R. 9845</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240925">September 25, 2024</action-date><action-desc><sponsor name-id="M001206">Mr. Morelle</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, <committee-name committee-id="HAG00">Agriculture</committee-name>, <committee-name committee-id="HED00">Education and the Workforce</committee-name>, <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize competitive grants for the establishment of HOPE Accounts Pilot Projects and HOPE Action Plans Pilot Projects, and for other purposes.</official-title></form><legis-body id="H58690895377D44828A5FFBDB21F39AEB" style="OLC"><section section-type="section-one" id="H2788C42A88764BA7A8A931699F094176"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health, Opportunity, and Personal Empowerment Act of 2024</short-title></quote> or <quote><short-title>HOPE Act of 2024</short-title></quote>.</text></section><section id="HAA87762458D24C94B50C7BE8EDC2DDC1"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H4CFF6D8A86504E55A4E9B7808C733D75"><enum>(1)</enum><text>In 2022, according to the Department of Agriculture, 44,151,000 individuals in the United States (including 13,394,000 children) lived in food insecure households.</text></paragraph><paragraph id="H40D37104E9EB4303A17B72294864ED98"><enum>(2)</enum><text>Food hardship continues to be high, even after the official end of the COVID–19 public health emergency, with the Household Pulse Survey of the Bureau of the Census finding that, between March 1 and April 1, 2024, 23,220,357 individuals in the United States did not have enough to eat either often or sometimes.</text></paragraph><paragraph id="H3D3F20217CEB421B9A6D7848BC98B589"><enum>(3)</enum><text>In 2022, according to the Bureau of the Census, 37,920,000 individuals in the United States (including 11,149,000 children) lived below the Federal poverty line. The majority of these individuals living in poverty were working people, children, older individuals, veterans, and individuals with disabilities.</text></paragraph><paragraph id="H0669524E2EF0411B8FF72AB76E3FD84B"><enum>(4)</enum><text display-inline="yes-display-inline">Many low-income individuals work multiple jobs and, contrary to common misconceptions, if unemployed, they spend a great deal of time looking for work. They often travel by public transportation, laboriously making multiple connections to shuttle between home, work, social service agencies, houses of worship, and grocery stores. Low-income individuals living in rural and suburban areas far from work and without adequate public transportation rely upon vehicles to get to work, but these vehicles are often less reliable secondhand vehicles that often break down. From traveling greater distances between available jobs and livable areas with affordable housing options, seeking out scarce childcare options that fit a tight budget and a constrained travel schedule, and caring for elderly parents or grandparents because a senior living facility is not financially realistic, low-income individuals have little spare time.</text></paragraph><paragraph id="HC5C99E0AF1FA48FBB4EFF4695BA88B69"><enum>(5)</enum><text display-inline="yes-display-inline">While government safety net programs help tens of millions of individuals avoid starvation, homelessness, and other outcomes even more dreadful than everyday poverty, there are significant obstacles that those seeking and maintaining government assistance face for as long as they are eligible. Qualified applicants are often required to travel significant distances to multiple government offices, preparing and submitting piles of nearly identical paperwork to access the different government assistance programs. Even when the application process begins online, the eligible applicant is often still required to physically follow up with each government office with physical copies, for near identical meetings. As a result, many low-income people are actually unaware of all the government benefits for which they are eligible, reducing the amount of help going to individuals in need by tens of billions of dollars every year. The lines in these offices can seem endless, and sometimes clients need to wait outside for hours in the worst kinds of weather. Many offices do not have weekend or night hours, so an applicant is at risk of losing wages when often their only option is to apply for government help during work hours.</text></paragraph><paragraph id="H5316FBF06F46451D95CD4D78D6B65910"><enum>(6)</enum><text>Each year, many vital government programs go underutilized because eligible beneficiaries are hindered by obtrusive, time consuming, and repetitive application barriers. In fiscal year 2019, according to the Department of Agriculture, 18 percent of all people eligible for the Supplemental Nutrition Assistance Program (referred to in this paragraph as <quote>SNAP</quote>), 23 percent of the <quote>working poor</quote> eligible for SNAP, and 68 percent of adults over 60 who were eligible for SNAP failed to participate in such program. According to the Department of Agriculture, the overall coverage rate of pregnant women, infants, and children up to age 5 eligible for the Special Supplemental Nutrition Program for Women, Infants, and Children (commonly known as <quote>WIC</quote>) declined from 55 percent in 2016 to 50 percent in 2020. In fiscal year 2023, according to the Department of Agriculture, 47 percent of children in the United States who received meals through the National School Lunch Program did not received meals through the School Breakfast Program. In 2022, 8 percent of individuals in the United States lacked health insurance for the entire year, according to the Bureau of the Census. The Internal Revenue Service estimates that one in 5 low-income United States workers eligible for the Earned Income Tax Credit do not claim it.