Miscellaneous.</toc-entry></toc></subsection></section><section id="HC408823F00774ECEAEA10FFC84431216"><enum>2.</enum><header>Findings and purposes</header><subsection id="H30BD68A592254DAFABD32BE877B5ADCA"><enum>(a)</enum><header>Findings</header><text>Congress finds that the national protracted housing crisis has existed for decades and only continues to worsen, with the lack of quality and affordable housing affecting all but the wealthiest households.</text></subsection><subsection id="H9A343F20EF614825B58DDEB330199EEF"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text><paragraph id="HED2294E0C9B54DAB9F2318AA926450A8"><enum>(1)</enum><text>to establish a robust public entity to develop a stock of permanently affordable, quality, publicly financed, and climate resilient housing that is shielded from market speculation; and</text></paragraph><paragraph id="HF6A678CB034B47ED819CF20B8062FBDB"><enum>(2)</enum><text>to stabilize communities and improve general welfare by maintaining a housing system, as an alternative to market-rate housing, that offers affordability, fair housing choice, and quality to all families that are unable to afford market rents, including families in underserved communities and families that have experienced historical legacies of exclusion.</text></paragraph></subsection></section><section id="H12DCCA40535C4DF8A3359A4FE2D4006F"><enum>3.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="H4D2805D26FB74DBCBC8176148465FC1B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In this Act:</text><paragraph id="H6FFE6C57D8FD49E3893FA345D62522B3"><enum>(1)</enum><header>Affordable housing</header><text>The term <term>affordable housing</term> means housing that complies with the standards established under section 7(c).</text></paragraph><paragraph id="H3D341E71FEFD481CBE5C1B3A50EA2286"><enum>(2)</enum><header>At risk of homelessness</header><text>The term <term>at risk of homelessness</term> has the meaning given the term in section 401 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>).</text></paragraph><paragraph id="H750F02398D8045DF954E039EBF27BC77"><enum>(3)</enum><header>Authority</header><text>The term <term>Authority</term> means the Housing Development Authority established under section 4(a).</text></paragraph><paragraph id="H281906C548BD4425BADB0574D8717171"><enum>(4)</enum><header>Board</header><text>The term <term>Board</term> means the Board of Directors of the Authority established under section 4(c)(1).</text></paragraph><paragraph id="H1599CAD37A3C478AB9BFAC46BC49548A"><enum>(5)</enum><header>Community land trust</header><text>The term <term>community land trust</term> means a nonprofit entity or a State or local government or instrumentality thereof that—</text><subparagraph id="H2F68E02E1E594634A2D14BF397EAAFFA"><enum>(A)</enum><text>is not sponsored by a for-profit organization;</text></subparagraph><subparagraph id="HEE80B31AC23F49EB9F056BD774EFFB13"><enum>(B)</enum><text>has as a primary purpose the provision and maintenance of housing that provides long-term affordability for low-income families and moderate-income families;</text></subparagraph><subparagraph id="H458B5DAADDFA45BEAD8EAEB023C66ACA"><enum>(C)</enum><text>provides housing described in subparagraph (B) using a ground lease, deed covenant, or other similar legally enforceable measure, as determined by the Authority, that—</text><clause id="H9C24ED7001884B1C99E07D7CD59C047C"><enum>(i)</enum><text>keeps the housing permanently affordable to low-income families and moderate-income families; and</text></clause><clause id="H2D9A7A597C0C45E9A29300411EAFD73D"><enum>(ii)</enum><text>enables low-income families and moderate-income families to purchase the housing for homeownership; and</text></clause></subparagraph><subparagraph id="HF883C99A55D34F74BB74856AA78ADC13"><enum>(D)</enum><text>maintains preemptive purchase options to purchase the property so the housing remains affordable to low-income families and moderate-income families.</text></subparagraph></paragraph><paragraph id="H0B17367EE2BF403797904FDB052F34D2"><enum>(6)</enum><header>Community-led development organization</header><text>The term <term>community-led development organization</term> means a nonprofit organization comprised of or acting on behalf of individuals seeking to establish, develop, maintain, and reside in a resident-owned multifamily housing building that includes shared community amenities, whether through the development of a new building or the rehabilitation or conversion of an existing building.</text></paragraph><paragraph id="HAB7ABEE3D85F453AA769A9651B2B60FA"><enum>(7)</enum><header>Consumer Price Index</header><text>The term <term>Consumer Price Index</term> means the most recent Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></paragraph><paragraph id="HF8A29C2FBA0C4D159967BA8452A20605"><enum>(8)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Housing and Urban Development.</text></paragraph><paragraph id="HFAFF641B54AA4B8B8462D92E438B24A0"><enum>(9)</enum><header>Distressed</header><text>The term <term>distressed</term> means, with respect to an asset, that—</text><subparagraph id="H05DC398B96F74BF6B62F61799F2707EB"><enum>(A)</enum><text>the obligor thereof is subject to a bankruptcy, insolvency, liquidation, or other similar action or proceeding;</text></subparagraph><subparagraph id="H82E059B99A6A4B518E33A666291D8BD3"><enum>(B)</enum><text>the obligor thereof has failed to make any payment of principal or interest with respect to the asset when due (whether at scheduled maturity or any accelerated date of maturity or any other date fixed for payment or prepayment thereof or otherwise) beyond any period of grace provided with respect thereto;</text></subparagraph><subparagraph id="HDB6B194578F14BCF9FF0A69C7F9B12B4"><enum>(C)</enum><text>the asset is classified by the lender as <quote>nonperforming</quote> pursuant to generally accepted accounting principles; or</text></subparagraph><subparagraph id="H100973ED53C04B048EC29CE7A0C18220"><enum>(D)</enum><text>the asset is in a physically distressed condition, as shall be defined by the Authority.</text></subparagraph></paragraph><paragraph id="H6C3DC7FADFC645E498E4E8F091C5162E"><enum>(10)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity described in subparagraph (A) of section 6(c)(2), subject to subparagraph (B) of that section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B6A000E06B8409DB99DF8290297F7C6"><enum>(11)</enum><header>Family</header><text>The term <term>family</term> includes an individual.</text></paragraph><paragraph id="H711C1BAB432A4FC28738F92472C8BF91"><enum>(12)</enum><header>Homeless</header><text>The term <term>homeless</term> has the meaning given the term in section 103 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11302">42 U.S.C. 11302</external-xref>).</text></paragraph><paragraph id="H0A4F3248447E455896350EB3D8EE76DD"><enum>(13)</enum><header>Income</header><text>The term <term>income</term> has such meaning as provided by the Secretary that is consistent with regulations issued by the Secretary in implementing section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph><paragraph id="H98831CA3172A43109635A4A62BB3F119"><enum>(14)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></paragraph><paragraph id="HD3A1D2B39CB44986B002E2BFFA72245F"><enum>(15)</enum><header>Permanent affordability</header><text>The term <term>permanent affordability</term> means a designation for a residential property, the affordability of which is preserved in perpetuity through—</text><subparagraph id="H9602FCB447F041479B6CB29D4A2F3ADE"><enum>(A)</enum><text>a real property interest held by the Authority; and</text></subparagraph><subparagraph id="H3A5B02D5C5DF4AC0A2267DFC7E5DCBA6"><enum>(B)</enum><text>the inclusion of a permanently affordable social housing use restriction in the deed to the land and, where applicable, any ground lease to the improvements on the land.</text></subparagraph></paragraph><paragraph id="H9F74550DFF60462B8DF659FEE182B03E"><enum>(16)</enum><header>Permanently affordable social housing; social housing</header><subparagraph id="HC0750C7DE3164B838207EEE3607725CB"><enum>(A)</enum><header>In general</header><text>The term <term>permanently affordable social housing</term> or <term>social housing</term> means housing, including newly constructed, acquired, rehabilitated, or renovated housing, that meets the following requirements:</text><clause id="H88F82464E5D04CC9B3FFD19454E09AC2"><enum>(i)</enum><header>Social ownership</header><text>The housing is owned by the Authority or an eligible entity.</text></clause><clause id="H4A04811B1A484DC4B19392DC6D04F644"><enum>(ii)</enum><header>Permanent stability</header><text>The housing is—</text><subclause id="HC0D1F81D67F54545876FBEBA5ACB88BC"><enum>(I)</enum><text>protected from for-profit investors and the speculative market; and</text></subclause><subclause id="H0CC4AB77F8344B9C8AC6B2E813AC252D"><enum>(II)</enum><text>subject to restrictions that ensure that it is never resold for excessive profit, as determined by the Authority.</text></subclause></clause><clause id="H2D5177BF93974356820B0AE72EC18588"><enum>(iii)</enum><header>Permanent affordability</header><text>The housing meets the requirements of paragraph (15) and, in the aggregate, is permanently affordable to families at a range of income levels, including extremely low-income families and no-income families.</text></clause><clause id="H7C6C40745F8F4EEBAFED984C7AF47AD0"><enum>(iv)</enum><header>Community control</header><text>The housing is developed, owned, managed, and operated in a way that is democratically accountable to residents, the community, and the public, with residents having a direct role in management and decision-making, such as through a tenant organization.</text></clause><clause id="HC974AB497D784F57A21B33A37014B271"><enum>(v)</enum><header>Equitable</header><text>The housing promotes racial and gender equity and prevents displacement of communities of color.</text></clause><clause id="H6753A8A1F303410EA5369BD298433772"><enum>(vi)</enum><header>Sustainability</header><text>The housing is built, renovated, or rehabilitated using construction methods and materials that—</text><subclause commented="no" display-inline="no-display-inline" id="HE58BCDAFC6E34F2382AD78B2F9BD7068"><enum>(I)</enum><text display-inline="yes-display-inline">prioritize energy efficiency, the long-term safety and health of occupants, and disaster resilience; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HEB98E709488E46D49BF8A36D61D5D3A1"><enum>(II)</enum><text display-inline="yes-display-inline">are guided by an evidence-based approach designed to reduce pollution burdens and climate volatility.</text></subclause></clause><clause id="H95FBC683A0404F48BA62511E0D38D20B"><enum>(vii)</enum><header>High quality and accessible</header><text>The housing is of high quality and accessible to all people regardless of age, physical need, or other factors.</text></clause><clause id="H4C437EFAF01D4FD1BE087BF767CC53B0"><enum>(viii)</enum><header>Tenant security</header><text>The housing provides renter protections to residents.</text></clause></subparagraph><subparagraph id="H09E4294DD59840D8AC42245586605608"><enum>(B)</enum><header>Public housing</header><text>The Authority may provide any funding or support to public housing that is necessary for the public housing to meet the requirements under subparagraph (A), consistent with the rules and regulations that are otherwise applicable to public housing.</text></subparagraph></paragraph><paragraph id="HAC8A0315687C44C8BE93F1F29F204D6C"><enum>(17)</enum><header>Permanently affordable social housing use restriction</header><text>The term <term>permanently affordable social housing use restriction</term>, with respect to real property, means a use restriction, established by the Secretary by rulemaking after notice and an opportunity for public comment, that ensures that the property complies with the requirements under subparagraph (A) of the definition of <term>permanently affordable social housing</term>.</text></paragraph><paragraph id="HCA1322D6F11D46F0A66CC86445C77CEE"><enum>(18)</enum><header>Public housing</header><text>The term <term>public housing</term> means housing assisted under section 9 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE9AF2708DF0D42AAB9E6901055A34111"><enum>(19)</enum><header>Public housing agency</header><text>The term <term>public housing agency</term> has the meaning given the term in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph><paragraph id="HFC1C08473AD5441A92E8A5055C80D921"><enum>(20)</enum><header>Resident-owned cooperative</header><text>The term <term>resident-owned cooperative</term> means a nonprofit entity that supports shared-equity homeownership that—</text><subparagraph id="HD94DFE968F7D4F17BF276F19FE4BEB76"><enum>(A)</enum><text>has as a primary purpose the provision and maintenance of owner-occupied housing that provides long-term affordability for low-income families and moderate-income families;</text></subparagraph><subparagraph id="H9ABF84CAB04545708597553BCAB3DFDA"><enum>(B)</enum><text>provides housing described in subparagraph (A) using a limited equity cooperative agreement, or other similar legally enforceable measure, as determined by the Authority, that—</text><clause id="HD3F14B258493477FA1476B6B6EE65D9E"><enum>(i)</enum><text>keeps the housing permanently affordable to low-income families and moderate-income families; and</text></clause><clause id="HB2C3D069D5BD4F2CB7515D9B2EA8E82C"><enum>(ii)</enum><text>enables low-income families and moderate-income families to purchase the housing for homeownership; and</text></clause></subparagraph><subparagraph id="HCE2059A1CE2348FC85890FDEF12EF7B5" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>maintains preemptive purchase options to purchase the property so the housing remains affordable to low-income families and moderate-income families. </text></subparagraph></paragraph><paragraph id="HC40D6E443B314B89BC73AF9A703EAF50"><enum>(21)</enum><header>Secretary</header><text>The term <term>Secretary</term>, except as otherwise provided, means the Secretary of Housing and Urban Development.</text></paragraph><paragraph id="H91E3D260F3894C21AD1202D8925A5CB7"><enum>(22)</enum><header>Short sale</header><text>The term <term>short sale</term> means a sale of a residential real property that is subject to a mortgage, deed or trust, or other security interest that secures a residential mortgage loan that—</text><subparagraph id="H0F0DF01D910D402FAF9EEE48AB66D439"><enum>(A)</enum><text>will result in proceeds in an amount that is less than the remaining amount due under the mortgage loan; and</text></subparagraph><subparagraph id="HEF57804506904236ACCF3ED0B156474B"><enum>(B)</enum><text>requires authorization by any securitization vehicle or other investment vehicle or holder of the mortgage loan, or the servicer acting on behalf of such a vehicle or holder.</text></subparagraph></paragraph><paragraph id="H304B198B44E44B23952FEA6492C48271"><enum>(23)</enum><header>Supportive services</header><text>The term <term>supportive services</term> means services that address the needs of persons served by a project, including—</text><subparagraph id="H29B821A4A74E492BB9E52540E11A2BE2"><enum>(A)</enum><text>provision of tenant organizing technical assistance;</text></subparagraph><subparagraph id="H20B59ACFAD22418981D213CE8DB10D68"><enum>(B)</enum><text>establishment and operation of a child care services program;</text></subparagraph><subparagraph id="H3A83A7C373A645E9A23E9738902F8892"><enum>(C)</enum><text>establishment and operation of an employment assistance program;</text></subparagraph><subparagraph id="H8B201033056340C090620028089421D1"><enum>(D)</enum><text>provision of outpatient health services, food, and case management;</text></subparagraph><subparagraph id="HF145FC3EE2194AEFBE2EE03A93AE1850"><enum>(E)</enum><text>provision of mental health services and victim services;</text></subparagraph><subparagraph id="H99197C08CFEB42AE950987E1CD5A193C"><enum>(F)</enum><text>provision of assistance in obtaining other Federal, State, and local assistance available for residents of the project, including mental health benefits, employment counseling, and medical assistance;</text></subparagraph><subparagraph id="HEC14658D3C3042E194A367884828F92D"><enum>(G)</enum><text>provision of transportation services that facilitate the ability of an individual to obtain and maintain employment and access health care;</text></subparagraph><subparagraph id="HBA58FF738B2E4273BF74CB92A5365345"><enum>(H)</enum><text>provision of services for older adults;</text></subparagraph><subparagraph id="H9E1AADD03B104AE083B3D0BC4C6034AD"><enum>(I)</enum><text>security services; and</text></subparagraph><subparagraph id="H365DFFA5A6604BD6A7BFBFC5DEF8E27F"><enum>(J)</enum><text>other services necessary to maintain housing and sustain a quality housing community.</text></subparagraph></paragraph><paragraph id="HC2508FF7643A4D11BB72F3B8D2096029" commented="no"><enum>(24)</enum><header>Tenant organization</header><text display-inline="yes-display-inline">The term <term>tenant organization</term>, with respect to rental housing means a tenant-led organization—</text><subparagraph id="HC64D20403FEC428D9B501B4167CAF5FE" commented="no"><enum>(A)</enum><text>that seeks to—</text><clause id="HD08BC71635434F309C66B2132EA1369E" commented="no"><enum>(i)</enum><text>promote the collective interests and rights of the tenants;</text></clause><clause id="H4FF4B31972264E6DA4B3E7EB23760917" commented="no"><enum>(ii)</enum><text>improve housing conditions;</text></clause><clause id="H0361240612594D45A296E8DEB2A88E81" commented="no"><enum>(iii)</enum><text>build renter authority; and</text></clause><clause id="H9C7941955D4748288ADB2FE1AA1FA1C0" commented="no"><enum>(iv)</enum><text>advocate for policy changes for the benefit of tenants; and</text></clause></subparagraph><subparagraph id="H1A033E804C95467CBCF143AE5E76B85D" commented="no"><enum>(B)</enum><text>which may be organized with respect to—</text><clause id="H0DFED38C568040B0B14888309992F6A5" commented="no"><enum>(i)</enum><text>housing sharing the same landlord or building; or</text></clause><clause id="HE2ED1E71B333415C8CFCC5C9D757EA78" commented="no"><enum>(ii)</enum><text>housing having different landlords or buildings.