Act:</text><paragraph id="HD9DA68D28A8748588CD65A47F0B6E114"><enum>(1)</enum><header>Amateur athletic competition</header><text>The term <term>amateur athletic competition</term> has the meaning given the term in section 220501 of title 36, United States Code.</text></paragraph><paragraph id="HC60945A656234C8996516A10EA373B40"><enum>(2)</enum><header>Anonymized sports wagering data</header><text>With respect to a sports wager accepted by a sports wagering operator, the term <term>anonymized sports wagering data</term> means—</text><subparagraph id="HE92943F6005C4A0BB96D52918D5EAB5E"><enum>(A)</enum><text>a unique identifier for the transaction and, if available, the individual who placed the sports wager, except that such identifier shall not include any personally identifiable information of such individual;</text></subparagraph><subparagraph id="H9EFFF21C697844B081F1CAF310E47792"><enum>(B)</enum><text>the amount and type of sports wager;</text></subparagraph><subparagraph id="HDD8FDB3775834CEFB4132253D25F083B"><enum>(C)</enum><text>the date and time at which the sports wager was accepted;</text></subparagraph><subparagraph id="H396E406C27424E2493BA9EEFA5307A39"><enum>(D)</enum><text>the location at which the sports wager was placed, including the internet protocol address, if applicable; and</text></subparagraph><subparagraph id="H9614E8EA1584498E86ACA1A695B7A361"><enum>(E)</enum><text>the outcome of the sports wager.</text></subparagraph></paragraph><paragraph id="H3B6D32C852BD4807B7BB185ADD91947A"><enum>(3)</enum><header>Gambling disorder</header><text>The term <term>gambling disorder</term> means—</text><subparagraph id="H8A0A54C90DE84C73B0AECE6A20423DAE"><enum>(A)</enum><text>gambling disorder, as the term is used by the American Psychiatric Association in the publication entitled <quote>Diagnostic and Statistical Manual of Mental Disorders, 5th Edition</quote> (or a successor edition);</text></subparagraph><subparagraph id="H4FD2075C31C640F4B9146BA079FF51C8"><enum>(B)</enum><text>pathological gambling;</text></subparagraph><subparagraph id="H68FDE02C92DC439399C7510FB677A912"><enum>(C)</enum><text>gambling addiction; and</text></subparagraph><subparagraph id="H2FB15B39F73F4FA99496C19CD1F15CC4"><enum>(D)</enum><text>compulsive gambling.</text></subparagraph></paragraph><paragraph id="HCA26CC9DEE5C4D41AF684313F73BB9AD"><enum>(4)</enum><header>Governmental entity</header><text>The term <term>governmental entity</term> means—</text><subparagraph id="HCC1DAC3968C843ECAC989B6E653D435C"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="H99048760255340D39E9347BC86339B1F"><enum>(B)</enum><text>a political subdivision of a State; and</text></subparagraph><subparagraph id="HBCC72F645BB24EF0B66314AD3D37DEC5"><enum>(C)</enum><text>an entity or organization, including an Indian Tribe, that has governmental authority within the territorial boundaries of the United States, including Indian lands.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1AD57D77CF4746639CBFB7EF22848B25"><enum>(5)</enum><header>Indian lands</header><text display-inline="yes-display-inline">The term <quote>Indian lands</quote> has the meaning given the term in section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>)).</text></paragraph><paragraph id="H91243D67268849B2B1B0B7B4BC6DFB1B"><enum>(5)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <quote>Indian tribe</quote> in section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>).</text></paragraph><paragraph id="H8E9C04779CC847E0B6B44D5DEBE90F42"><enum>(6)</enum><header>Interactive sports wagering platform</header><text>The term <term>interactive sports wagering platform</term> means a person or entity that offers licensed sports wagering over the internet, including through an internet website and mobile devices, on behalf of a licensed gaming facility.</text></paragraph><paragraph commented="no" id="HBE43E123940E4569A94BFEEB499634B4"><enum>(7)</enum><header>Interstate sports wagering compact</header><text>The term <term>interstate sports wagering compact</term> means a compact to offer sports wagering in accordance with this Act between—</text><subparagraph commented="no" id="H3C559BC4BB6D42BE9C100179B1EEDF52"><enum>(A)</enum><text>2 or more States with a State sports wagering program;</text></subparagraph><subparagraph commented="no" id="H164063DBE4F040B4AEA9A2828FA38BA4"><enum>(B)</enum><text>1 or more States with a State sports wagering program and 1 or more Indian Tribes; or</text></subparagraph><subparagraph commented="no" id="H53FD739AA0AB4F9A8C25898D74DC00B2"><enum>(C)</enum><text>2 or more Indian Tribes.</text></subparagraph></paragraph><paragraph id="H5B1B1FA26BA84EEBBE2F454285D2F842"><enum>(8)</enum><header>Licensed gaming facility</header><text display-inline="yes-display-inline">The term <term>licensed gaming facility</term> means a person licensed by a State regulatory entity or an Indian Tribe licensed by a State regulatory agency for the conduct of gaming.</text></paragraph><paragraph id="H72862B7166F54C4094A1F3301276F2EF"><enum>(9)</enum><header>Microbet</header><text display-inline="yes-display-inline">The term <quote>microbet</quote> means a wager placed on an outcome or occurrence within a sporting event which may or may not be related to the ultimate result of the sporting event.</text></paragraph><paragraph id="HA7A000E23FFD4DE3BD79C56E1AAE34D8"><enum>(10)</enum><header>National self-exclusion list</header><text>The term <term>national self-exclusion list</term> means the list maintained under section 553A of the Public Health Service Act, as added by section 202 of this Act, in cooperation with State regulatory entities, under sections 103(b)(6)(A)(ii) of this Act.</text></paragraph><paragraph id="H0327CEA1E7874C1084AE1B0EAABA3BFD"><enum>(11)</enum><header>Official</header><text>The term <term>official</term> means a referee, umpire, judge, reviewer, or any other individual authorized to administer the rules of a sporting event.</text></paragraph><paragraph id="HAA8BA9F1A9094FC6BA8967144C73F03E"><enum>(12)</enum><header>Proposition bet</header><text display-inline="yes-display-inline">The term <quote>proposition bet</quote> means a side wager on a part of a sporting event that does not concern the final outcome of the sporting event.</text></paragraph><paragraph id="H45F6A714CC114BECA2AEC8EEC6E97BFF"><enum>(13)</enum><header>Reasonable lender standard</header><text display-inline="yes-display-inline">The term <quote>reasonable lender standard</quote> means application of underwriting criteria that would be applied by a lender that is an insured depository institution (as defined under section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>)) for an unsecured loan extended to a consumer.</text></paragraph><paragraph id="HD81AAAB4D0474AA49BEC3823FC363A47"><enum>(14)</enum><header>Sporting event</header><text>The term <term>sporting event</term> means any athletic competition.</text></paragraph><paragraph id="HCE6CC66A8A7F40F8ADBE870E82F6B6BE"><enum>(15)</enum><header>Sports organization</header><text>The term <term>sports organization</term> means—</text><subparagraph id="H0F34F84CDD5648B69D8BEE47D7A12E03"><enum>(A)</enum><text>a person or governmental entity that—</text><clause id="H18AC714F961A4837878A86622FC6F1D4"><enum>(i)</enum><text>sponsors, organizes, schedules, or conducts a sporting event; and</text></clause><clause id="HA26F7370FFAC4AC6971BC594DD31ADF3"><enum>(ii)</enum><text>with respect to the sporting event and the participants in the sporting event—</text><subclause id="H9F31DBE0B02A4E0AA9A1841FA733C855"><enum>(I)</enum><text>prescribes final rules; and</text></subclause><subclause id="H941150D55515444D8D1550C8B9B7E4A2"><enum>(II)</enum><text>enforces a code of conduct; and</text></subclause></clause></subparagraph><subparagraph id="H2D75E5C789E84ECEA8BCF3CDC016E8A2"><enum>(B)</enum><text>a league or association of 1 or more persons or governmental entities described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HC3DE39C724B84759BDCBA62AD87DDF2A"><enum>(16)</enum><header>Sports wager</header><subparagraph commented="no" display-inline="no-display-inline" id="HB4DED305FE644478B539948BF7F05770"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (C), the term <term>sports wager</term> means the staking or risking by any person of something of value upon the outcome of a sporting event, including the outcome of any portion or aspect thereof, upon an agreement or understanding that the person or another person will receive something of value in the event of a certain outcome.