</text></paragraph><paragraph id="H46951385CE084D0790B3ADC9FFAF6944"><enum>(7)</enum><text>The United States has hundreds of thousands of nonprofit groups providing high-quality and much needed social services, but it is nearly impossible for struggling people to determine which of those organizations provide services they need, whether the organization is conveniently located, and for which services they are eligible. If they do determine that a nonprofit organization (or multiple nonprofit organizations) could help, they need to take yet more time to visit each one.</text></paragraph><paragraph id="HD151CA3A87D248DD98F9C483EBD6A3A7"><enum>(8)</enum><text>Since many government and nonprofit programs require frequent reapplications and recertifications, a low-income individual often has to repeat the same endless and frustrating process. </text></paragraph><paragraph id="HF5D8553E8B914EB2B6DBE43294567597"><enum>(9)</enum><text>Technology has fundamentally revamped the lives of most individuals, usually for the better. According to the Pew Research Center, 79 percent of adult individuals with incomes of $30,000 or less have a smart phone as of 2023 (not because a smart phone is a luxury but because it is an essential tool of learning and work in modern United States) but they rarely can use these devices to apply for benefits. Digital technology, combined with policy improvements, can simplify the lives and boost the long-term self-sufficiency of low-income individuals in the United States.</text></paragraph></section><section id="H64C71E64CE5F4655A4293AA71EBEA97A"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="H5D5094AA194E4209B493488B8CB10D3C"><enum>(1)</enum><header display-inline="yes-display-inline">Eligible entity</header><text>The term <term>eligible entity</term> means a State, unit of general purpose local government, Tribal government, or an entity that represents a smaller geographical area therein (including a neighborhood). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7D836D636D694E18A8BFF6BEA43888E5"><enum>(2)</enum><header>HOPE</header><text>The term <term>HOPE</term> means Health, Opportunity, and Personal Empowerment.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7E6840330E944886875E0024BD67FEAF"><enum>(3)</enum><header display-inline="yes-display-inline">Individual with a disability</header><text>The term <term>individual with a disability</term> means an individual with a disability (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0FFCA1AA350E4C969188CA0BBD30B258"><enum>(4)</enum><header display-inline="yes-display-inline">Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code.</text></paragraph><paragraph id="H1353E71125F44879B7F2B242C42EAD79"><enum>(5)</enum><header>Older individual</header><text>The term <term>older individual</term> has the meaning given such term in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>).</text></paragraph><paragraph id="H4AB10F3CF6064D8DB7360FFDF3F13659"><enum>(6)</enum><header>Qualified business or nonprofit organization</header><text>The term <term>qualified business or nonprofit organization</term> means an entity that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3E8BE824EE074C988F6D0CC7741DA17B"><enum>(A)</enum><text display-inline="yes-display-inline">is—</text><clause commented="no" display-inline="no-display-inline" id="H8017F746FB6E4241ACFD2B4AA9BC92EA"><enum>(i)</enum><text display-inline="yes-display-inline">a private business; or </text></clause><clause commented="no" display-inline="no-display-inline" id="HF4260EAA854F406DA0C83E5D50213C52"><enum>(ii)</enum><text display-inline="yes-display-inline">a nonprofit organization; </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9EE61F734A6143FB8E79644D78450645"><enum>(B)</enum><text display-inline="yes-display-inline">is based in the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD543AEBFD1104CBB9BB53FAD392A3A25"><enum>(C)</enum><text>has relevant, successful experience in technology.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB993DD10B7CF4569A5169C316BDC60A5"><enum>(7)</enum><header display-inline="yes-display-inline">Secretaries</header><text>The term <term>Secretaries</term> means the Secretary of Health and Human Services, the Secretary of Agriculture, and the Secretary of Housing and Urban Development, acting collaboratively (except as otherwise provided in this Act). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE4054B02DBDB44F3A20657C7D08967E7"><enum>(8)</enum><header display-inline="yes-display-inline">Target population</header><text>The term <term>target population</term> includes an individual who—</text><subparagraph id="H6B001B7CCE8D440388731C4998142CDA" commented="no"><enum>(A)</enum><text>earns an individual or household income below 200 percent of the Federal poverty line;</text></subparagraph><subparagraph id="H1604657C97F14FF48B20394968DA5DEF" commented="no"><enum>(B)</enum><text>suffers from food insecurity;</text></subparagraph><subparagraph id="H97789F14B6FF440A864BD919FB504AB8" commented="no"><enum>(C)</enum><text>earns insufficient individual or household income to ensure food security or economic security;</text></subparagraph><subparagraph id="H73E4B732020E4691942EC353C775B2D7" commented="no"><enum>(D)</enum><text>lives in a rural, suburban, or urban community that suffers from high rates of poverty, hunger, or food insecurity;</text></subparagraph><subparagraph id="HAA3645FCC0D545F79C3C7263A2764AED" commented="no"><enum>(E)</enum><text>is