concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Controlled Substances Act to provide for the regulation of critical parts of tableting machines and encapsulating machines, and for other purposes.</official-title></form><legis-body id="H5793695E44444A88B9644926A6FFC392" style="OLC"><section id="H1142BBE1604043CBB2C00B1FCF14F517" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop The Opioid Pill Presser and Fentanyl Act</short-title></quote> or the <quote><short-title>STOPP Act</short-title></quote>.</text></section><section id="HE746DC9548C24B18A4AB74EDA36D2962"><enum>2.</enum><header>Definitions</header><subsection id="HECC287B7AA8F4F66A57AA6B7C1136439"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) is amended—</text><paragraph id="H4268A381FA85485BA6BB497CF06A7643"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (38), by striking <quote>or an encapsulating machine</quote> and inserting <quote>an encapsulating machine, a critical part of a tableting machine, or a critical part of an encapsulating machine</quote>;</text></paragraph><paragraph id="HB0A317ECAB694611B72E91B7142C0879"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (39)(B)—</text><subparagraph id="HF495B0054A2D4850A41771B1B222D6A5"><enum>(A)</enum><text>by striking <quote>distribution, importation, or exportation of</quote> and inserting <quote>distribution, receipt, sale, importation, or exportation of, or an international transaction involving shipment of</quote>; and</text></subparagraph><subparagraph id="HE145DE7102D049EFA456BB596476A85B"><enum>(B)</enum><text>by striking <quote>or encapsulating machine</quote> and inserting <quote>, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine</quote>;</text></subparagraph></paragraph><paragraph id="H7E6CB6F7A4A0446F8D40EF78746B7231"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (42), by striking <quote>a listed chemical</quote> and inserting <quote>a listed chemical, a tableting machine, an encapsulating machine, a critical part of a tableting machine, or a critical part of an encapsulating machine</quote>;</text></paragraph><paragraph id="H1EB9683997334BC7ABE574F889B6C16C"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (43), by striking <quote>a listed chemical</quote> and inserting <quote>a listed chemical, a tableting machine, an encapsulating machine, a critical part of a tableting machine, or a critical part of an encapsulating machine</quote>; and</text></paragraph><paragraph id="H372430BD0EF946B79F3D816056E44C60"><enum>(5)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HE1FB9EC1CB7248F68A5806C7959AAE73" display-inline="no-display-inline"><paragraph id="HB05A5F7A5ADA4CFCA493B4812ECA9CC5"><enum>(60)</enum><text display-inline="yes-display-inline">The term <term>critical part</term>, when used in reference to a tableting machine or encapsulating machine, means any of the following integral parts when designed primarily for use in a tableting or encapsulating machine:</text><subparagraph id="H2C0C8BD8036D41988FF1799FC38C0545"><enum>(A)</enum><text>Press punch.</text></subparagraph><subparagraph id="H2BE29615FDB44D769DA9060243118DA7"><enum>(B)</enum><text>Die system.</text></subparagraph><subparagraph id="H60EA865EFFFD48E9A6A39BBC06205673"><enum>(C)</enum><text>Press turret.</text></subparagraph><subparagraph id="H9ED4D2EDE2E54EE6AE49C77E1474CEE2"><enum>(D)</enum><text>Hopper.</text></subparagraph><subparagraph id="HDBC09BB26122456ABDC65BA5E112698C"><enum>(E)</enum><text>Compression roller.</text></subparagraph><subparagraph id="HF43CC79250DF41268710430CFD553D63"><enum>(F)</enum><text>Discharge chute.</text></subparagraph><subparagraph id="H25F74D248D25490886502D616D0FF38F"><enum>(G)</enum><text>Vacuum system.</text></subparagraph><subparagraph id="H4B02FC1C1E71465180289E9C48F89E58"><enum>(H)</enum><text>Capsule feeding unit.</text></subparagraph><subparagraph id="H2A8516AAE611410C805B1BE1A9DB9CCD"><enum>(I)</enum><text>Automatic feeding unit.</text></subparagraph><subparagraph id="HCDA9D1EE36F24F1CB4EFC19DAC72B6AF"><enum>(J)</enum><text>Any other item identified in a regulation published by the Attorney General used in the operating of tableting or encapsulating machines.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE161385F450A4D8BB9920F4E6BE28B11"><enum>(b)</enum><header>Technical corrections</header><text display-inline="yes-display-inline">Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>), as amended by subsection (a) is further amended—</text><paragraph id="H987CA758510340BA8C53E1EA92F5C075"><enum>(1)</enum><text>by redesignating paragraph (58) (defining the term <term>serious violent felony</term>) as paragraph (59); and</text></paragraph><paragraph id="HDC7D326686684285A4E5CF34F30D6A6E"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating the second paragraph (57) (defining the term <term>serious drug felony</term>) as paragraph (58).