</text></clause></subparagraph></paragraph><paragraph id="H32FA1D3FCC614845861D8F5F029B224F"><enum>(25)</enum><header>Tribally designated housing entity</header><text>The term <term>tribally designated housing entity</term> has the meaning given the term in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></paragraph><paragraph id="H953C292BE92145368B9FEB9E27E9E179"><enum>(26)</enum><header>Underserved community</header><text>The term <term>underserved community</term> means a population sharing a particular characteristic, or a geographic community, that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA8419137BC2F45F89834DA4DD644A9E3"><enum>(A)</enum><text display-inline="yes-display-inline">has been systematically denied a full opportunity to participate in aspects of economic, social, and civic life; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H40170811FE8347759572A333821918FD"><enum>(B)</enum><text display-inline="yes-display-inline">may include—</text><clause commented="no" display-inline="no-display-inline" id="H0B0DF6A161DD4337A7D0A02035B4BED3"><enum>(i)</enum><text display-inline="yes-display-inline">Black, Latino, and Indigenous and Native American persons, Asian Americans and Pacific Islanders, and other persons of color;</text></clause><clause commented="no" display-inline="no-display-inline" id="H5031032B1C5E4CF5889807544B582AA4"><enum>(ii)</enum><text display-inline="yes-display-inline">members of religious minorities;</text></clause><clause commented="no" display-inline="no-display-inline" id="H9B29D595F4DD469D86D839A06D5FED08"><enum>(iii)</enum><text display-inline="yes-display-inline">lesbian, gay, bisexual, transgender, and queer (commonly known as <quote>LGBTQ+</quote>) persons;</text></clause><clause commented="no" display-inline="no-display-inline" id="H481BB554BEC7497FA53918F662316986"><enum>(iv)</enum><text display-inline="yes-display-inline">persons with disabilities;</text></clause><clause commented="no" display-inline="no-display-inline" id="H38CBFD55450449F3B5627D0EC688D3E7"><enum>(v)</enum><text display-inline="yes-display-inline">persons who live in rural areas; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HF331FAEF65F64FEA849D3555401DDD38"><enum>(vi)</enum><text display-inline="yes-display-inline">persons otherwise adversely affected by persistent poverty or inequality.</text></clause></subparagraph></paragraph></subsection><subsection id="H1ADA21A0A2774198897A4F9C9AEC7B4E"><enum>(b)</enum><header>Income levels</header><paragraph commented="no" display-inline="no-display-inline" id="H799B82E645E44BE7B7A9FCEDE6F23F9C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>In this Act, subject to paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCD7C6971588D4063AF5333145D3B6148"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>moderate-income family</term> means a family that satisfies the definition of the term <term>persons of moderate income</term> in section 102(a) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302(a)</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8B64F6BE3F614C5B8BA41BB2B899C768"><enum>(B)</enum><text>the term <term>low-income family</term> means a family that satisfies the definition of the term <term>persons of low income</term> in section 102(a) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302(a)</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDDF764C5D8684F28AE3EDB0B8A456E42"><enum>(C)</enum><text>the term <term>extremely low-income family</term> means a family that satisfies the definition of the term <term>extremely low-income families</term> in section 3(b)(2) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)(2)</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDFB295646F294200B09D49E64A12190D"><enum>(2)</enum><header>Authority of Secretary to establish variations</header><text display-inline="yes-display-inline">For purposes of paragraph (1) and subject to the considerations described in section 7(c)(4), the Secretary may establish a percentage of median income for a term defined in paragraph (1) of this subsection for any area that is higher or lower than the percentage set forth in the applicable provision of law referenced in such paragraph (1) if the Secretary finds the variation to be necessary because of unusually high or low family incomes or cost of living in the area.</text></paragraph></subsection></section><section id="H24AEC56ED2AE4EA88EE75648C2DEC6B3"><enum>4.</enum><header>Establishment of authority</header><subsection id="HD1BE7AA8C76843638F02B6B9D07BCC74"><enum>(a)</enum><header>Establishment</header><paragraph id="HF62E9931D02B489493DDB1858052F84E"><enum>(1)</enum><header>In general</header><text>There is established within the Department of Housing and Urban Development an independent authority to be known as the <quote>Housing Development Authority</quote>, to carry out the purposes set forth in section 5.</text></paragraph><paragraph id="HC3B36E68355C40D9AFCA5295BE4C4DE5"><enum>(2)</enum><header>Applicability of other laws</header><text>Except as otherwise provided expressly by law, all Federal laws concerning public or Federal contracts, property, works, officers, employees, budgets, or funds, including chapters 5 and 7 of title 5, United States Code, shall apply to the exercise of the powers of the Authority.</text></paragraph><paragraph id="H8354A5E8AEC9493589ABA2086812E01B"><enum>(3)</enum><header>Autonomy</header><text>Notwithstanding any other provision of law, including the Department of Housing and Urban Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3531">42 U.S.C. 3531 et seq.</external-xref>), the Secretary may not—</text><subparagraph id="H3B459545EB5A40A8AA5F0E7CC557F3E1"><enum>(A)</enum><text>intervene in any matter or proceeding before the Authority; or</text></subparagraph><subparagraph id="H99A4FE3AAA6A4C6B967B1FF0B3FC92B6"><enum>(B)</enum><text>merge or consolidate the Authority, or any of the functions or responsibilities of the Authority, with any division or office of the Department.</text></subparagraph></paragraph><paragraph id="H8FD1196737F2439D8DB18F9509A0C8FC"><enum>(4)</enum><header>Rules and orders</header><text>No action of the Authority shall be subject to approval or review by the Secretary, and the Secretary may not delay or prevent any action by the Authority.</text></paragraph></subsection><subsection id="HC9E3AD8DBC4641988CBF029B554DC5E2"><enum>(b)</enum><header>Ownership</header><text>Any real property acquired by the Authority shall be acquired in perpetuity with the authority to convey properties to eligible entities.</text></subsection><subsection id="HF293015BDEB14AFD81BD904A2C6CFE51"><enum>(c)</enum><header>Board</header><paragraph id="H6DADDB263A66409FA52D7D3BAAA8B424"><enum>(1)</enum><header>In general</header><text>The Authority shall be governed by a Board of Directors.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD30D00B1904E45EF8723E6D046D9EC28"><enum>(2)</enum><header display-inline="yes-display-inline">Membership</header><subparagraph id="H0171D359BD1843C8A56A0B7C28ACDB82"><enum>(A)</enum><header>In general</header><text>The Board shall consist of 15 members appointed by the President, by and with the advice and consent of the Senate, one of whom the President shall designate as chairperson.</text></subparagraph><subparagraph id="H77A3693222F24154B78A2E4DC1C24233"><enum>(B)</enum><header>Types of appointments</header><text>Of the 15 members of the Board—</text><clause commented="no" display-inline="no-display-inline" id="H1B474D5AD619477C85FF3FE006D300F7"><enum>(i)</enum><text display-inline="yes-display-inline">9 shall be appointed under subparagraph (C); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H1D759AB2EF5A4385831EAB4FF5975F45"><enum>(ii)</enum><text>6 shall be appointed under subparagraph (D).</text></clause></subparagraph><subparagraph id="HADBDF99CA0F04DF1B1D28B976954CDE8"><enum>(C)</enum><header>Stakeholder members</header><clause id="HB887528FCCB34860B6ADCE1FB52C78A6"><enum>(i)</enum><header>In general</header><text>Of the 9 members of the Board appointed under this subparagraph (referred to in this subsection as <term>stakeholder members</term>)—</text><subclause id="H5A52A96F42A145998F90BA5E81259251"><enum>(I)</enum><text>2 shall be appointed from among the officers of Federal agencies who have experience and expertise with affordable and low-income housing and community development and financing, but at no time may more than 1 member be from any single such agency;</text></subclause><subclause id="H1A7F28B599E54BAEBDA296E28E7E6527"><enum>(II)</enum><text>2 shall represent labor organizations, as that term is defined in section 2 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152</external-xref>), of which building and construction employees are members;</text></subclause><subclause id="HA980122FC0FE4173B947E26D1DF20E45"><enum>(III)</enum><text>2 shall have expertise in housing finance, housing development, or housing management;</text></subclause><subclause id="HC066824203AB49A5BA499B1785422CDC"><enum>(IV)</enum><text>2 shall have technical expertise in architecture, affordable housing construction and financing, urban planning, or engineering; and</text></subclause><subclause id="HF6B62412A4234927A6332C2FBE7ADD8E"><enum>(V)</enum><text>1 shall be an expert in fair housing and civil rights.</text></subclause></clause><clause id="H56EA4F35F5734058AE65BAF90165628B"><enum>(ii)</enum><header>Environmental expertise; diverse experience</header><text>In appointing members under clause (i), the President—</text><subclause id="HB5B8434ACB77488C860DBF89708A743F"><enum>(I)</enum><text>shall appoint not less than 1 individual who has extensive expertise in climate, environmental justice, or sustainable building; and</text></subclause><subclause id="H0B9A90B8A6DC424BBE9E1B5380E75C83"><enum>(II)</enum><text>shall appoint a mix of individuals with experience in rural, urban, and Native communities.</text></subclause></clause></subparagraph><subparagraph id="HAF72AF6A7F5B4509928453E29F0A4CF1"><enum>(D)</enum><header>Resident members</header><clause id="HD38B7214C2E3436C94707AB94032583B"><enum>(i)</enum><header>In general</header><text>The 6 members of the Board appointed under this subparagraph (referred to in this subsection as <term>resident Board members</term>) shall be residents of public housing or permanently affordable social housing.</text></clause><clause id="HEC7273C446CE49C18F9C1D44686A5C12"><enum>(ii)</enum><header>Notice of expiration of term</header><text>The Authority shall publish notice of the expiration of the term of a resident Board member not later than 90 days before the date of the expiration.</text></clause><clause id="H0B5DEFFCC20E4F7087651E3E2FC7D68E"><enum>(iii)</enum><header>Vacancies</header><text>If a vacancy occurs during the term of a resident Board member—</text><subclause id="H2CA35ADE8E864BF49090FA847E17FB71"><enum>(I)</enum><text>the Authority shall publish notice of the vacancy not later than 10 business days after the vacancy occurs; and</text></subclause><subclause id="HB6AA20559F7D48EDA238E560C73C04BE"><enum>(II)</enum><text>the President shall appoint the successor resident Board member within a reasonable time after the expiration of 60 days following the provision of notice under subclause (I).</text></subclause></clause></subparagraph></paragraph><paragraph id="HCD1F39B827BE4A35AFBBCE0E4468EBAC"><enum>(3)</enum><header>Terms</header><subparagraph id="H9495F4996E3547B0B7E32945CD02887B"><enum>(A)</enum><header>In general</header><text>A member of the Board shall serve for a term of 4 years or until the member’s successor has been appointed, except as provided in subparagraphs (B) and (C).</text></subparagraph><subparagraph id="HDD43BB520E724052815D26AD19F2863C"><enum>(B)</enum><header>Terms of initial appointees</header><text>As designated by the President at the time of appointment—</text><clause id="H709AB9451C3E49B0AA5677F2447185D7"><enum>(i)</enum><text>of the stakeholder members first appointed in accordance with paragraph (2)(C)—</text><subclause id="H3DF2671316D34FA9A3A5ABAE1EEA59EC"><enum>(I)</enum><text>4 shall be appointed for terms of 2 years each; and</text></subclause><subclause id="H74C299A51E2B4AD7BF9983D75C6A5EEA"><enum>(II)</enum><text>5 shall be appointed for terms of 4 years each; and</text></subclause></clause><clause id="H0CAED46C0D0D4EFF943D371858B97B16"><enum>(ii)</enum><text>of the resident members first appointed in accordance with paragraph (2)(D)—</text><subclause id="H4DF582C4C438437AA476368DAE542F61"><enum>(I)</enum><text>3 shall be appointed for terms of 4 years each; and</text></subclause><subclause id="H60A4B97CCA6449B4AF2CDA9B70ADED74"><enum>(II)</enum><text>3 shall be appointed for terms of 6 years each.</text></subclause></clause></subparagraph><subparagraph id="H6EEAD23B69F74D669F6DCA0D6B137F7C"><enum>(C)</enum><header>Vacancy</header><clause id="H6541F91344D84B4887BC028FD2A72CB8"><enum>(i)</enum><header>Appointment for remainder of term</header><text>Any member of the Board appointed to fill a vacancy occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed only for the remainder of that term.</text></clause><clause id="H6B843701227E49D580E2AAC5FDCE0B91"><enum>(ii)</enum><header>Service after expiration of term</header><text>A member of the Board may serve after the expiration of that member’s term until a successor has taken office.</text></clause><clause id="HC3A76591FE2041B1A797505BE00A2DED"><enum>(iii)</enum><header>Filling of vacancies</header><text>A vacancy in the Board shall be filled in the manner in which the original appointment was made.</text></clause></subparagraph></paragraph><paragraph id="H82019F0D71044C288459B8B78C5B3B3F"><enum>(4)</enum><header>Prohibition</header><text>No part of any earnings of the Authority shall inure to the benefit of any member of the Board.</text></paragraph><paragraph id="H0B2611A0B1C64B48B7E95E0943E53804"><enum>(5)</enum><header>Open meetings</header><text>The proceedings of the Board shall be open to the public.</text></paragraph><paragraph id="H671D72A8B1D840E390B7CFB4D0B87C0A"><enum>(6)</enum><header>Comprehensive training program for Board members; technical assistance training for resident Board members</header><subparagraph id="HEDD2AFF975544C61AF1C47ABC6C426D1"><enum>(A)</enum><header>Requirement</header><text>Each member of the Board shall complete a training program, as developed by the Authority—</text><clause id="HDA3664DA105746B0AD954502DD24336D"><enum>(i)</enum><text>not later than 90 days after being appointed or reappointed to the Board; and</text></clause><clause id="H6C69A5A3F5044CAD938F1CD747D401C3"><enum>(ii)</enum><text>not less frequently than once every 2 years thereafter.</text></clause></subparagraph><subparagraph id="H4DD277E34AC64EC6B522A4446A31B604"><enum>(B)</enum><header>Establishment of program</header><text>The Authority shall establish and implement a comprehensive training program for members of the Board on the proper management of the Authority, including applicable laws and topics relating to—</text><clause id="H15646EF2ECF24449AF795A81E08621C6"><enum>(i)</enum><text>open meetings;</text></clause><clause id="H880CCFCBE6C148C291EE5AAF996D6CE6"><enum>(ii)</enum><text>public records;</text></clause><clause id="H9AEA2100473D4A7F849E81E0241BEDB0"><enum>(iii)</enum><text>conflicts of interest;</text></clause><clause id="H4D74509EFA2F4E6484202EFEAB6A2BC6"><enum>(iv)</enum><text>uniform procurement;</text></clause><clause id="HBC1D0C7764554AECA7D2ADC22CEC1190"><enum>(v)</enum><text>housing finance;</text></clause><clause id="HFB4B292511D846FDBE2DC2B2F035C3C0"><enum>(vi)</enum><text>fraud prevention;</text></clause><clause id="HFFBDC82FA10C45EE96A1DBAD29ADD3DF"><enum>(vii)</enum><text>fiduciary responsibilities;</text></clause><clause id="HC5876653EBFD41BAAF264552C3FF7D23"><enum>(viii)</enum><text>fair housing;</text></clause><clause id="H10B89EE6244444468A018B49A3D4830E"><enum>(ix)</enum><text>tenant selection, occupancy, and participation policies;</text></clause><clause id="H3D71A17DE8DF4331BE845C54E7FD6699"><enum>(x)</enum><text>prohibiting discrimination in housing; and</text></clause><clause id="H609D0331FAF54E3E9BF695C1320C3CD6"><enum>(xi)</enum><text>best practices relating to the general inspection, maintenance, and repair of dwelling units and capital improvements in public housing and other social housing.</text></clause></subparagraph><subparagraph id="H8E8BA67E17D646B08EE012D4525746F7"><enum>(C)</enum><header>Technical assistance</header><clause id="H947A7CFE7D1842A2B5D91A1F3150FE6B"><enum>(i)</enum><header>Training for resident Board members</header><text>The Authority shall provide independent technical assistance training to resident Board members with the goal of enabling resident Board members and members of tenant organizations to participate fully in the oversight of the Authority’s operation and capital planning.</text></clause><clause id="HBF75DF9258D84A4BAD717DBB19797F86"><enum>(ii)</enum><header>Training for residents generally</header><text>The Authority shall permit residents of public housing and social housing who are not members of the Board to attend technical assistance training provided under clause (i).</text></clause><clause id="H6BCB5DA2564E4E709BC5B9B332D0A232"><enum>(iii)</enum><header>Development of training program</header><text>The Authority shall develop the training program provided under clause (i) in consultation with—</text><subclause commented="no" display-inline="no-display-inline" id="H96F2EB918D6D461393433132675A71B0"><enum>(I)</enum><text display-inline="yes-display-inline">the Secretary;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H7A58DEDDD3354798801E50A84230CE0E"><enum>(II)</enum><text display-inline="yes-display-inline">government officials;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H5972575640BE4B21B1E6D7B3B94D02F8"><enum>(III)</enum><text display-inline="yes-display-inline">residents of public housing and social housing; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA0E68C01E8A24231A85531F1F83F1FD5"><enum>(IV)</enum><text display-inline="yes-display-inline">public housing and social housing advocacy and industry professional organizations.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="HB1B1C19766CE4775A7ABB74C044A0C75"><enum>(d)</enum><header>Stocks, bonds, and certificates</header><paragraph id="H751BEA65D4BB4C36A3F94BBF78585EA9"><enum>(1)</enum><header>In general</header><text>The Authority may issue bonds guaranteed by the United States to carry out the purposes of this Act, which bonds shall be legal investments for—</text><subparagraph id="HCEBB1B3784554D1D924B00C8CF3D5EED"><enum>(A)</enum><text>the deposits and the income derived therefrom of savings banks;</text></subparagraph><subparagraph id="H4C639C9B260643D687CC37400A83D34F"><enum>(B)</enum><text>the trust funds of trust companies;</text></subparagraph><subparagraph id="H4067CD623B79455796537941D7FD7FD6"><enum>(C)</enum><text>the capital and other funds of insurance companies; and</text></subparagraph><subparagraph id="HFB150AB79B8C4E1994B92C3121F0DFC7"><enum>(D)</enum><text>funds over which the Department of the Treasury has exclusive control.</text></subparagraph></paragraph><paragraph id="HCA6D7A043B9D446598DBF4E670723269"><enum>(2)</enum><header>Negotiable instruments</header><text>The bonds, notes, and certificates of indebtedness under this subsection shall constitute negotiable instruments for all purposes.