homeless;</text></subparagraph><subparagraph id="H364E7F3AF14949EF9DD74468278B139C" commented="no"><enum>(F)</enum><text>receives (or recently received) assistance under a State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>), relating to temporary assistance for needy families;</text></subparagraph><subparagraph id="H9FBC7CA7615D486093BA2A22560D22CE" commented="no"><enum>(G)</enum><text>is eligible for benefits under any Federal nutrition assistance program or Federal antipoverty program; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H04749AFCCD84486C9AF04EB49D8F3873"><enum>(H)</enum><text display-inline="yes-display-inline">is formerly a youth in transition from foster care or the juvenile detention facilities. </text></subparagraph></paragraph></section><section id="H842304DD2AA64FC48EC77FFED403CDE9"><enum>4.</enum><header>Competitive grants for pilot projects</header><subsection commented="no" display-inline="no-display-inline" id="H989F2102114946C6B0FEA69BA51ABD96"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>For each of fiscal years 2025 through 2030, the Secretaries shall make grants, on a competitive basis, to eligible entities to aid target populations through carrying out a HOPE Accounts Pilot Project described in subsection (b) or a HOPE Action Plans Pilot Project described in subsection (c).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HC3B393D2665540D88A3613976C93C20B"><enum>(b)</enum><header>HOPE Accounts Pilot Project</header><text>A HOPE Accounts Pilot Project shall enable individuals from target populations to establish through cooperating banks, credit unions, or governmental or Tribal agencies HOPE accounts for such individuals—</text><paragraph id="H7EDEE168ACE64BE4B59A1AF3DB52B795"><enum>(1)</enum><text display-inline="yes-display-inline">to have their paychecks deposited directly in such accounts;</text></paragraph><paragraph id="HA7581E9DEE4E400FB8853230C063B9A9"><enum>(2)</enum><text display-inline="yes-display-inline">to use such accounts to increase savings that would be matched with funds provided by government and private sources, including individual development accounts;</text></paragraph><paragraph id="HFE5A5692123740809359BCA90D03A671"><enum>(3)</enum><text display-inline="yes-display-inline">to use an account application on a smart phone to easily locate and sign up for job training and placement services online;</text></paragraph><paragraph id="HDD06AB7CBC134F3799B045ADAC91CAEE"><enum>(4)</enum><text display-inline="yes-display-inline">to use any smart phone, digital tablet, or computer—</text><subparagraph id="HD6F20FBF4893479C879141615B855DE8"><enum>(A)</enum><text>to learn about the public and philanthropic programs that provide benefits to such individuals, including aid—</text><clause commented="no" display-inline="no-display-inline" id="H0A0ED2D5E4FD46669D9E983DF03F1A8F"><enum>(i)</enum><text display-inline="yes-display-inline">to improve health, nutrition, job training and placement, housing, and income; and </text></clause><clause commented="no" display-inline="no-display-inline" id="H1DBD491519B7482EBB3C380A15C9D87D"><enum>(ii)</enum><text display-inline="yes-display-inline">to receive Federal and State tax credits; and</text></clause></subparagraph><subparagraph id="H36D8584CC0C94660B786453FFB104A1E"><enum>(B)</enum><text display-inline="yes-display-inline">subject to applicable Federal, State, local, or Tribal law and, in the case of private benefits, the cooperation of the provider of such benefits, to simultaneously apply for, submit eligibility documents for, enroll in, and manage the use of such benefits at once through the convenience of their device if such individuals or their households are eligible for 1 or more of such benefits; </text></subparagraph></paragraph><paragraph id="H13EDB544E8B14F1AA700AB7D167F4B27"><enum>(5)</enum><text display-inline="yes-display-inline">to receive—</text><subparagraph commented="no" display-inline="no-display-inline" id="HE6E308B367FE4AD3BC00873FD4B8CEB7"><enum>(A)</enum><text display-inline="yes-display-inline">a basic smart phone, digital tablet, or computer, if such individuals do not own a smart phone, digital tablet, or computer; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5736F4FE019F48E582A7D8C392DB2ABC"><enum>(B)</enum><text>subsidized internet Wi-Fi access;</text></subparagraph></paragraph><paragraph id="HD11609D4F1DD424FB49928D6194C7617"><enum>(6)</enum><text display-inline="yes-display-inline">to obtain the access and information described in paragraph (4) with assistance at libraries, government offices, or nonprofit organizations if such individuals are uncomfortable using internet technology themselves;</text></paragraph><paragraph id="H4562B516A9B94D4AA771026B17AEC453"><enum>(7)</enum><text display-inline="yes-display-inline">if such individuals are older individuals or individuals with a disability, to obtain access to the information described in paragraph (4) through receiving home visits with the assistance of government employees, employees of nonprofit organizations, or participants in an AmeriCorps program carried out under subtitle C of title I of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12571">42 U.S.C. 12571 et seq.</external-xref>) or under title II of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/5000">42 U.S.C. 5000 et seq.