which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require annual surveys of Federal employee managers, and for other purposes.</official-title></form><legis-body id="HCBD710C713AC45D59BDE58E4801331C9" style="OLC"><section id="H89DDDA89836D4A59A86B8D983F3FA636" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Manager Attitudes and Notions According to Government Employee Responses Act</short-title></quote> or the <quote><short-title>MANAGER Act</short-title></quote>.</text></section><section id="H1F79F91A8F244CE886025EC1D0D9A19F"><enum>2.</enum><header>Federal employee manager surveys</header><subsection id="H664DF60375A342C2AC143C6897EA0AAB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1128 of the National Defense Authorization Act for Fiscal Year 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/136">Public Law 108–136</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/5/7101">5 U.S.C. 7101</external-xref> note) is amended—</text><paragraph id="H7711FEC358CA46338E0E40267D64B636"><enum>(1)</enum><text>by redesignating subsections (b), (c), and (d) as subsections (c), (d), and (e), respectively; </text></paragraph><paragraph id="HCBCC3075DDDC4048A10D79C99059BB3E"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block id="HBA30B189B47B4988B92B638B3C814D25" style="OLC"><subsection id="HAB2D61BB1D6B450A87FD2AB252D73158"><enum>(b)</enum><header>Managers</header><paragraph id="H93DB4B25DFD04879AFFC6C9B2A4B32B6"><enum>(1)</enum><header>In general</header><text>Each agency shall conduct an annual survey of its managers that shall, in addition to the topics covered by the survey under subsection (a), include the following questions:</text><subparagraph id="H34F6F4163C6447B7A528740BBE6551FA"><enum>(A)</enum><text>I have confidence my agency leadership will support me if I try to discipline an employee.</text></subparagraph><subparagraph id="H435B344DB8124027880345CD765DD277"><enum>(B)</enum><text>I have confidence in the current system to discipline employees.</text></subparagraph><subparagraph id="HA0DFB20EDAB64944939C4B3FD9B97FBF"><enum>(C)</enum><text>I feel supported as a manager.</text></subparagraph><subparagraph id="HAEC436051CB94658BDA386B46C311CAD"><enum>(D)</enum><text>I have adequate training regarding how to discipline employees.</text></subparagraph><subparagraph id="H2D070ABC2407460D8ABB238393DA8543"><enum>(E)</enum><text>I have adequate time to observe new employees and attempt to correct deficiencies before their probationary period expires.</text></subparagraph><subparagraph id="H6CA4971E527D4D48A29215CC506B0CB6"><enum>(F)</enum><text>I have opted not to attempt to discipline an employee over the past year because I have no confidence in the system.</text></subparagraph><subparagraph id="H9B4C91F0A340495F9B0CAD105CA1B895"><enum>(G)</enum><text>My input is sought regarding labor negotiations that will impact my work unit.</text></subparagraph><subparagraph id="H3ABE0B1528EC4D5DA88F4C9994B8C8E0"><enum>(H)</enum><text>I would recommend that a colleague in my agency become a manager if given the option to do so.</text></subparagraph><subparagraph id="H39EA5D2A8DC34A4CA7EE399F7D9EFC87"><enum>(I)</enum><text>The inability to discipline poor performers or otherwise bad employees hurts the morale of my work unit.</text></subparagraph><subparagraph id="HA0AD2901296C4AE39E857FA7C8BF4CBC"><enum>(J)</enum><text>Good employees in my work unit have left because of the inability to discipline problematic employees.</text></subparagraph></paragraph><paragraph id="HF712A5D0016F4AA8A1A51B5A2BC2CD9B"><enum>(2)</enum><header>Response options</header><text display-inline="yes-display-inline">Each survey under paragraph (1) shall include an option to provide narrative responses to each question required under such paragraph, in addition to any other quantitative or qualitative response options.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H66F6D1028DD746998BAA5601E0EDDECC"><enum>(3)</enum><text display-inline="yes-display-inline">in subsections (c) and (d), as redesignated by paragraph (1) of this subsection, by striking <quote>subsection (a)</quote> each place it appears and inserting <quote>subsection (a) or (b)</quote>; and</text></paragraph><paragraph id="H7AD51F233D45478B81C8AD998AC48920"><enum>(4)</enum><text>by amending subsection (e), as so redesignated, to read as follows:</text><quoted-block style="OLC" id="H3E3A0906422A411EA3551DC8C6B6F62C" display-inline="no-display-inline"><subsection id="H33D5B8250C4D4E6C9AA3F4F57BC53C3C"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="H6CD69651BB8244E3A902EBD45D0C5338"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>agency</quote> means an Executive agency (as that term is defined in section 105 of title 5, United States Code); and</text></paragraph><paragraph id="H02C6AEF98C6644E4ACA8F6905EF38237"><enum>(2)</enum><text>the term <term>Federal manager</term> means a Federal employee who—</text><subparagraph id="H9D08A3B2EC9F45A0AA5E3A165B3FDEB7"><enum>(A)</enum><text>has obtained the grade of GS–13 of the General Schedule or higher; and</text></subparagraph><subparagraph id="HD886A0FF20D64CEABFBF3E26C2CA46CA"><enum>(B)</enum><text>is a supervisor or management official (as those terms are defined in section 7103 of such title 5).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5B1B4015EC754E2FBFF43035C1E25606"><enum>(b)</enum><header>Requirement To update surveys</header><text>Not later than 180 days after the date of the enactment of this Act, the Office of Personnel Management shall update the regulations required under subsection (c) of such section 1128, as so redesignated, in order to implement the amendments made by this Act.</text></subsection></section></legis-body></bill>