</text></paragraph><paragraph id="H309B943D73EA4CCCB12C58860C2F2AFC"><enum>(3)</enum><header>Other characteristics</header><text>The bonds, notes, and certificates of indebtedness under this subsection—</text><subparagraph id="HBE9328F2C0AD41AABB689630543F9388"><enum>(A)</enum><text>may be payable from the income of the Authority or constitute a general obligation thereof;</text></subparagraph><subparagraph id="HFF0169C0E8F048F0A4D28E60899D98BF"><enum>(B)</enum><text>may be sold at not less than par, at public or private sale;</text></subparagraph><subparagraph id="H4D34E4BF17E042FA8061E16EC92D411E"><enum>(C)</enum><text>may contain any covenants, terms, and conditions, as determined by the Authority, that are not inconsistent with law; and</text></subparagraph><subparagraph id="H324580670F28410C81CBB6F4EC844535"><enum>(D)</enum><text>may be issued with or without the corporate seal.</text></subparagraph></paragraph></subsection><subsection id="H21F0E7CA06FF444EB0D5AA64A115A7F0"><enum>(e)</enum><header>Bylaws, rules, and regulations</header><text>The Board may make such bylaws, rules, and regulations, not inconsistent with this Act, as may be necessary for the proper conduct of the affairs of the Authority, including provisions for—</text><paragraph id="HA6C8F90696F44108818D983750554104"><enum>(1)</enum><text>compensation of members of the Board; and</text></paragraph><paragraph id="HDE200422D2314CD68CE816EC708C4EED"><enum>(2)</enum><text>the removal, resignation, or suspension of members of the Board.</text></paragraph></subsection><subsection id="HB4FBF2AE450A4C15A3197EAEF3DCAA2B"><enum>(f)</enum><header>Officers and employees</header><paragraph id="HBF03C4B4FE0F49578365FBD1B88CF94C"><enum>(1)</enum><header>In general</header><text>The Authority may select, employ, and fix the compensation of such officers, employees, attorneys, or agents as shall be necessary for the performance of the duties of the Authority under this Act, without regard to the provisions of other laws applicable to the employment or compensation of officers, employees, attorneys, or agents of the United States, notwithstanding section 4(a)(2).</text></paragraph><paragraph id="HDCA382864DAC4CF4A219F8EB438146EA"><enum>(2)</enum><header>Compensation</header><text>No officer, employee, attorney, or agent employed by the Authority shall be paid compensation at a rate in excess of the rate provided for the members of the Board.</text></paragraph></subsection><subsection id="HA5EF750F8D5A439B96DD59C7BC454490"><enum>(g)</enum><header>Salaries and expenses</header><text>The Authority—</text><paragraph id="H3AD9BB253B7048EC99CF4D878EF931FD"><enum>(1)</enum><text>shall pay such proportion of the salary and expenses of the members of the Board, including resident Board members, and of its officers and employees as the Board may determine to be equitable, including childcare, transportation, and any other necessary accommodations; and</text></paragraph><paragraph id="HE846DD36CEB34BF794ECD29188E9841C"><enum>(2)</enum><text>may operate out of the physical locations of each of the Federal Home Loan Banks, upon making reasonable compensation to the Federal Home Loan Bank, as determined by the Board.</text></paragraph></subsection><subsection id="H99CA561EF1CB4D66AEE57B580CD4D13F"><enum>(h)</enum><header>Offices</header><text>The Board may establish a principal office and regional offices of the Authority as the Board considers appropriate to carry out the responsibilities of the Authority.</text></subsection><subsection id="H5D89B4A18FF840BD9EE0318759E8A90E"><enum>(i)</enum><header>Use of mails</header><text>The Authority may use the United States mails in the same manner and under the same conditions as other departments and agencies of the United States.</text></subsection><subsection id="H51BE07B8F5134ED2AB2B7439BA59F352"><enum>(j)</enum><header>Operating assistance</header><text>The Authority may provide operating assistance to its properties and collect surplus cash, as defined by the Secretary.</text></subsection><subsection id="HB12028F2D5CF4344B0561483FC67E8C3"><enum>(k)</enum><header>Technology infrastructure</header><paragraph commented="no" display-inline="no-display-inline" id="HB2EAF7D591154B189CD14432F6EB3DCB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>In the acquisition and development process of the Authority’s technology infrastructure, the Authority shall—</text><subparagraph id="H2949B6CAB68A480EA5DD529582FC6EA4"><enum>(A)</enum><text>focus on the needs of users and take into consideration, to the extent practicable—</text><clause id="HCC7C63D8A4D44063A52609816F32EF4C"><enum>(i)</enum><text>the guidelines outlined in the U.S. Web Design Standards maintained by the General Services Administration and the Digital Services Playbook and TechFAR Handbook for Procuring Digital Services Using Agile Processes of the U.S. Digital Service; and</text></clause><clause id="H743BD49173B84B39AF7DC7449EFB83DB"><enum>(ii)</enum><text>the relevant successor documents or recommendations of the guidelines described in clause (i);</text></clause></subparagraph><subparagraph id="H6CB6C4B17AC84897828FF9B75662DD55"><enum>(B)</enum><text>use modern, relevant privacy- and security-enhancing technology; and</text></subparagraph><subparagraph id="HA2E73A02780345EFB9669DE774E3CFD8"><enum>(C)</enum><text>plan for the ongoing operations and maintenance of its systems and products to ensure their ongoing capability.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0404163DD0234E6084BDEFA75F5C7555"><enum>(2)</enum><header>21st Century Integrated Digital Experience Act</header><text display-inline="yes-display-inline">The 21st Century Integrated Digital Experience Act (<external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/336">Public Law 115–336</external-xref>) shall apply to the Authority in the same manner as that Act applies to an Executive agency, except that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3E86D47BC6CC46B084B4AF510FCDC1CC"><enum>(A)</enum><text display-inline="yes-display-inline">any reference in that Act to the head of an Executive agency shall be deemed to be a reference to the Board; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2A150DF78AE04EE296D21D1F7BE09525"><enum>(B)</enum><text display-inline="yes-display-inline">any reference in that Act to the Chief Information Officer of an Executive agency shall be deemed to be a reference to an equivalent employee of the Authority.</text></subparagraph></paragraph></subsection></section><section id="H1AFE92E2595C49F48B0F34E2AAF10E94"><enum>5.</enum><header>Purposes of the authority</header><text display-inline="no-display-inline"> The purposes of the Authority shall be to—</text><paragraph id="HDCBEF719409B4BA0B67E8BB6F9F794E0"><enum>(1)</enum><text>acquire real estate, public land, corporate-owned vacant properties, including vacant, blighted, or underutilized developments, and publicly assisted or privately owned properties with liens, fees, or tax violations for the purpose of—</text><subparagraph id="H8AD97F2AF15D41839010CD9C9038F592"><enum>(A)</enum><text>providing adequate housing for extremely low-income families, low-income families, and moderate-income families;</text></subparagraph><subparagraph id="H2DDD82F264014DBC8C6B9F1471671DFF"><enum>(B)</enum><text>preventing involuntary displacement of families; and </text></subparagraph><subparagraph id="H36D332BBBAEA4167A59DE924FFFEF9EB"><enum>(C)</enum><text>stabilizing communities, including underserved communities that have experienced historical legacies of exclusion;</text></subparagraph></paragraph><paragraph id="HEDB8A94D4970464698D4D47CB7A1580C"><enum>(2)</enum><text>operate and maintain the physical and functional conditions of acquired properties to—</text><subparagraph id="H7493CC6476844367AAF54C8C49635177"><enum>(A)</enum><text>preserve, modernize, and enhance the value, affordability, habitability, climate resiliency, energy efficiency, environmental sustainability, and residential and community amenities for current and future occupants of the real property; and</text></subparagraph><subparagraph id="HAB6A676AAD7E49AB9C650EFF388037D3"><enum>(B)</enum><text>contribute to the economic and social conditions of the surrounding community;</text></subparagraph></paragraph><paragraph id="HD231B9108A7149828E6E775A5ED7D326"><enum>(3)</enum><text>rehabilitate, modernize, finance, and construct real property to carry out the purposes of this Act described in section 2(b);</text></paragraph><paragraph id="HA88A9450DC554568925A1F5D9ACF1443"><enum>(4)</enum><text>rehabilitate, modernize, finance, and construct real property so as to comply with such standards as the Authority shall require to encourage maximum environmental performance, including—</text><subparagraph id="H8990C4C110844348A13D1D4F21CE3060"><enum>(A)</enum><text>using low-embodied carbon construction materials, as determined using a Type III Environmental Product Declaration (or a successor document) and in coordination with the Administrator of the Environmental Protection Agency;</text></subparagraph><subparagraph id="H0149836E393A4BB499F3CF7BD5A9E5BE"><enum>(B)</enum><text>encouraging zero indoor or outdoor air emissions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H37EC79D9963A4482B639BB65298B6F94"><enum>(C)</enum><text display-inline="yes-display-inline">ensuring accessibility of the property in accordance with—</text><clause commented="no" display-inline="no-display-inline" id="HDCD26C1C3F154D53BB1CCF8C98E332D6"><enum>(i)</enum><text display-inline="yes-display-inline">section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="HB48B2F5FE94A4B4A9D650764F75E2308"><enum>(ii)</enum><text display-inline="yes-display-inline">titles II and III of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131 et seq.</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/12181">42 U.S.C. 12181 et seq.</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="H9FF841DE14654F83974553544169B7D9"><enum>(iii)</enum><text display-inline="yes-display-inline">the Architectural Barriers Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4151">42 U.S.C. 4151 et seq.</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="HFD5C6245B3E149E69D90F996884205EC"><enum>(iv)</enum><text display-inline="yes-display-inline">the requirements under section 804(f)(3)(C) of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3604">42 U.S.C. 3604(f)(3)(C)</external-xref>) relating to design and construction;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5E5AAF6FF028493D9832ACE0D0618D60"><enum>(D)</enum><text display-inline="yes-display-inline">reflecting the highest international architectural standards and the architectural standards of the neighborhood and the community in which the real property is situated; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H775AADA6B09846C89F3B118467FBF50A"><enum>(E)</enum><text display-inline="yes-display-inline">employing innovative design principles and materials to advance public safety, fire safety and social infrastructure;</text></subparagraph></paragraph><paragraph id="H67059E82AE2D44CB8EA26A8CEE7518C5"><enum>(5)</enum><text>advance the streamlining of construction procedures and development processes, which shall include engaging with jurisdictions on permitting and zoning reform, within and across all levels of government to reduce project time and cost burden, while maintaining high-quality standards;</text></paragraph><paragraph id="H9C75B92FA5154566AF5EE1E7FFD5EE6B"><enum>(6)</enum><text>establish and use model policies and procedures for engaging community members, including community members at highest risk of housing displacement and unaffordability, and local governments to ensure projects leverage community expertise and responsive feedback to accurately and equitably assess and address local or regional needs for additional housing;</text></paragraph><paragraph id="HFFE9E9124A32490294E488CA2A50390A"><enum>(7)</enum><text>convey acquired real property to eligible entities that will use it to guarantee affordable, habitable, and environmentally sustainable housing to extremely low-income families, low-income families, and moderate-income families;</text></paragraph><paragraph id="H840A2F43FF7840EDA9C03FEDA4A0C69B"><enum>(8)</enum><text>finance and support the transfer of acquired property to eligible entities, which may include technical assistance, administrative support, or ongoing operational support;</text></paragraph><paragraph id="HBA71EC7F5BE04601991DF4E7D931591F"><enum>(9)</enum><text>provide an appropriate and expedient manner for owners of distressed properties to transfer ownership of those properties to the Authority;</text></paragraph><paragraph id="H5701B10B8302401F8A49C48FDA07AD67"><enum>(10)</enum><text>stabilize neighborhoods by reducing—</text><subparagraph id="H2CD91E09CF4745CBB75E712BDE726E31"><enum>(A)</enum><text>foreclosures; and</text></subparagraph><subparagraph id="HCF809607F93A42C7A027C564430AC352"><enum>(B)</enum><text>blighted or neglected real property;</text></subparagraph></paragraph><paragraph id="H075CD1CCD0D640F08A457CAC96BFA457"><enum>(11)</enum><text>across the portfolio of the Authority’s properties, encourage a range of housing types that accommodate homeless families, families at risk of homelessness, and extremely low-income families, low-income families, and moderate-income families unable to afford market rents;</text></paragraph><paragraph id="HC459798E6E914855876697D2D45915CB"><enum>(12)</enum><text>promote intentional placement of housing in a balance of neighborhoods affording future residents choice in where they live, which may include proximity to work, transit, childcare, education, healthcare, access to food, and culturally relevant community resources;</text></paragraph><paragraph id="HB2D56EF99DB749C09F345166FB3A2868"><enum>(13)</enum><text>ensure that, within any real property—</text><subparagraph id="HAD99433F24AA4A9EB57EA9D76CE63A28"><enum>(A)</enum><text>the quality of comparable dwelling units does not materially differ between units at various price levels;</text></subparagraph><subparagraph id="HD44A9CD2AD0C45FDA59CDD447CB24337"><enum>(B)</enum><text>access to services and facilities does not materially differ between units at various price levels; and</text></subparagraph><subparagraph id="H15BA107232FC409DAF0AB71E1E87C8FA"><enum>(C)</enum><text>units at various price levels are not—</text><clause id="HBC302B8E7F9C4D2C870E6D5685368D33"><enum>(i)</enum><text>physically located apart from one another; or</text></clause><clause id="H5E08CD80A71B43DF876FEB82B23250E4"><enum>(ii)</enum><text>outwardly identifiable according to affordability level;</text></clause></subparagraph></paragraph><paragraph id="HBDB1D4F165E74892AADBF731C8200BF1"><enum>(14)</enum><text>establish dignified, accessible, and streamlined processes for residents that minimize information collection burden, ensure privacy, and reduce barriers to accessing and maintaining affordable housing;</text></paragraph><paragraph id="H5274ECF5FE154CEE9289D108DF4953A7"><enum>(15)</enum><text>coordinate with the Secretary of Health and Human Services, the Secretary of Agriculture, and the Secretary of Education to facilitate collaborative or co-located supportive service programs, which may include—</text><subparagraph id="HC0A3A7D9ABDD4F3AA9E4262F2E207C6C"><enum>(A)</enum><text>childcare and early childhood education;</text></subparagraph><subparagraph id="H5D10E07B43CF415FA2A708255EBA089B"><enum>(B)</enum><text>out-of-school time programs;</text></subparagraph><subparagraph id="H3BBBC7121FDC4350B7FAB97F1F3A2464"><enum>(C)</enum><text>food and nutrition programs;</text></subparagraph><subparagraph id="H73DB3355D50141FC991C5AFBF7DE2D81"><enum>(D)</enum><text>health care programs;</text></subparagraph><subparagraph id="H27F2B4ECAB6041A8958D75808787FB36"><enum>(E)</enum><text>programs for older adults; and</text></subparagraph><subparagraph id="HA597C030371047D29BC93F2FDB67131F"><enum>(F)</enum><text>other programs;</text></subparagraph></paragraph><paragraph id="H186AA8F4CEB74A158E348450F314FDDD"><enum>(16)</enum><text>acquire housing that enables the Authority to assist people who wish to voluntarily relocate out of areas at high risk for extreme weather and into safer, affordable housing;</text></paragraph><paragraph id="HD5F3E727C2334D96A79EA695CB83936A"><enum>(17)</enum><text>in areas affected by a natural disaster or emergency declaration, acquire housing and assist with relocation and the provision of safe, affordable housing;</text></paragraph><paragraph id="HE73923F9D9E54B5EAC03377302F10D0E"><enum>(18)</enum><text>encourage public land banking for permanently affordable social housing;</text></paragraph><paragraph id="HC539D3C8D7B3429D9C67950A1945155D"><enum>(19)</enum><text>preserve and improve existing public housing developments and affordable housing stock;</text></paragraph><paragraph id="HF8125A1B7EAA4170B11521143C25C1E8"><enum>(20)</enum><text>provide relief to mortgage borrowers experiencing risk of foreclosure and preserve homeownership in times of economic distress or market instability; and</text></paragraph><paragraph id="H0D95B4566B9F4BC282A4487F9234CEFB"><enum>(21)</enum><text>affirmatively further fair housing by overcoming patterns of segregation, eliminating inequities in access to housing and related community assets, and fostering inclusive communities free from barriers that restrict access to opportunity based on protected characteristics.</text></paragraph></section><section id="HBC2AE7C3ACA940EB80376D5989133BC5"><enum>6.</enum><header>Powers and duties</header><subsection id="HFE30A524845E480AA58C9919A6DBCFE0"><enum>(a)</enum><header>Acquisition and purchase</header><paragraph commented="no" display-inline="no-display-inline" id="H26E0E1F2A4C248CCBDC8370933918AF0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Authority may acquire or purchase any real estate property for use as social housing through any legal means, including as provided in this subsection.</text></paragraph><paragraph id="H326FC9E51CD748B3BAC951ACFEF1CDC6"><enum>(2)</enum><header>Rights of first negotiation, offer, and refusal</header><subparagraph id="H2D28FC6326E64131A4A852CF73EE73A5"><enum>(A)</enum><header>In general</header><text>Subject to any applicable contract in effect on the date of enactment of this Act, and subject to the right of first refusal allowed by <external-xref legal-doc="usc" parsable-cite="usc/26/42">section 42(i)(7)</external-xref> of the Internal Revenue Code of 1986, the owner of any real property provided assistance by the Department, including public housing units and land subject to demolition, disposition, or conversion, shall afford the Authority a right of first negotiation, first offer, and first refusal to purchase, acquire, or otherwise receive the real property at a price that does not exceed the sum of—</text><clause commented="no" display-inline="no-display-inline" id="HCD3256E864CF463AA3916FC1507EBE53"><enum>(i)</enum><text display-inline="yes-display-inline">the amount of outstanding indebtedness secured by the real property; and</text></clause><clause id="HEA10227FBF9B47EBB33C0D3DFA0CD44C" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">any associated amount of Federal, State, or local tax or other contractual liability projected to be imposed as a result of the sale, disposition, transfer, or other conveyance of the real property to the Authority under this subsection.