which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to address the shortage of medical laboratory personnel, and for other purposes.</official-title></form><legis-body id="H3058A0C34983477A8BAE1DDAE943F072" style="OLC"><section id="HC52A0F75164144E59F19F3B09A2E6BB6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Laboratory Personnel Shortage Relief Act of 2024</short-title></quote>.</text></section><section id="H8A74CCCA3C7B404A9C48EA2FFB466948" section-type="subsequent-section" commented="no"><enum>2.</enum><header>Including medical laboratory personnel and services in National Health Service Corps programs</header><subsection id="H371AEF375F6342E598982D740DEFFBDF"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 331(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254d">42 U.S.C. 254d(a)</external-xref>) is amended—</text><paragraph id="H8138C85B4088451EBFEF10C73220AC16"><enum>(1)</enum><text>in paragraph (3)(D), by striking <quote>or mental health</quote> and inserting <quote>mental health, or medical laboratory services</quote>; and</text></paragraph><paragraph id="HD74A4339BE6448A68F42BFA607E377A2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HA80C163EDA8742B5A448191A771E081D" display-inline="no-display-inline"><subparagraph id="H7F7C622BA1B74113A04D2960FA60194F" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">The term <term>medical laboratory personnel</term>—</text><clause id="H06B0C76A75934ABB90DB00A996E7376E"><enum>(i)</enum><text>means individuals—</text><subclause id="HE211432B3A0F43E992D1E34BB56DC5E9"><enum>(I)</enum><text>seeking or receiving training in an accredited medical laboratory science program; or</text></subclause><subclause id="HEAC306C58BEF4916BA2B9B76E7D2F4B0"><enum>(II)</enum><text>employed in a position in which the individual examines materials derived from the human body for the purpose of providing information for the diagnosis, prevention, or treatment of a disease or impairment of human beings; and</text></subclause></clause><clause id="H802883AED7B94BC28ADB0C9083AE5134"><enum>(ii)</enum><text>includes phlebotomists, medical laboratory assistants, histotechnologists, laboratory scientists, laboratory technicians, and genetic counselors.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H61D42F1F13914FE88F15DA4DDA796E82"><enum>(b)</enum><header>Medical laboratory health professional target areas</header><text display-inline="yes-display-inline">Section 332 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254e">42 U.S.C. 254e</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H92424F4BE09942D4AD3693BD29A6F915" display-inline="no-display-inline"><subsection id="H33EF0737F8F94C22BBE6C4D901081A5C" commented="no"><enum>(l)</enum><header>Medical laboratory health professional target areas</header><paragraph id="H575D444101784EEE84CA222A35479780" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a program of—</text><subparagraph id="HEB157DC189E84C479882B0E01DE50CA1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">identifying medical laboratory health professional target areas; and</text></subparagraph><subparagraph id="H261FF7B7425F486A809D4C02E6D1C413" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">assigning members of the Corps who are medical laboratory personnel to such areas.</text></subparagraph></paragraph><paragraph id="H2CAA81C4105648F9B92007A1DB3CFC57" commented="no"><enum>(2)</enum><header>Applicable provisions</header><text display-inline="yes-display-inline">The provisions of paragraphs (1), (2), (3), (4), and (6) of subsection (k) shall apply to the identification of medical laboratory health professional target areas and the assignment of medical laboratory personnel under this subsection except that—</text><subparagraph id="H9A95E49A35844D37B15EBBB3ACD3C62D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">references to maternity care health professional target areas shall be treated as references to medical laboratory health professional target areas; and</text></subparagraph><subparagraph id="H64A70D25805B42FEA17639416782A11E" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">references to maternity care health professionals and maternity care shall be treated as references to medical laboratory personnel and medical laboratory services, respectively.