</external-xref>);</text></paragraph><paragraph id="H820D1DA399B449FBB09022E7EBDF251E"><enum>(8)</enum><text display-inline="yes-display-inline">to access health care information that specifies medical benefits, and any out-of-pocket costs, for each of the health plans for which such individuals may be eligible, and to empower them, as practicable, to easily select the plan that works best for them;</text></paragraph><paragraph id="HA7443163B3504F0088C422DF1C17772A" commented="no"><enum>(9)</enum><text>to deposit in the account cash that is set aside for education, job training, starting a business, or buying a home;</text></paragraph><paragraph id="H1918C05C1374434D80D1167179982F16"><enum>(10)</enum><text display-inline="yes-display-inline">in 1 central online account—</text><subparagraph id="HA2ED409E28B742D4AD0F84793E60B2F0"><enum>(A)</enum><text display-inline="yes-display-inline">to easily access and monitor the status, amounts, and recertification deadlines for some or all their benefits and savings; and</text></subparagraph><subparagraph id="HA4974BD1D12342D1AD2A34D3DD678AD6"><enum>(B)</enum><text>to pay bills online, saving high check cashing fees and enormous amounts of time;</text></subparagraph></paragraph><paragraph id="H847E4D187A1F441C80CA793CF24DCF18"><enum>(11)</enum><text display-inline="yes-display-inline">to budget their resources by using real-time cash flow data and long-term financial planning data, including calculating how much they would lose in interest on credit cards versus how much they would gain in interest by saving more;</text></paragraph><paragraph id="HF72B2C08E5D1436AA859FDE28E3D03FB"><enum>(12)</enum><text display-inline="yes-display-inline">to access calendar and scheduling functions that enable them to keep track of all job search, work, family, and school obligations, as well as any social service filing or appointment dates;</text></paragraph><paragraph id="H3F0ED537C6C141B9BF383E3DBB4ED5C8"><enum>(13)</enum><text display-inline="yes-display-inline">to be protected by security and privacy systems so that only such individuals, and not the government, nonprofit organizations, or banking partners, would be able to see or track private financial and appointment information; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4AFC0BDE9362446D9230F0086DF11FF5"><enum>(14)</enum><text display-inline="yes-display-inline">notwithstanding other provisions of law, to easily and clearly authorize their sharing of personal and financial information with multiple government agencies, solely for the purpose of those government agencies enabling those to apply for and utilize government benefits. </text></paragraph></subsection><subsection id="HC1C2A3D2B6044AB5BBCD01C5A3EE5322"><enum>(c)</enum><header>HOPE Action Plans Pilot Project</header><text display-inline="yes-display-inline">A HOPE Action Plans Pilot Project shall enable individuals from target populations to partner with government and nonprofit organizations by entering into voluntary agreements with such government and nonprofit organizations to carry out HOPE action plans that—</text><paragraph id="H7133E4A9CC5D4904A2C1BE59DB123019"><enum>(1)</enum><text display-inline="yes-display-inline">specify exactly how the parties to such plans will help such individuals and their families earn, learn, and save better in order to ensure greater economic opportunity for themselves and their children by working together in a long-term, positive relationship for the purpose of ensuring upward mobility;</text></paragraph><paragraph id="H6F42109D14CE489CB0E89C6A7D98DA66"><enum>(2)</enum><text display-inline="yes-display-inline">could empower such individuals and their families to better organize their time and focus their activities on productive endeavors while providing them extra resources to do so;</text></paragraph><paragraph id="H640ECEAA22BD428889731148977274E6"><enum>(3)</enum><text display-inline="yes-display-inline">could be short-term (a period of not more than 2 years) and aimed at helping families achieve very basic goals, such as avoiding homelessness and hunger;</text></paragraph><paragraph id="HF096CFD79A27410990D8D808FAEE8374"><enum>(4)</enum><text display-inline="yes-display-inline">could be long-term (a period of more than 2 years) with far more ambitious goals for upward mobility; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H825546485CE6441D9D5C818EDE10D240"><enum>(5)</enum><text display-inline="yes-display-inline">would require that participating individuals and their families and participating government entities and nonprofit organizations have equal rights to hold each other accountable for plan outcomes and funding.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H02F1A26F26164C9A95417AF7528E01EF"><enum>(d)</enum><header display-inline="yes-display-inline">Applications; period of grants</header><paragraph commented="no" display-inline="no-display-inline" id="H63A41A12F7A845219B00A1362EFDA4D9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretaries shall each create an application process for eligible entities to apply for a grant under this section. To be eligible to receive a grant under this section, an eligible entity shall submit to one of the Secretaries an application—</text><subparagraph commented="no" display-inline="no-display-inline" id="H643341BB826B46F9A72895F1ECC2F7AD"><enum>(A)</enum><text display-inline="yes-display-inline">that contains a description of how the applicant proposes to use the grant funds to implement the components of a HOPE Accounts Pilot Project described in subsection (b) or a HOPE Action Plans Pilot Project described in subsection (c); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD8FA2EB2A844481AAC52A3783C49865E"><enum>(B)</enum><text display-inline="yes-display-inline">that is submitted in such form, at such time, and containing such other information as the Secretaries may require.