</text></clause></subparagraph><subparagraph id="HA419DF8D354946DDBFF3176AC81FC963"><enum>(B)</enum><header>Relocation</header><text>Relocation of a household due to any acquisition, rehabilitation, or demolition under this section of any property assisted by the Department shall be subject to the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/42/4601">42 U.S.C. 4601 et seq.</external-xref>) and part 24 of title 49, Code of Federal Regulations, or any successor regulation.</text></subparagraph></paragraph><paragraph id="H4F52932B77F1456BB59E34632B673EFF"><enum>(3)</enum><header>Eminent domain</header><subparagraph id="H58FDDB3963E9475A8F28D64314518D9B"><enum>(A)</enum><header>Power</header><text>The Authority may acquire properties for the purposes described in section 5 by the exercise of the right of eminent domain in a court of competent jurisdiction.</text></subparagraph><subparagraph id="HED5F5CE9D97E4879B6A21001FBD6AAB0"><enum>(B)</enum><header>Scope of power</header><text>The Authority—</text><clause id="H2B431ACC518C4359A9E54B85F3C411D4"><enum>(i)</enum><text>shall use the eminent domain power of the Authority—</text><subclause id="H21F445B1D5AA42E2B474CFFF8BC14122"><enum>(I)</enum><text>in a manner consistent with the purposes described in section 5; and</text></subclause><subclause id="HAF47A59779994974904A8644F9EDF515"><enum>(II)</enum><text>to preserve and create social housing; and</text></subclause></clause><clause id="HEE18079E82A948DC830B34E116B251FF"><enum>(ii)</enum><text>may use the eminent domain power of the Authority—</text><subclause id="H32735C98EC4D4D2094E45C5B5A2E8CD7"><enum>(I)</enum><text>if residents of federally assisted housing form a tenant organization and petition the Authority to acquire the property;</text></subclause><subclause id="HC017B48B26834666885980AAB3DB8158"><enum>(II)</enum><text>if a State or local government is seeking to block the development of affordable housing (including a project not already supported by the Authority); or</text></subclause><subclause id="H11E0546406144C42BF261561EAD583D2" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>to support transit-oriented development.</text></subclause></clause></subparagraph><subparagraph id="HB421988A0CA54D808A76AF6570F53727"><enum>(C)</enum><header>Prohibited uses</header><text>The Authority may not use the eminent domain power of the Authority—</text><clause id="H4E43922FC999499D8C3009DDA600C556"><enum>(i)</enum><text>for widespread displacement of individuals or families;</text></clause><clause id="HF6154BDE382C49A7839304F54347C857"><enum>(ii)</enum><text>for the destruction of communities;</text></clause><clause id="H2F140DAF37C242C0B876957C5E1BB67E"><enum>(iii)</enum><text>in a manner that is targeted on the basis of any protected characteristic; or</text></clause><clause id="H377D37C9E1684644A663BEFEF1AF805E"><enum>(iv)</enum><text>for the development of a highway or other similar infrastructure project that is ancillary to or not required for the preservation or creation of affordable housing.</text></clause></subparagraph><subparagraph id="H46162BAA862147118392BAA37E0B45A8"><enum>(D)</enum><header>Engagement</header><text>When using the eminent domain power, the Authority shall—</text><clause id="HB023BEE0F2144DBCB374D188F841E3F9"><enum>(i)</enum><text>meaningfully engage with communities affected by the use of the eminent domain power;</text></clause><clause id="H16D76E4B6FB64CEDA5283D69F71B9E4D"><enum>(ii)</enum><text>enter into community benefit agreements to ensure displacement through the use of the eminent domain power is minimized; and</text></clause><clause id="H4BC207CEC3534168A79367E84F4F1DDE"><enum>(iii)</enum><text>provide reasonable alternatives for any individuals displaced or potentially harmed by the use of the eminent domain power.</text></clause></subparagraph></paragraph><paragraph id="HCC652BA8E7FC406D88852C1B96EBA186"><enum>(4)</enum><header>Receivership</header><text>The Authority may, notwithstanding any other provision of law, take over as receiver for residential real estate properties, if appointed by the court or official authorized under law to appoint a receiver for a financial institution, public housing agency, or other entity, to ensure maintenance of quality for the benefit of the inhabitants and the community, including undertaking maintenance and renovation activities necessary to maintain or achieve compliance with applicable building, safety, health, and habitability codes and requirements.</text></paragraph></subsection><subsection id="HE28B23AEB6954358A21BE75F1E830DDA"><enum>(b)</enum><header>Operation and management</header><text>The Authority may—</text><paragraph id="H1D8BF28A95C242F0B98DDB726696FAC9"><enum>(1)</enum><text>hold any real property acquired under subsection (a) for the purpose of maintaining or increasing social housing stock;</text></paragraph><paragraph id="HE4A7FAFCF29644F0859B67C49F2751A1"><enum>(2)</enum><text>operate real property described in paragraph (1) as rental property and collect income; and</text></paragraph><paragraph id="HAC8F45756B92454AA016FDE69C3E3F8D"><enum>(3)</enum><text>update and improve real property described in paragraph (1) to maintain quality and conditions, which may include actions to retrofit and update the real property to be energy efficient, low-carbon, safe, healthy, climate-resilient, and accessible, including retrofits and updates for—</text><subparagraph id="HDA078F13A0674781BF5F052F51F47A38"><enum>(A)</enum><text>energy efficiency, including—</text><clause id="H29BD3519B5A2403B9F36E46D8C7BEBB2"><enum>(i)</enum><text>installing energy efficient windows;</text></clause><clause id="HBBEDAE25E5DA4BF684428C8621BD1BC5"><enum>(ii)</enum><text>super-insulating roofs and exterior walls;</text></clause><clause id="H6774B743E0104173884D315F09C0D50E"><enum>(iii)</enum><text>electrifying water heating;</text></clause><clause id="H598641383B01498A8EE6FC31D8A398B6"><enum>(iv)</enum><text>installing electric heat pumps for heating or air conditioning; and</text></clause><clause id="HEEDCD5BA9C4A4DCB8655C8E6CCECB9F4"><enum>(v)</enum><text>increasing the airtightness of building envelopes, heat recovery systems, and ventilation systems;</text></clause></subparagraph><subparagraph id="H74066D997DD84260BBB60FD89B69692B"><enum>(B)</enum><text>remediation to—</text><clause commented="no" display-inline="no-display-inline" id="H2DA8CD79CB4F454F9EAED350A73F4665"><enum>(i)</enum><text display-inline="yes-display-inline">eliminate any mold, asbestos, lead-based paint, lead-based paint hazards, lead pipes, radon, or other toxins or contaminants in the real property or otherwise affecting residents of the real property; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HC7FA5D4586AC42B186F3B193F62D3217"><enum>(ii)</enum><text display-inline="yes-display-inline">utilize least toxic building materials;</text></clause></subparagraph><subparagraph id="H63260B7217C746EC91A83492BD31F816"><enum>(C)</enum><text>in-unit efficiency upgrades, including installing energy efficient insulation and efficient and all-electric appliances;</text></subparagraph><subparagraph id="H1D0B7D8F44E14BACBB74A6C48EC0BD18"><enum>(D)</enum><text>providing drinking water, including replacing pipes and ensuring compliance with the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>) and other applicable standards of the Environmental Protection Agency;</text></subparagraph><subparagraph id="H359E029264354FFE9E4ACD316A244692"><enum>(E)</enum><text>energy systems, including installing renewable energy rooftops, renewable energy generation, and photovoltaic glass windows, purchasing clean energy grid supply in bulk, and investing in community-scale energy systems;</text></subparagraph><subparagraph id="H10FC2322552F4E1F9A07F5A335C2BCF6"><enum>(F)</enum><text>emergency response, including installing battery storage for backup and rigid foam wall insulation in hurricane and earthquake-prone areas to create shear walls and resistance to structural damage from walls tilting or falling during high winds or earthquakes; </text></subparagraph><subparagraph id="H144022D3BC4645AEA72A57259F5A544C"><enum>(G)</enum><text>transportation, including providing dedicated infrastructure for transportation by bicycle, electric bicycle, micromobility, or electric vehicles, including charging stations; and</text></subparagraph><subparagraph id="HC6A3F97E0D284CED9F65A228FDB8ED2E"><enum>(H)</enum><text>otherwise meeting minimum property standards established by the Authority or the Secretary.</text></subparagraph></paragraph></subsection><subsection id="H11E50D0B69DD48CAAE433006C2A2A3AE"><enum>(c)</enum><header>Support to eligible entities</header><paragraph id="H305C064E45E84D8EBCB18C6746B90F9C"><enum>(1)</enum><header>In general</header><text>The Authority—</text><subparagraph id="HB0B28FDFBDFF43048957B16AE9DBB004"><enum>(A)</enum><text>may convey any real estate property owned or held by the Authority to an eligible entity under paragraph (2) for use as affordable housing under section 7(c);</text></subparagraph><subparagraph id="HC1B9878D709146B9BE87626E8B2B02D4" commented="no"><enum>(B)</enum><text>may not convey real property that is uninhabitable under this subsection unless the Authority has—</text><clause id="HE3EBDEA2D1EB446386AA7941324F5AAC" commented="no"><enum>(i)</enum><text>taken any actions necessary to bring the real property into compliance with applicable building, safety, health, and habitability codes and requirements; or</text></clause><clause id="H8FAD5C69DD0D4E73A1BD733A099FDD94" commented="no"><enum>(ii)</enum><text>entered into such agreements with the conveyee sufficient to ensure that any actions necessary to bring the real property into compliance with applicable building, safety, health, and habitability codes and requirements will be taken before the property is occupied;</text></clause></subparagraph><subparagraph id="H831A016BCCB24FDB8214EF71B2330814"><enum>(C)</enum><text>finance or assist in financing the acquisition of residential real estate properties by eligible entities under paragraph (2) for use as affordable housing;</text></subparagraph><subparagraph id="H8A24588E1ABA4532867597C60391767B"><enum>(D)</enum><text>contract directly with any eligible entity for the purpose of developing and managing an affordable housing project involving the purchase or acquisition of the right to use completed or remodeled dwelling units, including condominium units, individual buildings that are part of a larger development, or a portion of the units in a multifamily development, or the construction of new buildings, except that—</text><clause id="HF8278A4F46854A19B8CD45E1003B4E14"><enum>(i)</enum><text>the project shall be subject to rules and regulations promulgated by the Authority, which shall include a procedure for providing public notice of the availability of funding and a ranking of priority for projects according to criteria for selection;</text></clause><clause id="HD558AAA62BD745EBAD8CDFB25CB3C0BB"><enum>(ii)</enum><text>the project shall seek to reasonably comply with any applicable laws, ordinances, and regulations of the State and political subdivision thereof in which the project is located, relating to the construction and repair of buildings, zoning, and the protection of public health; and</text></clause><clause id="H434F15D371514319B60684D1724B0874"><enum>(iii)</enum><text>the project budget may include capital funds to establish spaces for supportive services and funds to provide such services.</text></clause></subparagraph></paragraph><paragraph id="HE5AEFC2D87B843B88727749782F60187"><enum>(2)</enum><header>Eligible entities</header><subparagraph id="HEF04F76490EE4BB389B78BC11E362C5A"><enum>(A)</enum><header>In general</header><text>For purposes of conveyance of assets under this subsection, the following entities shall be eligible entities:</text><clause id="HE704172253074D24850B4A530C901071"><enum>(i)</enum><text>A mission-driven nonprofit organization that—</text><subclause id="H6506D489375A4FE29C9999A703453DCB"><enum>(I)</enum><text>has as one of its primary purposes—</text><item id="HC34B4F7486024127952807CCF6C81DFE"><enum>(aa)</enum><text>the provision of housing that is affordable to low-income families and moderate-income families; or</text></item><item id="H6BBB6F166B854B6CBC17D3ADCAE270EE"><enum>(bb)</enum><text>the provision of evidence-based supportive services, shelter, or housing assistance for homeless persons or families or those at risk of homelessness; or</text></item></subclause><subclause id="H1049FE69EF73477CA854A9FCD231B4D6"><enum>(II)</enum><text>is otherwise considered by the Authority as a suitable purchaser.</text></subclause></clause><clause id="HCB6D08C6CB9A4D3FB85FAD7BCEA85E56"><enum>(ii)</enum><text>A tenant organization, resident-owned cooperative, or community-led development organization.</text></clause><clause id="H908BE7773C594B2F91AEBC76CD3A55DF"><enum>(iii)</enum><text>A public housing agency.</text></clause><clause id="H3505236FA4F2419FB9E0A3DB619A0A33"><enum>(iv)</enum><text>A State, local, or Tribal governmental agency or other instrumentality.</text></clause><clause id="H8A30EEFDB803483590CFEDF243B9444F"><enum>(v)</enum><text>A community land trust.</text></clause><clause id="H5D95314416AD440F8FA2EF682D73ED9E"><enum>(vi)</enum><text>Such other entities considered by the Authority as suitable conveyees.</text></clause></subparagraph><subparagraph id="H7CBF65B1D51142A48F5ECB02D6F7BDFC"><enum>(B)</enum><header>Ineligible entities</header><clause id="H4D58DE85D68547B1904041B924D9B239"><enum>(i)</enum><header>In general</header><text>The Authority shall establish standards for excluding entities from eligibility under subparagraph (A) as appropriate to ensure the preservation and permanent affordability of housing and protection of residents.</text></clause><clause id="H76BAE25E76364D13A7129EBA1FAE5D0D"><enum>(ii)</enum><header>Maintenance of nonprofit eligibility</header><text>The Authority shall establish procedures to ensure that any eligible entity that is a nonprofit organization, and to which a real property is conveyed under this subsection, maintains its nonprofit status under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text></clause></subparagraph><subparagraph id="HB9D783122C1546E28B8DD11DF8242882"><enum>(C)</enum><header>Use restrictions</header><text>A conveyance under this subsection shall all be accompanied by a permanently affordable social housing use restriction.</text></subparagraph><subparagraph id="H6EB8BDBB8F3D4B84A042189750DD8215"><enum>(D)</enum><header>Requirement</header><text>An eligible entity may receive conveyance of a real property or mortgage under this subsection only if the eligible entity enters into such binding agreements as the Authority considers necessary to ensure that the property involved—</text><clause id="H7D353307CF454BC696577F0FA0F769BE"><enum>(i)</enum><text>is used as permanently affordable housing; and</text></clause><clause id="H66638902AEE3449788E237BD248B568E"><enum>(ii)</enum><text>cannot be resold, sold, transferred, or assigned into the private market.</text></clause></subparagraph><subparagraph id="HCC01C85B0F7F4A309BFA1477E5CC016D"><enum>(E)</enum><header>Reversionary interest</header><clause id="HEB3F5F6BDA974C6BAC4CD9789A59E9D9"><enum>(i)</enum><header>In general</header><text>The Authority shall hold a reversionary interest in each real property the Authority conveys to an eligible entity under this subsection, with the power to reclaim a real property if the eligible entity is found to have violated the permanently affordable social housing use restriction.</text></clause><clause id="HE12B56BC22C64F1CADE686B793A1EE95"><enum>(ii)</enum><header>Compensation</header><text>If the Authority exercises the reversionary interest under clause (i) on a real property, the Authority shall, at the time the Authority exercises the reversionary interest, compensate each stakeholder who holds limited equity in the real property.</text></clause><clause id="HDD5DC688F9944A33918A6D03D0C77D72" commented="no"><enum>(iii)</enum><header>Exception for public housing</header><text>Clause (i) shall not apply to a real property that the Authority conveys to an eligible entity under this subsection for use as public housing.</text></clause></subparagraph><subparagraph id="H311F82E271944EE0A1824B8A2F0768A8"><enum>(F)</enum><header>Limited equity</header><text>A resident of a real property acquired under this subsection by an eligible entity may purchase limited equity in the real property, at the discretion of the eligible entity.</text></subparagraph><subparagraph id="H813A95CB58B7405DAB007215C063D5AD"><enum>(G)</enum><header>Limits on profit</header><text>An eligible entity or stakeholder claiming limited equity in a real property conveyed by the Authority under this subsection shall limit the sum of profit that may be taken on leasehold interests and any shares of stock, equity, or other financial interest in the property to a rate of 2 percent per year, compounded annually and adjusted for inflation.</text></subparagraph></paragraph></subsection><subsection id="H1D8327A32CD84185BFBA54A28322A94C"><enum>(d)</enum><header>Financing</header><paragraph id="HBA7EACF954F24AA2A84F1B33C44804ED"><enum>(1)</enum><header>In general</header><text>The Authority may issue, purchase, acquire, hold, or service a mortgage on any real estate property.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41FDC3783BCD4D20B949FF94277FA6F2"><enum>(2)</enum><header>Distressed mortgages</header><text>The Authority may seek to recoup any losses incurred on a distressed mortgage acquired under paragraph (1) from the responsible party if the Authority determines, not later than 5 years after acquisition, that the mortgage fell into distress due to—</text><subparagraph id="HB7B3F579C5FF4ACAA0CCF4C65A4B8773"><enum>(A)</enum><text>unfair or abusive terms or practices;</text></subparagraph><subparagraph id="H595B31D6403C4A3EB26EA655B4663DC0"><enum>(B)</enum><text>fraud or deception; or</text></subparagraph><subparagraph id="H1846981ABCC1489BABC664F6553812D0"><enum>(C)</enum><text>equity stripping or other such actions taken by an individual who constructively owns the real property or exercises control over the real property.