</text></subparagraph><subparagraph id="H7694E2E765FA462AAE1837F367B83DD6"><enum>(B)</enum><header>Inclusion</header><text>With respect to an amateur or professional sporting event, the term <term>sports wager</term> includes—</text><clause id="HF0A661848D734790AD02FC9E6693AECD"><enum>(i)</enum><text>a straight bet;</text></clause><clause id="H9FB9D1C7BCFD42F0AC4538CA95C6B070"><enum>(ii)</enum><text>a teaser;</text></clause><clause id="HFD0E1E2585464C5E88FF98D05CC16CFE"><enum>(iii)</enum><text>a variation of a teaser;</text></clause><clause id="H9D62DABA931B4DAF8A2A644D4BB7D7FB"><enum>(iv)</enum><text>a parlay;</text></clause><clause id="H18BA87BCF5E34EA09E42FC56651EE78D"><enum>(v)</enum><text>a total or over-under;</text></clause><clause id="HDB20B094B8D8410FB6B7BD72511C2BB9"><enum>(vi)</enum><text>a moneyline;</text></clause><clause id="H180E823B83EA4366A1E9030409621B31"><enum>(vii)</enum><text>a betting pool;</text></clause><clause id="HAFC3DD45E03149799AC76DED9CDEB89C"><enum>(viii)</enum><text>exchange wagering;</text></clause><clause id="H7CD4AF51996E411E8C40C041F9D9F4FE"><enum>(ix)</enum><text>in-game wagering, including in-game wagering on—</text><subclause id="H2D1A37C2C6F44FD0A01455CF61493EFE"><enum>(I)</enum><text>a final or interim game score;</text></subclause><subclause id="H2451915DD019416294A367D39C985FFC"><enum>(II)</enum><text>statistics; or</text></subclause><subclause id="H28BE0AA5E298462A855135CDC97F0A4A"><enum>(III)</enum><text>a discrete in-game event;</text></subclause></clause><clause id="HC2188191264146A08731627AF7088F12"><enum>(x)</enum><text>a sports lottery; and</text></clause><clause id="HBBC20FB83E984B0BBD2FD9F6C84DCDDB"><enum>(xi)</enum><text>a proposition bet.</text></clause></subparagraph><subparagraph id="HED564EA377F54FD3B1A3F06DBB23D280"><enum>(C)</enum><header>Exceptions</header><text>The term <term>sports wager</term> does not include—</text><clause id="H3DD281FB8A3B4116A4A95F307A49F536"><enum>(i)</enum><text>any activity excluded from the definition of the term <quote>bet or wager</quote> under section 5362 of title 31, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H4ED0375783564D27A8D2A6DE68BA47AC"><enum>(ii)</enum><text>any activity that does not violate a provision of the Interstate Horseracing Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/15/3001">15 U.S.C. 3001 et seq.</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="H1A7B025696284B28AE9183188A5B6684"><enum>(17)</enum><header>Sports wagering</header><text>The term <term>sports wagering</term> means the acceptance of a sports wager by a sports wagering operator.</text></paragraph><paragraph id="HFD4E22F969394690AB877BE207CE4F69"><enum>(18)</enum><header>Sports wagering operator</header><text>The term <term>sports wagering operator</term> means—</text><subparagraph id="HA37732F58A9C4D08B29280DCF3002092"><enum>(A)</enum><text>a licensed gaming facility that offers sports wagering; and</text></subparagraph><subparagraph id="H0D62A102B3394D87B388C2896F7AF6F7"><enum>(B)</enum><text>an interactive sports wagering platform.</text></subparagraph></paragraph><paragraph id="H9FF1FC2C6A584897B5379C2D1E6D7762"><enum>(19)</enum><header>Sports wagering opt-in State</header><text>The term <term>sports wagering opt-in State</term> means a State that administers a State sports wagering program.</text></paragraph><paragraph id="H48C3DAED6E4646C29A7A197BFE948810"><enum>(20)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="HCD38559B0E9D445D8CB54717E59F9253"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="H77828FB9E67B465DB053C4DB619F1574"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph id="HA6BA5E4DCB294388A98D135063848A2C"><enum>(C)</enum><text>any commonwealth, territory, or possession of the United States.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H81E0A53B11A2408CB3769CFD8F4A16BC"><enum>(21)</enum><header>State regulatory entity</header><text display-inline="yes-display-inline">The term <term>State regulatory entity</term> means the governmental entity—</text><subparagraph commented="no" display-inline="no-display-inline" id="HAA297BE228D449EA99B9150F65556BBE"><enum>(A)</enum><text display-inline="yes-display-inline">established or designated by a sports wagering opt-in State under section 102(a)(2)(A)(ii); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC5635C476E404A16B2822B9C76ACE901"><enum>(B)</enum><text>responsible, solely or in coordination with 1 or more other governmental entities, for the regulation of sports wagering in the applicable sports wagering opt-in State.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC53E8096E54644B7928FEE36D6F84896"><enum>(22)</enum><header>State social gambling law</header><text>The term <term>State social gambling law</term> means a State law that allows sports wagering that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H181542A45C7D40398C918C6EAC2E03C2"><enum>(A)</enum><text>is not conducted as a business;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEB7566064B77435A88838B986BD2E23B"><enum>(B)</enum><text>involves 2 or more players who compete on equal terms; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFA478C8CD1D0467F8BA64B5792B183F8"><enum>(C)</enum><text>does not provide a benefit to—</text><clause commented="no" display-inline="no-display-inline" id="HDAB721799D5D458C8996FE5D60CCDF1F"><enum>(i)</enum><text>a player, other than the winnings of the player; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H6CE472066D2C4F81BE9C41BE801CF008"><enum>(ii)</enum><text>a person who is not involved in a sports wager.</text></clause></subparagraph></paragraph><paragraph id="H4651A473A60A4F2AAF70777DFC36835B"><enum>(23)</enum><header>State sports wagering program</header><text>The term <term>State sports wagering program</term> means a program administered and overseen by a State pursuant to an application approved by the Attorney General under subsection (b) or (e) of section 102.</text></paragraph><paragraph commented="no" id="H1EFAF0DA6E844F79A625CB7346E02A6B"><enum>(24)</enum><header>Suspicious transaction</header><text>The term <term>suspicious transaction</term> means a transaction or an arrangement that a sports wagering operator knows or has reason to know, as determined by a director, officer, employee, or agent of the sports wagering operator is or would be if completed—</text><subparagraph commented="no" id="HF188F31B20504710842B40E4A25B8F66"><enum>(A)</enum><text>a violation of, or part of a plan to violate or evade, any Federal, State, or local law (including regulations); or</text></subparagraph><subparagraph commented="no" id="H0FF5798C5AB4453EAA6DF358CB01E82F"><enum>(B)</enum><text>sports wagering by or on behalf of an individual described in subparagraph (C), (D), or (E) of section 103(b)(4). </text></subparagraph></paragraph><paragraph commented="no" id="H9321297211644FE0A63D87FF459ADABE"><enum>(25)</enum><header>Suspicious transaction report</header><text>The term <term>suspicious transaction report</term> means a report submitted to a State regulatory entity or a sports organization under section 103(b)(13).</text></paragraph><paragraph id="H20C465F525264DA59AC7C8CAF5171AF5" commented="no"><enum>(26)</enum><header>Tribal-State compact</header><text>The term <term>Tribal-State compact</term> means a compact entered into between a State and an Indian Tribe pursuant to section 11(d)(3) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2710">25 U.S.C. 2710(d)(3)</external-xref>).</text></paragraph></section><title id="HD3F415469A254AE59B0B65F59D1FA907"><enum>I</enum><header>Minimum Federal Standards for Sports Betting</header><section id="H19F005427C0340608EB0D36C4118DA63"><enum>101.</enum><header>General prohibition on sports wagering</header><subsection id="H6E5C3DFA40CC497F99BEB72334795F7A"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), it shall be unlawful for any person to knowingly accept a sports wager.