R. 9846</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240925">September 25, 2024</action-date><action-desc><sponsor name-id="N000191">Mr. Neguse</sponsor> (for himself and <cosponsor name-id="C001114">Mr. Curtis</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Disaster Recovery Reform Act of 2018 to require the President to automatically waive certain critical document fees for individuals and households affected by major disasters for which assistance is provided under the Individuals and Households Program.</official-title></form><legis-body id="HB3B6BD53065C431BB30811F2702DA908" style="OLC"><section section-type="section-one" id="H4F387C8227214ED58EB5497023921094"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Replacing Essential Passports and Licenses After Certain Emergencies Act</short-title></quote> or the <quote><short-title>REPLACE Act</short-title></quote>.</text></section><section id="H1291AF31BD7C4010877C4952A2EC977A"><enum>2.</enum><header>Critical document fee waiver</header><text display-inline="no-display-inline">Section 1238(a) of the Disaster Recovery Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/42/5174b">42 U.S.C. 5174b</external-xref>) is amended—</text><paragraph id="HF63FBFA9BA2E45B58174280F98CFEF4B"><enum>(1)</enum><text>in paragraph (2), by striking <quote>applies regardless</quote> and inserting <quote>and the requirement of the President to waive fees under paragraph (4) apply regardless</quote>;</text></paragraph><paragraph id="HBE7E08CC43584B46948C2CDBE93823E8"><enum>(2)</enum><text>by redesignating paragraph (4) as paragraph (8); and</text></paragraph><paragraph id="H6DFEE296FEC440429339AB18D159A432"><enum>(3)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7E6587D478424E3CA8778126F326A67C"><paragraph id="HBA09F890B6F34E9DB6F3135667A4B6F3" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President, in consultation with the Governor of a State, shall provide a fee waiver described in paragraph (1) to any individual or household that has been adversely affected by a major disaster declared under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>)— </text><subparagraph id="HD748CCF067534E2E98D5002EDAEE37CE"><enum>(A)</enum><text>for which the President provides assistance to individuals and households under section 408 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>); and</text></subparagraph><subparagraph id="H0C98FB457D4C41C3AA770908C1BDBB2C"><enum>(B)</enum><text>that destroyed a critical document described in paragraph (1) of the individual or household.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H83C03F978C65496CBDCBE8681FC943F1"><enum>(5)</enum><header>Waiver availability</header><text>The Secretary of State and the Director of the United States Citizenship and Immigration Services shall make publicly available on the website of the Department of State and the United States Citizenship and Immigration Services, respectively, a notice of the availability of fee waivers described in paragraph (4).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0BBDCF8614204E699E64A93AE6E94670"><enum>(6)</enum><header>Report from USCIS</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this paragraph, and every year thereafter, the Director of the United States Citizenship and Immigration Services shall submit to Congress a report that includes, for the period covered by the report—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA11D54A1308C4165B2565BDA1C6FD6F0"><enum>(A)</enum><text display-inline="yes-display-inline">the number of fee waivers granted under this subsection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF79D29D663FA4E619D9DC70B8811974C"><enum>(B)</enum><text display-inline="yes-display-inline">the cost to the United States Citizenship and Immigration Services of granting fee waivers under this subsection.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35149E83B9AE4055AE67EB9F53DC2052"><enum>(7)</enum><header>Report from Department of State</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this paragraph, and every year thereafter, the Secretary of State shall submit to Congress a report that includes, for the period covered by the report—</text><subparagraph commented="no" display-inline="no-display-inline" id="H57BA6AD7BCDE4E6AA1D65DBF02A272C8"><enum>(A)</enum><text display-inline="yes-display-inline">the number of fee waivers granted under this subsection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4DC30A65606C4CA3B5BEDECE15140E02"><enum>(B)</enum><text display-inline="yes-display-inline">the cost to the Department of State of granting fee waivers under this subsection.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