</text></subparagraph></paragraph><paragraph id="H9DCA86A3D29242819D8E3E50B86380E3"><enum>(2)</enum><header>Period</header><text>A grant under this section shall be for a period not to exceed 5 years.</text></paragraph></subsection><subsection id="H6F803710662541CB9AB9B8705BCA6356"><enum>(e)</enum><header>Form of grants</header><text>If a Secretary finds it appropriate, the Secretary may use cooperative agreements, as described in section 6305 of title 31, United States Code, for purposes of making grants under this section.</text></subsection><subsection id="H094CEDABF02240E4AF15DF7EFFBBC805"><enum>(f)</enum><header>Amount of grant</header><text>Grants made under this section shall range in amounts from $250,000 to $3,000,000, and shall be proportionate to the geographical size, project complexity, and number of individuals participating in each project supported by the grant. Eligible entities may receive grants made under this section by 2 or more of the Secretaries. To the extent funds are available, the Secretaries shall each make not fewer than 8 such grants annually.</text></subsection><subsection id="H0614C34C8D5A49D286075BCA62DA9BB7"><enum>(g)</enum><header>Distribution of grants</header><text>To the extent practicable, the Secretaries shall make grants for pilot projects that operate statewide, as well as pilot projects designed to serve specific rural, urban, and suburban areas. To the extent practicable, pilot projects for which grants are made shall be distributed among diverse administrative regions of the Department of Housing and Urban Development, the Department of Health and Human Services, and the Department of Agriculture.</text></subsection><subsection id="H556D43FDEDE1425EA2DE8A78E6C42ACC"><enum>(h)</enum><header>Preference</header><text>For purposes of making grants under this section, preference shall be given to grants for pilot projects that—</text><paragraph id="H3B2033DC8EC24AB59D6ABFE2D3C6FF46"><enum>(1)</enum><text>serve individuals in rural or urban communities that are historically underserved and have a high rate of poverty;</text></paragraph><paragraph id="H4B347B913B514A47949BD789951EE107"><enum>(2)</enum><text>simultaneously carry out a HOPE Accounts Pilot Project described in subsection (b) and a HOPE Action Plans Pilot Project described in subsection (c);</text></paragraph><paragraph id="H4E343EE41E0645E3BF16C0CD949AFBB5"><enum>(3)</enum><text>involve low-income individuals as equal partners in project planning and implementation;</text></paragraph><paragraph id="H89402BAE2E804951A2098F95529D5757"><enum>(4)</enum><text>make additional funds available directly to low-income households through action plans, either through government payments or through subgrants to nonprofit organizations;</text></paragraph><paragraph id="H82700E828AEA47E6AFCCC08757A51D91"><enum>(5)</enum><text>are matched by considerable non-Federal funds without penalizing rural or urban communities that are very low income, underserved, and cannot provide non-Federal matching funds;</text></paragraph><paragraph id="H60706D8D6A3746BEA1361857AA6D0FDE"><enum>(6)</enum><text>propose concrete plans for long-term sustainability and expansions without future Federal grant funds;</text></paragraph><paragraph id="H432EEA67476B4CB1A4B98AC1E5B8CCC1"><enum>(7)</enum><text>assist low-income households to apply for Federal earned income tax credits and State tax credits;</text></paragraph><paragraph id="H22BF6FC2E0424DA282807ADFE857928E"><enum>(8)</enum><text display-inline="yes-display-inline">provide resources in English and in additional languages commonly spoken in the area served by the pilot project;</text></paragraph><paragraph id="HEA981C6B87A84A05B8BAD3046A3E5809"><enum>(9)</enum><text display-inline="yes-display-inline">prioritize client-facing, fully-tested, technology and mobile device applications;</text></paragraph><paragraph id="H29AD42A0A1904AB6885B0F4AEE298ED1"><enum>(10)</enum><text display-inline="yes-display-inline">include a robust monitoring and evaluation planning and reporting plan, including proposed staffing and reporting for that plan, including reporting on—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA8F5F3456151492F9F3D0836598E073F"><enum>(A)</enum><text display-inline="yes-display-inline">the extent to which the pilot project makes it easier, quicker, and less costly for low-income individuals in the United States to access a variety of benefits;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0723DA1A74314F3BAC7B5322814A8619"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which the pilot project will save administrative funds over the long run; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H84DBC1BB36F5469A9D99FF04B8465683"><enum>(C)</enum><text display-inline="yes-display-inline">the extent to which the accuracy and integrity of the benefits programs included are maintained or improved; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9BEAC9BE803248D98E31831F426914E7"><enum>(D)</enum><text display-inline="yes-display-inline">the extent to which low-income households are able to more easily obtain free or low-cost banking services;</text></subparagraph></paragraph><paragraph id="H13882614C1584FCB95B07EBB93E647F2"><enum>(11)</enum><text display-inline="yes-display-inline">subcontract part of the implementation of the pilot project to United States-based private businesses, banks, savings and loans, credit unions, co-ops, or nonprofit organizations, with relevant, successful experience in similar or related project activities;</text></paragraph><paragraph id="H21830FB9C9244327AAFA78E0D715CE04"><enum>(12)</enum><text display-inline="yes-display-inline">incorporate a benefits calculator to enable