R. 9701</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240919">September 19, 2024</action-date><action-desc><sponsor name-id="M001221">Mr. Molinaro</sponsor> (for himself, <cosponsor name-id="L000598">Mr. LaLota</cosponsor>, <cosponsor name-id="M000317">Ms. Malliotakis</cosponsor>, <cosponsor name-id="G000597">Mr. Garbarino</cosponsor>, <cosponsor name-id="L000599">Mr. Lawler</cosponsor>, <cosponsor name-id="D000632">Mr. D'Esposito</cosponsor>, <cosponsor name-id="L000600">Mr. Langworthy</cosponsor>, <cosponsor name-id="T000478">Ms. Tenney</cosponsor>, and <cosponsor name-id="W000828">Mr. Williams of New York</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the reallocation of certain grant funds from jurisdictions that do not allow for consideration the danger, risk, or threat an individual poses to the community when determining bail or pretrial release or that have in effect a policy providing for the sealing of certain criminal records.</official-title></form><legis-body id="H9574D5B9EEC74A8B81BD895F4518B970" style="OLC"><section id="H3ED37FBF56A446F48BFB484A8A31F6C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Our Streets Safe Act of 2024</short-title></quote>.</text></section><section id="H0F3A472F7EA048239CC5FF7DE9AA8D99"><enum>2.</enum><header>Requirement for States receiving Byrne grant funds</header><text display-inline="no-display-inline">Section 505 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10156">34 U.S.C. 10156</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H3EB567362F784A2D88ED163F6BFAD1A8" display-inline="no-display-inline"><subsection id="HCC164C396DDB4FD9BE9B934B5A584DFC"><enum>(j)</enum><header>Requirement for dangerousness standard for pretrial release</header><paragraph id="H4CA20635B34940ADAEF4E3530A47DA3F"><enum>(1)</enum><header>Requirement on States</header><text>The Attorney General shall withhold the amount that would otherwise be made available to a State under subsection (b)(1) if the State—</text><subparagraph id="H5395106DF02D4DE78135C5B9CAAF1853"><enum>(A)</enum><text>does not allow a State court or magistrate to consider the danger, risk, or threat an individual poses to the community when determining bail or pretrial release; or</text></subparagraph><subparagraph id="H70C37D3281224975AAC70DBB4ED92E6B"><enum>(B)</enum><text display-inline="yes-display-inline">has in effect a general policy providing for the sealing of the criminal records of felons (other than juveniles).</text></subparagraph></paragraph><paragraph id="HF9DB9E300226435EBBC73A4F2B670C66"><enum>(2)</enum><header>Reallocation</header><text display-inline="yes-display-inline">The Attorney General shall reallocate funds that are withheld from a State under this subsection to units of local government within that State, for use in accordance with section 501(a)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