</text></subsection><subsection id="H7063BD2BE73348C38D100E4FBC9489E8"><enum>(b)</enum><header>Exceptions</header><text>It shall not be a violation of subsection (a) for—</text><paragraph id="HED2A6AFEFE5F438DBAA7475D2D1FAEAB"><enum>(1)</enum><text>a sports wagering operator located in a sports wagering opt-in State to accept a sports wager in accordance with State law; or</text></paragraph><paragraph id="HCE00CDA7D2244085AE69B9E559B7067F"><enum>(2)</enum><text>a person to accept a sports wager in accordance with an applicable State social gambling law.</text></paragraph></subsection><subsection id="H605327E06E324731BDDAACA8C6E5B616"><enum>(c)</enum><header>Injunctions</header><paragraph id="HA05D1C4372AB4BCBB0E4D15DEDA10496"><enum>(1)</enum><header>In general</header><text>If the Attorney General believes a person has violated, is violating, or will violate subsection (a), the Attorney General may bring a civil action in the appropriate district court of the United States or the appropriate United States court of a territory or possession of the United States, which shall have jurisdiction in proceedings in accordance with the Federal Rules of Civil Procedure to enjoin a violation of subsection (a).</text></paragraph><paragraph id="HB09ABDA24EFC4CCA9E5BDE955481972E"><enum>(2)</enum><header>Jury trial</header><text>In the case of an alleged violation of an injunction or restraining order issued under paragraph (1), trial shall be, on demand of the accused, by a jury in accordance with the Federal Rules of Civil Procedure.</text></paragraph></subsection><subsection id="H668EB7507A924772BF206F07EC2B1F86"><enum>(d)</enum><header>Civil penalties</header><paragraph id="H25A51CD10E2842399BE53392B5F829C9"><enum>(1)</enum><header>In general</header><text>Any person who violates subsection (a) shall be, with respect to any such violation, subject to a civil penalty of not more than the greater of $10,000 or 3 times the amount of the applicable sports wager.</text></paragraph><paragraph id="H3018C8CBE67D4414BA981E39BC194FFB"><enum>(2)</enum><header>Separate violations</header><text>A separate violation occurs for each sports wager accepted in violation of subsection (a).</text></paragraph><paragraph id="H1A210A08DB5B4FF5ADE4A69A27E9E4B8"><enum>(3)</enum><header>Jurisdiction</header><text>The district courts of the United States and appropriate United States courts of the territories and possessions of the United States shall have jurisdiction to enforce this subsection in accordance with section 1355 of title 28, United States Code.</text></paragraph><paragraph id="HA5A98358432243B4AC5B1D74FEA61ABE"><enum>(4)</enum><header>Effect of law</header><text>A violation of subsection (a) shall not constitute a crime, and a judgment for the United States and imposition of a civil penalty pursuant to paragraph (1) shall not give rise to any disability or legal disadvantage based on conviction for a criminal offense.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H357622D2AC4F4DC5AE82F3DA2F15D8D1"><enum>(e)</enum><header display-inline="yes-display-inline">Civil penalty not exclusive of criminal penalty</header><text display-inline="yes-display-inline">A civil penalty, injunction, or temporary restraining order imposed under this section shall be independent of, and not in lieu of, criminal prosecutions or any other proceedings under any other law of the United States, including sections 1084 and 1955 of title 18, United States Code.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HBB045D69182C459692A5937F27BA8C0E"><enum>(f)</enum><header>Effective date</header><text>Subsection (a) shall take effect on the date that is 18 months after the date of enactment of this Act.</text></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="H16F932BF4753478FAC91C451DEA08F74"><enum>102.</enum><header>State sports wagering program</header><subsection id="H28A0735F101B4FA3A581CA6784E13B9F"><enum>(a)</enum><header>Initial Application</header><paragraph id="H97E0CBC8137A48FD8928A3526316A50B"><enum>(1)</enum><header>In general</header><text>To request approval to administer a State sports wagering program, a State shall submit an application to the Attorney General at such time, in such manner, and accompanied by such information as the Attorney General may require.</text></paragraph><paragraph id="HE3D0F425C9DD4084BACD6F1AE50C2231"><enum>(2)</enum><header>Contents</header><text>An application under paragraph (1) shall include—</text><subparagraph id="H4FA70DF557EE49BD91A189E0BDA7319E"><enum>(A)</enum><text>a full and complete description of the State sports wagering program the State proposes to administer under State law, including—</text><clause id="H2FE2F8CDB78C488B86AB1CB851BBCC40"><enum>(i)</enum><text>each applicable State law relating to sports wagering; and</text></clause><clause id="H92C47C06F5F04F9D943853261E2CB7E9"><enum>(ii)</enum><text>an identification of the State regulatory entity; and</text></clause></subparagraph><subparagraph id="H7ED9167794F34D448115A85AE513D53D"><enum>(B)</enum><text>an assurance from the attorney general or chief legal officer of the State that the laws of the State provide adequate authority to carry out the proposed State sports wagering program.</text></subparagraph></paragraph></subsection><subsection id="H061B37E37E1848A08F388E034E439C8D"><enum>(b)</enum><header>Approval by Attorney General</header><paragraph id="H5891E7B49BCB40B1BA51673AC79DD83F"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date on which the Attorney General receives a complete application under this section, the Attorney General shall approve the application unless the Attorney General determines that the proposed State sports wagering program does not meet the standards set forth in section 103.</text></paragraph><paragraph id="H26B0F4DE8D3B41C4827EDB76D3BFE298"><enum>(2)</enum><header>Denial of application</header><text>A decision of the Attorney General to deny an application submitted under this section shall—</text><subparagraph id="HE447123AA8D14D8AA916BA67D722D673"><enum>(A)</enum><text>be made in writing; and</text></subparagraph><subparagraph id="H985F5562B5264585AAE54460087BDB15"><enum>(B)</enum><text>specify the 1 or more standards under section 103 that are not satisfied by the proposed State sports wagering program.</text></subparagraph></paragraph></subsection><subsection id="H6DD678041078492888FCC3FAE3D80214"><enum>(c)</enum><header>Notice of material changes</header><text>In the case of a material change to a State law relating to sports wagering, the State regulatory entity, or other information included in an application submitted pursuant to subsection (a) or (e), not later than 30 days after the date on which the change is made, the State shall submit to the Attorney General a notice of such change.</text></subsection><subsection id="H93587A038AEA4F638D735C938ABD2E53"><enum>(d)</enum><header>Duration</header><text>A State sports wagering program shall be valid for a fixed 3-year period beginning on the date on which the Attorney General approves the application of the applicable State under subsection (a) or (e).</text></subsection><subsection id="H621ECE6DAC1647A2AACEAD649B2580B3"><enum>(e)</enum><header>Renewal application and approval</header><text>Not later than the date on which the 3-year period referred to in subsection (d) ends, a State seeking to renew the approval of the State sports wagering program may submit to the Attorney General a renewal application that—</text><paragraph id="H748E2D04DDD741BA8AC77B34D66CE01E"><enum>(1)</enum><text>includes the information described in subsection (a); and</text></paragraph><paragraph id="H261EE327DE984C7085CC21CE847BD5E5"><enum>(2)</enum><text>shall be subject to the approval process under subsection (b).</text></paragraph></subsection><subsection id="HA4CE6D9F5AB54358A5CD8483B7C72D4C"><enum>(f)</enum><header>Revocation and review</header><paragraph id="H25776E9D35EE4358BA3F8DD37E83D3CE"><enum>(1)</enum><header>Emergency revocation of approval</header><text>The Attorney General shall promulgate regulations that provide procedures by which the Attorney General may revoke the approval of a State to administer a State sports wagering program before the date on which the 3-year term described in subsection (d) expires if the Attorney General finds that the sports wagering program does not meet 1 or more standards set forth in section 103.