applicants to learn how the receipt of some benefits might or might not impact whether they are eligible for other benefits and might impact the amount of those other benefits for which they are eligible;</text></paragraph><paragraph id="H3281B2B9858B43B6BDE07B1BA9035698"><enum>(13)</enum><text display-inline="yes-display-inline">include planning and funding for the eligible entities to train their staffs and clients to utilize the new technologies under the pilot project;</text></paragraph><paragraph id="HAFCEEE3A17074D10A5E4E86F4DD14674"><enum>(14)</enum><text display-inline="yes-display-inline">in rural and other areas without strong broad-band service, integrate activities under the pilot project with other activities to strengthen local-broad band service;</text></paragraph><paragraph id="HA0D9DC3724D842EAB5D186320BAD8D39"><enum>(15)</enum><text display-inline="yes-display-inline">enable low-income individuals in the United States to obtain smart phones, and data services, at no cost or at a reduced cost;</text></paragraph><paragraph commented="no" id="H68B8D2451FE34B03B6573DE99DF77C48"><enum>(16)</enum><text display-inline="yes-display-inline">ensure that individuals without personal smart phone, tablet, or computer access are able to benefit from the systems and technological improvements under the pilot project at public locations such as public libraries, community centers, and social service offices;</text></paragraph><paragraph id="H1EAA55BC3C574A02A3DD93ACA0D72C53"><enum>(17)</enum><text display-inline="yes-display-inline">propose a detailed, workable plan to thoroughly beta test and field test any new technologies or systems under the pilot project before making such technologies or systems available to all households, individuals, or the entire area served by the pilot project; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H851177E095A94A1F8B2C54EB8E3C6172"><enum>(18)</enum><text display-inline="yes-display-inline">identify the applicable Federal, State, local, or Tribal statutory and regulatory authorities, including waiver authorities, to be potentially leveraged to most effectively implement the pilot project.</text></paragraph></subsection></section><section id="H0584B86B91444462ACC0E590B99DC418"><enum>5.</enum><header>HOPE technology innovation contracts</header><subsection commented="no" display-inline="no-display-inline" id="HF3EC230D64BD44B4B19BA950B78F7E3D"><enum>(a)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, in consultation with the Secretary of Agriculture and the Secretary of Housing and Urban Development, shall hold a merit-based competition to award HOPE Technology Innovation Contracts to qualified business or nonprofit organizations to create technology applications, widgets, and templates that eligible entities can use to create HOPE accounts described in section 4(b).</text></subsection><subsection id="H803FE350F041415983710BBB7105012F"><enum>(b)</enum><header>Number of contracts</header><text display-inline="yes-display-inline">The Secretary shall award not more than 10 and not fewer than 2 contracts under this section for each of fiscal years 2025 through 2030.</text></subsection><subsection id="HE7F61AA7D6EC41E3A9F350D210225C9B"><enum>(c)</enum><header>Size of contracts</header><text display-inline="yes-display-inline">Contracts under this section shall range in size from $200,000 to $4,500,000.</text></subsection><subsection id="HCF979EA05BEE4F64BED561CA5971DB46"><enum>(d)</enum><header>Availability to the public</header><text display-inline="yes-display-inline">All technologies developed with funds from a contract under this section shall be open-sourced and available to the public at no cost.</text></subsection><subsection id="H9B40D65D8BB0436FA7020B74A06DAC8D"><enum>(e)</enum><header>Household data</header><paragraph commented="no" display-inline="no-display-inline" id="H3C7306B7B0574DC685AEF60D7A1AEC37"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a qualified business or nonprofit organization that enters into a contract under this section shall not have access to any client or household data through such contract.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35329747CC23441FB19C60294B3E163E"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">A qualified business or nonprofit organization that enters into a contract under this section and that is also a contractor or subgrantee for an<italic></italic> eligible entity for purposes of assisting such entity in carrying out a HOPE Accounts Pilot Project described in section 4(b) may have limited, functional access to client or household data with respect to such assistance. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H806FAA7AFCE84C20B9D153CAFF546244"><enum>(3)</enum><header>Prohibition on sharing or selling data</header><text display-inline="yes-display-inline">In no case shall a qualified business or nonprofit organization that enters into a contract under this section share or sell client or household data obtained through such contract.