</text></subparagraph></paragraph><paragraph id="H02E3DC0DA56447789A2AD1AC5DB3EDF3"><enum>(3)</enum><header>Financing tenant purchases</header><text>The Authority shall provide technical assistance and financing to support the purchase of rental properties by tenant organizations and community land trusts, regardless of incorporation status, under section 7 and otherwise, which may include financing such repairs and improvements as may be necessary to comply with subsection (c)(1)(B)(ii) of this section.</text></paragraph></subsection><subsection id="HBF4C49E41CFE411091BBD7B87C266CAC"><enum>(e)</enum><header>Clearinghouse</header><text>To facilitate the exercise of the powers under subsections (a) through (d), the Authority shall establish a clearinghouse—</text><paragraph id="H8B85345948AA4C7EBEDD542C111AF119"><enum>(1)</enum><text>for the Authority to provide notice of, and to market, in accordance with the requirements of this Act, real estate assets held by the Authority;</text></paragraph><paragraph id="H812F252E5AFD4847B165389A33AF478C"><enum>(2)</enum><text>for owners of distressed real estate assets to provide notice of the availability of, and to market, such assets to the Authority; and</text></paragraph><paragraph id="H23E81E838D22478FA661F928A4BB4FE0"><enum>(3)</enum><text>for public availability of notices provided to the Authority under section 10.</text></paragraph></subsection><subsection id="H88871B85BCD8432B90EF26D84644A59C"><enum>(f)</enum><header>Rulemaking</header><text>The Authority may promulgate any regulations necessary to carry out the powers, duties, and functions of the Authority.</text></subsection><subsection id="H3F34D494ED204306A89A178A508B99C7"><enum>(g)</enum><header>Annual report to Congress</header><text>The Authority shall annually provide a report to Congress evaluating the effectiveness of the Authority's actions.</text></subsection><subsection id="HF42EDC0FEF3D4544A64B1FD14D3FCFA7"><enum>(h)</enum><header>Preservation of affordability</header><text>The Authority may monitor the affordability of homeownership and adopt internal policies or recommend congressional action, as needed, to preserve affordability.</text></subsection></section><section id="HA70EC9D84CA7408FB84767C6306520DD" commented="no"><enum>7.</enum><header>Requirements for social housing providers</header><subsection commented="no" display-inline="no-display-inline" id="H5B6A4F32E2684AFA8AD7641148623A6E"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text>In this section, the term <term>social housing provider</term> means—</text><paragraph id="HD999559F5C824C6488D4800D2ECF92B7" commented="no"><enum>(1)</enum><text>the Authority acting pursuant to section 6(b)(2); and</text></paragraph><paragraph id="H736953662B294BDD81C89D7615B44678" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>an eligible entity, with respect to real property acquired under section 6(c)(1)(A).</text></paragraph></subsection><subsection id="H1183B84441764AEBBAD0B423C579B14F" commented="no"><enum>(b)</enum><header>General applicability</header><text>A social housing provider that makes social housing available for rent shall comply with the requirements of this section.</text></subsection><subsection id="HE40812B21CB6445584D94B287720672B"><enum>(c)</enum><header>Accessibility and affordability standards</header><text>The Authority shall establish affordability and accessibility standards for social housing, which shall—</text><paragraph id="HF4DCD0588ECD4FC7A7E6E63CC9A7A7E5"><enum>(1)</enum><text>ensure that units of social housing, in the aggregate, are truly financially accessible to families at a range of income levels, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2DD77F38EAF247DDA73962A9C994C991"><enum>(A)</enum><text display-inline="yes-display-inline">families who are homeless or at risk-of homelessness; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE3684151250C45DBA9B9B235BDFA985D"><enum>(B)</enum><text display-inline="yes-display-inline">extremely low-income families, low-income families, and moderate-income families;</text></subparagraph></paragraph><paragraph id="H72FA256FD1984161AA30576E7A854194"><enum>(2)</enum><text>ensure that not less than 40 percent of dwelling units are set aside for extremely low-income families in newly constructed units of permanently affordable social housing or other housing units preserved or rehabilitated as permanently affordable social housing;</text></paragraph><paragraph id="HAE136DAD0B614DBABB09AA2F91032B14"><enum>(3)</enum><text>ensure that not less than 70 percent of dwelling units are set aside for low-income families and extremely low-income families; and</text></paragraph><paragraph id="H6BF26BCC38D3402E8E7385CAF87CC6EF"><enum>(4)</enum><text>take into consideration—</text><subparagraph id="HE113E7FE00D14ACD9F10FA2200FA8D59"><enum>(A)</enum><text>requirements for affordable housing under other programs for assistance for affordable housing;</text></subparagraph><subparagraph id="H0E86D3A734E74FBCB9FC73F39EB2E2E7"><enum>(B)</enum><text>Federal income thresholds in section 215(a) of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12745">42 U.S.C. 12745(a)</external-xref>);</text></subparagraph><subparagraph id="H7640D2872D4A4504906C04E482187031"><enum>(C)</enum><text>neighborhood-scale rental markets, which may include Small Area Fair Market Rent standards published by the Department; and</text></subparagraph><subparagraph id="H937B9351DF9E4E96BEA0D287D6429ED4"><enum>(D)</enum><text>household financial expenditures, burdens, or costs, and historical legacies of exclusion, due to which the Secretary may establish new, comprehensive income thresholds, more generous than the thresholds described in subclause (II) as reasonably feasible and in accordance with financial sustainability.</text></subparagraph></paragraph></subsection><subsection id="H7DDF705117D540D4AA6598D8ADC6950F"><enum>(d)</enum><header>Rents</header><paragraph id="H26DBBEF1E8774751995F31F792FE3251"><enum>(1)</enum><header>Initial rent</header><text>A social housing provider shall set the initial annual rent plus the sum of fees charged to a household living in permanently affordable social housing at 25 percent of the adjusted gross income of the household.</text></paragraph><paragraph id="H7F7F5E6D72CE4647A7994075D8CFE637"><enum>(2)</enum><header>Increases</header><text>An increase in rent for a property described in paragraph (1) may not exceed the lesser of—</text><subparagraph id="H39E3236E585C4FA4BF6AF86C69684AE5"><enum>(A)</enum><text>3 percent per year; or</text></subparagraph><subparagraph id="H067DCE2F1590451FB9E30000CCAA5A71"><enum>(B)</enum><text>the percentage increase (if any) in the Consumer Price Index since the previous rent increase. </text></subparagraph></paragraph><paragraph id="H317F24645D094F778ABFF39CCB3CCA3C"><enum>(3)</enum><header>Recalibration</header><text>Rent for a property described in paragraph (1) shall be recalibrated to 25 percent of the household’s adjusted gross income—</text><subparagraph id="HB8F82DF00654447D9892DD42F787D68D"><enum>(A)</enum><text>not less frequently than once every 5 years;</text></subparagraph><subparagraph id="H5FD9200DB6594E43AD188BDDF22AB241"><enum>(B)</enum><text>when the household’s adjusted gross income, as defined by the Secretary, changes by 10 percent or more; and</text></subparagraph><subparagraph id="H5E03FFC814974D529922313BCEB38F2F"><enum>(C)</enum><text>when the household requests a recalibration due to economic hardship under a process established by the Authority.</text></subparagraph></paragraph><paragraph id="HAC0B15200E244612A3D16A4C87B69EEF"><enum>(4)</enum><header>Public housing rental guidelines and formula</header><text>The rental guidelines and formula described in section 3(a) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(a)</external-xref>) shall supersede paragraphs (1), (2), and (3) of this subsection with respect to rent for a real property conveyed to a public housing agency under section 7(c) for use and operation as public housing.</text></paragraph></subsection><subsection id="H4FF10532D38F4AD8B85142A58F914721"><enum>(e)</enum><header>Resident, applicant, and tenant protections</header><paragraph commented="no" display-inline="no-display-inline" id="H0A02402BA9E04560B9AF3631B403F71E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>A social housing provider shall comply with the resident, applicant, and tenant protections under this subsection.</text></paragraph><paragraph id="H5AFA2A80B17341779F8EFBEC082A662E" commented="no"><enum>(2)</enum><header>Just-cause evictions</header><subparagraph id="HDCB548E128CA4710A66948F0A2E10CEA"><enum>(A)</enum><header>In general</header><text>A social housing provider may not terminate or refuse to renew a tenancy except for just cause and only pursuant to advance written notice to the tenant and evidence of such just cause, in accordance with this subparagraph.</text></subparagraph><subparagraph id="HEC9FC1675CC840CFA29A6F579D7B179C"><enum>(B)</enum><header>Definition of just cause</header><text>For the purposes of this paragraph, the term <term>just cause</term> means—</text><clause id="H02C6DD6E7A544A68AFBA6BE4A0E0BB89"><enum>(i)</enum><text>at-fault just case, as described in subparagraph (C); or</text></clause><clause id="H6CB87C03765A44F3AECF344C3F7D841A"><enum>(ii)</enum><text>no-fault just cause, as described in subparagraph (D).</text></clause></subparagraph><subparagraph id="HF26DCE1E6057479E801925AEE88DF71F"><enum>(C)</enum><header>At-fault just-cause</header><clause id="H45C6058A087443388C86227DD148DE00"><enum>(i)</enum><header>Grounds</header><text>For purposes of this paragraph, at-fault just cause grounds for eviction are any of the following:</text><subclause id="H76475F694D554C959145AC53437827CD"><enum>(I)</enum><text>The tenant’s failure to pay rent.</text></subclause><subclause id="H9A61FDA547B441558B81658EA0FDD00A"><enum>(II)</enum><text>The tenant’s engagement in serious criminal activity on the premises that poses an imminent and direct threat to the health or safety of other tenants.</text></subclause><subclause id="H5BF4199282504F63B819702E393D91A0"><enum>(III)</enum><text>The tenant causing substantial damage to the premises after being issued a written notice to correct the violation.</text></subclause><subclause id="H5494D424E6774FB387F65A8C0451E12C"><enum>(IV)</enum><text>The tenant maintaining, committing, or permitting the maintenance or commission of a nuisance at the property.</text></subclause><subclause id="HE7FCF1F5DB474855A8D728CBE9735465"><enum>(V)</enum><text>The tenant permitting the premises to be used for a criminal purpose.</text></subclause><subclause id="HF377FC2A18774459B83047D5E43962F5"><enum>(VI)</enum><text>The tenant's refusal to execute the social housing provider’s request for a written extension or renewal of a lease based on terms similar to the terms of the tenant’s prior lease without an unreasonable rent increase.</text></subclause><subclause id="HB79F51ABC3A14587A655B7921A5985CA"><enum>(VII)</enum><text>The tenant's refusal to deliver possession of the premises after providing written notice to the social housing provider of the intent to terminate the tenancy and after the social housing provider’s acceptance of that notice.</text></subclause></clause><clause id="H6CC4EABA317E4E1CB272DF1E4D422FCA"><enum>(ii)</enum><header>Notice</header><subclause id="HF23B5414DF264C53AAFDC9C1CADC25C4"><enum>(I)</enum><header>Notice of violation</header><text>Before a social housing provider issues a notice to terminate a tenancy for at-fault just cause based on a curable lease violation, as defined by the Authority, the social housing provider shall first give the tenant written notice of the violation and the opportunity to cure the violation within a reasonable period of time, subject to the time periods specified in paragraph (10)(A).</text></subclause><subclause id="HCB3F63A82CBD4C33AB357CC9F65BA261"><enum>(II)</enum><header>Notice of termination of tenancy</header><text>If a tenant does not cure a violation within the reasonable period of time set forth in a notice under subclause (I), the social housing provider may serve the tenant with a notice of termination of tenancy without a further opportunity to cure the violation.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H5ED4469BBD1B44C596E4D8DE8387A18E"><enum>(III)</enum><header>Uncurable lease violations</header><text>Nothing in this clause shall be construed to require notice in the case of an uncurable lease violation, as defined by the Authority.</text></subclause></clause><clause id="H5259F75EBD934044BC3FB7285E8773F7"><enum>(iii)</enum><header>Unreasonable rent increase</header><text>For purposes of this subparagraph, the term <term>unreasonable rent increase</term> means an increase in rent that exceeds the lesser of—</text><subclause id="H2CE2B9E213DB4472929D3AF072141E3D"><enum>(I)</enum><text>3 percent per year; or</text></subclause><subclause id="HC54284555A1843D5A6847D1D6C825C6E"><enum>(II)</enum><text>the percentage increase (if any) in the Consumer Price Index since the previous rent increase.</text></subclause></clause><clause id="H574840A762BD4745BCC02082B94ED760"><enum>(iv)</enum><header>Limitation</header><subclause id="H81AB348C8CC543799A908EEB058A3B6A"><enum>(I)</enum><header>In general</header><text>Notwithstanding clauses (i), (ii), and (iii), a social housing provider may not unfairly penalize an individual or an individual’s household based on the individual’s criminal history or minor legal infractions.</text></subclause><subclause id="H9D0FDC29F9EA41FFA3ED4213ECB31A2E"><enum>(II)</enum><header>Authority</header><text>To carry out subclause (I), the Authority, acting through the Board by rulemaking after notice and an opportunity for public comment—</text><item id="HC698630C456E499B9B73C211127A493C"><enum>(aa)</enum><text>may define what activities, crimes, and convictions, if any, may result in termination of a lease or exclusion of a resident from social housing; and</text></item><item id="H5A4C9F853E9044A19A347365DA073863"><enum>(bb)</enum><text>shall establish inclusive procedures, policies, and regulations to support the reintegration of individuals with criminal records into communities to ensure they have access to stable housing.</text></item></subclause></clause></subparagraph><subparagraph id="H1D87C1743C2946548BC63FFECCDF47C7"><enum>(D)</enum><header>No-fault just-cause</header><clause id="HB4984DB07FD74E30A6220A95C9599054"><enum>(i)</enum><header>Grounds</header><text>For purposes of this paragraph, no-fault just cause grounds for eviction are the following:</text><subclause id="HF928B38E0B684774AA6812142C613A8D"><enum>(I)</enum><text>The social housing provider intends to remove the dwelling unit from the rental market or substantially remodel or demolish the dwelling unit.</text></subclause><subclause id="H1108BC776EC64EDD95BE77BD9DA76733"><enum>(II)</enum><text>The social housing provider is required to comply with a local ordinance or an order from a court or other governmental entity which requires the tenant to vacate the property.</text></subclause></clause><clause id="H5895DC9F55E64EAABE651FCB91328751"><enum>(ii)</enum><header>Relocation costs</header><text>In the case of a no-fault just cause termination of tenancy, the evicting social housing provider shall assist the tenant with relocation costs regardless of the tenant’s income by providing—</text><subclause id="H82F45350C9C0403EACB06101E6148312"><enum>(I)</enum><text>a direct payment of 1 month’s rent; or</text></subclause><subclause id="H14CEAFFED26D48899536DB0CAE2F46AB"><enum>(II)</enum><text>a written waiver of the tenant’s last month of rent.</text></subclause></clause></subparagraph><subparagraph id="HCE4EFF1EF5234574B301749C3DAB11F3"><enum>(E)</enum><header>No waiver of rights</header><text>Any waiver of rights provided by this paragraph shall be void.</text></subparagraph></paragraph><paragraph id="H89956193429D41F68F88D28E41BF067D"><enum>(3)</enum><header>Prohibiting discrimination on the basis of source of income</header><subparagraph id="HE0DDCC546AEF4081A2685AB08ED0827B"><enum>(A)</enum><header>Prohibition</header><text>The Authority shall ensure that with respect to any unit of permanently affordable social housing, no person may engage in any conduct because of the source of income of a person that would be unlawful under the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>) if the conduct were engaged in because of a protected characteristic under that Act.</text></subparagraph><subparagraph id="HD8242B7561554FEBAE9072DE7BD30879"><enum>(B)</enum><header>Source of income</header><text>For purposes of this subparagraph, the term <term>source of income</term> includes—</text><clause id="H441315E220A54AB9A9AB70979D844C71"><enum>(i)</enum><text>a housing voucher under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) and any form of Federal, State, or local housing assistance provided to a family or provided to a housing owner on behalf of a family, including rental vouchers, rental assistance, and rental subsidies from nongovernmental organizations;</text></clause><clause id="HFA5F714461794618AF847757EE01C656"><enum>(ii)</enum><text>any amount received by an individual (including any amount to which an individual is entitled for which payment is made to a representative payee) by reason of entitlement to—</text><subclause id="H77767E2D3AC64C0CBDE22DBB6496EA5E"><enum>(I)</enum><text>a monthly benefit under title II or XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>, 1381 et seq.); or</text></subclause><subclause id="H7E34615FCA7740089ACD5897388F8F46"><enum>(II)</enum><text>a benefit under the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231">45 U.S.C. 231 et seq.</external-xref>);</text></subclause></clause><clause id="H1B14E0D287C149929AF76D626A79B92D"><enum>(iii)</enum><text>income received by court order, including spousal support and child support;</text></clause><clause id="HC6F9F4BA090D4254BFCDDB82B624178C"><enum>(iv)</enum><text>any payment from a trust, guardian, or conservator; and</text></clause><clause id="H36054B4FAA2F4D5BB6BC4E386905FF8D" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text>any other lawful source of income.</text></clause></subparagraph></paragraph><paragraph id="H23CADEEEA33E41DD9F7B311437CB3692"><enum>(4)</enum><header>Admissions restrictions</header><subparagraph id="H26A2AAA8BC874BE4998643F73D852378"><enum>(A)</enum><header>Screening</header><text>A social housing provider may screen applicants for permanently affordable social housing solely for the purpose of determining their ability to pay rent or otherwise comply with the material terms of the lease, provided the screening process and criteria comply with subparagraph (B).