</text></paragraph><paragraph id="H9919FBC655FD4B96943D7126D219C1C1"><enum>(2)</enum><header>Administrative review</header><text>The Attorney General shall promulgate regulations that provide procedures by which a State may seek administrative review of any decision by the Attorney General—</text><subparagraph id="H05F6730353354BBEA476C8403D563504"><enum>(A)</enum><text>to deny an application under subsection (b);</text></subparagraph><subparagraph id="HFD43098DE14F4D14AC9C0D32ABAED817"><enum>(B)</enum><text>to deny a renewal application under subsection (e); or</text></subparagraph><subparagraph id="H9AEA7E97267B4424AC1D2C58C4791487"><enum>(C)</enum><text>to revoke an approval under paragraph (1) of this subsection.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HEFC048D300314601AB431EF7699C4753"><enum>103.</enum><header>State sports wagering program standards</header><subsection commented="no" id="HC60B6B470B764AFA95566B9A9CD1D6E0"><enum>(a)</enum><header>In general</header><text>The Attorney General shall approve an application under section 102 unless the Attorney General determines that the proposed State sports wagering program does not meet the standards set forth in subsection (b).</text></subsection><subsection commented="no" id="HABFAB029F4FE47C2BBAC9F5D6773F274"><enum>(b)</enum><header>Standards for State sports wagering programs</header><text>A State sports wagering program shall meet each of the following standards:</text><paragraph commented="no" id="HD0CEB5C2394943F384CD7C99C2C932C0"><enum>(1)</enum><header>State regulatory entity</header><text>Establish or designate a public entity in the applicable State as the State regulatory entity for the purposes of regulating sports wagering operators and enforcing sports wagering laws in the State.</text></paragraph><paragraph commented="no" id="H15534D23DF37464586B3BF05A2442738"><enum>(2)</enum><header>Permissible sports wagering</header><subparagraph commented="no" id="H47F85BE32F3844DC9DD9D0EB090AE61A"><enum>(A)</enum><header>In-person sports wagering</header><text>Provide that in-person sports wagering may be offered only by a sports wagering operator.</text></subparagraph><subparagraph commented="no" id="HAB5771CE25CC4EC9A27C58B1F47A400B"><enum>(B)</enum><header>Internet sports wagering</header><clause commented="no" id="HF263CBD71D46450F9CA7A37DD83564D8"><enum>(i)</enum><header>In general</header><text>With respect to any authorization of sports wagering on an interactive sports wagering platform, provide that such sports wagering, as available, is available only to—</text><subclause commented="no" id="H7A0913BCF5884A9B8A7027C6A915FCE8"><enum>(I)</enum><text>individuals located in the State; or</text></subclause><subclause commented="no" id="H78B45892590A43EF80DAC6C55E0F3BBE"><enum>(II)</enum><text>in the case of an interstate sports wagering compact approved by the Attorney General, individuals located in States and on Indian lands of Indian Tribes that are party to the compact.</text></subclause></clause><clause commented="no" id="HBA2E6FEE073F43DFA2205BC2F6635595"><enum>(ii)</enum><header>Location verification</header><text>Include location verification requirements reasonably designed to prevent an individual from placing a sports wager on an interactive sports wagering platform from a location other than a location described in clause (i).</text></clause></subparagraph><subparagraph commented="no" id="H5524E539B7354A7EB1F98BD51D6AD6AB"><enum>(C)</enum><header>Sports wager approval</header><clause commented="no" id="H89B327BFBB2D46069BAC3C0E7FDC3707"><enum>(i)</enum><header>In general</header><text>Provide that a sports wagering operator shall not accept a sports wager unless such sports wager or class of sports wagers is expressly approved by the State regulatory entity.</text></clause><clause commented="no" id="HC699C64AB2C84F579DA7CDF23CD8F2ED"><enum>(ii)</enum><header>Approval criteria</header><text>Direct the State regulatory entity to establish criteria for decisions with respect to the approval of a sports wager or a class of sports wagers, such as whether the outcome of the event or contingency on which the sports wager is placed is—</text><subclause commented="no" id="H7C619B9EF1904F20A2D5AB72C68D84E3"><enum>(I)</enum><text>verifiable;</text></subclause><subclause commented="no" id="HE6133C25D5AC4262AB7C0A4CBB4DC641"><enum>(II)</enum><text>generated by a reliable and independent process; and</text></subclause><subclause commented="no" id="H977F0DDABF0B4EC5BD82AD867F21D5BB"><enum>(III)</enum><text>unlikely to be affected by any sports wager placed.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H9FACD2AF5A9E4A14A2CC9B22E059B84D"><enum>(D)</enum><header>Prohibition on amateur or intercollegiate proposition bets</header><text display-inline="yes-display-inline">Prohibit the State regulatory entity from approving, or a sports wagering operator from accepting, a proposition bet on—</text><clause commented="no" id="H72C3AC666A674F14A67559861F23374A"><enum>(i)</enum><text>any amateur athletic competition; or</text></clause><clause commented="no" id="H918F68340CA849D08CFD3EA699720326"><enum>(ii)</enum><text>any intercollegiate sport (as defined in the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref>)).</text></clause></subparagraph><subparagraph commented="no" id="HF3C97EB149764432BB6786B1B3B78507"><enum>(E)</enum><header>Prohibition of sports wagering on sporting events that have commenced</header><text display-inline="yes-display-inline">Prohibit the State regulatory entity from approving, or a sports wagering operator from accepting, a sports wager on any sporting event, once such event has commenced.</text></subparagraph></paragraph><paragraph commented="no" id="HD3AE2A04BB6543DA8B70197F718ABD9B"><enum>(3)</enum><header>Restrictions on sports wagering to protect contest integrity</header><subparagraph commented="no" id="HB118CFF2336140938D8A3B9AA7F8120E"><enum>(A)</enum><header>Definition of necessary to maintain contest integrity</header><text>In this paragraph, the term <term>necessary to maintain contest integrity</term> means that, in the absence of a restriction, there is a reasonably foreseeable risk that the outcome of the sporting event or contingency on which the wager is placed would be affected by the wager.</text></subparagraph><subparagraph commented="no" id="H0907B9FD66BD432489FE6BB05FCD7B0F"><enum>(B)</enum><header>Contest integrity</header><text>Prohibit a sports wagering operator from accepting a sports wager in violation of a notice of restriction received by the sports wagering operator under subparagraph (E)(i).</text></subparagraph><subparagraph commented="no" id="HF7FFD8E0F5A64C1DA71688D51C583A89"><enum>(C)</enum><header>Request to restrict sports wagering</header><clause commented="no" id="H7D9D7149D6D74F3AA1A80AA160CB0F80"><enum>(i)</enum><header>In general</header><text>With respect to a sporting events sponsored, organized, or conducted by a sports organization, permit the sports organization to submit to the State regulatory entity a request to restrict, limit, or exclude wagers on 1 or more sporting events, including by restricting, limiting, and excluding sports wagers on 1 or more performances of an athlete in 1 or more sporting events in which such athlete participates, if the applicable sports organization determines that such restriction is necessary to maintain contest integrity.</text></clause><clause commented="no" id="H2631C4D3F56C41748C0D8A7FA0DDD167"><enum>(ii)</enum><header>Deadlines for submission</header><text>Provide that the State regulatory entity shall establish reasonable deadlines for the submission of a request under clause (i) in advance of the applicable sporting event.</text></clause></subparagraph><subparagraph commented="no" id="H12807912B4BB4897A8EF4887458BA63A"><enum>(D)</enum><header>Determination by the State regulatory entity</header><text>Provide that the State regulatory entity shall promptly—</text><clause commented="no" id="H77FE412FE0A24594B42CC317AEEE913F"><enum>(i)</enum><text>approve a request described in subparagraph (C)(i) unless the State regulatory entity determines, considering any information provided by the sports organization and any other relevant information, that a restriction is not necessary to maintain contest integrity;</text></clause><clause commented="no" id="H8FD8387124AC41929C0CCA4D76BCD027"><enum>(ii)</enum><text>provide a written explanation of a determination under clause (i) to approve or deny a request;</text></clause><clause commented="no" id="H80D5877806D0428EA0C17D0558CEB939"><enum>(iii)</enum><text>make such written explanation available to the public; and</text></clause><clause commented="no" id="H30866CD52D8245AFBF3713F4FD7D8EC9"><enum>(iv)</enum><text>provide a process by which the sports organization that submitted the request may seek review of such determination.