</text></paragraph></subsection><subsection id="H232903DD44A046E1B9B7D78F7325D1FC"><enum>(f)</enum><header>Preferences</header><text display-inline="yes-display-inline">In awarding contracts under this section, the Secretary of Health and Human Service shall give preference to contracts—</text><paragraph id="H18BB06C75BF8437AAB968FD649009E9A"><enum>(1)</enum><text display-inline="yes-display-inline">for client facing technology, with the Secretary giving higher preference for mobile device applications and uses and giving secondary preference for tablet, computer, and texting uses;</text></paragraph><paragraph id="H73855DBF5E7E4857921F768C0F9CB310"><enum>(2)</enum><text display-inline="yes-display-inline">that incorporate fail-safe systems to maintain the privacy and security of data;</text></paragraph><paragraph id="H67B99F35CA824A5D9E0F4C8106AE4948"><enum>(3)</enum><text display-inline="yes-display-inline">that are easily adaptable at the lowest possible financial costs with the least possible staff time by eligible entities carrying out a pilot project supported by section 4 and other State, county, city, municipal, and Tribal governments in a manner that can easily be utilized by low-income individuals in the United States; and</text></paragraph><paragraph id="H989E08B17064490D8C39240212977FD4"><enum>(4)</enum><text display-inline="yes-display-inline">that build in the ability to be easily updated as technologies evolve.</text></paragraph></subsection></section><section id="H6C54C91A32B044FB96C5AF5BE259E53F"><enum>6.</enum><header>Maintenance of effort and nondisplacement of workers</header><text display-inline="no-display-inline">None of the pilot projects carried out under section 4, or contracts carried out under section 5, shall do any of the following:</text><paragraph id="H8BF6E84C8C19425DBEE5297A76CE2D4F"><enum>(1)</enum><text display-inline="yes-display-inline">Decrease the overall monetary value of Federal, State, local, or Tribal government funding assistance given to any individual or family, although all entities involved in the pilot project or contract may independently, or jointly, increase funding under such project or contract.</text></paragraph><paragraph id="HA92D5F8BBB6B429DB14BBA83FF1EE2DB"><enum>(2)</enum><text>Decrease the overall Federal, State, local, or Tribal government funding for antipoverty programs spent by communities or agencies participating in the pilot project or contract, although all entities involved in the pilot project or contract may independently, or jointly, increase funding.</text></paragraph><paragraph id="HCE4AC68E3A0A4DB983104B539A3017A8"><enum>(3)</enum><text>Lengthen the amount of time or increase the requirements necessary to receive any government benefits, or in any way make it more difficult to obtain any form of government assistance.</text></paragraph><paragraph id="HFADC173F74744E7CA6E7F1EC88127A7B"><enum>(4)</enum><text>Limit the legal rights of anyone in the target populations to receive government or nonprofit assistance.</text></paragraph><paragraph id="H52FD7C6253224E93A7E58A4DF1FB6444"><enum>(5)</enum><text display-inline="yes-display-inline">Decrease overall public sector employment in any community of the eligible entity carrying out the project or qualified business or nonprofit organization carrying out the contract, but public employees could be transferred at similar or higher salaries and pay grades from positions that oversee paperwork to positions that provide direct services to the public, assuming such transfers do not violate collective barraging agreements or their other rights as public employees.</text></paragraph><paragraph id="H6EEF8472F7E244D7A55A7B03DD3CD966"><enum>(6)</enum><text>Decrease or increase work requirements for existing government programs.</text></paragraph><paragraph id="H4CD7968AA47B4C14994151634EEC0102"><enum>(7)</enum><text>Reduce program integrity measures or increase the possibility of fraud in any government program.</text></paragraph><paragraph id="HF2A220A05B7042EAAE37D61F77659254"><enum>(8)</enum><text display-inline="yes-display-inline">Track or monitor the physical location or immigration status of immigrants, be used for any immigration enforcement activity against any individuals, or be used to provide any data under any circumstance or to any extent to agencies involved in immigration enforcement activities or policy.</text></paragraph><paragraph id="H850AFAA0893E44798BEEA87676A71F26"><enum>(9)</enum><text display-inline="yes-display-inline">Enable the eligible entity carrying out the project or qualified business or nonprofit organization carrying out the contract or a contractor, subcontractor, or partner of the eligible entity or qualified business or nonprofit organization to share or sell client or household data obtained through the project or contract.</text></paragraph><paragraph id="HB0B4F883027E44409929E2A8D1EB55B9"><enum>(10)</enum><text display-inline="yes-display-inline">Eliminate the existing ability of applicants to apply for, recertify, or manage government benefits by physically visiting a government office.</text></paragraph></section><section id="H219FEE0B583744FE8B5E16F3512DD1B1"><enum>7.</enum><header>Annual reports to Congress</header><subsection id="H638643AE575B42A4B73DDA19174DDF76"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than September 30 of each of fiscal years 2025 through 2031, the Secretaries shall submit to Congress a report on the results of pilot projects carried out under section 4 or contracts carried out under section 5.</text></subsection><subsection id="H39479950AA494B0D82FCFDF33A5B98ED"><enum>(b)</enum><header>Contents of report</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include detailed data on—</text><paragraph commented="no" display-inline="no-display-inline" id="H2CD88CA76F9541EBAEC5C1FA01E699CA"><enum>(1)</enum><text display-inline="yes-display-inline">the extent to which such pilot projects and contracts make it easier, quicker, and less costly for low-income individuals in the United States to access a variety of benefits; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAC0AE4407E1A4AC3A9D547AB435E80D9"><enum>(2)</enum><text display-inline="yes-display-inline">the extent to which the pilot projects and contracts will save administrative funds over the long-run;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H15B975B878AA401C9AA9961EA887C2A4"><enum>(3)</enum><text display-inline="yes-display-inline">the extent to which the accuracy and integrity of the benefits programs included are maintained or improved; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H02E786983BFD437B90A61F09072D92E0"><enum>(4)</enum><text display-inline="yes-display-inline">the extent to which low-income households are able to more easily obtain free or low-cost banking services.