which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services and the Secretary of Housing and Urban Development to jointly award grants for the purposes of improving access to, developing, or expanding services that provide an individual with transportation to or from substance use disorder treatment or supportive services.</official-title></form><legis-body id="HB719203F054F47E1AA1A6D1818852A5B" style="OLC"><section id="HEEE2C6EEF85346BDBF5E73619E2F09F2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Connections to Health Infrastructure and Emergency Recovery Services Act of 2024</short-title></quote> or the <quote><short-title>CHIERS Act of 2024</short-title></quote>.</text></section><section id="HE82673FFAF144C41AF07963C925429D6"><enum>2.</enum><header>Grants for transportation to substance use disorder treatment or supportive services</header><subsection id="H6E6174C55DCC4E6BAFC9C09FDF691043" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning not later than 1 year after the date of enactment of this Act, the Secretaries shall jointly award grants to eligible entities for the purposes of improving access to, developing, or expanding services that provide a covered individual with transportation, including first and last mile transportation, to or from substance use disorder treatment or supportive services at no cost to such individual.</text></subsection><subsection id="H21B17F6F1D83494FA18ECD15C6A9C371"><enum>(b)</enum><header>Use of funds</header><paragraph id="H7707E18991FD40D1B9AA0A71D0C4F60E"><enum>(1)</enum><header>In general</header><text>A grant awarded under this section may be used for the following purposes:</text><subparagraph id="HD953D8D91D824BF1A5890A69DDB3EE92" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">To provide the transportation services described in subsection (a) on a prescheduled or on-demand basis.</text></subparagraph><subparagraph id="HDA8DA5F4F8634A2F9C4DC3FDFCC18306"><enum>(B)</enum><text display-inline="yes-display-inline">To acquire a motor vehicle for the transportation services described in subsection (a).</text></subparagraph><subparagraph id="H541E0102922C449899CF92FA67928E90"><enum>(C)</enum><text>To assist personnel who provide the transportation services described in subsection (a) in obtaining any license that may be required to provide such services.</text></subparagraph><subparagraph id="HA262F1A0E24F4C68ACDA0F60773A2574"><enum>(D)</enum><text display-inline="yes-display-inline">To provide training and professional development for personnel who provide the transportation services described in subsection (a).</text></subparagraph><subparagraph id="H6626C6EB38134DD0A98FAB2F88A0277E"><enum>(E)</enum><text display-inline="yes-display-inline">To raise awareness about the transportation services described in subsection (a), including through expanding street outreach activities.</text></subparagraph><subparagraph id="HC024D02A0B9B44E3B7C9741C577C6A1E"><enum>(F)</enum><text display-inline="yes-display-inline">For ridesharing or taxi services that provide the transportation services described in subsection (a) on an on-demand basis.</text></subparagraph><subparagraph id="H2328DA4345B74E42A30F0BA1474305E9"><enum>(G)</enum><text display-inline="yes-display-inline">For such other activities as the Secretaries determine appropriate.</text></subparagraph></paragraph><paragraph id="HB77836FD146B4BDCB2AA0156085CB9EC"><enum>(2)</enum><header>Exclusions</header><text>A grant awarded under this section may not be used—</text><subparagraph id="H36DB6FC429174CAE8DF906F1B7BC3A7A"><enum>(A)</enum><text>for transporting an individual to receive involuntary treatment; or</text></subparagraph><subparagraph id="HF432B3E8BAD04CB490BD3A5CD3EFD767"><enum>(B)</enum><text>by law enforcement personnel. </text></subparagraph></paragraph></subsection><subsection id="H2B086E9AF0DA4CDDBCFD1319138C269F"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity seeking a grant under this section shall submit to the Secretaries an application including—</text><paragraph id="H7A5688A735D642B184D0376D99D5E20F"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the activities the eligible entity plans to carry out using grant funds under this section;</text></paragraph><paragraph id="HDBF4C23E33034406B399667E9B7EBD23"><enum>(2)</enum><text display-inline="yes-display-inline">the identity of each entity that the eligible entity plans to partner with to conduct such activities, including the activities the identified entity plans to carry out using grant funds under this section; and</text></paragraph><paragraph id="HC570DDCC87FA457E8CF8408052773509"><enum>(3)</enum><text display-inline="yes-display-inline">performance measures the eligible entity intends to use to measure the effectiveness of the activities carried out using grant funds under this section in reducing cancelled or missed appointments.