which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To restore funding for the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA).</official-title></form><legis-body id="H5357CDE12787446298AE12D546095ED0" style="OLC"><section id="HA06D9E85FD8E4D04918668EBA5A95344" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>UNRWA Funding Emergency Restoration Act of 2024</short-title></quote>.</text></section><section id="H3969105E5C22495B8C309293A502A888"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HC5EAA198655E4BD186527805922CE279"><enum>(1)</enum><text display-inline="yes-display-inline">The humanitarian crisis in Gaza has reached a catastrophic emergency level, with two million Palestinian civilians suffering daily due to escalating conflict and deprivation. </text></paragraph><paragraph id="H0D527FFFA1CA47619B91476840E2DE82"><enum>(2)</enum><text display-inline="yes-display-inline">The Integrated Food Security Phase Classification (IPC) has warned of imminent famine in northern Gaza if humanitarian assistance, including food, water, and medicine, are not immediately provided to Palestinian civilians. Hostilities hindering the delivery of aid in southern Gaza threaten to create a similar situation. United States Agency for International Development Director Samantha Power testified that famine is currently underway in parts of Gaza.</text></paragraph><paragraph id="HEB86C822434043CFAF0101C05550CAC0"><enum>(3)</enum><text>The United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) has since 1949 played a vital and central role in providing shelter, education, healthcare, and financial assistance to millions of Palestinians living in vulnerable refugee communities across Gaza, the West Bank, Syria, Lebanon, and Jordan. </text></paragraph><paragraph id="H73195371BC8B4B059D59C25B273D9B10"><enum>(4)</enum><text display-inline="yes-display-inline">UNRWA’s aid operations are essential to meeting the humanitarian needs of Palestinian civilians in Gaza and beyond. U.S. United Nations Alternative Representative for Special Political Affairs Robert Wood expressed to the United Nations Security Council that UNRWA is critical to averting a famine in Gaza, stating <quote>Other United Nations agencies and humanitarian organizations have reiterated they are not equipped to replace UNRWA, as UNRWA performs essential government-like functions their organizations do not have the capacity or structure to deliver.</quote>.</text></paragraph><paragraph id="HA71695446103440B9DF730F819D1A63D"><enum>(5)</enum><text display-inline="yes-display-inline">UNRWA remains the primary distributor of aid in Gaza and is essential to accommodating any humanitarian aid surge to the besieged population. </text></paragraph><paragraph id="H6D672DDBAD5D435885AEE20F32F3FD13"><enum>(6)</enum><text display-inline="yes-display-inline">Following allegations of direct involvement by individual UNRWA employees in the devastating terrorist attacks of October 7, 2023, UNRWA Commissioner-General Lazzarini acted swiftly and decisively, fully cooperating with Israeli authorities, publicly disclosing the allegations, and immediately terminating all the employees involved.</text></paragraph><paragraph id="HF3064F674ED544F6A5D018CC9356DE3A"><enum>(7)</enum><text display-inline="yes-display-inline">United Nations Secretary-General Guterres has taken additional corrective steps, including by completing an investigation into the allegations by the United Nation’s highest oversight body, the Office of Internal Oversight Services (OIOS). </text></paragraph><paragraph id="HC694E6AA65554AFE91C5A1353C317837"><enum>(8)</enum><text display-inline="yes-display-inline"> In April 2024, an independent, outside review concluded that UNRWA has established a significant number of mechanisms and procedures to ensure compliance with humanitarian principles with an emphasis on the principle of neutrality. This review included recommendations for steps to strengthen neutrality policies, all of which UNRWA immediately agreed to implement.</text></paragraph><paragraph id="HF807AFBB8D5848F6B227D6CC8DE1C3E3"><enum>(9)</enum><text display-inline="yes-display-inline">Almost all parties, including the European Union, United Kingdom, Germany, Sweden, Japan, France, Switzerland, Canada, The Netherlands, Australia, Italy, Austria, Finland, Iceland, Romania, and Estonia have already restored funding to UNRWA following these strong actions taken by the United Nations and the commitments made by UNRWA toward complete accountability and reform.</text></paragraph><paragraph id="H2ACC783637D0413881200630099528D8"><enum>(10)</enum><text>Ireland, Portugal, Spain, Belgium have since provided resources to UNRWA above their original commitments.