<section id="H838913A2BB344F05BBBB17013575B9EC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Major Borderland Environmental Ruin from Wildfires (EMBER) Act</short-title></quote>.</text></section> <section id="H5D27B211CA294DF98E1D95995060870D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="HF55A0368FA13485CBC2A01A3AEC29CF4"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="HA213AC1A04184F4FB297CFB4F87410B4"><enum>(A)</enum><text>the Committees on Natural Resources, Agriculture, Homeland Security, and the Judiciary of the House of Representatives; and</text></subparagraph>
<subparagraph id="H209C83619AFE43FD980887FD4AC66916"><enum>(B)</enum><text>the Committees on Energy and Natural Resources, Agriculture, Nutrition, and Forestry, Homeland Security and Governmental Affairs, and the Judiciary of the Senate.</text></subparagraph></paragraph> <paragraph id="H95D7BE4472364EEAB9AB69E89EC5FF61"><enum>(2)</enum><header>Border State</header><text display-inline="yes-display-inline">The term <term>Border State</term> means a State that abuts the southern border.</text></paragraph>
<paragraph id="H9148AD6750AD4FB4BC54A3C4684A0A17"><enum>(3)</enum><header>Covered federal lands</header>
<subparagraph id="H15B1EA32E9544DF4BAAA32775E0B30BE"><enum>(A)</enum><header>In general</header><text>The term <term>covered Federal lands</term> means land—</text> <clause id="H717DF7EC984D484E8359C1F61786CD91"><enum>(i)</enum><text>owned by the United States;</text></clause>
<clause id="H77565CC3FB07475D9E41FF05EA35B8E4"><enum>(ii)</enum><text>located in a unit that shares an exterior boundary with the southern border; and</text></clause> <clause id="H65B6A74EF9114D42BB368F827B4E308F"><enum>(iii)</enum><text>administered by—</text>
<subclause id="H2E6B839245824DA4BF4B1D1701891C8B"><enum>(I)</enum><text>the National Park Service;</text></subclause> <subclause id="H7E0567D5A6304E76A6963D81D06454A1"><enum>(II)</enum><text>the Bureau of Land Management;</text></subclause>
<subclause id="H27A6242C7D404306A1D56776A4E40B4F"><enum>(III)</enum><text>the United States Fish and Wildlife Service;</text></subclause> <subclause id="HF37E73F2E9BB4AF8BB115E304C45EF67"><enum>(IV)</enum><text>the Bureau of Reclamation; or</text></subclause>
<subclause id="H2C0AF46D35524545BA6C6738BF7DF620"><enum>(V)</enum><text>the Forest Service.</text></subclause></clause></subparagraph> <subparagraph id="H13F9681754424A88ACEA8F7F80AF8D4C"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered Federal lands</term> does not include Federal lands held in trust for Indian Tribes.</text></subparagraph></paragraph>
<paragraph id="HE22EBCF3778F435EA696C4AC5A980651"><enum>(4)</enum><header>Operational control</header><text display-inline="yes-display-inline">The term <term>operational control</term> has the meaning given such term in section 2(b) of the Secure Fence Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/8/1701">8 U.S.C. 1701</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/367">Public Law 109–367</external-xref>).</text></paragraph> <paragraph id="HA6216371350C4DEAB36DA7CF6F8BBA42"><enum>(5)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text>
<subparagraph id="HEBBE36C89DAB4E56B5F7EAC50CFB6B4A"><enum>(A)</enum><text>the Secretary of the Interior, with respect to lands under the jurisdiction of the Secretary of the Interior; and</text></subparagraph> <subparagraph id="H14FB990D866947199C816AB0B088657F"><enum>(B)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service, with respect to National Forest System lands.</text></subparagraph></paragraph>