</text></clause></subparagraph><subparagraph commented="no" id="H9F88E45E540747F79EC8FC166B3FFF81"><enum>(E)</enum><header>Notice of restriction</header><text>Provide that the State regulatory entity shall establish a process—</text><clause commented="no" id="HD66B36D7749A454D810E5E4F76365DDA"><enum>(i)</enum><text>to provide to sports wagering operators prompt notice of any restriction approved by the State regulatory entity; and</text></clause><clause commented="no" id="HA09A7B74F34745C8BD9B9FC7A3642BB2"><enum>(ii)</enum><text>to make such notice publicly available.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HA91C3603F7B3499097561E8AA71F1CAC"><enum>(4)</enum><header>Prevention of sports wagering by prohibited individuals</header><text>Prohibit a sports wagering operator from accepting sports wagers from any—</text><subparagraph commented="no" id="HA923A1D59ECB4BF2B927E18E847E659F"><enum>(A)</enum><text>individual younger than 21 years of age;</text></subparagraph><subparagraph commented="no" id="H17AD0B3D03BC43E1BB32E70EED7C06A7"><enum>(B)</enum><text>individual on the national self-exclusion list;</text></subparagraph><subparagraph commented="no" id="H344339B741944009827B64241100F6F0"><enum>(C)</enum><text>athlete, coach, official, or employee of a sports organization or any club or team of a sports organization, with respect to a sporting event sponsored, organized, or conducted by the sports organization;</text></subparagraph><subparagraph commented="no" id="H7F53A0836FF245218AD701631104A886"><enum>(D)</enum><text>employee of a player or an official union of a sports organization, with respect to a sporting event sponsored, organized, or conducted by the sports organization;</text></subparagraph><subparagraph commented="no" id="HBD5604CBD3664FCBA3295ED18FC27842"><enum>(E)</enum><text>individual who, with respect to a sporting event sponsored, organized, or conducted by a sports organization, is—</text><clause commented="no" id="HC51F9F41FCE44586B8FE5D16FB5F96EF"><enum>(i)</enum><text>credentialed or accredited by the sports organization; and</text></clause><clause commented="no" id="HF77A500175D349458FC30C5DF46959C0"><enum>(ii)</enum><text>prohibited from placing a sports wager by the terms of such credential or accreditation; or</text></clause></subparagraph><subparagraph commented="no" id="H978B5F9B804A4DD294DB8923C401F323"><enum>(F)</enum><text>individual convicted of an offense under subsection (a) or (b) of section 224 of title 18, United States Code.</text></subparagraph></paragraph><paragraph commented="no" id="H4433A731384748AB953BE0F50001E3DB"><enum>(5)</enum><header>Authorized data</header><subparagraph commented="no" id="H760D8AC3CA754BD2B4BC0AA8D5951542"><enum>(A)</enum><header>Result of a sports wager</header><clause commented="no" id="H9E04C71100B94BB489B562083A7DEDF3"><enum>(i)</enum><header>Market transition period</header><text>With respect to any sports wager accepted on or before December 31, 2024, provide that a sports wagering operator shall determine the result of a sports wager only with data that is licensed and provided by—</text><subclause commented="no" id="H8E3B981092884E29ADBA2E7A76DD9943"><enum>(I)</enum><text>the applicable sports organization; or</text></subclause><subclause commented="no" id="HADB81A1E667D4EE2832EAE70526E6684"><enum>(II)</enum><text>an entity expressly authorized by the applicable sports organization to provide such information.</text></subclause></clause><clause commented="no" id="H6A4A09532DD94642956B5446A218D3C0"><enum>(ii)</enum><header>Post-transition period</header><text>With respect to any sports wager accepted after December 31, 2024, provide that a sports wagering operator shall determine the result of a sports wager only with data that is obtained from a source that the State regulatory entity has—</text><subclause commented="no" id="H8C81EEAA107441C2962F8E38E6C4026D"><enum>(I)</enum><text>found to provide—</text><item commented="no" id="H6F4FFD5DBB174C9599B892B0AE218B4D"><enum>(aa)</enum><text>data of substantially similar speed, accuracy, and consistency to the data available under clause (i); and</text></item><item commented="no" id="H1BA0DEDADDAB4664B46E7D9DAD810FF2"><enum>(bb)</enum><text>only data that is—</text><subitem commented="no" id="HE262BE59843745DEAC34429D37E86F56"><enum>(AA)</enum><text>legally obtained; and</text></subitem><subitem commented="no" id="H3EE45F5A8491476F87A766F09FA7E83A"><enum>(BB)</enum><text>in full compliance with the terms of any applicable contract or license;</text></subitem></item></subclause><subclause commented="no" id="H7F114F1537914A6B962CFA4E80E15782"><enum>(II)</enum><text>expressly authorized to provide such data to sports wagering operators; and</text></subclause><subclause commented="no" id="H7A658717D1E345A5AE146CD277B565F4"><enum>(III)</enum><text>identified in the application of the State regulatory entity under section 102.</text></subclause></clause></subparagraph><subparagraph commented="no" id="HCFCA8B1F78D04320868D8535B9597910"><enum>(B)</enum><header>Other purposes</header><text>Provide that the statistics, result, outcome, or other data used by a sports wagering operator for a purpose other than to determine the result of a sports wager shall be in the public domain or otherwise legally obtained.</text></subparagraph></paragraph><paragraph commented="no" id="H1E2D0A14B226415D934843FD1687F3AC"><enum>(6)</enum><header>Consumer protections</header><subparagraph commented="no" id="H11E5C5297F3B4DCEADCE17F82E510DCC"><enum>(A)</enum><header>Self-exclusion</header><clause commented="no" id="H9206AC1E77254BBFAAFB62CEA3C2E9D5"><enum>(i)</enum><header>State self-exclusion list</header><text>Provide a process by which an individual may restrict himself or herself from placing a sports wager with a sports wagering operator located in the State, including by imposing sports wager limits.</text></clause><clause commented="no" id="HFDC038AA30A94B4DBA3F8E64609973AC"><enum>(ii)</enum><header>National self-exclusion list</header><text>Provide, through the State regulatory entity acting in cooperation with the Assistant Secretary for Mental Health and Substance Use, a process by which an individual may restrict himself or herself from placing a sports wager with a sports wagering operator located in any sports wagering opt-in State, including by imposing sports wager limits, and placing himself or herself on the national self-exclusion list.</text></clause><clause commented="no" id="H45820259FA28475FB7C049AF7F40EA27"><enum>(iii)</enum><header>Reasonable steps required</header><text>Provide that a sports wagering operator may not accept a sports wager by an individual who is—</text><subclause commented="no" id="H69F7D3AEEEDA4FEE9F69F0982183DCD6"><enum>(I)</enum><text>described in clause (i); or</text></subclause><subclause commented="no" id="H5AC0BDFA26664D00949D6724C44167FC"><enum>(II)</enum><text>included on the national self-exclusion list.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H7E340952BE774CAC90B5D817088FEB7D"><enum>(B)</enum><header>Withdrawal restrictions</header><text>Prohibit a sports wagering operator from—</text><clause commented="no" id="H96123BBA350544FCAE8AABF9B9466E31"><enum>(i)</enum><text>requiring an individual engaged in sports wagering to participate in a publicity or an advertising activity of the sports wagering operator as a condition of withdrawal of the winnings of the individual; and</text></clause><clause commented="no" id="H760C5DE3317C4033A476ABB5A70E8DF4"><enum>(ii)</enum><text>imposing on any individual engaged in sports wagering—</text><subclause commented="no" id="HB340DA795CCE4EA4A3EED504318168E1"><enum>(I)</enum><text>a minimum or maximum withdrawal limit for the account of the individual;</text></subclause><subclause commented="no" id="HD851DDF4219D4C2D8AAF4757A91B4E6D"><enum>(II)</enum><text>any restriction on the right of the individual to make a withdrawal from the account of the individual based on the extent of the sports wagering by the individual;</text></subclause><subclause commented="no" id="HE7FD772A72D64ECAA244A5F6C04BD6C8"><enum>(III)</enum><text>an unreasonable deadline for the provision of information relating to the identity of the individual as a condition of withdrawal from the account of the individual; or</text></subclause><subclause commented="no" id="HAD1A8DC3492F468392E4B5DF76F7F3EB"><enum>(IV)</enum><text>a dormancy charge for an account of the individual that is not used to place a sports wager.