</text></paragraph></subsection><subsection id="H1A561EDE1893434582B3E515BAEE6554"><enum>(d)</enum><header>Duration</header><text display-inline="yes-display-inline">A grant awarded under this section shall be for a period of not less than 1 year.</text></subsection><subsection id="H4703037AE9E447D194EBA70098B83241"><enum>(e)</enum><header>Supplement not supplant</header><text display-inline="yes-display-inline">A recipient of a grant under this section shall use the grant to supplement, not supplant, the level of State or local funds that would be made available for the activities funded under this section in the absence of the receipt of a grant under this section.</text></subsection><subsection id="H2C797A107D6141DEA948C0F46AEB504D"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after receiving a grant under this section, a grantee shall submit to the Secretaries a report including such information as the Secretaries determine necessary to evaluate the performance of the grantee under the grant.</text></subsection><subsection id="HDF7A5F937DC84D2F87490ED91D0F93D3"><enum>(g)</enum><header>Technical assistance</header><text>The Secretaries—</text><paragraph id="H43ED756CDEFF4FAD8E48AD4CE237022F"><enum>(1)</enum><text display-inline="yes-display-inline">shall jointly provide technical assistance, publish best practices, and conduct outreach to grantees and eligible entities under this section; and</text></paragraph><paragraph id="H13745956143246208298114215AC96F7"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent amounts are made available in advance in appropriation Acts, may make available not more than 2 percent of the funds made available pursuant to this section for the purposes of paragraph (1).</text></paragraph></subsection><subsection id="H5F72A6ACD91F458F9B90BD4C27F2C8E5"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HB0B9561E73D24008A608181FA9E11602"><enum>(1)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means an individual with a substance use disorder who—</text><subparagraph id="HF9CC31926CB5495C8BB5F2976F1FB723"><enum>(A)</enum><text>is experiencing homelessness;</text></subparagraph><subparagraph id="HBCC6E4B91BB64360A7E7E3F88B25329B"><enum>(B)</enum><text>resides in a low-income community, as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D</external-xref> of the Internal Revenue Code of 1986; or</text></subparagraph><subparagraph id="H5837B7BA5D4C4CB7862128140441C721"><enum>(C)</enum><text>resides in a community in which transportation poses a barrier to health care access, as determined by the Secretaries.</text></subparagraph></paragraph><paragraph id="HAF3DF8D9613F422B9114DD8B5B5891A4"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="HDAC5EABEBB0E4FA19F929C622AE117BA"><enum>(A)</enum><text>a nonprofit organization that has experience in providing—</text><clause id="H9416AEFD50B04C7C98290389A3FF56D7"><enum>(i)</enum><text display-inline="yes-display-inline">substance use disorder treatment;</text></clause><clause id="H5A29A148232D4E9DB189176F941454F8"><enum>(ii)</enum><text display-inline="yes-display-inline">services to individuals experiencing homelessness; or</text></clause><clause id="H6AE7AA8AF2104ED5A71667EBEB3D441F" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">services to a population that experiences disparities in health status and health care access;</text></clause></subparagraph><subparagraph id="HFFFD036B8E924EBD824EC955627B8131"><enum>(B)</enum><text display-inline="yes-display-inline">a State or county governmental entity, or any other local or regional governmental entity, including a public health agency;</text></subparagraph><subparagraph id="H67E7D90549CF4546968D9B280CCCF6BD"><enum>(C)</enum><text display-inline="yes-display-inline">an Indian Tribe or Tribal organization, as such terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>);</text></subparagraph><subparagraph id="H2A058AA3BE27481FB01B2648E7DE6949"><enum>(D)</enum><text display-inline="yes-display-inline">a continuum of care established and operating for a geographic area for purposes of the Continuum of Care Program under subtitle C of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11381">42 U.S.C. 11381 et seq.