</text></subparagraph><subparagraph id="H1FBAB686806D48C1A4B7401495918DDF"><enum>(B)</enum><header>Rules and procedures</header><text>A social housing provider may not discriminate in a manner prohibited by—</text><clause id="H3B6833B3EE564380B267058B03CA12A1"><enum>(i)</enum><text>section 804 of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3604">42 U.S.C. 3604</external-xref>); or</text></clause><clause id="H4F1967C69DCE4321A58E5B4C25F24466"><enum>(ii)</enum><text>section 701(a) of the Equal Credit Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1691">15 U.S.C. 1691(a)</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="H7CB1577E21414E948AD92590EE90BFD9"><enum>(5)</enum><header>Prohibited bases of discrimination</header><text>A social housing provider may not implement any rules or procedures that deny or discriminate against an eligible applicant for permanently affordable social housing solely on the basis of—</text><subparagraph id="HCAA92C1237694BACA54A88904D968AC8"><enum>(A)</enum><text>irrelevant criminal history, in accordance with the final rule of the Department entitled <quote>Reducing Barriers to HUD-Assisted Housing</quote>, published in the Federal Register on April 10, 2024 (89 Fed. Reg. 25332);</text></subparagraph><subparagraph id="H053F2BD83E0C41D9AEF8E76180CDCCB2"><enum>(B)</enum><text>credit history; or</text></subparagraph><subparagraph id="HAAD452C74D5B44F19E06444DBF7AB962"><enum>(C)</enum><text>any other information that is not directly related to, or directly predictive of, an applicant’s ability to pay rent or otherwise comply with the material terms of the lease.</text></subparagraph></paragraph><paragraph id="HCB867CCD367648F1AAAC214AEFC979E5"><enum>(6)</enum><header>Democratic control</header><text>In the case of social housing that is a multifamily rental property, tenants shall have control of living and operating conditions in the property through a democratically elected resident organization, board, or council.</text></paragraph><paragraph id="HFE7F62649D5A46A6894A549142FD5017"><enum>(7)</enum><header>Resident associations and tenant organizations</header><text>Residents of permanently affordable social housing shall have the right to organize to form resident associations and tenant organizations with automatic bargaining rights to address issues related to their living environment.</text></paragraph><paragraph id="H01E275922FDA4853A816275DAAF67894"><enum>(8)</enum><header>Right to return without re-screening</header><text>A household that must relocate from a dwelling unit in a property temporarily due to the Authority’s acquisition, rehabilitation, or demolition of the property shall have a right to return to the property and shall not be excluded from occupancy based on any re-screening, income eligibility, or income targeting.</text></paragraph><paragraph id="H62761E4421A542EBA858F91E8E19069F"><enum>(9)</enum><header>Phased-in rent increase</header><text>In the case of a household occupying a dwelling unit in a property that initially is not social housing and has a rent lower the maximum rental allowed under subsection (d), upon conversion of the property to permanently affordable social housing, the social housing provider shall phase in any potential rent increase at a rate that does not exceed, over any 5-year period, 10 percent each year.</text></paragraph><paragraph id="HC8219C4F5A10462DAECB3EF12ADF7EAE"><enum>(10)</enum><header>Resident procedural rights in leases</header><subparagraph commented="no" display-inline="no-display-inline" id="H6BF6FD6C692C41F09D60154BC5744309"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>A lease for occupancy of a dwelling unit in permanently affordable social housing shall incorporate each item under this paragraph.</text></subparagraph><subparagraph id="HBBD6D35687244654B023DF1D6363192C"><enum>(B)</enum><header>Termination notification</header><text>The social housing provider shall provide adequate written notice of termination of the lease, which—</text><clause id="H8B1C39B9934941F580F075AEBED2E01A"><enum>(i)</enum><text>except as provided in clause (ii), may not be fewer than 30 days; or</text></clause><clause id="H55D562EF8D9541FEA23AA866146BDB7E"><enum>(ii)</enum><text>if a tenant is engaging in serious criminal activity on the premises that poses an imminent and direct threat to the health and safety of other tenants, may not exceed 30 days.</text></clause></subparagraph><subparagraph id="H7E1EA5D64F704DE291FD3D423FE1E77B"><enum>(C)</enum><header>Grievance process</header><clause id="H67F021563B2A4E6DA30343CD82CE32E2"><enum>(i)</enum><header>Opportunity for information hearing</header><text>For any dispute, termination of assistance, eviction, or other adverse determinations related to a resident’s tenancy, welfare, or status, the social housing provider shall provide the resident an opportunity for an informal hearing.</text></clause><clause id="H49867FFC69134C99ADE9C4E77B722293"><enum>(ii)</enum><header>Notice of opportunity to request informal hearing</header><text>A social housing provider shall provide residents notice of the opportunity to request an informal hearing described in clause (i).</text></clause><clause id="HC5C2B8962D844443AC98D3B93B0F3B35"><enum>(iii)</enum><header>Rule of construction</header><text>This subparagraph shall not provide any right to an informal hearing for a class grievance or to settle a dispute between residents not involving the social housing provider.</text></clause></subparagraph></paragraph></subsection><subsection id="H0CA446310121444E8F8F7DAABD51DAAC"><enum>(f)</enum><header>Additional requirements for social housing providers</header><paragraph id="H861B4ED72E4A41A28DA2D9D274C8A5FE" commented="no"><enum>(1)</enum><header>Waiting list</header><subparagraph id="H79B48CEC3F6B45CDAC9BF0B7A3A22267" commented="no"><enum>(A)</enum><header>In general</header><clause id="H6E20350323C947F9AD6C13351E86EC15" commented="no"><enum>(i)</enum><header>Establishment of waiting lists and resident selection and transfer policy</header><subclause commented="no" display-inline="no-display-inline" id="H57AEF283E5E04CE4B8B36DE086BE82A4"><enum>(I)</enum><header display-inline="yes-display-inline">Waiting lists</header><text>The Authority shall establish—</text><item commented="no" display-inline="no-display-inline" id="HDD63585BB8CA4BFBA3C92612E113EB2E"><enum>(aa)</enum><text display-inline="yes-display-inline">a waiting list for all social housing; or</text></item><item commented="no" display-inline="no-display-inline" id="H4E2A6E9EEFDD4782A480B927F38A4B4A"><enum>(bb)</enum><text display-inline="yes-display-inline">a waiting list for each social housing site.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H1BCD967EB24844E3AAB238DA00725514"><enum>(II)</enum><header>Resident selection and transfer policy</header><text display-inline="yes-display-inline">The Authority shall establish a resident selection and transfer policy under which individuals on an existing waiting list maintained by a public housing agency may be transferred to a waiting list established under subclause (I).</text></subclause></clause><clause id="H23CE246C4AF8460F82E8E3FC804592AA" commented="no"><enum>(ii)</enum><header>Priority for residents of occupied properties to reside in property</header><text>In the case of an occupied property that is converted to social housing, existing tenants shall receive priority to live in the social housing.</text></clause><clause id="H3E045AFF7A3C464085758DEB77F67BCB" commented="no"><enum>(iii)</enum><header>Public housing</header><text>The Authority shall determine the best policies and procedures to transition applicants from any public housing waiting list to a social housing waiting list established under clause (i)(I), and shall consider—</text><subclause id="H0D0D50AEF53541C4B7D44F4127E5B7A1" commented="no"><enum>(I)</enum><text>transferring applicants from an existing site-based public housing waiting list to a new site-based social housing waiting list;</text></subclause><subclause id="H283345D3FFBB4AE4A444FCFEE8F7BB50" commented="no"><enum>(II)</enum><text>transferring applicants from an existing site-based public housing waiting list to a waiting list for all social housing;</text></subclause><subclause id="H61338A1D74EA4A23BC99E9EF700F74B8" commented="no"><enum>(III)</enum><text>transferring an existing community-wide public housing waiting list to a different community-wide social housing waiting list; and</text></subclause><subclause id="H6291FE2E2A9348109D4F842C00692538" commented="no"><enum>(IV)</enum><text>informing applicants on a community-wide public housing waiting list how to transfer their application to 1 or more newly created site-based social housing waiting lists.</text></subclause></clause></subparagraph><subparagraph id="H46D95A92E8F24BF5B7B0F82613395258" commented="no"><enum>(B)</enum><header>Means of contact</header><text>The owner of a real property being converted to permanently affordable social housing and the social housing provider may determine the most appropriate means of informing applicants on any public housing or social housing community-wide waiting list in the community in which the property is located about the opportunity to apply for, or be transferred to a waiting list for, the new social housing, given the number of applicants, available resources, and the admissions requirements of the property, including—</text><clause id="H391AB7615CA242409E1632F10E0F2D41" commented="no"><enum>(i)</enum><text>contacting each applicant on the waiting list by direct mail or email;</text></clause><clause id="H82EE79D653C94AD1B0F7069586679B58" commented="no"><enum>(ii)</enum><text>advertising the availability of housing to the population that is less likely to apply, both minority and non-minority groups, through various forms of media within the marketing area, such as radio stations, posters, and newspapers;</text></clause><clause id="HAFA5C6B3642D44D6A5BC21FFFE46D4EC" commented="no"><enum>(iii)</enum><text>informing local nonprofit entities and advocacy groups, such as disability rights groups; and</text></clause><clause id="H51946295DD5749E88EF16B3F19CB9490" commented="no"><enum>(iv)</enum><text>conducting other outreach as appropriate.</text></clause></subparagraph><subparagraph id="HBA15D2C2D5924D1E95E47632EE43259E" commented="no"><enum>(C)</enum><header>Requirements</header><clause id="H06FC4B175DC545169F4186582BEDB0D8" commented="no"><enum>(i)</enum><header>Persons with disabilities or limited English proficiency</header><text>Any activity by a social housing provider to contact applicants on a public housing waiting list or social housing waiting list shall be conducted in a manner that ensures—</text><subclause commented="no" display-inline="no-display-inline" id="H4F53AF6B12714CE199AC16B95934D12F"><enum>(I)</enum><text display-inline="yes-display-inline">effective communication with persons with disabilities; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H3D5AD2ABE8A84064B7D184CD91E6B819"><enum>(II)</enum><text display-inline="yes-display-inline">meaningful access for persons with limited English proficiency (which may include communications in languages other than English).</text></subclause></clause><clause id="HFF7ACF1109E44198899C9ACA28D1696E" commented="no"><enum>(ii)</enum><header>Site-based waiting list</header><text>When using a site-based waiting list, a social housing provider shall consider waiting list and transfer policies that expand opportunities for tenants seeking an emergency transfer under, or consistent with, the owner’s emergency transfer plan, and allowing for easier moves between assisted properties.</text></clause></subparagraph><subparagraph id="H1181643E5DE841DB966F965BB99BCA5C" commented="no"><enum>(D)</enum><header>Administration</header><text>After the initial waiting list has been established for a social housing property, the social housing provider shall administer the waiting list in a manner that facilitates the fair and uniform treatment of applicants for, residents of, and units at the property, in accordance with all applicable civil rights and fair housing laws and regulations.</text></subparagraph></paragraph><paragraph id="HBCE7BE9154A5475381D25C444C7954E9" commented="no"><enum>(2)</enum><header>Access to records</header><text>A social housing provider shall cooperate with any reasonable requests for information made by the Authority (if applicable), an applicant, or a resident, including to support the permanently affordable social housing program evaluation, and including project financial statements, operating data, and rehabilitation work.</text></paragraph><paragraph id="H4EF80D38D3FB4294AC7EAE4AFFBD65F1" commented="no"><enum>(3)</enum><header>Operating budget</header><text>A social housing provider that is an eligible entity shall—</text><subparagraph id="HBA7A05ADAA6F4700B9B3D9D345F10ED1" commented="no"><enum>(A)</enum><text>submit to the Authority annually an operating budget for the permanently affordable social housing and such other information as the Authority considers necessary to assess the financial health of the permanently affordable social housing; and</text></subparagraph><subparagraph id="H5FD4D110786F49068CCA30EB1E4D4275" commented="no"><enum>(B)</enum><text>determine annually whether the permanently affordable social housing—</text><clause id="H7835C8565C0745778EC8982F9D13A5C6" commented="no"><enum>(i)</enum><text>is generating excess cash that shall be reinvested or returned to the Authority; or</text></clause><clause id="H340F1317CAA5445992AB505F93319D88" commented="no"><enum>(ii)</enum><text>is in need of operating assistance, including adequate capitalization of reserves for replacement, from the Authority.</text></clause></subparagraph></paragraph><paragraph id="H8600F50EAD6541C1AFD3DCD19DB078C0" commented="no"><enum>(4)</enum><header>Reinvestment of surplus</header><text>A social housing provider shall prioritize any reinvestment of surplus operating funds for social housing dwelling units for families whose household incomes are at or below 30 percent of area median income.</text></paragraph><paragraph id="H257BD4FC72F94C0E91034F270474889D" commented="no"><enum>(5)</enum><header>Economic opportunities for low- and very low-income persons</header><text>The operation of permanently affordable social housing shall be considered a program that provides housing and community development assistance for purposes of section 3 of the Housing and Urban Development Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701u">12 U.S.C. 1701u</external-xref>).</text></paragraph></subsection><subsection id="H56CC53D2EAEA4818927BA9D6BB3E125D"><enum>(g)</enum><header>Private right of action</header><text>A tenant of a permanently affordable social housing who is charged a rent that exceeds the amount permitted under subsection (d) or who is evicted in violation of subsection (e) may bring in an appropriate district court of the United States a civil action to obtain injunctive relief, compensatory damages and punitive damages, or such other relief as the court may consider to be appropriate.</text></subsection></section><section id="HD0085972008E4C3F86263441269163A0"><enum>8.</enum><header>Labor and Buy America provisions</header><subsection id="HAC3BF8131E894695A4F2437A43D38425"><enum>(a)</enum><header>In general</header><text>In carrying out their respective authorities under this Act, the Authority and each eligible entity — </text><paragraph id="HD100C30DFECC4828A97D219BBCA33BEA"><enum>(1)</enum><text>shall ensure that construction materials and manufactured products used are—</text><subparagraph id="H2F916186D32F46A8AD709C215381711F"><enum>(A)</enum><text>substantially manufactured, mined, and produced in the United States in accordance with section 8302 of title 41, United States Code (including the amendments to that section made by the Build America, Buy America Act (subtitle A of title IX of division G of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/41/8301">41 U.S.C. 8301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>))); and</text></subparagraph><subparagraph id="HDFFA7D8DA82944469FE59FACBA661DB0"><enum>(B)</enum><text>to protect workers and residents, included in the Recommendations of Specifications, Standards, and Ecolabels for Federal Purchasing list (or a successor document) developed under the Environmentally Preferable Purchasing Program of the Environmental Protection Agency;</text></subparagraph></paragraph><paragraph id="H4E65E7EDD47B497C823E349DB82392DD"><enum>(2)</enum><text>shall ensure that all laborers and mechanics employed by contractors or subcontractors in the performance of construction, prosecution, completion, or repair work carried out, in whole or in part, with assistance made available under this Act, including negotiable instruments described in section 4(d), shall be paid wage rates not less than those prevailing on projects of a similar character in the locality, as determined by the Secretary of Labor, in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code;</text></paragraph><paragraph id="HC5D1C0B33F4040688681BA42A98AF11E"><enum>(3)</enum><text>with respect to any construction project for which the total estimated cost of the construction is $25,000,000 or more, shall ensure each contractor and subcontractor engaged in the construction on the project agrees, for the project, to negotiate or become a party to a project labor agreement as that term is defined in section 22.502 of title 48, Code of Federal Regulations (as in effect on the date of enactment of this Act);</text></paragraph><paragraph id="H8189026EC9C2430F977BC525B1AC6764"><enum>(4)</enum><text>may not hire employees through a temporary staffing agency, unless the project is not being carried out under a project labor agreement and the relevant State workforce agency certifies that temporary employees are necessary to address an acute, short-term labor demand;</text></paragraph><paragraph id="H50C4B38C856E45BFAA32954669B9EE4F"><enum>(5)</enum><text>shall implement measures to ensure that outreach and recruitment efforts extend to local and underrepresented communities, including through support for pre-apprenticeship programs or the adoption of local hire provisions to the extent permitted by law;</text></paragraph><paragraph id="HF2E9246C19E9437282FB6294ACE5149A"><enum>(6)</enum><text>shall adopt—</text><subparagraph id="HE8DD4D2E4347402988E37318795ACB66"><enum>(A)</enum><text>an explicit policy on any issue involving the organization of employees, including the employees of all contractors and subcontractors engaged in the construction on the project, for purposes of collective bargaining, not to deter the employees with respect to—</text><clause id="HBBD79A8C42EB44A2A64449A6465B87B7"><enum>(i)</enum><text>labor organizing for the employees engaged; and</text></clause><clause id="H4A03E57EA686406082FBD112FC9F4D1F"><enum>(ii)</enum><text>the employees’ choice to form and join labor organizations;</text></clause></subparagraph><subparagraph id="HB8DB92A911414CABBD9E13CCCFFD77D2"><enum>(B)</enum><text>such policies that require—</text><clause id="HF4E73488254D4ABF813B44131C42178C"><enum>(i)</enum><text>the posting and maintenance of notices in the workplace to notify the employees of their rights under the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>);</text></clause><clause id="H39D689FF9BAF4B1990B370F59B385626"><enum>(ii)</enum><text>that the employees are, at the beginning of their employment, provided notice and information regarding the employees’ rights under the National Labor Relations Act; and</text></clause><clause id="HD025E58821154793AB726BC56E067294"><enum>(iii)</enum><text>an employer to voluntarily recognize a labor organization in cases where a majority of the employees have joined and requested representation; and </text></clause></subparagraph><subparagraph id="H56FDFB95029D4446BC389A158924DB81" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>a safety and health program that includes all the core elements of a workplace safety and health program, as recommended by the Occupational Safety and Health Administration;</text></subparagraph></paragraph><paragraph id="HD8F71DFBF45D4BDC80D58591DD918779"><enum>(7)</enum><text>shall consider an individual performing any service for the social housing provider, a contractor, or subcontractor as an employee, and not an independent contractor, unless—</text><subparagraph id="H3A51F56D7CA5432F94E8F2F66725B34F"><enum>(A)</enum><text>the individual is free from control and direction in connection with the performance of the service, both under the contract for the performance of the service and in fact;</text></subparagraph><subparagraph id="HF03F55DF5AF14F9180318A57F6B99819"><enum>(B)</enum><text>the service is performed outside the usual course of the business of the social housing provider, contractor, or subcontractor, respectively; and</text></subparagraph><subparagraph id="HD678D7CB67F546D79A484E62E136DE6A" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>the individual is customarily engaged in an independently established trade, occupation, profession, or business of the same nature as that involved in such service; and</text></subparagraph></paragraph><paragraph id="HCD4341242E984040BD3832343DEF313C" commented="no"><enum>(8)</enum><text>shall ensure that the installation, operation, and maintenance of electric vehicle chargers by qualified technicians meets the standards described in section 680.106(j) of title 23, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><subsection id="H97E48AD38A7D4F968403A92B96B16A0A" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Action To enforce independent contractor requirement</header><text>A third party, including a State or local government, may bring an action in any court of competent jurisdiction to enforce the requirement under subsection (a)(7).