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H62EDA70200BC431DACB6A9637EEC1E02"><enum>(C)</enum><header>Disclosure</header><clause commented="no" id="H7A0EA5ADBDCD4C63A584B3CD9E654B61"><enum>(i)</enum><header>Restrictions or conditions</header><text>Provide that a sports wagering operator shall provide an individual with adequate and clear information relating to any applicable restriction or condition before the individual opens an account with the sports wagering operator.</text></clause><clause commented="no" id="H87810261F321427EBBD9969BE41E1CCC"><enum>(ii)</enum><header>Bonuses offered</header><text>Provide that a sports wagering operator shall provide to an individual engaged in sports wagering clear information relating to any bonus offered, including the terms of withdrawal of the bonus.</text></clause><clause commented="no" id="HF2B4B5F2DED145339D61CD6F8D6C4C32"><enum>(iii)</enum><header>Public availability</header><text>Provide that the information described in clauses (i) and (ii) be available to the public.</text></clause></subparagraph><subparagraph commented="no" id="HB3DA6B5659AA41E3A67E397CCEA866B2"><enum>(D)</enum><header>Treatment and education funding</header><text>Provide that a sports wagering operator shall allocate an appropriate percentage of the revenue from sports wagering to—</text><clause commented="no" id="H86B94804F9F94FEF9F1639D208D5F318"><enum>(i)</enum><text>treatment for gambling disorder; and</text></clause><clause commented="no" id="H81A68EA64FEE48F8BD6BC619F9BDCF13"><enum>(ii)</enum><text>education on responsible gaming.</text></clause></subparagraph><subparagraph commented="no" id="H5670660809E5462C899D3093A32C7734"><enum>(E)</enum><header>Reserve requirement</header><text>Provide that a sports wagering operator shall maintain a reserve in an amount not less than the sum of—</text><clause commented="no" id="H0C6C44F31D6745D9AAC06B9173B6230F"><enum>(i)</enum><text>the amounts held by the sports wagering operator for the account of patrons;</text></clause><clause commented="no" id="HEBA1B64A0F8D4D7CB304AC08957AF8E9"><enum>(ii)</enum><text>the amounts accepted by the sports wagering operator as sports wagers on contingencies the outcomes of which have not been determined; and</text></clause><clause commented="no" id="HC5320D88F3D940E38107F6753C1F8942"><enum>(iii)</enum><text>the amounts owed but unpaid by the sports wagering operator on winning wagers during the period for honoring winning wagers established by State law or the sports wagering operator.</text></clause></subparagraph><subparagraph commented="no" id="H899B5B235F514E0B96367A70476427F0"><enum>(F)</enum><header>Affordability protections</header><text display-inline="yes-display-inline">Provide that a sports wagering operator—</text><clause commented="no" id="H2E22AF52A9C248D4A7FE1C345D553BB2"><enum>(i)</enum><text>may not accept more than 5 deposits from an individual during a 24-hour period;</text></clause><clause commented="no" id="H78B0DB5DCC6148A1B6E87B5B6BC3573B"><enum>(ii)</enum><text>may not accept deposits made using a credit card; and</text></clause><clause commented="no" id="H862CD9051270470F8728881FB83CF9DC"><enum>(iii)</enum><text display-inline="yes-display-inline">shall be required, before accepting sport wagers from an individual in an amount that is more than $1,000 during a 24-hour period or $10,000 during a 30-day period, to conduct an affordability check which shall be satisfied by 1 or both of the following ways:</text><subclause commented="no" id="HBF07FFC146D44C2AA78C48FFBEDED324"><enum>(I)</enum><text display-inline="yes-display-inline">Verification that the proposed deposit is not greater than 30 percent of the monthly income of the individual.</text></subclause><subclause commented="no" id="H6B4D15AFF3904BAB8FE9ACC8323A8CDE"><enum>(II)</enum><text>Verification through a reasonable lender standard based on issuance of an unsecured loan for the proposed deposit through methods normally used by consumer lenders.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H085347C4922540848808CE4B5DE9C47E"><enum>(G)</enum><header>Artificial intelligence restriction</header><text display-inline="yes-display-inline">Provide that a sports wagering operator may not use artificial intelligence to—</text><clause commented="no" id="HC78F2357FA2A4047B965605C50453C42"><enum>(i)</enum><text> track the sports wagers of an individual; </text></clause><clause commented="no" id="H79701C6205944538849760C58F4F007C"><enum>(ii)</enum><text display-inline="yes-display-inline">create an offer or promotion targeting a specific individual; or</text></clause><clause commented="no" id="H13DCC7BBE668489F9474421E203A99B3"><enum>(iii)</enum><text>create a gambling product, such as a microbet. </text></clause></subparagraph></paragraph><paragraph commented="no" id="H7CABAC30AB8F4BAAB4F82E93B138C8B0"><enum>(7)</enum><header>Advertising</header><text>Provide that advertisements for a sports wagering operator—</text><subparagraph commented="no" id="H435C1ABDFA8142AB9FE02E274E2FE7E0"><enum>(A)</enum><text>shall—</text><clause commented="no" id="HBC112DE8E4D6415B83AE8065B01F4C32"><enum>(i)</enum><text>disclose the identity of the sports wagering operator; and</text></clause><clause commented="no" id="H947A2D26EDEF4D689C77C267BB364F28"><enum>(ii)</enum><text>provide information about how to access resources relating to gambling addiction; </text></clause></subparagraph><subparagraph commented="no" id="H87E1385536A8439BBC2B4AF89C60149B"><enum>(B)</enum><text>shall not recklessly or purposefully target—</text><clause commented="no" id="H6D6E6B1FBB9C4FE0976A8E06227962F8"><enum>(i)</enum><text>problem gamblers;</text></clause><clause commented="no" id="H25032544DDE34D5A86EFA8B4EDC8AE96"><enum>(ii)</enum><text>individuals suffering from gambling disorder; or</text></clause><clause commented="no" id="H46D33117BD3244C491A0CF2A44CD6223"><enum>(iii)</enum><text>individuals who are ineligible to place a sports wager, including individuals younger than 21 years of age;</text></clause></subparagraph><subparagraph commented="no" id="HF1486DFDAC68477F935F2ED477EDA56F"><enum>(C)</enum><text display-inline="yes-display-inline">may not be broadcasted—</text><clause commented="no" id="HBD4770C27A3B48238F37C5DE1433D848"><enum>(i)</enum><text>between the hours of 8:00am and 10:00pm local time; or</text></clause><clause commented="no" id="H15EDEB7922AF489CB1AB47D5AB8D8DD9"><enum>(ii)</enum><text>during a live broadcast of a sporting event; and</text></clause></subparagraph><subparagraph commented="no" id="HB47C9ACDE1954FF59B22CB6B4CBE0A29"><enum>(D)</enum><text display-inline="yes-display-inline">may not include—</text><clause commented="no" id="H5A8B42F60CEC4EDDBA07D239BED6F556"><enum>(i)</enum><text>odds boosts or similar offers, including advertising that contains the phrase <quote>bonus</quote>, <quote>no sweat</quote>, <quote>bonus bet</quote>, or any other similar term; or</text></clause><clause commented="no" id="H0B73521B61B44587A26C8966BDFDD629"><enum>(ii)</enum><text>any information on how to place a sports wager or how sports wagers work. </text></clause></subparagraph></paragraph><paragraph commented="no" id="H06F86E8A79984C57ADE669E796DD921E"><enum>(8)</enum><header>Licensing requirement</header><subparagraph commented="no" id="H682ADAFE340A48DF990222AEF433E2D9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Provide that a sports wagering operator located in the State shall be licensed by the State regulatory entity.</text></subparagraph><subparagraph commented="no" id="HEA0BAB20D76A4F67A9C9FC3395570BF3"><enum>(B)</enum><header>Suitability for licensing</header><clause commented="no" id="HE94FFC88E73747C6BCA8DFE0A9CB61B1"><enum>(i)</enum><header>In general</header><text>Provide that before granting a license to a prospective sports wagering operator, the State regulatory entity shall make a determination, based on a completed background check and investigation, with respect to whether the prospective sports wagering operator and any person considered to be in control of the prospective sports wagering operator is suitable for license in accordance with suitability standards established by the State regulatory entity.