</text></paragraph></subsection></section><section id="HE583F2EB47C64957807264D0861960E1"><enum>3.</enum><header>Regulated transactions of critical parts</header><subsection id="H56CB6DB939594541987022C83A780F9F"><enum>(a)</enum><header>Record of regulated transactions</header><text>Section 310 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/830">21 U.S.C. 830</external-xref>) is amended—</text><paragraph id="H88C16F285BF34B5291FE21C5E555B030"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="H60520EBEB9CC4A1A9FEDBCB894F65DF7"><enum>(A)</enum><text>by striking <quote>or an encapsulating machine</quote> and inserting <quote>an encapsulating machine, a critical part of a tableting machine, or a critical part of an encapsulating machine</quote>; and</text></subparagraph><subparagraph id="HE166F211794841878DFB99FB429C2913"><enum>(B)</enum><text>by inserting <quote>, in such form and manner as the Attorney General shall prescribe by regulation,</quote> after <quote>record of the transaction</quote>; and</text></subparagraph></paragraph><paragraph id="HD80BB2FAB69C485E909352367F1BCE26"><enum>(2)</enum><text>in paragraph (a)(2), by striking <quote>or encapsulating machine</quote> and inserting <quote>, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine</quote>.</text></paragraph></subsection><subsection id="H00FF9ECBB1AF4354AD92DA047563A6D5"><enum>(b)</enum><header>Reports to attorney general and recordkeeping</header><text>Section 310(b)(1) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/830">21 U.S.C. 830</external-xref>) is amended—</text><paragraph id="H637A8C49093242138CDFC9AF4FEBCDEB"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="H46652AF2B6C94394B85A23F8598C32E0"><enum>(A)</enum><text>by striking <quote>payment or delivery</quote> and inserting <quote>payment or delivery of a listed chemical, tableting machine, encapsulating machine, a critical part of a tableting machine, or a critical part of an encapsulating machine</quote>; and</text></subparagraph><subparagraph id="HF4862A3361774DF080074FEF8DE04F53"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>any other circumstance that the regulated person believes may indicate that the listed chemical</quote> and inserting <quote>any other circumstance that the regulated person believes may indicate that the listed chemical, tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine</quote>;</text></subparagraph></paragraph><paragraph id="H70575FDE9466413DB6E3239E26C903D9"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>listed chemical</quote> and inserting <quote>listed chemical, tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine</quote>; and</text></paragraph><paragraph id="HC2ED3F77DABD4A8D9F25D5FF535FD698"><enum>(3)</enum><text>in subparagraph (D), by striking <quote>or an encapsulating machine</quote> and inserting <quote>, an encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine</quote>.</text></paragraph></subsection><subsection id="H60B797E0B32141BF9B2A0BAFE8EC91FB" commented="no"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply beginning on the date that is 120 days after the date of enactment of this Act, except that the Attorney General may, by order published in the Federal Register, postpone such date of application for such period as the Attorney General may determine to be necessary for the efficient administration of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>).</text></subsection></section><section id="H80E0731DBACB4D4CBA94FA6CF2408C12"><enum>4.</enum><header>Serialization of certain machines and parts</header><text display-inline="no-display-inline">The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) is amended by inserting after section 310 (<external-xref legal-doc="usc" parsable-cite="usc/21/830">21 U.S.C. 830</external-xref>) the following:</text><quoted-block style="OLC" id="H9CA012BE52274CD4840A9E1FF4BE8CB4" display-inline="no-display-inline"><section id="H5B202E5D150A4EDFBDF19B4DC46192EC"><enum>310A</enum><header>Serialization of certain machines and parts</header><subsection id="H9C371942522E4E118010DD3EC0058C6D"><enum>(a)</enum><header>Serial number</header><text>Each manufacturer, distributor, importer, or exporter of a tableting machine, encapsulating machine, a critical part of a tableting machine, or a critical part of an encapsulating machine shall, when and as required by regulation of the Attorney General, identify the tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine by a serial number which shall be engraved, cast, or otherwise permanently affixed to a non-removable part of the tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine in accordance with such regulations.