</text></paragraph></subsection></section><section id="H38EEB65ADC554E868617049CB592EFF7"><enum>8.</enum><header>Authorization of appropriations; technical assistance authorized</header><subsection id="H6EAAFCA252864B0C8FB9E7F968EA0BDA"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this Act for each of fiscal years 2025 through 2030—</text><paragraph id="H11334CC2299445F59C449A5FED15C1D6"><enum>(1)</enum><text display-inline="yes-display-inline">$10,000,000 to the Secretary of Housing and Urban Development, of which—</text><subparagraph commented="no" display-inline="no-display-inline" id="H52132D71A75A402FA15CF503374FF682"><enum>(A)</enum><text display-inline="yes-display-inline">$500,000 shall be used internally by the Department of Housing and Urban Development for staff and other expenses to plan, award, and oversee pilot projects under section 4; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA01B403BAE564B02AEADF952C1D0BCC9"><enum>(B)</enum><text display-inline="yes-display-inline">$9,500,000 shall be available for grants under section 4;</text></subparagraph></paragraph><paragraph id="HCF2292C596F34C8A8D3E0B0259E37F36"><enum>(2)</enum><text display-inline="yes-display-inline">$10,000,000 to the Secretary of Agriculture, of which—</text><subparagraph commented="no" display-inline="no-display-inline" id="H928356A05A2141DFAFDFD53A2CDEAB26"><enum>(A)</enum><text display-inline="yes-display-inline">$500,000 shall be used internally by Department of Agriculture for staff and other expenses to plan, award, and oversee pilot projects under section 4; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFFD425386F8A47F294ED08B2AAB4FBF7"><enum>(B)</enum><text display-inline="yes-display-inline">$9,500,000 shall be available for grants under section 4; and</text></subparagraph></paragraph><paragraph id="H12D30EF762BF4321BF647BB5577E1639"><enum>(3)</enum><text display-inline="yes-display-inline">$15,000,000 to the Secretary of Health and Human Services, of which—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC5109CCD5C9340838DF817C4414F492B"><enum>(A)</enum><text display-inline="yes-display-inline">$500,000 shall be used internally by the Department of Health and Human Services for staff and other expenses to plan, award, and oversee pilot projects under section 4 and the contracts under section 5; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCBC4E83701784012AFA14861DBA2275B"><enum>(B)</enum><text display-inline="yes-display-inline">$9,500,000 shall be available for grants under section 4; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCAB612F5853B4287B9B90B7CC98DC904"><enum>(C)</enum><text display-inline="yes-display-inline">$5,000,000 shall be available for contracts under section 5.</text></subparagraph></paragraph></subsection><subsection id="H2BBD3C75EB9C450194EBFA9894B6F4E4"><enum>(b)</enum><header>Technical assistance authorized</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, the Secretary of Agriculture, the Secretary of Housing and Urban Development, the Secretary of Veterans of Affairs, the Secretary of the Interior, the Secretary of Labor, the Commissioner of the Internal Revenue Service, the Chief Executive Officer of the Corporation for National and Community Service, the Administrator of the Small Business Administration, the Director of the Office of Management and Budget, the Director of the Office of Science and Technology Policy, the Chairman of the Federal Deposit Insurance Corporation, and the Domestic Policy Council may, to advance the objectives of the pilot projects carried out under section 4 and the contracts carried out under section 5—</text><paragraph id="HF577A795AC1D43C0BE55E81E703C6700"><enum>(1)</enum><text>provide technical assistance;</text></paragraph><paragraph id="H62D37942D34C40A1BF749A7DA44AB1B9"><enum>(2)</enum><text>solicit voluntary, nonmonetary assistance from universities, credit unions, and private sector technology companies, banks, and financial institutions; and</text></paragraph><paragraph id="H3C8F12026CAD4FB8B9C1A73494596983"><enum>(3)</enum><text display-inline="yes-display-inline">inform eligible entities of the applicable Federal, State, local, or Tribal statutory and regulatory authorities, including waiver authorities.</text></paragraph></subsection><subsection id="H9A481BEDFD6144168315EE65501528D1"><enum>(c)</enum><header>Persistent Poverty Counties</header><paragraph id="H0E584A0C5EFC444CBB6CE0C1BA353BFD"><enum>(1)</enum><header>Allocation requirement</header><text>Of the amount appropriated to carry out this Act, not less than 10 percent shall be allocated to provide assistance in persistent poverty counties.</text></paragraph><paragraph id="HBD84D14CC9CC4E9782791AA149E3BF55"><enum>(2)</enum><header>Definition of persistent poverty county</header><text>For purposes of this subsection, the term <term>persistent poverty county</term> means any county that has had 20 percent or more of its population living in poverty during the 30-year period ending on the date of enactment of this Act, as measured by the 2000, 2010, and 2020 decennial censuses.</text></paragraph></subsection></section></legis-body></bill>