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H856962A44AF74016B0F0D42CB222ACC5"><enum>(c)</enum><header>Authority for certain labor standards</header><text>With respect to the labor standards specified in subsection (a)(2), the Secretary of Labor shall have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></subsection></section><section id="H6E781BC1F4444C879730086098AF15D2"><enum>9.</enum><header>Duty to serve</header><subsection id="HE8036FD16F56450EA576E75342359CFE"><enum>(a)</enum><header>Duty</header><text>To further the purposes of this Act, the Authority shall serve rural and Native communities.</text></subsection><subsection id="H75BF2B21698B4806BA4CFD5D3FB01162"><enum>(b)</enum><header>Evaluation and reporting of compliance</header><paragraph id="H30559486718243B68BE215421711F29F"><enum>(1)</enum><header>Evaluation method</header><text>The Authority shall, by regulation, establish effective for 2025 and each year thereafter a method for evaluating whether, and the extent to which, the Authority has complied with the duty under subsection (a) and for rating the extent of such compliance.</text></paragraph><paragraph id="HF250F58F257044518B8D9FA1BCD04666"><enum>(2)</enum><header>Annual evaluation</header><text>Using the method established under paragraph (1), the Authority shall, for 2025, and each year thereafter, evaluate compliance described in that subparagraph and rate its performance as to extent of compliance.</text></paragraph><paragraph id="HB8827D66F2C24B6CB758A53FE28977E7"><enum>(3)</enum><header>Annual report</header><text>The Authority shall annually publish and submitted to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report that contains the evaluation and rating for the year as described in paragraph (2).</text></paragraph></subsection></section><section id="H479C5F55CB65474BB2D3551C660E0137"><enum>10.</enum><header>Community and tenant opportunity To purchase multifamily rental properties</header><subsection id="H16AE81ACC046420CA73D96C8B35D1755"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HC799023FABF2437F98B2D0EAF41D94DA"><enum>(1)</enum><header>Approved statement of interest</header><text>The term <term>approved statement of interest</term>, with respect to a property, means a qualifying tenant organization's statement of interest in purchasing the property that has been approved by the Authority. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H36A341A06888408792C09211214E7F41"><enum>(2)</enum><header display-inline="yes-display-inline">Covered rental property</header><text display-inline="yes-display-inline">The term <term>covered rental property</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3625901EBB57441BA4E67811BC812111"><enum>(A)</enum><text display-inline="yes-display-inline">means multifamily housing that contains 3 or more separate rental dwelling units and—</text><clause id="HFD69BC65DFED48D7A7D75C6BB9B79C57"><enum>(i)</enum><text>received a credit under <external-xref legal-doc="usc" parsable-cite="usc/26/41">section 41</external-xref> of the Internal Revenue Code of 1986 by reason of subsection (h)(4)(B) of that section;</text></clause><clause id="H4472E00F3E4E47498BC1421C6E14140B"><enum>(ii)</enum><text>has a mortgage made by the Secretary of Agriculture under section 515 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1485">42 U.S.C. 1485</external-xref>);</text></clause><clause id="HB585E15D0E8E4EFF83655AC2A467DB85"><enum>(iii)</enum><text>has a distressed or nonperforming mortgage loan held by the Federal National Mortgage Association or the Federal Home Loan Mortgage Authority;</text></clause><clause id="HC9248953FB134D899263CE1D04E2D909"><enum>(iv)</enum><text>secures a mortgage loan issued by a member institution of a Federal Home Loan Bank; or</text></clause><clause id="H771EB0A274E34D8690C064CE2C9F0C2A"><enum>(v)</enum><text>has a federally insured mortgage and has an organization of tenants that has demonstrated an interest in, and maintained an approved statement of interest in, purchasing, subject to the application process and procedures determined by the Authority; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H55C6CFB0582745ADB5EB55279F6C4806"><enum>(B)</enum><text>does not include a student housing dormitory.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47F1305BBFC94ABAABF396A310490D43"><enum>(3)</enum><header>First-look and first opportunity to purchase period</header><text>The term <term>first-look and first opportunity to purchase period</term> means the 30-day period described in subsection (d)(1)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H65154347C32443CDB58F0C32565DD7AA"><enum>(4)</enum><header display-inline="yes-display-inline">Notice period</header><text display-inline="yes-display-inline">The term <term>notice period</term> means the 90-day period described in subsection (c)(2)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBE3CBE1A0612457EB1035F9290A91B30"><enum>(5)</enum><header>Qualifying tenant organization</header><text>The term <term>qualifying tenant organization</term> means an incorporated tenant organization.</text></paragraph></subsection><subsection id="H1CAF27A1461F45818032C5618D19AB78"><enum>(b)</enum><header>Excluded property transfers</header><text>This section does not apply to—</text><paragraph id="HB76CE943256E4BDA95926E24795B172F"><enum>(1)</enum><text>any transfer by devise or intestacy or any other transfer made in connection with a bona fide effort to pass an interest in real property to one’s devisees or heirs (including such a transfer made in connection with a living trust); or</text></paragraph><paragraph id="H78DDD544E367492DBFF8C5CA624966FF"><enum>(2)</enum><text>any transfer between or among spouses, domestic partners, siblings (including half-siblings, step-siblings, and adoptive siblings), parents (including step-parents and adoptive parents) or guardians and their children, grandparents and their grandchildren, aunts or uncles and their nieces or nephews, great-aunts or great-uncles and their grand-nieces or grand-nephews, or first or second cousins, or any combination thereof.</text></paragraph></subsection><subsection id="HF50C4A63C72E457F946ECF6DB1C25E96"><enum>(c)</enum><header>Obligation To provide notice of intent to sell</header><paragraph id="HCBD165CE484A46E4AC697FF9A09F7822"><enum>(1)</enum><header>In general</header><text>The owner of a covered rental property shall provide written notice to tenants and the Authority of the owner’s interest in selling, transferring, assigning, or conveying the property or the mortgage on the property, as soon as is practicable in good faith.</text></paragraph><paragraph id="H37CC0A9C76814C87919BEC1DACE0201E"><enum>(2)</enum><header>Notice period; procedures</header><text>The owner of a covered rental property may not sell, transfer, assign, or convey the property or the mortgage on the property, including by means of any short sale or sale pursuant to foreclosure, unless the owner—</text><subparagraph id="HE538840A190440F88222D3EB51CE0F54"><enum>(A)</enum><text>provides written notice to tenants and the Authority not later than 90 days before the property or mortgage would be sold, transferred, assigned, or conveyed; and</text></subparagraph><subparagraph id="HFB25A406A406483EAFE54F1FE8E1C82F"><enum>(B)</enum><text>provides a first look, opportunity to purchase, and right of first refusal to purchase the property in accordance with the procedures and requirements under subsection (d).</text></subparagraph></paragraph></subsection><subsection id="H07F10CBC194544BD97CCE76E1DAE66DE"><enum>(d)</enum><header>Additional obligations</header><paragraph id="H9C3AE68FF8574545ACC7CAE3DFD34426"><enum>(1)</enum><header>First-look and first opportunity to purchase period</header><subparagraph id="H4CC1406B17434D3EA0A75721DEB647DC"><enum>(A)</enum><header>In general</header><text>During the 30-day period beginning on the day after the last day of the notice period, the owner of the covered rental property shall provide eligible entities the first opportunity to purchase the property.</text></subparagraph><subparagraph id="HBFB6D0B0BE1646B19FCBC70E8F07E070"><enum>(B)</enum><header>Priority for eligible entities</header><text>The owner of the covered rental property may not offer the covered rental property for sale to any other purchaser, solicit any offer or bid to purchase the covered rental property, or otherwise enter into a contract for the transfer, sale, assignment, or conveyance of the covered rental property until after the end of the first-look and first opportunity to purchase period.</text></subparagraph></paragraph><paragraph id="HDE7B5BEA78624CF4B9CC11281F30AE4D"><enum>(2)</enum><header>Priority of first look and opportunity to purchase</header><subparagraph id="HAAB661E70C5F4143B1D032B251720810"><enum>(A)</enum><header>In general</header><text>Any eligible entity wishing to take advantage of the priority granted under paragraph (1) with respect to a covered rental property shall provide a notice of offer of sale by the end of the first-look and first opportunity to purchase period.</text></subparagraph><subparagraph id="HF293BA1A7F2A4075BEA97B64C30E083F"><enum>(B)</enum><header>Order of priority</header><text>The owner of covered rental property shall consider offers described in subparagraph (A) according to the following order of priority:</text><clause id="H7BB6873427F74CF5B0E649955F01A074"><enum>(i)</enum><text>An offer from a qualifying tenant organization that was incorporated before the notice period and that has a current, approved statement of interest in purchasing the covered rental property.</text></clause><clause id="HE70F4EC58A1946FAA825F63594BD4F23"><enum>(ii)</enum><text>An offer from a qualifying tenant organization that was incorporated during the notice period.</text></clause><clause id="H94980D5F69B44F50A778623ACD22B419"><enum>(iii)</enum><text>An offer from an eligible entity that a qualifying tenant organization of the covered rental property has endorsed.</text></clause><clause id="H4BBB4793A5D4405AAD7878AA5B330E02"><enum>(iv)</enum><text>An offer from an eligible entity that a qualifying tenant organization of the covered rental property has not endorsed.</text></clause></subparagraph></paragraph><paragraph id="H0CE662CC653A4961832594CFA18AE179"><enum>(3)</enum><header>Right of first refusal</header><text>After the owner of a covered rental property complies with subsection (c) and paragraphs (1) and (2) of this subsection, if the owner does not sell the covered rental property to an eligible entity under such paragraph (2) and instead opts to make the covered rental property available for sale to a third party, including by means of any short sale or sale pursuant to foreclosure, any eligible entity shall have the right to match any third-party offer (referred to in this subsection as the <quote>right of first refusal</quote>.</text></paragraph><paragraph id="H715E44A3D4F342AF96BD4EBE7F04EDCE"><enum>(4)</enum><header>Failure to sell</header><text>If the owner of a covered rental property does not enter into a sales contract during the 1-year period beginning on the date on which the right of first refusal under paragraph (3) is triggered, the obligation to provide notice of the interest and intent to sell under subsection (c) shall renew, and the owner may not sell the property except pursuant to subsection (c) and this subsection.</text></paragraph></subsection><subsection id="HFAB70A2C9C014A12BC33485302ABAF23"><enum>(e)</enum><header>Rights of tenants</header><paragraph id="H5ECF6C9DD9584E7681EB17DC9EACED7A" commented="no"><enum>(1)</enum><header>Tenant notification</header><text>The owner of a covered rental property, in notifying the tenants of the covered rental property of the interest of the owner in selling, transferring, assigning, or conveying the property or the mortgage on the property under subsection (c), shall provide the notice in an accessible manner that clearly outlines the process under this section and available resources.</text></paragraph><paragraph id="H0CA416038C67410796F9EF68CBCBE49B"><enum>(2)</enum><header>Tenant opportunity to purchase</header><text>Not later than the first day of the first-look and first opportunity to purchase period, the owner of a covered rental property shall notify tenants of the opportunity to purchase the covered rental property in an accessible manner that clearly outlines their rights and the resources available under this section to support a purchase.</text></paragraph><paragraph id="H99DCAA7BB88A425990A59F182140323B"><enum>(3)</enum><header>Tenant notification of offers</header><text>The owner of a covered rental property shall notify the tenants of the property of each offer to purchase the property made by an eligible entity.</text></paragraph><paragraph id="H1CA3D6345B5546608D8447E19139A908"><enum>(4)</enum><header>Tenant organizations</header><subparagraph id="H2C3F3F14D60D46ED887584CD04FA0F66" commented="no"><enum>(A)</enum><header>Right to purchase only as organization</header><text>Nothing in subsection (d) shall be construed to provide the right to purchase a covered rental property to an individual tenant.</text></subparagraph><subparagraph id="H876942CBFC604D1D9A56A71B0AEB9D0E"><enum>(B)</enum><header>Technical assistance</header><text>As part of the technical assistance provided under section 6(d) and subsection (g) of this section, the Authority shall provide resources to expedite the incorporation of tenant organizations to better allow tenants to participate in the process for purchase of a covered rental property under subsection (d) of this section, including pre-notification tenant training especially in areas at high risk for displacement.</text></subparagraph></paragraph><paragraph id="H7586285CA6084C98BE53C0A256CD6E10"><enum>(5)</enum><header>Establishment of resident-owned cooperative or community land trust</header><text>A qualifying tenant organization that wishes to purchase a covered rental property under this section shall establish a resident-owned cooperative or community land trust to purchase the covered rental property.</text></paragraph><paragraph id="H00026C9ED57B463EA0918542F88674E3"><enum>(6)</enum><header>Rights after purchase</header><text>If a qualifying tenant organization purchases a covered rental property under this section, the subsequent resident organization may resell the property to an eligible entity.</text></paragraph><paragraph id="H054F3A4AECD14CF88BB68FDC533FE100"><enum>(7)</enum><header>Endorsements</header><text>A qualifying tenant organization for a covered rental property may endorse an eligible entity’s offer of sale for purposes of the order of priority under subsection (d)(2)(B), by a majority vote of tenants and subject to procedures outlined by the Authority.</text></paragraph><paragraph id="HD4AD177C33EB4CE093FB1F1747AA9D33"><enum>(8)</enum><header>Representatives</header><text>A qualifying tenant organization may retain a legal representative to act as an agent of the qualifying tenant organization for purposes of this section. </text></paragraph><paragraph id="H226BE85A441A4BBC8F41CBDDB2E72A75"><enum>(9)</enum><header>Conveyance of rights</header><text>A tenant of a covered rental property may not assign, transfer, sell, or convey the rights afforded to the tenant under this section.</text></paragraph></subsection><subsection id="HFA1D8EBA7D564AB18E713AA380698297"><enum>(f)</enum><header>Responsibilities of all interested parties</header><text>For purposes of this section, an eligible entity, including a qualifying tenant organization and a legal representative of a qualifying tenant organization, and an owner of a covered rental property shall negotiate in good faith and communicate within reasonable timeframes.