</text></subsection><subsection id="H4EE38A0CB10047C0995341404BA845A8"><enum>(b)</enum><header>Reporting</header><text><italic></italic>Any regulated person who manufactures, distributes, receives, sells, imports, or exports a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine that is subject to the serialization requirement set forth in subsection (a), shall report the transaction to the Attorney General and maintain records of such transaction, in such form and manner as the Attorney General shall prescribe by regulation.<italic></italic></text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H2399A835A7A2416E9C7A3DBBED19B9CB"><enum>5.</enum><header>Registration of certain machines and parts</header><text display-inline="no-display-inline">The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), as amended by section 3, is further amended by inserting after section 310A, the following: </text><quoted-block style="OLC" id="HACFECBA275B2483FAD6918BFF205CB46" display-inline="no-display-inline"><section id="H2CD87436705D4140BEC26E13B9BB6546"><enum>310B.</enum><header>Registration of certain machines and parts</header><subsection id="HA5833BEC4F344FB9B76D4D9FD2EF03CD"><enum>(a)</enum><header>Registration of certain machines and parts</header><text>Each manufacturer, distributor, importer, or exporter of a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine shall, when and as required by regulation of the Attorney General, register the tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine with the Attorney General in accordance with such regulation.</text></subsection><subsection id="H5EF45889543B46DE8627ECC4DFE65E95"><enum>(b)</enum><header>Reporting</header><text display-inline="yes-display-inline">Any regulated person who manufactures, distributes, receives, sells, imports, exports, or destroys a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine that is required to be registered pursuant to subsection (a), shall report that act to the Attorney General and maintain records of such act as required in section 310, in such form and manner as the Attorney General shall prescribe by regulation.</text></subsection><subsection id="H3D26C975477641699582FE97D61D54F9"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Attorney General is authorized to promulgate rules and regulations relating to tableting machines and encapsulating machines. The Attorney General shall by regulation establish which tableting machines, encapsulating machines, critical parts of tableting machines, and critical parts of encapsulating machines are subject to the registration and reporting requirements of subsections (a) and (b) and the information to be provided pursuant to subsections (a) and (b), which shall include the location of the tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine.</text></subsection><subsection id="H676A125872DC45FD89E31A36311E9E61"><enum>(d)</enum><header>National pill press registry</header><text>The Attorney General shall maintain a central registry of all tableting machines, encapsulating machines, critical parts of a tableting machine, or critical parts of an encapsulating machine that are subject to the registration requirement set forth in subsection (a), which shall be known and referred to as the National Pill Press Registry.</text></subsection><subsection id="HAF5E70BAA3DE41A888EA52CC8E26E8CC"><enum>(e)</enum><header>Definitions</header><text>For the purposes of this section:</text><paragraph id="HC401073C0E7343E0BC3387189B0D8403"><enum>(1)</enum><header>Manufacture</header><text>The term <term>manufacture</term> means the production or assembly of a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine.</text></paragraph><paragraph id="H0B3064D4064C40ED8F9D816694F431E2"><enum>(2)</enum><header>Distribute</header><text>The term <term>distribute</term> means to deliver a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine.</text></paragraph><paragraph id="H7AC7E645941849B7AC69D921DF0BBE02"><enum>(3)</enum><header>Deliver</header><text>The term <term>deliver</term> means the actual, constructive, or attempted transfer of a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine, whether or not there exists an agency relationship.</text></paragraph><paragraph id="HB103F0B896614999AE3F561B518EE45B"><enum>(4)</enum><header>Destroy</header><text>The term <term>destroy</term> means to cause such serious damage to a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine so that it can no longer be used for its intended purpose.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8A4122FD5D8F45AFA92DF11236F30D92"><enum>6.