</text></subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="HAF71543D02404243B05F926B66D7D658"><enum>(c)</enum><header>Loan repayment program</header><text display-inline="yes-display-inline">Section 338B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254l-1">42 U.S.C. 254l–1</external-xref>) is amended—</text><paragraph id="H85A29F6A571F4C6AB5F1583D31BF491F"><enum>(1)</enum><text>in subsection (a)(1), by inserting <quote>medical laboratory personnel,</quote> after <quote>dentists,</quote>; and</text></paragraph><paragraph id="H78B7CD56C01E477BB26A9A698A213CA6"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H6F785456C76E4B96ADCB635DE9C7E8D2"><enum>(A)</enum><text>by striking <quote>an individual must—</quote> and all that follows through <quote>or physician assistant;</quote> and inserting the following: </text><quoted-block style="OLC" id="H565517A3AC214D01BBDB5161332A858D" display-inline="yes-display-inline"><text>an individual must—</text><paragraph id="H71DD3B4609CD4F998C7542812B6544CB"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H188224765566408889EFE0A2BD0C74E3"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H1A90C236BD524DF39C13C71DF52CCD8F"><enum>(i)</enum><text display-inline="yes-display-inline">have a degree in medicine, osteopathic medicine, dentistry, or another health profession, or an appropriate degree from a graduate program of behavioral and mental health;</text></clause><clause id="H0C1CDA086E3043E1A18624F73B7AD268" indent="up2"><enum>(ii)</enum><text>be certified as a nurse midwife, nurse practitioner, or physician assistant; or</text></clause><clause id="H1A4DEACD88A54706A98D815FA9D224F0" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">have a degree in medical laboratory science;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H4B49FE8A0CF24F46B7A3E291296690CD"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), by inserting <quote>medical laboratory science,</quote> after <quote>mental health,</quote>; and</text></subparagraph><subparagraph id="HE434D8C756F646BAAAAC9A2982A2CB44"><enum>(C)</enum><text>in paragraph (1)(C)(ii), by inserting <quote>medical laboratory science,</quote> after <quote>dentistry,</quote>.</text></subparagraph></paragraph></subsection></section><section id="HF529721355A14D4EB63801AEBAEEB376"><enum>3.</enum><header>Medical laboratory personnel education program</header><text display-inline="no-display-inline">The Public Health Service Act is amended by inserting after section 778 (<external-xref legal-doc="usc" parsable-cite="usc/42/295f-3">42 U.S.C. 295f–3</external-xref>) the following:</text><quoted-block id="H10559EBFA1C84D998C66F1F7F94E871E"><section id="H3155E4887982414BBB8D6BEA7FE355A4"><enum>779.</enum><header>Medical laboratory personnel education program</header><subsection id="HC9790114912C438C96DBC0BF55C8F560"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may make grants to, or enter into contracts with, eligible entities that the Secretary has determined are capable of carrying out such grant or contract—</text><paragraph id="H9E1FA35C8232406C97C4227ABA9EF9EC"><enum>(1)</enum><text display-inline="yes-display-inline">to plan, develop, operate, or participate in an accredited medical laboratory professional education program that awards an associate’s, bachelor’s, or graduate degree or certificate; and</text></paragraph><paragraph id="H01C6594FB2BA4EAB991A4C85A14809B8"><enum>(2)</enum><text>to recruit, train, and develop faculty for such program.</text></paragraph></subsection><subsection id="H5528A5E6AFA24A90ABE5C298327C31E3"><enum>(b)</enum><header>Priorities in making awards</header><text display-inline="yes-display-inline">In awarding grants and contracts under paragraph (1), the Secretary shall give priority to eligible entities that—</text><paragraph id="H636647E21E4B440F8DC9FC5D5570D0B9"><enum>(1)</enum><text>utilize innovative approaches to clinical teaching;</text></paragraph><paragraph id="H800DAD5E527B48A99374DFC550E046AC"><enum>(2)</enum><text>are committed to training individuals from rural, underrepresented, or disadvantaged backgrounds;</text></paragraph><paragraph id="HA0B3537C8EFA49A0BCC80363E662BDFC"><enum>(3)</enum><text>teach collaboration among health professionals; or</text></paragraph><paragraph id="HE80B476B06AE4C80BE65BF07B1FEDAAA"><enum>(4)</enum><text>provide training in cultural competency and health literacy.</text></paragraph></subsection><subsection id="H7B20A2C02A784FF699C1BF2C80B06547"><enum>(c)</enum><header>Duration of awards</header><text display-inline="yes-display-inline">A grant or contract awarded under this subsection shall be for a period of 3 years.</text></subsection><subsection id="HBC4D5E4ECF324ECCA1D715A608BF5874"><enum>(d)</enum><header>Eligible entity defined</header><text>In this section, the term <term>eligible entity</term> means an accredited nonprofit hospital, school of allied health, or nonprofit entity that sponsors accredited internship programs required for professional certification.</text></subsection><subsection id="H42FCA8C5DD464BC8A03C156421D78B2F"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section—</text><paragraph id="HB4F7878225CF448D85BC543887989BD8"><enum>(1)</enum><text display-inline="yes-display-inline">$25,000,000 for the first full fiscal year beginning after the date of enactment of this Act; and</text></paragraph><paragraph id="HF8F32DFE5CCB43A481E256D7D0E19165"><enum>(2)</enum><text display-inline="yes-display-inline">such sums as may be necessary for subsequent fiscal years.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
