" display-inline="no-display-inline"><section id="H272083BF84354FDE8C88D9FF316279A6"><enum>30107.</enum><header>Liability for specified expenses resulting from sinking of certain decommissioned commercial vessels</header><subsection id="HF2A22F82B3764B11AEAAA8B5AF41A7CA"><enum>(a)</enum><header>Liability for transferor</header><text display-inline="yes-display-inline">Except as provided in subsection (b), any person who transfers title of a covered vessel to another for use as a recreational vessel shall be liable for any specified expenses resulting from the vessel sinking on navigable waters of the United States.</text></subsection><subsection id="HB5EE4E90C9634A4E8EC7F083FADB6E21"><enum>(b)</enum><header>Exceptions</header><paragraph id="H0C4AC9B6FD294486A6DDB48FF850C3E6"><enum>(1)</enum><header>Vessel length; vessel age</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to a vessel less than 35 feet in length or fewer than 40 years old.</text></paragraph><paragraph id="H12A3E2ED812F4C64868F821967FBC461"><enum>(2)</enum><header>Insurance</header><text>Subsection (a) shall not apply to a person who transfers title of a covered vessel to a person who, at the time of the transfer, has insurance—</text><subparagraph id="HB9C6B38B9CE2472C8538115FD3E6977B"><enum>(A)</enum><text>applicable to the vessel for the 12-month period beginning on the date of the transfer; and</text></subparagraph><subparagraph id="H6007E559507D42C18E1C9F8C3C199021"><enum>(B)</enum><text>that, in the case the vessel sinks, covers specified expenses.</text></subparagraph></paragraph></subsection><subsection id="HB730179782D240008A9F386FDE95904C"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3ED781D031FD4E2894EC40225C756AF4"><enum>(1)</enum><header>Commercial vessel</header><text>The term <term>commercial vessel</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/4462">section 4462(a)(4)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/4462">26 U.S.C. 4462(a)(4)</external-xref>).</text></paragraph><paragraph id="HE5F526045283485FA283F50B736F132F"><enum>(2)</enum><header>Covered vessel</header><text display-inline="yes-display-inline">The term <term>covered vessel</term> means—</text><subparagraph id="H4611D1C99C34409B92722853579D7300"><enum>(A)</enum><text>commercial vessel; or</text></subparagraph><subparagraph id="HC0205472F0444B8996ACE04C89476F2B"><enum>(B)</enum><text>a recreational vessel that was previously a commercial vessel.</text></subparagraph></paragraph><paragraph id="H385FE43FAB894700886AF5AAD8973BD8"><enum>(3)</enum><header>Specified expenses</header><text display-inline="yes-display-inline">The term <term>specified expenses</term> mean, with respect to a sunken vessel—</text><subparagraph id="H650B9512CD944159A3C2ADBF1798E329"><enum>(A)</enum><text>damages attributable to the sinking of the vessel; and</text></subparagraph><subparagraph id="H3046FF5701B04B8B91D0C72C71B8E17B"><enum>(B)</enum><text>expenses relating to—</text><clause id="H4337A305907D4DA998FA1B41250A5541"><enum>(i)</enum><text>removal of the vessel and any debris;</text></clause><clause id="H70D6626FBDF741368B085EE3365AEB3E"><enum>(ii)</enum><text>clean-up of any pollution attributable to the sinking of the vessel; and</text></clause><clause id="HCA05391186304773AF9CF04648E4176D"><enum>(iii)</enum><text display-inline="yes-display-inline">any shut down of, or repairs or maintenance to, a water intake pump as a result of pollution attributable to the sinking of the vessel.</text></clause></subparagraph></paragraph><paragraph id="HAA360C9F619748EBAE01286776B3116A"><enum>(4)</enum><header>Recreational vessel</header><text>The term <term>recreational vessel</term> has the meaning given such term in section 2101 of title 46, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H98B755DA8D934D3C8F4697F642FDB42A"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/301">chapter 301</external-xref> of title 46, United States Code, is amended by adding at the end the following new item: </text><quoted-block style="USC" id="H0B7EC5A753C24C6199B34288F3AE2405" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">30107.
