R. 9690</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240919">September 19, 2024</action-date><action-desc><sponsor name-id="C001130">Ms. Crockett</sponsor> (for herself, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, and <cosponsor name-id="D000530">Mr. Deluzio</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to clarify the limitations period during which an action may be commenced for judicial review of a final rule.</official-title></form><legis-body id="H7C03123F4720419692016878EF31D86F" style="OLC"><section id="HD46CCF6A6A10499D94E58F495E9F64D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Timely Initiation to Modify Executive Rulemaking Act</short-title></quote> or the <quote><short-title>TIMER Act</short-title></quote>.</text></section><section id="H242CCCC0F1D44A3CBE42A97C0BC09B3F"><enum>2.</enum><header>Statute of limitations</header><text display-inline="no-display-inline">Section 2401 of title 28, United States Code, is amended—</text><paragraph id="H84C42BAD8F8E4461900B739975766308"><enum>(1)</enum><text>in subsection (a), by inserting after <quote>chapter 71 of title 41</quote> the following: <quote>and subject to subsection (b)</quote>; </text></paragraph><paragraph id="H32468C059B504669A82CED723608EA99"><enum>(2)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="H50D6EA7F4B2B4D6F97B76CE24CC419C9"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="USC" id="H1CC8942951414BBE9370B61B368C1837" display-inline="no-display-inline"><subsection id="H5B428D300F1C48C687BAC2DD79B36916"><enum>(b)</enum><text display-inline="yes-display-inline">A civil action commenced against the United States under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code, for judicial review of a final rule shall be barred unless the complaint is filed within six years after the date on which the final rule is issued.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