</external-xref>);</text></subparagraph><subparagraph id="HA80EC053FBFA4E4F80BE6DE7F626E3CE"><enum>(E)</enum><text display-inline="yes-display-inline">a Federally qualified health center, as such term is defined in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>);</text></subparagraph><subparagraph id="H04A427EB8CAD4435A70DB6310696FB26"><enum>(F)</enum><text display-inline="yes-display-inline">a comprehensive opioid recovery center funded by a grant under section 552 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-7">42 U.S.C. 290ee–7</external-xref>);</text></subparagraph><subparagraph id="HF05F62038F904497909CEC0C9FB696C6" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">an entity conducting street outreach funded by a grant under the emergency solutions grants program authorized under subtitle B of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11371">42 U.S.C. 11371 et seq.</external-xref>);</text></subparagraph><subparagraph id="HDBCEEFC72359434AAD5CB8E4173E89B2" commented="no"><enum>(H)</enum><text display-inline="yes-display-inline">a consortium of 2 or more entities described in this paragraph; and</text></subparagraph><subparagraph id="H764D118B7C9845C3B73DFC3C6BA2CB0E"><enum>(I)</enum><text display-inline="yes-display-inline">such other entities as the Secretaries determine appropriate.</text></subparagraph></paragraph><paragraph id="H6A73F713B7BA4410813FD01B83E36C6B"><enum>(3)</enum><header>First and last mile transportation</header><text display-inline="yes-display-inline">The term <term>first and last mile transportation</term> means, for purposes of the travel of a covered individual to and from substance use disorder treatment or supportive services, the provision of such transportation services as may be necessary to ensure that the individual has transportation for the entire route to be traveled, including transportation to and from a source of public transit.</text></paragraph><paragraph id="HE985518042C4425F9FF33B6B2CBB09DA"><enum>(4)</enum><header>Law enforcement personnel</header><text>The term <term>law enforcement personnel</term> has the meaning given such term in section 884(g) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/464">6 U.S.C. 464(g)</external-xref>).</text></paragraph><paragraph id="HBC05F28BB17F4E7A8477EEF3DF8CCEB7"><enum>(5)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code. </text></paragraph><paragraph id="H766E92CA266943D48880BF20068F6E2D"><enum>(6)</enum><header>Secretaries</header><text display-inline="yes-display-inline">The term <term>Secretaries</term> means—</text><subparagraph id="H5711358A2FA24F9899A6A4D8EA046CEE"><enum>(A)</enum><text>the Secretary of Health and Human Services, acting through the Assistant Secretary for Mental Health and Substance Use; and</text></subparagraph><subparagraph id="HD63937AFBBCF4EC4A9AF7C4800F0D524"><enum>(B)</enum><text>the Secretary of Housing and Urban Development, acting through the Director of the Office of Special Needs Assistance Programs.</text></subparagraph></paragraph><paragraph id="H6A33E4192FF24037B6605FF4E35C0E5E"><enum>(7)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph><paragraph id="H7F4329A7C10E42D2B3D0EA3050D0461A"><enum>(8)</enum><header>Substance use disorder</header><text>The term <term>substance use disorder</term> has the meaning given such term in section 1934 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-34">42 U.S.C. 300x–34</external-xref>). </text></paragraph><paragraph id="H290CDFA60EEF4746A3CA699549736D7C" commented="no"><enum>(9)</enum><header>Substance use disorder treatment</header><text>The term <term>substance use disorder treatment</term>—</text><subparagraph id="HD64F4C0A8C0E41FC95785AD48CAF7DD8" commented="no"><enum>(A)</enum><text>has the meaning given such term in section 702 of the <short-title>Office of National Drug Control Policy Reauthorization Act of 1998</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/21/1701">21 U.S.C. 1701</external-xref>); and</text></subparagraph><subparagraph id="H9C860FF0BFCC4A63B816A4252AAF177C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text><clause id="HB73023238ADA400B92859F11AAA6126A" commented="no"><enum>(i)</enum><text>an overdose prevention program; and</text></clause><clause id="HB7FBE4DD112F4DC3A5C8CA0C7FC403A8" commented="no"><enum>(ii)</enum><text>detoxification services.</text></clause></subparagraph></paragraph><paragraph id="H54C557EE8F3E4CA4B0F41DA8146D62F8"><enum>(10)</enum><header>Supportive services</header><text display-inline="yes-display-inline">The term <term>supportive services</term> has the meaning given such term in section 401 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