</text></subsection><subsection id="H6499CC4B0E304006898F69432CEF21A5"><enum>(g)</enum><header>Role of Authority</header><paragraph id="H779DD25859114CA9A02BFB39D6F24C8C"><enum>(1)</enum><header>In general</header><text>The Authority shall—</text><subparagraph id="H958DBF29BF14488C8A67BBE4AE4BFDDE"><enum>(A)</enum><text>establish an Office of Community and Tenant Opportunity to Purchase Act to provide direct technical assistance and grants for technical assistance to eligible entities, and legal representatives of qualifying tenant organizations, in order to support and enhance the ability of eligible entities, including qualifying tenant organizations, to make purchases under this section;</text></subparagraph><subparagraph id="H879D458B37AC40418B7570FE771DF061"><enum>(B)</enum><text>establish an application process, procedures, and requirements for qualifying tenant organizations to establish and maintain a statement of interest in purchasing a covered rental property; and</text></subparagraph><subparagraph id="HE69F735E8101462C96C18480752D1825"><enum>(C)</enum><text>finance purchases made by eligible entities under this section, consistent with the purposes of section 5.</text></subparagraph></paragraph><paragraph id="H5831D4C287EE46948E9EF0B00CADA83E"><enum>(2)</enum><header>Application for statement of interest in purchasing</header><text>The application for a qualifying tenant organization to establish a statement of interest in purchasing a covered rental property shall include such information as the Authority determines appropriate.</text></paragraph><paragraph id="H83E63F1EB2034811AFF91E3AA097F0B5"><enum>(3)</enum><header>Priorities</header><text>In the funding of purchases made under this section or the approval of a qualifying tenant organization’s statement of interest in purchasing a covered rental property, the Authority may prioritize based on the following factors:</text><subparagraph id="H1C80E75B90B444D88A0CB6C037FD953A"><enum>(A)</enum><text>The affordable housing needs of a region or State.</text></subparagraph><subparagraph id="HC23FCD1C11AF443F8DA4BDDE6E729DA9"><enum>(B)</enum><text>The potential number of permanently affordable housing units.</text></subparagraph><subparagraph id="HE9BAFA9C910F4CD99A7B8638C6E2BF5A"><enum>(C)</enum><text>The feasibility of a project.</text></subparagraph><subparagraph id="H06D9325877B0476387DB2E9F5A822D29"><enum>(D)</enum><text>The opportunity to improve the condition and quality of housing for extremely low-income families or low-income families.</text></subparagraph><subparagraph id="HE070DBA231B94B74BEF5EEC65E75CA08"><enum>(E)</enum><text>The pressures of displacement and the opportunity to preserve naturally occurring affordable housing.</text></subparagraph><subparagraph id="HAC65F036082140759D0347C5C68D1767"><enum>(F)</enum><text>Any factors related to the purposes or powers of the Authority.</text></subparagraph></paragraph><paragraph id="H7E966F0C7A8043BD8D182D0FC022E8BB"><enum>(4)</enum><header>Noncompliance regulations</header><text>The Authority shall promulgate regulations establishing penalties for noncompliance under this section and appropriate financial penalties to enforce this section.</text></paragraph><paragraph id="H3104239DA2384BC690097180C652F864"><enum>(5)</enum><header>General regulations</header><text>The Authority—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5C05C1D570CD48C08C00DC553393E87D"><enum>(A)</enum><text display-inline="yes-display-inline">shall promulgate regulations necessary to carry out this section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC7D25F1D9DF541C0BCEFD52B6D7AA683"><enum>(B)</enum><text display-inline="yes-display-inline">in conjunction with the Secretary and State and local housing agencies, shall promulgate regulations to carry out this section with respect to purchases made by eligible entities.</text></subparagraph></paragraph></subsection></section><section id="HBBCCDF54ACB448CF9142A77702C91260"><enum>11.</enum><header>Maximum contingent liability</header><subsection id="H74F2EF841D6542F4BD56B86EF560A361"><enum>(a)</enum><header>In general</header><text>The maximum contingent liability of the Authority outstanding at any time may not exceed in the aggregate the applicable amount under subsection (b).</text></subsection><subsection id="H8008AB8722D84395B0AC0CC07A99F6FD"><enum>(b)</enum><header>Amount specified</header><paragraph id="H1F70DB7CE8EC40E2ACDA9B25353D2136"><enum>(1)</enum><header>Initial 5-year period</header><text>For purposes of subsection (a), the applicable amount for the 5-year period beginning on the date of the enactment of this Act is $150,000,000,000.</text></paragraph><paragraph id="H05686BD59F1C47C3A6755D59B38223B7"><enum>(2)</enum><header>Subsequent 5-year periods</header><text>Not later than 5 years after the date of enactment of this Act, and not less frequently than once every 5 years thereafter, the Board shall adjust the amount specified in paragraph (1) to reflect the percentage increase (if any) in the Consumer Price Index since the previous adjustment under this paragraph.</text></paragraph></subsection></section><section id="HBABD4811EA854612AB46496D5467172F"><enum>12.</enum><header>Authority funds</header><subsection id="H1704B8D542C542D5B33F5CB3CE0CA9B7"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H424A4BC52633442480CFA44D67A00B96"><enum>(1)</enum><header>Cost</header><text display-inline="yes-display-inline">The term <term>cost</term>, with respect to a direct loan or loan guarantee, has the meaning given the term in section 502 of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H51CCE618EB9149B6AB71CBA25D913BF3"><enum>(2)</enum><header>Direct loan</header><text>The term <term>direct loan</term> has the meaning given the term in section 502 of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC6465897DB514678B63279088E977E34"><enum>(3)</enum><header>Loan guarantee</header><text display-inline="yes-display-inline">The term <term>loan guarantee</term> has the meaning given the term in section 502 of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>).</text></paragraph><paragraph id="H40673DFAD4314E3D85EFDAC308396EC7"><enum>(4)</enum><header>Project-specific transaction costs</header><subparagraph id="H37A4D6F85A7746C8AA5C115A1D5F7894"><enum>(A)</enum><header>In general</header><text>The term <term>project-specific transaction costs</term>—</text><clause id="HF6CBB8600E564A179C92D0C9258614FA"><enum>(i)</enum><text>means the costs incurred by the Authority for travel and legal expenses and direct and indirect costs incurred by the Authority in claims settlements; and </text></clause><clause id="H41E6431AC92849769162E7506BD7C71B"><enum>(ii)</enum><text>does not include the costs of information technology (as that term is defined in section 11101 of title 40, United States Code).</text></clause></subparagraph><subparagraph id="H5C448FAB94B14F71B3D23FD654D5A745" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Treatment</header><text>Project-specific transaction costs shall not be considered administrative expenses for the purposes of this section. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1C1A4FA59D114A87AE91526B886374A0"><enum>(b)</enum><header display-inline="yes-display-inline">Authority capital account</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Authority Capital Account</quote> to carry out the purposes of the Authority.</text></subsection><subsection id="H63E9F108B49D43B7AD1C2B900C64CBE0"><enum>(c)</enum><header>Funding</header><text>The Authority Capital Account shall consist of—</text><paragraph id="H8A79F0B79D6D4BC5BC104631C4A55E6E"><enum>(1)</enum><text>fees charged and collected under subsection (d);</text></paragraph><paragraph id="HCB1B3D8FEE8E404ABC296AEB2785FD14"><enum>(2)</enum><text>any amounts received under subsection (f);</text></paragraph><paragraph id="H8180BBB9EB9F4AF085D42D756B66D036"><enum>(3)</enum><text>investments and returns on investments under subsection (h);</text></paragraph><paragraph id="HCFEB0DE083464F639954CA61CA0116D6"><enum>(4)</enum><text>payments received in connection with sales and other business of the Authority;</text></paragraph><paragraph id="HA2F56122CD7B43F2B1EB5077A0FDC437"><enum>(5)</enum><text>any proceeds from bonds sold under section 4(d);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7D3AB17876A543428447F14B9E22AE92"><enum>(6)</enum><text display-inline="yes-display-inline">any amounts appropriated to the Authority Capital Account; and</text></paragraph><paragraph id="HB17A0FD0763F4E1684B1A5385908645C"><enum>(7)</enum><text>all other collections transferred to or earned by the Authority, excluding the cost of direct loans and loan guarantees.</text></paragraph></subsection><subsection id="H690EDA3954C54940B8B14E15CBD50223"><enum>(d)</enum><header>Fee authority</header><text>The Authority may charge and collect fees for providing services in amounts to be determined by the Board.</text></subsection><subsection id="HAAD58AD3B12D455F9C996B07C21CBC7D"><enum>(e)</enum><header>Use of Authority Capital Account</header><text>The Authority may use amounts in the Authority Capital Account to carry out the purposes described in section 5, including for—</text><paragraph id="H63D8DC0EBEBE4AEB8F1F3E4592817941"><enum>(1)</enum><text>the cost of direct loans and loan guarantees;</text></paragraph><paragraph id="H2BACA4D17FEE4392BC061824993E49CE"><enum>(2)</enum><text>administrative expenses of the Authority;</text></paragraph><paragraph id="H858FC0544B2E41E0827B31927F675724"><enum>(3)</enum><text>for the cost of providing support authorized by section 6;</text></paragraph><paragraph id="HF1C91BB84AFB42C2825671ACE0989B66"><enum>(4)</enum><text>project-specific transaction costs;</text></paragraph><paragraph id="H7DB5FDE1FC55476E8DFEA706B4AA362B"><enum>(5)</enum><text>payment of all insurance and reinsurance claims of the Authority;</text></paragraph><paragraph id="HFAFDA6D2AB61414282A290EB1695BE35"><enum>(6)</enum><text>repayments to the Treasury of the United States of amounts borrowed under subsection (f); and</text></paragraph><paragraph id="H9AF29D3809F346699366C2B1B9B08FC2" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text>dividend payments to the Treasury of the United States under subsection (g).</text></paragraph></subsection><subsection id="HFBE45A1837FF429094EF97310C5D2ED1"><enum>(f)</enum><header>Authority To borrow</header><text>The Authority may borrow from the Treasury of the United States such sums as may be necessary to fulfill obligations of the Authority and any such borrowing shall be at a rate determined by the Secretary of the Treasury, taking into consideration the current average market yields on outstanding marketable obligations of the United States of comparable maturities, for a period jointly determined by the Authority and the Secretary of the Treasury, and subject to such terms and conditions as the Secretary of the Treasury may require.</text></subsection><subsection id="HE155ED31465C46A1A11CEFA88CD1120A"><enum>(g)</enum><header>Dividends</header><text>The Board, in consultation with the Director of the Office of Management and Budget, shall annually assess a dividend payment to the Treasury of the United States if the Authority Capital Account is more than 100 percent reserved.</text></subsection><subsection id="H67977BADE965477798C706537BDE42F4"><enum>(h)</enum><header>Investment authority</header><paragraph id="HE97D1F3270C44392B117576F5CEC36AB"><enum>(1)</enum><header>In general</header><text>The Authority may request the Secretary of the Treasury to invest such portion of the Authority Capital Account as is not, in the Authority’s judgement, required to meet the current needs of the Authority Capital Account.</text></paragraph><paragraph id="H02A064D14D5448C1B2DC97020D6E765E"><enum>(2)</enum><header>Form of investments</header><text>Investments under paragraph (1) shall be made by the Secretary of the Treasury in public debt obligations, with maturities suitable to the needs of the Authority Capital Account, as determined by the Authority, and bearing interest at rates determined by the Secretary of the Treasury, taking into consideration current market yields on outstanding marketable obligations of the United States of comparable maturities.</text></paragraph></subsection><subsection id="HB81743CC66E743978E533912C882E38F"><enum>(i)</enum><header>Collections</header><text>Interest earned under subsection (h) and amounts, excluding fees related to insurance or reinsurance, collected under subsection (d), shall not be collected for any fiscal year except to the extent provided in advance in appropriation Acts.</text></subsection></section><section id="HD19DF77D277A411E977F603DC941D000"><enum>13.</enum><header>Authorization of appropriations for Authority</header><subsection id="H973E4F75EC81470EB1A6D9C168089485"><enum>(a)</enum><header>Authority funds</header><text>There is authorized to be appropriated to the Authority Capital Account established under section 12(b) to carry out this Act $30,000,000,000 for each of fiscal years 2025 through 2035.</text></subsection><subsection id="H8801CA262BEE4CF8997BC62CFF4DA91D"><enum>(b)</enum><header>Allocations to Indian Tribes and tribally designated housing entities</header><paragraph id="HABD6C7F71EFC4F098B7C35324C7BA555"><enum>(1)</enum><header>In general</header><text>The Authority shall allocate not less than 5 percent of amounts appropriated under subsection (a) to provide assistance to Indian Tribes and tribally designated housing entities—</text><subparagraph id="HF92A1B050E374825B539201D8353BA33"><enum>(A)</enum><text>in accordance with notice and comment rulemaking procedures under section 553 of title 5, United States Code; and</text></subparagraph><subparagraph id="H815BA8650D6B4550939B585A724DD924"><enum>(B)</enum><text>in consultation with Indian Tribes, tribally designated housing entities, and the Office of Native American Programs of the Department of Housing and Urban Development.</text></subparagraph></paragraph><paragraph id="H923E696D134246D6B130C16742B346F1"><enum>(2)</enum><header>Supplement not supplant</header><text>To the greatest extent possible, the allocation described in paragraph (1) shall supplement and not supplant any funding that an Indian Tribe or a tribally designated housing entity receives from a governmental source.</text></paragraph></subsection><subsection id="H5F89516CFF934EEE95A739F96B85726F"><enum>(c)</enum><header>Allocations to rural communities</header><paragraph id="HFDD115FCBE494E52AAB15680C0D4CEA2"><enum>(1)</enum><header>In general</header><text>The Authority shall allocate not less than 10 percent of amounts appropriated under subsection (a) to provide assistance to housing entities in rural communities—</text><subparagraph id="HA20A6BA81F5D4AA5B88448689EBC03EF"><enum>(A)</enum><text>in accordance with notice and comment rulemaking procedures under section 553 of title 5, United States Code; and</text></subparagraph><subparagraph id="H8CF57B5300BE4C4F90C07DAA928274E2"><enum>(B)</enum><text>in consultation with the Rural Housing Service of the Department of Agriculture.</text></subparagraph></paragraph><paragraph id="H204F6C5C8AB94F31859BE0BC5353F4E2"><enum>(2)</enum><header>Supplement not supplant</header><text>To the greatest extent possible, the allocation described in paragraph (1) shall supplement and not supplant any funding that a rural housing entity receives from a governmental source.</text></paragraph></subsection></section><section id="H4250A952663F4325B5E1A69F10496037" commented="no"><enum>14.</enum><header>Authorization of appropriations for public housing backlog</header><text display-inline="no-display-inline">There is authorized to be appropriated for assistance from the Public Housing Capital Fund established under section 9(d) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g(d)</external-xref>) such sums as may be necessary to address the public housing capital backlog at the Department, which amount shall remain available until expended and, notwithstanding subsections (c)(1) and (d)(2) of such section 9, shall be allocated to public housing agencies based upon the extent of the capital need of each agency, as determined according to the most recent physical needs assessment of the agencies, with a minimum amount for each agency to be specified by the Authority. </text></section><section id="H498D544C61DD4E69B9E46EADF21AD0A1"><enum>15.</enum><header>Repeal of Faircloth Amendment</header><text display-inline="no-display-inline">Section 9(g) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g(g)</external-xref>) is amended by striking paragraph (3).</text></section><section id="H9918AD238EE3420081671661F357AF3E"><enum>16.</enum><header>Miscellaneous</header><subsection id="H113A2A0BE0954DA8BD457356B4A2A4A9"><enum>(a)</enum><header>Savings clause</header><text>Except as may be otherwise expressly provided in this Act, all powers and authorities conferred by this Act shall be cumulative and additional to and not in derogation of any powers and authorities otherwise existing.</text></subsection><subsection id="HBBDE674E4C56425CA982192981AC89D8" commented="no"><enum>(b)</enum><header>Severability</header><text>If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be invalid, the remainder of this Act and the amendments made by this Act, and the application of the provision or amendment to any other person or circumstance, shall not be affected.</text></subsection><subsection id="H964D4EBDA2034D76AC1EB7CE9D41001C" commented="no"><enum>(c)</enum><header>Effective date; interim appointments</header><text>This Act shall take effect on the date that is 60 days after the date of enactment of this Act, or on such earlier date as the President shall specify by Executive order published in the Federal Register, except that any of the officers provided for in section 4(c) may be nominated and appointed, as provided in that section, at any time after the date of enactment.</text></subsection><subsection id="H1CA7BCAA4AF145BBB666F467F48EF62C" commented="no"><enum>(d)</enum><header>Designation of temporary officers</header><paragraph id="H2B37D11D10F94163AC8A81F822363309" commented="no"><enum>(1)</enum><header>In general</header><text>If 1 or more officers required by this Act to be appointed by the President, by and with the advice and consent of the Senate, have not entered office as of the effective date of this Act under subsection (c), the President may designate any person who was an officer of the Department as of the day before that effective date to serve in that office in an acting capacity until the earlier of—</text><subparagraph id="H2FE3950B2DAB441B93442A35622412DF" commented="no"><enum>(A)</enum><text>the date on which the office is filled as provided in this Act; or</text></subparagraph><subparagraph id="H715789E8E5024C7094B66DEFB654562A" commented="no"><enum>(B)</enum><text>the date that is 60 days after the effective date.</text></subparagraph></paragraph><paragraph id="H6E67B8B6AC4640D88C0310A7A67B6F45"><enum>(2)</enum><header>Compensation</header><text>While serving in an office in an acting capacity as described in paragraph (1), a person shall receive compensation at the rate provided by this Act for that office. </text></paragraph></subsection></section></legis-body></bill>
