which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Homeland Security to notify the Commissioner of Social Security when there is a change to the citizenship status, status under the immigration laws, or work authorization status of an individual to whom a social security account number has been issued, and to require that an individual be a citizen or national of the United States to receive benefits under the Social Security Act.</official-title></form><legis-body id="H97C3D720605C426B89ACF053C9AD5032" style="OLC"><section id="HAE38E5DC024C47D18BA23F285DA664C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Security for Americans Reform Act of 2024</short-title></quote> or the <quote><short-title>SSA Reform Act of 2024</short-title></quote>.</text></section><section id="HBE6767A9A9CB4372B9F06EFEC0FD0D87"><enum>2.</enum><header>Notification to Social Security Administration regarding changes in status under the immigration laws</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall notify the Commissioner of Social Security not later than 180 days after there is a change to the citizenship status, status under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)), or work authorization status of an individual to whom a social security account number has been issued.</text></section><section id="HF1CAAAAE6BE34E8196C281E93C8C3585"><enum>3.</enum><header>Report</header><text display-inline="no-display-inline">Beginning on the date that is one year after the date of enactment of this Act, and on an annual basis thereafter, the Secretary of Homeland Security and the Commissioner of Social Security shall jointly submit to Congress a report that includes, for the previous 1-year period, the following:</text><paragraph id="HE22BD4D0BE6F4B1B8A237A4178F26DDE"><enum>(1)</enum><text>The number of notifications under section 2 related to—</text><subparagraph id="HD8A35983A58D4983B77C88721FF683AC"><enum>(A)</enum><text>changes in citizenship status;</text></subparagraph><subparagraph id="HB58342ACA3DC4F57A34CA27BF29C887C"><enum>(B)</enum><text display-inline="yes-display-inline">changes in status under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)); and</text></subparagraph><subparagraph id="HAD4C9CBF1E254DB7A285C7E2BAC92A11"><enum>(C)</enum><text>changes in work authorization status.</text></subparagraph></paragraph><paragraph id="HA864811901DA4424A1B9AF1484B0A474"><enum>(2)</enum><text>The average amount of time it took the Secretary to notify the Commissioner after a status change.</text></paragraph><paragraph id="H257C5B5BAA784FC29D4F4FB4F59A1A08"><enum>(3)</enum><text>Any challenges or barriers faced during the notification process and recommendations for improving the notification process.</text></paragraph><paragraph id="H0B33AF9A60C24E3FAEAA452246C9D624"><enum>(4)</enum><text>The effectiveness of the notifications in preventing fraud and misuse of social security account numbers, including data on any fraudulent activities detected as a result of, or in part because of, the notifications, and any corrective actions taken.</text></paragraph><paragraph id="H273123F291834CCC8EC569EB439F0506"><enum>(5)</enum><text>The coordination between the Department of Homeland Security and the Social Security Administration, detailing—</text><subparagraph id="H4E99155EFF534AC09E86406B9673763D"><enum>(A)</enum><text>how data is shared, managed, and secured; and</text></subparagraph><subparagraph id="H4569ACE66C554189B407B4BA0D071A39"><enum>(B)</enum><text>best practices, areas for improvement, and the impact of data sharing on service efficiency.</text></subparagraph></paragraph></section><section id="HEB984B856F6C458AAFC93C4B1076647F" section-type="subsequent-section"><enum>4.</enum><header>Limitation of benefits under the Social Security Act</header><subsection id="H28D45F40CADD483893EB1EAC4527EB6D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Social Security Act or title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1601">8 U.S.C. 1601 et seq.</external-xref>), for any month in which an individual is not a citizen or national of the United States, such individual shall not be entitled to any benefit described in subsection (b).</text></subsection><subsection id="HDCD7D4E7BAF04448B59F56577FE890DB"><enum>(b)</enum><header>Benefits</header><text display-inline="yes-display-inline">A benefit described in this subsection is—</text><paragraph id="H8BAF4DF716484F039487AECB0658F96E"><enum>(1)</enum><text>an old-age, survivors, or disability insurance benefit under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>);</text></paragraph><paragraph id="HF44A1174B9B6497C897EC6B19E33E964"><enum>(2)</enum><text display-inline="yes-display-inline">benefits under the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>);</text></paragraph><paragraph id="H211629A21A164DE3BCC8D6305EA86FFA"><enum>(3)</enum><text display-inline="yes-display-inline">benefits under a State plan (or waiver of such plan) approved under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>);</text></paragraph><paragraph id="HFAB5C3C5C6B34DF8AE6914D93CF6F9A2"><enum>(4)</enum><text display-inline="yes-display-inline">benefits under a State child health plan (or waiver of such plan) under title XXI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>);</text></paragraph><paragraph id="H19FD3D33A911404C8FFB7CE00F457C38"><enum>(5)</enum><text display-inline="yes-display-inline">supplemental security income benefits under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>), including supplementary payments of the type described in section 1616(a) of such Act and payments pursuant to an agreement entered into under section 212(a) of <external-xref legal-doc="public-law" parsable-cite="pl/93/66">Public Law 93–66</external-xref>);</text></paragraph><paragraph id="H41FC9D1F82794B858A9D8239E84C4CE4"><enum>(6)</enum><text>assistance under a State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>); or</text></paragraph><paragraph id="HCB1C7858F1DE4DBAB91E79EC9BD5A2E9"><enum>(7)</enum><text>any other benefit administered by the Social Security Administration.</text></paragraph></subsection></section></legis-body></bill>
