which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modify the boundaries of the San Pablo Bay National Wildlife Refuge, and for other purposes.</official-title></form><legis-body id="H1C98CE78EAA24A939EB23E02A466503C" style="OLC"><section id="HB2FC79ED7A6D42F8A707F81A9BB80AE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>San Pablo Bay National Wildlife Refuge Expansion Act of 2024</short-title></quote>.</text></section><section id="H4B6D161C6EE9407CB62BFDADBD71C801"><enum>2.</enum><header>Boundary modification, acquisition, and administration</header><subsection id="HAE0764A78CD74DB2B162B7D3F7CAF63E"><enum>(a)</enum><header>In general</header><text>There shall be included within the boundaries of the National Wildlife Refuge the approximately 5,658 acres of lands, marshes, tidal flats, salt ponds, submerged lands, and open waters generally depicted on the Map as <quote>Proposed Boundary Expansion Area</quote>.</text></subsection><subsection id="H74D83B2BAF8542B59892648B5DB469DF"><enum>(b)</enum><header>Map</header><paragraph id="HEBCE033BE7864BF0A2F93B8B376ACC21"><enum>(1)</enum><header>Corrections</header><text>The Secretary may make clerical and typographical corrections to the Map.</text></paragraph><paragraph id="H11C4B60601B940978A3FCFE329FF731B"><enum>(2)</enum><header>Public availability; effect</header><text>The Map and any corrections made to the Map under paragraph (1) shall—</text><subparagraph id="H1CD0307354A7486493F3646C2C77D753"><enum>(A)</enum><text>be publicly available on the website of the United States Fish and Wildlife Service;</text></subparagraph><subparagraph id="H324822C72794493BA6D502861AC54609"><enum>(B)</enum><text>be on file and available for public inspection in the appropriate offices of the United States Fish and Wildlife Service, including the office located at 2100 Sears Point Road, Sonoma, California 95476; and</text></subparagraph><subparagraph id="HB77E7635E650402BBC33FF12D0BD9D92"><enum>(C)</enum><text>have the same force and effect as if included in this Act.</text></subparagraph></paragraph></subsection><subsection id="HEE0C828C1CE9413CA0E64D99D81E2ADD"><enum>(c)</enum><header>Acquisition</header><paragraph id="HFC1E3176F6214284A58FF455C974392A"><enum>(1)</enum><header>In general</header><text>The Secretary may acquire land, water, or interests therein, including conservation easements, within the boundaries of the National Wildlife Refuge, as modified by this Act, by donation, purchase from willing sellers with donated or appropriated funds, or exchange.</text></paragraph><paragraph id="H21729DB8A82D4847ABD276A4E16FE4D1"><enum>(2)</enum><header>No use of condemnation or eminent domain</header><text>The Secretary may not acquire any of the land, water, or interests therein under this section or for the purposes of this Act by condemnation or eminent domain.</text></paragraph></subsection><subsection id="H22F4E833D6364C76AB0A6721D8296D67"><enum>(d)</enum><header>Administration</header><text>Subject to valid existing rights, the Secretary shall administer the lands, waters, and interests therein acquired under this section—</text><paragraph id="H89C0CA1DCED54D959552F1D70264829C"><enum>(1)</enum><text>as part of the National Wildlife Refuge; and</text></paragraph><paragraph id="H651E2A933D5743CC9E02C297D718EC06"><enum>(2)</enum><text>in accordance with—</text><subparagraph id="H2DE5464112D74D5693A8E3CCB2A58F8B"><enum>(A)</enum><text>the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>); and</text></subparagraph><subparagraph id="H870D492327C44FD18A7DFFBB74658875"><enum>(B)</enum><text>this Act.</text></subparagraph></paragraph></subsection><subsection id="HCC7618282F524467A7E29EFAFE7643AA"><enum>(e)</enum><header>Cooperative agreements regarding non-Federal lands</header><text>The Secretary may enter into cooperative agreements with the State of California or any agency or political subdivision thereof and with any other person for the voluntary co-management of lands owned by such State, agency, subdivision, or person and located within or adjoining the boundaries of the National Wildlife Refuge, as modified by this Act.