</enum><header>Registration of manufacturers, importers, exporters, and dealers of tableting machines, encapsulating machines, and critical parts</header><text display-inline="no-display-inline">The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), as amended by section 3, is further amended by inserting after section 310B, the following: </text><quoted-block style="OLC" id="HE147A89A9E294F91B32849046F2E9E45" display-inline="no-display-inline"><section id="H8B25860CFCB34046A450F1C19CEEBEAB"><enum>310C.</enum><header>Registration of manufacturers, importers, exporters, and dealers of tableting machines, encapsulating machines, and critical parts</header><subsection id="H8EE7EE397D1D4FDCA3D33034166A4CE4"><enum>(a)</enum><header>Registration</header><paragraph id="H956C12FF44B34B8199A48D2C97890D7A"><enum>(1)</enum><header>In general</header><text>Every person who manufactures, imports, exports, or deals, or proposes to engage in the manufacture, importation, exportation, or dealing of any tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine, shall obtain, on an annual basis, a registration issued by the Attorney General.</text></paragraph><paragraph id="HA1776C9CFCC54E2BBC229E5E1117FB61"><enum>(2)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Attorney General may, by regulation, waive the requirement for registration of certain manufacturers, importers, exporters, and distributors of any tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine if the Attorney General finds that issuing such a waiver would be consistent with public health and safety.</text></paragraph><paragraph id="HE61DAC6F40FE4B0B94B87A2C47C10869"><enum>(3)</enum><header>Separate registrations required</header><text>A separate registration shall be required for each principal place of business where the applicant manufactures, imports, exports, or deals a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine.</text></paragraph><paragraph id="H0858E81A30834E5B89B478E04A76A7FB"><enum>(4)</enum><header>Termination</header><subparagraph id="H49B9A3F715244FE6800B34DC730056C5"><enum>(A)</enum><header>In general</header><text>A registration to manufacture, import, export, or deal a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine terminates if and when such registrant—</text><clause id="H3BFC3F532EA24735BC59055E9755AEE7"><enum>(i)</enum><text>ceases legal existence;</text></clause><clause id="HE2FA7E68CA5844A0B0AD0454B9D38BBE"><enum>(ii)</enum><text display-inline="yes-display-inline">ceases to engage in the manufacture, importation, exportation, or dealing of such a machine or critical part thereof; or</text></clause><clause id="H0C436F3E04A64F7B911616743FD9F469"><enum>(iii)</enum><text>surrenders such registration.</text></clause></subparagraph><subparagraph id="H11B5782D78174B98A5DB373A4C0C5ADC"><enum>(B)</enum><header>Notification</header><text display-inline="yes-display-inline">In the case of such a registrant who ceases legal existence or ceases to engage in the manufacture, importation, exportation, or dealing, such registrant, or agent or successor in interest of such registrant, shall promptly notify the Attorney General in writing of such fact.</text></subparagraph></paragraph><paragraph id="HAE329106A3EA4FE5BEF6AE9B762693FD"><enum>(5)</enum><header>Re-assignment</header><text>A registration to manufacture, import, export, or deal a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine may only be assigned to another entity with the written consent of, and upon such conditions as, the Attorney General may specify.</text></paragraph></subsection><subsection id="H67C7C23C190D4B7F91C8A3A85A5B3D87"><enum>(b)</enum><header>Registration considerations</header><text display-inline="yes-display-inline">The Attorney General shall register an applicant to manufacture, import, export, or deal a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine, unless the Attorney General determines that registration of the applicant is inconsistent with the public interest.</text></subsection><subsection id="H7623326B93D14607A7FFA49127048111"><enum>(c)</enum><header>Considerations</header><text display-inline="yes-display-inline">In determining the public interest for the purposes of subsection (b), the Attorney General shall consider—</text><paragraph id="HB0A1595C618B497A981A68391D385FB6"><enum>(1)</enum><text>development and maintenance of effective controls against diversion of tableting machines, encapsulating machines, and critical parts thereof into other than legitimate channels;</text></paragraph><paragraph id="H644F53545BE848ED948A726765CE6074"><enum>(2)</enum><text>compliance with applicable Federal, State, and local law;</text></paragraph><paragraph id="HBEEBF3E7FAF24C879BEDF9B1BA0A5219"><enum>(3)</enum><text>prior conviction record of the applicant;</text></paragraph><paragraph id="H7674D73F10854A6585ACD738665ABCA3"><enum>(4)</enum><text>past experience in the manufacture, import, export, and dealing of tableting machines, encapsulating machines, or critical parts thereof; and</text></paragraph><paragraph id="H24C1AC1BCAD040FE9B85AB70B76F046B"><enum>(5)</enum><text>such other factors as may be relevant to and consistent with the public health and safety.