<paragraph id="HD8C2B993971A41BDA4667B9E6308A7E3"><enum>(6)</enum><header>Southern border</header><text>The term <term>southern border</term> means the international border between the United States and Mexico.</text></paragraph></section> <section id="HCA970919BC964E938CD6DFFB25AFAAE7" section-type="subsequent-section"><enum>3.</enum><header>Southern Border Fuels Management Initiative</header> <subsection id="HD9864F34BD264E0DA59A7AE715E331A7"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of the Interior shall establish a program to be known as the <quote>Southern Border Fuels Management Initiative</quote> (in this section referred to as the <quote>Initiative</quote>).</text></subsection>
<subsection id="HBD2D6F50E1884B1AAB0374ED1FDE8F15"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Initiative is to carry out vegetation management activities along the southern border in order to—</text> <paragraph id="HA875A30186F54404AA29698D282A87EA"><enum>(1)</enum><text>reduce the risk of catastrophic wildfire along the southern border and improve landscape resilience;</text></paragraph>
<paragraph id="H0CAF995D051B4E8AB97939F4C25B8F88"><enum>(2)</enum><text>improve operational control of the southern border; and</text></paragraph> <paragraph id="H9A5730AA133A4BFEB365257069386C96"><enum>(3)</enum><text>improve visibility and sight lines along the southern border to increase safety for law enforcement.</text></paragraph></subsection>
<subsection id="HFC2B33DA96804734AC3EAD39047ED3A6"><enum>(c)</enum><header>Activities</header><text>In carrying out the Initiative, the Secretary shall—</text> <paragraph id="H397325FB9F434E06B9D901DB742C1F2F"><enum>(1)</enum><text>reduce hazardous fuels along the southern border;</text></paragraph>
<paragraph id="H48CACED21E6546118767F78EB0CE90B2"><enum>(2)</enum><text>address invasive or non-native species along the southern border that contribute to wildfire risk or decrease operation efficiency of border patrol operations;</text></paragraph> <paragraph id="H4CF7465063774F1A84C3289BB2B74A76"><enum>(3)</enum><text>install fuel breaks along the southern border; and</text></paragraph>
<paragraph id="HAF14F7089E3143AAA7D163B7B43488CD"><enum>(4)</enum><text>set targets for acres to treat under the program for each fiscal year. </text></paragraph></subsection> <subsection id="H127624F2FFB94E74BA1C3F04AC23A367"><enum>(d)</enum><header>Coordination</header><text>In carrying out the Initiative, the Secretary shall coordinate and may enter into memorandums of understanding with the Forest Service, U.S. Border Patrol, and State, local, or Tribal law enforcement agencies.</text></subsection>
<subsection id="H4CCA71547D0B4544956CCF811F3D86AD"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of the Interior to carry out this section $3,660,000 for each of fiscal years 2025 through 2031.</text></subsection> <subsection id="HFB5E360B00A4462CB1F8B734B43D8208"><enum>(f)</enum><header>Termination</header><text display-inline="yes-display-inline">The Initiative shall terminate 7 years after the date of the enactment of this Act.</text></subsection></section>
<section id="HE8F4CC22E0AF4D1B99986CCFD403DE93"><enum>4.</enum><header>Mitigating environmental degradation and wildland fires caused by illegal immigration</header>
<subsection id="HBB30905C2B8B4A1289113E88F4A10E4F"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary concerned, in coordination with the Secretary of Homeland Security, shall establish and implement policies and protocols to mitigate, avoid, or prevent—</text> <paragraph id="H1C34BDEA655A4B8BB949EE41E8B9838F"><enum>(1)</enum><text>wildland fires ignited by aliens without lawful immigration status; and</text></paragraph>
<paragraph id="H567A5B81DC9F40FEB2F961CB5DCAD6B4"><enum>(2)</enum><text>environmental degradation on covered Federal lands caused by aliens without lawful immigration status crossing the southern border.</text></paragraph></subsection> <subsection id="H5AA877D35E4F4520B6B9273A7C2C0E31"><enum>(b)</enum><header>Protocols</header><text>In developing the protocols under subsection (a), the Secretary concerned shall consider policies to—</text>