</text></subsection><subsection id="HD677F39AFE724743B3EA0805789EA739"><enum>(f)</enum><header>Transfer from other Federal agencies</header><text display-inline="yes-display-inline">Any Federal property located within or adjoining the boundaries of the National Wildlife Refuge, as modified by this Act, that is under the administrative jurisdiction of a department or agency of the Federal Government other than the Department of the Interior may, with the mutual concurrence of the head of the administering department or agency and the Secretary, be transferred without consideration to the administrative jurisdiction of the Secretary for the purposes of this Act.</text></subsection><subsection id="HF55A1A3F684E45009D5A7BA4E93F2B43"><enum>(g)</enum><header>Priority uses</header><text display-inline="yes-display-inline">In providing opportunities for compatible fish and wildlife dependent recreation, the Secretary, in accordance with paragraphs (3) and (4) of section 4(a) of the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd(a)</external-xref>), shall ensure that hunting, fishing, wildlife observation, photography, and environmental education and interpretation are priority public uses of the National Wildlife Refuge.</text></subsection><subsection id="HF8EBD1E825964570B125D722BD2D539E"><enum>(h)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Secretary should acquire land, water, or interests therein, including conservation easements, from willing sellers within or adjoining the boundaries of the National Wildlife Refuge, as modified by this Act, including by—</text><paragraph id="HF18BBECC9D874153A70FA5B34D4DC621"><enum>(1)</enum><text>including in each annual budget submission of the President under section 1105(a) of title 31, United States Code, a request for funding for Federal purposes from the Land and Water Conservation Fund established under section 200302 of title 54, United States Code, for such acquisition purposes; and</text></paragraph><paragraph id="H1CC9A388F5E94945BFDA7A5A40D7C5D7"><enum>(2)</enum><text>prioritizing using such funding made available each fiscal year for such acquisition purposes.</text></paragraph></subsection><subsection id="HAF01458D33E443EFA796ACB98AE125B7"><enum>(i)</enum><header>Public participation</header><text display-inline="yes-display-inline">The Secretary shall provide an opportunity for public participation in developing the land protection plan for the area generally depicted on the Map as <quote>Proposed Boundary Expansion Area</quote>, giving special consideration to public and private entities, individuals, and residential communities located within Napa, Marin, Sonoma, and Solano Counties, California.</text></subsection><subsection id="HE0075748B1DE4CF9BD977A5C46EDC440"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H128CB803CD10417F89974A8DBB85FC4D"><enum>(1)</enum><header>Map</header><text display-inline="yes-display-inline">The term <term>Map</term> means the map titled <quote>San Pablo Bay National Wildlife Refuge Boundary Modification Act</quote> and dated July 26, 2024.</text></paragraph><paragraph id="HA91D69691C8F4943BDF8D85B2A58B616"><enum>(2)</enum><header>National Wildlife Refuge</header><text>The term <term>National Wildlife Refuge</term> means the San Pablo Bay National Wildlife Refuge located in Marin, Sonoma, Napa, and Solano Counties, California.</text></paragraph><paragraph id="H926D4532838549D9A70C211640FC8991"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph></subsection></section><section id="H37C47770AFA4415D9169456D7F6551EF"><enum>3.</enum><header>Technical amendments</header><text display-inline="no-display-inline">Section 3 of <external-xref legal-doc="public-law" parsable-cite="pl/92/330">Public Law 92–330</external-xref> (86 Stat. 399) is amended—</text><paragraph id="HBDEE95553EAB43959E271525B4E0C1FA"><enum>(1)</enum><text>by striking <quote>he</quote> each place it appears and inserting <quote>the Secretary</quote>; </text></paragraph><paragraph id="HA4067077AE8248D598FAEB96E3D7CAA7"><enum>(2)</enum><text>in subsection (a), by striking <quote>Secertary</quote> and inserting <quote>Secretary</quote>; and</text></paragraph><paragraph id="HC2C2CB24D6E4429F8FA27B4CB36AB90C"><enum>(3)</enum><text>in subsection (b), by striking <quote>him</quote> and inserting <quote>the Secretary</quote>. </text></paragraph></section></legis-body></bill>