</text></paragraph></subsection><subsection id="HE3A117656F8F4FD2830BC090D95547B8"><enum>(d)</enum><header>Authorized activities</header><text>No person may manufacture, import, export, or deal any tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine unless such person has an active registration to do so issued by the Attorney General, unless—</text><paragraph id="H90B08D1C0B2B409686B8693890D64C94"><enum>(1)</enum><text>such person is an agent or employee of any registrant acting in the usual course of his business or employment; or</text></paragraph><paragraph id="H9E26596F611D46038596CDDFD174F7F9"><enum>(2)</enum><text>a common or contract carrier or warehouseman, or an employee thereof, whose possession of the tableting machine, encapsulating machine, or critical part thereof is in the lawful and usual course of his business or employment.</text></paragraph></subsection><subsection id="H015D702671E149B8A9FBE8AA59803764"><enum>(e)</enum><header>Inspection</header><text>The Attorney General is authorized to inspect the establishment of a registrant or applicant for registration in accordance with the rules and regulations promulgated by the Attorney General.</text></subsection><subsection id="HAEE374F6C3664B6AA087EE0DAF1470C4"><enum>(f)</enum><header>Denial, revocation, or suspension of registration</header><paragraph id="H4615D25F1D4F4A8D9B3742C2FD313AC9"><enum>(1)</enum><header>Suspension or revocation</header><text>A registration pursuant to subsection (b) of this section to manufacture, import, export, or deal a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine may be suspended or revoked by the Attorney General upon a finding that the registrant—</text><subparagraph id="HDAD5C8FD10494FABB76EF4E0D5B572C5"><enum>(A)</enum><text>has materially falsified any application filed pursuant to or required by this subchapter or subchapter II;</text></subparagraph><subparagraph id="H243FD0046D37459AB8717E0C6F4CB3E0"><enum>(B)</enum><text>has been convicted in any court of an offense involving a tableting machine, encapsulating machine, a critical part of a tableting machine, or a critical part of an encapsulating machine; or</text></subparagraph><subparagraph id="HE459B44D8E3D4456B8B67AEF0F228EF7"><enum>(C)</enum><text>has committed such acts as would render his registration inconsistent with the public interest.</text></subparagraph></paragraph><paragraph id="HCEE455A1D65E46E49303FE6A3137EE7F"><enum>(2)</enum><header>Order</header><subparagraph id="H4716FC8201C14C7C93DE8364C497B9FB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Before suspending or revoking a registration to manufacture, import, export, or deal tableting machines, encapsulating machines, critical parts of tableting machines, or critical parts of encapsulating machines, or pursuant to a denial of registration, the Attorney General shall serve upon the applicant or registrant an order to show cause why registration should not be denied, revoked, or suspended.</text></subparagraph><subparagraph id="HA6CDAA99EC4C4503876DB76E4AEBC489"><enum>(B)</enum><header>Contents</header><text>An order to show cause shall contain a statement of the basis for the denial, revocation, or suspension, including specific citations to any laws or regulations alleged to be violated by the applicant or registrant, direct the applicant or registrant to appear before the Attorney General at a time and place stated in the order, and notify the applicant or registrant of the opportunity to submit a corrective action plan on or before the date of appearance.</text></subparagraph><subparagraph id="HEF1AD6B386074A75A7A8A40F6310901D"><enum>(C)</enum><header>Corrective action plan review</header><text>Upon review of any corrective action plan submitted by an applicant or registrant pursuant to subparagraph (B), the Attorney General shall determine whether denial, revocation, or suspension proceedings should be discontinued, or deferred for the purposes of modification, amendment, or clarification to such plan.</text></subparagraph><subparagraph id="H1BBBB262B0C24B3F8F49789C221B98FF"><enum>(D)</enum><header>Applicable law</header><text>Proceedings to deny, revoke, or suspend shall be conducted in accordance with subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5. Such proceedings shall be independent of, and not in lieu of, criminal prosecutions or other proceedings under this subchapter or any other law of the United States.</text></subparagraph><subparagraph id="H6E06A21280D140C089451D82C147A522"><enum>(E)</enum><header>Relationship to immediate suspension order</header><text>The requirements of this subsection shall not apply to the issuance of an immediate suspension order under paragraph (3).