<paragraph id="HDC2325D1B1F54B529CDF71CD63135426"><enum>(1)</enum><text>reduce trash accumulation along the southern border, particularly in ecologically sensitive areas;</text></paragraph> <paragraph id="H35C98EB527CB42C1B830C9E1028F86D7"><enum>(2)</enum><text>prevent the ignition of wildland fires by aliens without lawful immigration status, particularly in areas where there is a risk of—</text>
<subparagraph id="H737E61516066455681DB408C22947B10"><enum>(A)</enum><text>loss of life or property;</text></subparagraph> <subparagraph id="H129B944C1CFA4A16B26A03309FCE176C"><enum>(B)</enum><text>damage to critical wildlife habitat;</text></subparagraph>
<subparagraph id="H9BC0D37371C84B8E8FADFD1340C027CF"><enum>(C)</enum><text>damage to public infrastructure; and</text></subparagraph> <subparagraph id="H28EEBD63B28D4358A85E6F1B044CDD1E"><enum>(D)</enum><text>degradation of watersheds or public water sources;</text></subparagraph></paragraph>
<paragraph id="HF7F5493B0A324A5FAF18DF98198EDD6A"><enum>(3)</enum><text>address the destruction of sensitive natural and archeological resources; and</text></paragraph> <paragraph id="H6780CE71515D4DA08404E1B73C353842"><enum>(4)</enum><text>address the destruction of wildlife habitat.</text></paragraph></subsection>
<subsection id="H49904291DDF54F40AB5C0255EC50E910"><enum>(c)</enum><header>Report to congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary concerned shall submit to the appropriate congressional committees a report that includes—</text> <paragraph id="H6516E19B12F046F7BCA20C07C4A62DCD"><enum>(1)</enum><text>a description of the policies and protocols established under subsection (a);</text></paragraph>
<paragraph id="H077D8C7E42044AABBCC4F628C167B1DE"><enum>(2)</enum><text>a catalog of all reported incidents of environmental degradation and wildland fires ignited by aliens without lawful immigration status, including—</text> <subparagraph id="HD3E29901929E4111B404903A69E6710A"><enum>(A)</enum><text>the number of acres burned and total number of fires ignited;</text></subparagraph>
<subparagraph id="HDA24FA82FC1F479A9930AB7BF996DEC6"><enum>(B)</enum><text>a description of each incident of environmental degradation and the total number of such incidents;</text></subparagraph> <subparagraph id="HE46CC198046447A69EDF3D680B9D1590"><enum>(C)</enum><text>the estimated cost of cleaning up or remediating such environmental degradation;</text></subparagraph>
<subparagraph id="H62B1AF4E83E04BF0964EE82A34A893E3"><enum>(D)</enum><text>the number of such aliens connected to each fire and whether or not they were apprehended; and</text></subparagraph> <subparagraph id="HDC3BA508A47342FFBF1D1DA28F34DBCB"><enum>(E)</enum><text>the area in which incidents of environmental degradation occurred, including areas congressionally designated for the protection of natural resources; and</text></subparagraph></paragraph>
<paragraph id="H4942F2B8396243018C1764DB151D147F"><enum>(3)</enum><text>additional resources or authorities necessary to mitigate, avoid, or prevent wildland fires and environmental degradation caused by aliens without lawful immigration status crossing the southern border.</text></paragraph></subsection> <subsection id="H0593BD1826074AB2810440C530D4D18D"><enum>(d)</enum><header>Updated report</header> <paragraph id="H9A0A6C97375B4996A00BA17FEBB31567"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall update its November 2011 report entitled <quote>Federal Agencies Could Better Utilize Law Enforcement Resources in Support of Wildland Fire Management Activities</quote>.</text></paragraph>
<paragraph id="H96F7D71AD45143319E48BF2AFF41CE73"><enum>(2)</enum><header>Additional states considered</header><text>In updating the report under paragraph (1), the Comptroller General shall include information on each Border State.</text></paragraph></subsection></section> </legis-body> </bill>