</text></paragraph><paragraph id="H684AB1DC79B44FB599D5DB6C85B3CCFC"><enum>(11)</enum><text>The United States has historically been the largest funder of UNRWA, and plays a pivotal role in supporting the agency’s critical mission. </text></paragraph><paragraph id="HBA47BAA26606457EBD46E4E62CA6F0E3"><enum>(12)</enum><text>Properly vetted funding for UNRWA remains in the comprehensive strategic interests of the United States, and its allies.</text></paragraph></section><section id="H903C95D0A14F49549F873ACB6D771EB0"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">Congress—</text><paragraph id="HDA1DA5CC0B424E66B0E07235B224A06A"><enum>(1)</enum><text display-inline="yes-display-inline">recognizes that preventing further erosion of civilian conditions in Gaza remains in the strategic and moral interests of the United States;</text></paragraph><paragraph id="H8991665A1C97467194CA44D7AA9262BB"><enum>(2)</enum><text display-inline="yes-display-inline">supports UNRWA’s unique and indispensable contribution to immediately addressing urgent humanitarian needs in Gaza, especially in mitigating and stopping the spread of famine;</text></paragraph><paragraph id="H2E01CFBFC6224ED3AEB083D213E79FD6"><enum>(3)</enum><text display-inline="yes-display-inline">urges the Government of Israel to assist the United Nations Office of Internal Oversight Services (OIOS) investigation team in its critical work;</text></paragraph><paragraph id="H104E5AE924CE49E299DB603A0D245447"><enum>(4)</enum><text display-inline="yes-display-inline">urges the Administration—</text><subparagraph id="HE494410364414AE088E5ECBABF57E20F"><enum>(A)</enum><text display-inline="yes-display-inline">to join United States allies in restoring funding to UNRWA given the responsible actions taken by the United Nations and UNRWA as well as the commitments made by UNRWA toward additional accountability, transparency, and reform; and</text></subparagraph><subparagraph id="H2C8AEA8FF9234046A9A7F7011A9A578D"><enum>(B)</enum><text display-inline="yes-display-inline">to ensure continued funding to UNRWA is assessed based on UNRWA’s ongoing execution of the recommendations of the independent outside review led by former French Foreign Minister Catherine Colonna;</text></subparagraph></paragraph><paragraph id="H18CB7C60C6624DA5991458157A33B751"><enum>(5)</enum><text display-inline="yes-display-inline">recognizes implementation of some of the independent outside review recommendations will require United Nations member state cooperation, including additional funding, and urges the United States and Israel to assist UNRWA in its implementation efforts; and</text></paragraph><paragraph id="HF84952D8B2EF4316AD08035F631B7F8C"><enum>(6)</enum><text display-inline="yes-display-inline">supports appropriating critical funds to UNRWA for fiscal year 2025. </text></paragraph></section><section id="HF0AC024184A24E5E913ECFC93E054334"><enum>4.</enum><header>Restoration of funding for UNRWA</header><subsection id="H31F9FE2D9CEE4A78BC11E65CC7E4834C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Effective on the date of the enactment of this Act—</text><paragraph id="H39228DEEE47142EFAA301D1F95350AD1"><enum>(1)</enum><text>title III of division G of the Further Consolidated Appropriations Act, 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref>) is hereby repealed;</text></paragraph><paragraph id="H5D0CE64B55D14BA89D967C9B72B28869"><enum>(2)</enum><text>section 308 of the Israel Security Supplemental Appropriations Act, 2024 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/50">Public Law 118–50</external-xref>) is hereby repealed; and</text></paragraph><paragraph id="H3125324704064A7BA6BCEFE22B4F088C"><enum>(3)</enum><text>the Secretary of State shall, notwithstanding any other provision of law and as soon as practicable—</text><subparagraph id="H3E577F066E444839A1D5F521F025C94F"><enum>(A)</enum><text>rescind the temporary pause in funding for UNRWA as described in the press statement entitled <quote>Statement on UNRWA Allegations</quote> issued on January 26, 2024; and</text></subparagraph><subparagraph id="H6938E7AA858F4AE6B3EF9A0B602850D3"><enum>(B)</enum><text>resume the provision of funding to UNRWA under current authorities of the Department of State.</text></subparagraph></paragraph></subsection><subsection id="H74853B5D1A6E43ADA8A74772EEE1E994"><enum>(b)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and quarterly thereafter through December 31, 2027, the Secretary of State shall submit to the appropriate congressional committees of jurisdiction a report on the steps UNRWA is taking to implement any recommendations made by the independent outside review led by former French Foreign Minister Catherine Colonna.</text></subsection></section></legis-body></bill>
