which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Credit Reporting Act to require reporting certain positive consumer credit information, and for other purposes.</official-title></form><legis-body id="H9A4EFEFBFF27462B88A57CA13693FAB3" style="OLC"><section id="H192DEF5D39D141ECB4947821931A8A81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reporting Medical Debt Payments as Positive Consumer Credit Information Act of 2024</short-title></quote>.</text></section><section id="H31F612FD2CC04D0F82CEBE97841ABC78"><enum>2.</enum><header>Positive credit reporting of medical debt payments permitted</header><subsection id="H23C36FD2A3544F3E89FB1B0196EBDB32"><enum>(a)</enum><header>In general</header><text>Section 623 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H4EC17E199C674CC3B7339E79C8DCF434" style="OLC"><subsection id="HDA85CE2F263145C0AD6F284DBB206834"><enum>(f)</enum><header>Positive credit reporting of medical debt payments</header><paragraph id="HC06CBAA2EB8A4B6FAD2D1D4D4F9BE843" commented="no"><enum>(1)</enum><header>Treatment of paid or settled medical debt</header><text display-inline="yes-display-inline">A furnisher of medical debt information may furnish to a consumer reporting agency information relating to medical debt paid or settled by a consumer which antedates the consumer report of the consumer by one year.</text></paragraph><paragraph id="H65C44359CA504472B068F64A1D446C1E"><enum>(2)</enum><header>Treatment of medical debt payment plan</header><text display-inline="yes-display-inline">A furnisher of medical debt information may furnish to a consumer reporting agency information relating to the satisfactory performance of a consumer meeting the obligations of a payment plan for a medical debt owned by such furnisher if—</text><subparagraph id="HD93B77C2F8634FC8BB1BED0220BD0E83"><enum>(A)</enum><text display-inline="yes-display-inline">such furnisher and the consumer have entered into a payment plan with respect to the medical debt; and</text></subparagraph><subparagraph id="HC6954E97C06A4329B40828196EE72F4E"><enum>(B)</enum><text display-inline="yes-display-inline">the consumer is meeting the obligations of the payment plan, as determined by such furnisher.</text></subparagraph></paragraph><paragraph id="H65E70D96330D48348932F7782D45B98A"><enum>(3)</enum><header>Reasonable procedures for positive consumer credit information from furnishers of medical debt</header><text>Consumer reporting agencies and credit score providers shall adopt reasonable procedures for positive information relating to a consumer’s medical debt described in this subsection so that such information is—</text><subparagraph id="HFC03B7098CD74815B6CBF04ADFB84DE8"><enum>(A)</enum><text>included in a consumer report;</text></subparagraph><subparagraph id="H7C24AD5C5260456D91EBF56391A89FE0" commented="no"><enum>(B)</enum><text>utilized in the generation of any credit score; and</text></subparagraph><subparagraph id="H902F9748D6224E19B9FC01952D7DE21D" commented="no"><enum>(C)</enum><text>provided to users of consumer reports and credit scores in a manner which is fair and equitable to the consumer in accordance with the requirements of this title.</text></subparagraph></paragraph><paragraph id="HD3B2810AF6AC43DEA03C708F4A495503"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HC30191B3DBDD47B0A4A69940417D3FEB"><enum>(A)</enum><header>Credit score</header><text display-inline="yes-display-inline">The term <term>credit score</term> has the meaning given in section 609(f)(2).</text></subparagraph><subparagraph id="H8EC972853B744B77B958F3BCE03E6CAE"><enum>(B)</enum><header>Credit score provider</header><text>The term <term>credit score provider</term> means an entity that generates and makes available a credit score to a person.</text></subparagraph><subparagraph id="H1D5D9962D60046478BCF8FF6DFD80F1F"><enum>(C)</enum><header>Furnisher of medical debt information</header><text>The term <term>furnisher of medical debt information</term> means an entity that—</text><clause id="H16DD77D9705F4259B5F9799062F4D0D5" commented="no"><enum>(i)</enum><text>owns a medical debt; and</text></clause><clause id="HDBA4949A10DC49C58AEDA9AD279554D5"><enum>(ii)</enum><text>provides to a consumer reporting agency information relating to transactions, accounts, balances, repayment terms, repayment history, and similar information relating to such medical debt.</text></clause></subparagraph><subparagraph id="H0C6F58856B104B9DAF47ACD182ADD2ED"><enum>(D)</enum><header>Medical debt</header><text>The term <term>medical debt</term> means a debt arising from the receipt of medical services, products, or devices.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