</text></subparagraph></paragraph><paragraph id="HC172687107614396B380AE43AFA86A1A"><enum>(3)</enum><header>Suspension of registration in cases of imminent danger</header><subparagraph id="H94FF4918929D45FB9A1BFF0307FAD403"><enum>(A)</enum><header>In general</header><text>The Attorney General may, in the discretion of the Attorney General, suspend any registration simultaneously with the institution of proceedings under this section, in cases where he finds that there is an imminent danger to the public health or safety. A suspension under this subsection shall continue in effect until the conclusion of such proceedings, including judicial review thereof, unless sooner withdrawn by the Attorney General or dissolved by a court of competent jurisdiction.</text></subparagraph><subparagraph id="HE10BFFD96B0C4F7FBE8BBB787B9A3FAA"><enum>(B)</enum><header>Imminent danger to the public safety defined</header><text display-inline="yes-display-inline">In this subsection, the phrase <quote>imminent danger to the public health or safety</quote> means that, due to the failure of the registrant to maintain effective controls against diversion or otherwise comply with the obligations of a registrant under this Act, there is a substantial likelihood that a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine will be used in the illicit manufacture of controlled substances and cause death, serious bodily harm, or abuse of a controlled substance in the absence of an immediate suspension of the registration.</text></subparagraph></paragraph></subsection><subsection id="H6B4887E1E6B14A3FA8DF32A73F96C878"><enum>(g)</enum><header>Disposition of tableting machines, encapsulating machines, and critical part</header><paragraph id="H0729E249B0FB4731A1602BF3E9B96D02"><enum>(1)</enum><header>In general</header><text>Upon termination, suspension, or revocation of registration of a registrant, the former registrant may, within 30 days or such additional period designated by the Attorney General for good cause, liquidate any remaining tableting machines, encapsulating machines, critical parts of tableting machines, or critical parts of encapsulating machines by lawfully selling, transferring, or otherwise disposing of the tableting machines, encapsulating machines, critical parts of a tableting machines, or critical parts of encapsulating machines to a registered manufacturer, importer, exporter, or dealer of tableting machines, encapsulating machines, critical parts of tableting machines, or critical parts of encapsulating machines.</text></paragraph><paragraph id="HA83E9D08F2D14C569BE6F4D7DF903907"><enum>(2)</enum><header>Exception</header><text>Except for the liquidation of remaining inventory to a registrant within 30 days (or approved period) in accordance with paragraph (1), a former registrant may no longer deal tableting machines, encapsulating machines, critical parts of tableting machines, or critical parts of encapsulating machines.</text></paragraph></subsection><subsection id="H1D86409AA4824B5FB85FC5163011BE70"><enum>(h)</enum><header>Records and reports</header><paragraph id="HBD92A1495C594721A999138852B1582F"><enum>(1)</enum><text>Every registrant shall maintain, on a current basis, a complete and accurate record of each tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine possessed, manufactured, received, imported, exported, sold, distributed, delivered, or destroyed, with such information, and in such form and manner as the Attorney General may by regulations require<italic></italic>.</text></paragraph><paragraph id="H5F725F178EF541FEBDB02F0536E10151"><enum>(2)</enum><text>Every registrant shall, at such time or times, with such information, and in such form and manner as the Attorney General may by regulations require<italic></italic>, make periodic reports to the Attorney General.</text></paragraph><paragraph id="H8220C94379A54CFF9A2F3C24EA8B0294"><enum>(3)</enum><text>Every record required under this section shall be kept and be readily retrievable, for at least 10 years, for inspection and copying by officers or employees of the United States authorized by the Attorney General.</text></paragraph></subsection><subsection id="H54A6DE4383E546D2AB12364ED3C9A5EB"><enum>(i)</enum><header>Regulations and fees</header><text>The Attorney General is authorized to promulgate rules and regulations and charge reasonable fees relating to the registration and control of the manufacture, importation, exportation, and dealing of tableting machines, encapsulating machines, critical parts of tableting machines, and critical parts of encapsulating machines. The Attorney General shall by regulation establish which tableting machines, encapsulating machines, critical parts of tableting machines, and critical parts of encapsulating machines are subject to the registration, recordkeeping, and reporting requirements under this section, and the form, manner, and information to be maintained and furnished under such requirements.