</text></clause><clause commented="no" id="HDD77B1015D3449F8BC4AA300F80A3D1A"><enum>(ii)</enum><header>Associates of applicants</header><text>Provide that if a prospective sports wagering operator is a corporation, partnership, or other business entity, a background check and investigation shall occur with respect to—</text><subclause commented="no" id="H88BCF919C964445CA3F9BDE52830EA24"><enum>(I)</enum><text>the president or other chief executive of the corporation, partnership, or other business entity; and</text></subclause><subclause commented="no" id="HA7CD709372B44892991E177F994A81E4"><enum>(II)</enum><text>any other partner or senior executive and director of the corporation, partnership, or other business entity, as determined by the State regulatory entity.</text></subclause></clause><clause commented="no" id="HB623F631B0F647FF993726C67E07EA53"><enum>(iii)</enum><header>Background check and investigation</header><text>Establish standards and procedures for conducting the background checks and investigations described in this subparagraph.</text></clause></subparagraph><subparagraph commented="no" id="H25AF7DF5FC9D4677BD103F012D249C43"><enum>(C)</enum><header>Unsuitability for licensing</header><text>With respect to the suitability standards under subparagraph (B)(i), provide that a prospective sports wagering operator shall not be determined to be suitable for licensing as a sports wagering operator if the prospective sports wagering operator—</text><clause commented="no" id="HE717F3B53BB744B6AB6F99ED92757199"><enum>(i)</enum><text>has failed to provide information and documentary material for a determination of suitability for licensing as a sports wagering operator;</text></clause><clause commented="no" id="HACB860DCB4894460B1D611666B598865"><enum>(ii)</enum><text>has supplied information which is untrue or misleading as to a material fact pertaining to any such determination;</text></clause><clause commented="no" id="HAE05BD885E134C9DB961EF274B2507B8"><enum>(iii)</enum><text>has been convicted of an offense punishable by imprisonment of more than 1 year;</text></clause><clause commented="no" id="H06CE84B5954042A7BCD3019F136074EB"><enum>(iv)</enum><text>is delinquent in—</text><subclause commented="no" id="H7C63E768858C4484AFE03145ADF20982"><enum>(I)</enum><text>filing any applicable Federal or State tax returns; or</text></subclause><subclause commented="no" id="H72C6608FCAC74F2EB4C205E2D81271AF"><enum>(II)</enum><text>the payment of any taxes, penalties, additions to tax, or interest owed to the United States or a State;</text></subclause></clause><clause commented="no" id="H13DEB06E4CB84FBF9025666A21DA49A0"><enum>(v)</enum><text>on or after October 13, 2006—</text><subclause commented="no" id="HB12C6FD5AAEC4220A3A788D9E09A594B"><enum>(I)</enum><text>has knowingly participated in, or should have known the prospective sports wagering operator was participating in, an illegal internet gambling activity, including—</text><item commented="no" id="HEE4CBE53D8434EB5AA7AAEBBFDCFD591"><enum>(aa)</enum><text>taking an illegal internet wager;</text></item><item commented="no" id="H5B923FC52C6347C98567159AE756C486"><enum>(bb)</enum><text>payment of winnings on an illegal internet wager;</text></item><item commented="no" id="H5411A33B248440C48682608157A2CD55"><enum>(cc)</enum><text>promotion through advertising of an illegal internet gambling website or service; or</text></item><item commented="no" id="HFEE5C9907B6A4A63A25A9D38F2083589"><enum>(dd)</enum><text>collection of any payment on behalf of an entity operating an illegal internet gambling website; or</text></item></subclause><subclause commented="no" id="H6F0811B9FF2B4563ABFD61D811AD9AD8"><enum>(II)</enum><text>has knowingly been owned, operated, managed, or employed by, or should have known the prospective sports wagering operator was owned, operated, managed, or employed by, any person who was knowingly participating in, or should have known the person was participating in, an illegal internet gambling activity, including an activity described in items (aa) through (dd) of subclause (I);</text></subclause></clause><clause commented="no" id="HC54E202EB0E246EFB5E6C2B65F1EBC7B"><enum>(vi)</enum><text>has—</text><subclause commented="no" id="H1A2DC1BCCD5A450B9BFFE316166E9BA1"><enum>(I)</enum><text>received any assistance, financial or otherwise, from a person who has, before the date of enactment of this Act, knowingly accepted bets or wagers from any other person who is physically present in the United States in violation of Federal or State law; or</text></subclause><subclause commented="no" id="HF0EC08584C7D49F4B18AA5579F175E05"><enum>(II)</enum><text>provided any assistance, financial or otherwise, to a person who has, before the date of enactment of this Act, knowingly accepted bets or wagers from any other person who is physically present in the United States in violation of Federal or State law;</text></subclause></clause><clause commented="no" id="H53D1A8342E2C468784370660766A36DC"><enum>(vii)</enum><text>with respect to any other entity that has accepted a bet or wager from any individual in violation of United States law, has purchased or otherwise obtained—</text><subclause commented="no" id="HCAE812AD098D494B802A9B6CCA4BC8A8"><enum>(I)</enum><text>such entity;</text></subclause><subclause commented="no" id="H149E46ECD6154CBC96FEF43265C079E5"><enum>(II)</enum><text>a list of the customers of such entity; or</text></subclause><subclause commented="no" id="HA7A04B9094914AE0AF74DA53DD2AC2BF"><enum>(III)</enum><text>any other part of the equipment or operations of such entity; or</text></subclause></clause><clause commented="no" id="H9031403D4088446994BDAD2B0167D827"><enum>(viii)</enum><text>fails to certify in writing, under penalty of perjury, that the applicant or other such person, and all affiliated business entities (including all entities under common control), during the entire history of such applicant or other such person and all affiliated business entities—</text><subclause commented="no" id="HBCF5DB4E37BE4FF1A0D2020186AE3D50"><enum>(I)</enum><text>have not committed an intentional felony violation of Federal or State sports wagering law; and</text></subclause><subclause commented="no" id="HE0AB1DDB04444EB187022FC50DBC9FEF"><enum>(II)</enum><text>have used diligence to prevent any United States person from placing a sports wager on an internet site in violation of Federal or State sports wagering laws.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H2179FF7D7E844288A4DD2281751C0330"><enum>(D)</enum><header>Revocation and suspension</header><text>Establish standards and procedures for suspending or revoking the license of a sports wagering operator.</text></subparagraph></paragraph><paragraph commented="no" id="H2F2D07BA4A1D470DA98C86908E46CD8A"><enum>(9)</enum><header>Employee background checks</header><text>Provide that a sports wagering operator—</text><subparagraph commented="no" id="H57FDDA58EEFD48639763B0CCA8F5AFD1"><enum>(A)</enum><text>shall ensure that each existing and newly hired employee or contractor of the sports wagering operator undergo an annual criminal history background check; and</text></subparagraph><subparagraph commented="no" id="H5E004E87F78742BA828D435CB91FF1EC"><enum>(B)</enum><text>shall not employ or enter into a contract with any individual who has been convicted of a Federal or State crime relating to sports wagering.</text></subparagraph></paragraph><paragraph commented="no" id="HA8A301B0A9444F5D88504B4C486DC588"><enum>(10)</enum><header>Recordkeeping requirements</header><subparagraph commented="no" id="HE13BA35D8B524EB08977FA3EBB22E711"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), with respect to each sports wager accepted by a sports wagering operator or attempted to be placed by an individual with a sports wagering operator, provide that the sports wagering operator shall secure and maintain a record of the following:</text><clause commented="no" id="H418AB2D12A474890B99B222C353C6CB8"><enum>(i)</enum><text>The name, permanent address, date of birth, and social security number or passport number of the individual who placed, or attempted to place, the sports wager, which the sports wagering operator shall verify in accordance with the requirements for verification of identity in parts 1010.312 and 1021.312 of title 31, Code of Federal Regulations (or any successor regulation).