</text></subsection><subsection id="HE7FD8F9E5FDC408B8EECF52F8E011650"><enum>(j)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this section:</text><paragraph id="H3490EFC82C204FD8B1E4A77E647910F7"><enum>(1)</enum><header>Deal</header><text>The term <term>deal</term> means to engage in the business of selling or distributing tableting machines, encapsulating machines, critical parts of tableting machines, or critical parts of encapsulating machines at wholesale or retail.</text></paragraph><paragraph id="H84A265880A8B41F2B92CC2C3A28D4A9E"><enum>(2)</enum><header>Delivery, distribute, destroy, manufacture</header><text>The terms <term>deliver</term>, <term>distribute</term>, <term>destroy</term>, and <term>manufacture</term> have the meanings given such terms in section 310B.</text></paragraph><paragraph id="H96A6DAAF3B2942FEB1673B4E3AF769D3"><enum>(3)</enum><header>Engaged in the business</header><text>The term <term>engaged in the business</term> means devoting time, attention, and labor to dealing tableting machines, encapsulating machines, critical parts of tableting machines, or critical parts of an encapsulating machine as a regular trade or business to predominantly earn a profit through the repetitive purchase and resale.</text></paragraph></subsection><subsection id="H80CBED6A1DFB402B8671D7B31B212227"><enum>(k)</enum><header>Effective date</header><text>This section shall apply beginning 120 days after the date of enactment of this section, except that the Attorney General may by order published in the Federal Register postpone the effective date of this section for such period as the Attorney General may determine to be necessary for the efficient administration of this Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5AA8E15219364E5AAE2C1FD75B5D1496" commented="no"><enum>7.</enum><header>Offenses; penalties</header><subsection id="H1E9F32CEA6B24C6B80BCC195D87813C9" commented="no"><enum>(a)</enum><header>Serial numbers</header><paragraph id="H0308E0672CFC400E9FE9271A72A2231F" commented="no"><enum>(1)</enum><header>Prohibited Acts B—Penalties</header><text>Section 402(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/842">21 U.S.C. 842(a)</external-xref>) is amended—</text><subparagraph id="H477818F3E54B46EA8B4D4AF1168E439B" commented="no"><enum>(A)</enum><text>in paragraph (16), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H34E92B7A112D4FC3BB76699E4D5E1CA6" commented="no"><enum>(B)</enum><text>in paragraph (17), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H2CE4730F8D7F47C3854C17D13BDFD339" commented="no"><enum>(C)</enum><text>by inserting after paragraph (17) the following:</text><quoted-block id="H9A9318D7DC6E4FB3899F8042FD38F239" style="OLC"><paragraph id="HEF0216798E3C4A2294B8A5B258DB5E8A" commented="no"><enum>(18)</enum><text>to violate subsection (a) of section 310A; </text></paragraph><paragraph id="H37FDA1F517B043E9B198A469E91FF9B7" commented="no"><enum>(19)</enum><text>to refuse or negligently fail to make a report under subsection (b) of section 310A;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA969475E9B2648599A92418B22591EE2" commented="no"><enum>(2)</enum><header>Prohibited Acts C—Penalties</header><text>Section 403 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/843">21 U.S.C. 843</external-xref>) is amended—</text><subparagraph id="H950C47C038D94637B32C9EB3B0542179"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), in each of paragraphs (6) and (7), by inserting <quote>critical part of a tableting machine, critical part of an encapsulating machine,</quote> after <quote>encapsulating machine,</quote>; and</text></subparagraph><subparagraph id="HA5301C1190F346F285A65D0467938958"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="H2E28B2927B61461A8C17A585449F84B0" style="OLC"><subsection id="H4935AD1EB60F4099BDB4BD1CD0792A26" commented="no"><enum>(g)</enum><text>It shall be unlawful to—</text><paragraph id="H2FD08139C1584E3AA282BF845E6D2FDB" commented="no"><enum>(1)</enum><text>intentionally remove, alter, or obliterate any serial number affixed to any tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine that is required to have a serial number pursuant to subsection (a) of section 310A, if the person removing, altering, or obliterating such serial number knows or has reasonable cause to believe the serial number is so required;</text></paragraph><paragraph id="H9E8C77F3F38A441E98930E98CB04D1CA" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">transport, ship, receive, or possess any tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine that is required to have a serial number pursuant to subsection (a) of section 310A, if the person transporting, shipping, receiving, or possessing such a machine or critical part thereof knows that the serial number has been removed, obliterated, or altered, and has reasonable cause to believe the serial number is required pursuant to subsection (a) of section 310A; or</text></paragraph><paragraph id="HE067C8577F3E480798E78F5A9E47F0C6"><enum>(3)</enum><text>possess a tableting machine or an encapsulating machine that is required to have a serial number pursuant to subsection (a) of section 310A, if the person in possession of such machine knows that the machine does not have a serial number, and has reasonable cause to believe the serial number is required pursuant to subsection (a) of section 310A.</text></paragraph></subsection><subsection id="HCC584B71DD634D6BA75812A89E51126D" commented="no"><enum>(h)</enum><text>In a prosecution for an offense under subsection (g)(3), it is an affirmative defense, as to which the defendant has the burden of proof by a preponderance of the evidence, that the person possessed the tableting machine or encapsulating machine on the day before the effective date of this subsection and, not later than 180 days after that date, or for such additional period designated by the Attorney General for good cause, the person—</text><paragraph id="HA442455FD36B4312A159D8446CC1A430" commented="no"><enum>(1)</enum><text>sold or otherwise transferred the tableting machine or encapsulating machine to a manufacturer, importer, exporter, or dealer of tableting machines or encapsulating machines that is registered under section 310C(a);</text></paragraph><paragraph id="HDC9188C75B914DC08592ECD123E07245" commented="no"><enum>(2)</enum><text>had a serial number engraved, cast, or otherwise affixed to a non-removable part of the tableting machine or encapsulating machine by a manufacturer, importer, exporter, or dealer of tableting machines or encapsulating machines that is registered under section 310C(a); or</text></paragraph><paragraph id="HEFB48F0F4AC2455681F9A5359D927686" commented="no"><enum>(3)</enum><text>destroyed the tableting machine or encapsulating machine.</text></paragraph></subsection><subsection id="H10924A05F62E4FA1B305A77914671CFB" commented="no"><enum>(i)</enum><text>For purposes of this subsection, the term <term>destroy</term> has the meaning given such term in section 310B.</text></subsection><subsection id="H17A67C7513C04294BB833AF20F82BAEF"><enum>(j)</enum><text display-inline="yes-display-inline">Subsection (g) does not apply to a manufacturer, importer, exporter, or dealer of tableting machines or encapsulating machines that is registered under section 310C(a)(1) or exempt from registration pursuant to section 310C(a)(2). Subsection (g) shall become effective 2 years after the date of enactment, except that the Attorney General may by order published in the Federal Register postpone the effective date of subsection (g) for such period as he may determine to be necessary for the efficient administration of this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H41DA2A6BB349417D8843460A650F3E0D" commented="no"><enum>(b)</enum><header>Registration of certain machines and parts</header><text display-inline="yes-display-inline">Section 402(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/842">21 U.S.C. 842(a)</external-xref>), as amended by subsection (a), is further amended by inserting after paragraph (19) the following:</text><quoted-block id="H47910A78B5FC43579181561662789472" style="OLC"><paragraph id="HF980874ECBA24CA4800E9CC8CF39B3E3" commented="no"><enum>(20)</enum><text>to violate subsection (a) or (b) of section 310B; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCD2A207FD1DC46D7A83E7F504687D73C" commented="no"><enum>(c)</enum><header>Registration of manufacturers, importers, exporters, and dealers</header><text display-inline="yes-display-inline">Section 402(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/842">21 U.S.C. 842(a)</external-xref>), as amended by subsections (a) and (b), is further amended by inserting after paragraph (20) the following:</text><quoted-block style="OLC" id="H8D3A333D654B420EA75ECCBFFDD25AC2" display-inline="no-display-inline"><paragraph id="H6B00ADA05A714715BC2CAF62EB3A84ED" commented="no"><enum>(21)</enum><text display-inline="yes-display-inline">to manufacture, import, export, or deal a tableting machine, encapsulating machine, critical part of a tableting machine, or critical part of an encapsulating machine without a registration required by section 310C, except as specified in subsection (g)(1) of such section. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