</text></clause><clause commented="no" id="H39EE2FC7A6A64A048D684491D113C7CC"><enum>(ii)</enum><text>The amount and type of the sports wager.</text></clause><clause commented="no" id="HAA9B21ACC95847C09E97FD9617BD6FFE"><enum>(iii)</enum><text>The date and time at which the sports wager was placed or attempted to be placed.</text></clause><clause commented="no" id="HC075E61DE5814EA485F8457BFFEA993D"><enum>(iv)</enum><text>The location at which the sports wager was placed or attempted to be placed, including the internet protocol address, if applicable.</text></clause><clause commented="no" id="H6A0A42BB2C344E5DBCE6D26849A15CB4"><enum>(v)</enum><text>The outcome of the sports wager.</text></clause></subparagraph><subparagraph commented="no" id="H36650C85348C4C0FAB22EC791F9BFE2E"><enum>(B)</enum><header>Exception</header><text>Provide that a sports wagering operator shall not be required to maintain a record of the information described in subparagraph (A) if—</text><clause commented="no" id="H06F8C7B3AACF4485939A0C13C0C2338C"><enum>(i)</enum><text>the sports wager is not placed by an individual through an account with the sports wagering operator;</text></clause><clause commented="no" id="H4FC8BB2AABE641E8B374FD23C10071DC"><enum>(ii)</enum><text>the amount of the sports wager does not exceed $10,000;</text></clause><clause commented="no" id="H47FD7E18F27847F799A7A5C696F40270"><enum>(iii)</enum><text>the sports wagering operator and any officer, employee, or agent of the sports wagering operator does not have knowledge, or would not in the ordinary course of business have reason to have knowledge, that the sports wager is 1 of multiple sports wagers placed by an individual or on behalf of an individual during 1 day that are, in the aggregate, in excess of $10,000; and</text></clause><clause commented="no" id="HCCA90BD51B9A4A51A47AFE334AD391A8"><enum>(iv)</enum><text>the sports wagering operator is not required, pursuant to section 31.3402(q)–1 of title 26, Code of Federal Regulations (or a successor regulation), to furnish a Form W–2G to the individual who placed the sports wager with respect to winnings from the sports wager.</text></clause></subparagraph><subparagraph commented="no" id="HA53EE2F0738E4F8BA2FFE756D6F5FBF1"><enum>(C)</enum><header>Records relating to suspicious transactions</header><text>Provide that, in addition to the records required to be maintained pursuant paragraph (A), a sports wagering operator shall be required to maintain any other records relating to a suspicious transaction, including video recordings, in the possession, custody, or control of the sports wagering operator.</text></subparagraph><subparagraph commented="no" id="H6AEA75220BF642BC8503B2C2C91F6922"><enum>(D)</enum><header>Duration of recordkeeping obligation</header><text>Provide that a sports wagering operator shall be required to maintain each record required under this paragraph for not fewer than 5 years after the date on which the record is created.</text></subparagraph></paragraph><paragraph commented="no" id="H0F9E9D479538489A98FBC92C5298C52C"><enum>(11)</enum><header>Data security</header><text>Provide that a sports wagering operator and the State regulatory entity shall take reasonable steps to prevent unauthorized access to, or dissemination of, sports wagering and customer data.</text></paragraph><paragraph commented="no" id="HCE7014FF195A4A8D99185DFCE85E345C"><enum>(12)</enum><header>Real-time information sharing</header><text display-inline="yes-display-inline">Provide that a sports wagering operator shall provide to the State regulatory entity anonymized sports wagering data in real-time or as soon as practicable, but not later than 24 hours, after the time at which a sports wager is accepted by the sports wagering operator.</text></paragraph><paragraph commented="no" id="H4EF237278AC0471AA850D7C9F85B0B15"><enum>(13)</enum><header>Suspicious transaction reporting</header><subparagraph commented="no" id="H099B7576C0A94C85ADAA43E6D784C2F9"><enum>(A)</enum><header>Reporting to State regulatory entity</header><text>Provide that each sports wagering operator located in the State shall promptly report the information described in paragraph (10)(A) for any suspicious transaction to the State regulatory entity, in such manner and accompanied by such additional information as the State regulatory entity may require.</text></subparagraph><subparagraph commented="no" id="HCEDD08F1CA7046C3A729E9EAF48062F7"><enum>(B)</enum><header>Reporting to sports organizations</header><clause commented="no" id="HF0D6341B6568436DA1FCC852712BD6ED"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), provide that a sports wagering operator shall simultaneously transmit to the applicable sports organization, and any component of the Department of Justice or other Federal law enforcement entity designated by the Attorney General to receive such reports, any suspicious transaction report submitted to a State regulatory entity under subparagraph (A).</text></clause><clause commented="no" id="H8851937D2ED941CB84FEEDE53505C5A2"><enum>(ii)</enum><header>Personally identifiable information</header><subclause commented="no" id="H32467686A43844C6A09C6FA25CEC3996"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), a suspicious transaction report submitted to a sports organization shall not contain any personally identifiable information relating to any individual who placed, or attempted to place, a sports wager.</text></subclause><subclause commented="no" id="H28D883C23E034460BE0A1F80CBD97B93"><enum>(II)</enum><header>Exception</header><text>A suspicious transaction report submitted to a sports organization shall include any available personally identifiable information relating to an individual described in subparagraph (C), (D), or (E) of paragraph (4).</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="HF52E28D0CDE24EF5A3FBB42E52E74C41"><enum>(14)</enum><header>Monitoring and enforcement</header><subparagraph commented="no" id="H6F30AE83324742BF9227A789903D63B1"><enum>(A)</enum><header>In general</header><text>Provide that the State regulatory entity, in consultation with law enforcement, shall develop and implement a strategy to enforce the sports wagering laws of the State.</text></subparagraph><subparagraph commented="no" id="H522CEF65F4914977A03CE1902425D4FC"><enum>(B)</enum><header>Authority to monitor and enforcement</header><text>Provide adequate authority to the State regulatory entity and law enforcement, as appropriate, to monitor compliance with and enforce the sports wagering laws of the State, including—</text><clause commented="no" id="H539FECCFE18543E1A81B1F9BE5EE3766"><enum>(i)</enum><text>the authority and responsibility to conduct periodic audits and inspect the books and records of each sports wagering operator located or operating in the State; and</text></clause><clause commented="no" id="HAF3CDFAEEBCE46FB9E0458717382C415"><enum>(ii)</enum><text>a requirement that the State regulatory entity shall refer evidence of potential criminal violations to the appropriate law enforcement entity.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HCEB040E53EEE4DD39289ADE23F4ED769"><enum>(15)</enum><header>Cooperation with investigations</header><subparagraph commented="no" id="HB3A4B7F0BBAF4A9FBDB7FC62BA051DCE"><enum>(A)</enum><header>Sports wagering operators</header><text>Provide that any sports wagering operator located or operating in the State shall cooperate with any lawful investigation conducted by—</text><clause commented="no" id="H3A2140538FDF46B6A443F0F9FB07051C"><enum>(i)</enum><text>the State regulatory entity;</text></clause><clause commented="no" id="H389A3185360E41D8871F0B6E998FE3DD"><enum>(ii)</enum><text>Federal or State law enforcement; or</text></clause><clause commented="no" id="H8D3E65F350984186B270B5383812D5D2"><enum>(iii)</enum><text>a sports organization, with respect to a sports wager—</text><subclause commented="no" id="H7D72F2B996024C97BB29134D1A4997DD"><enum>(I)</enum><text>on a sporting event sponsored, organized, or conducted by the sports organization;</text></subclause><subclause commented="no" id="HEC1DD4533E354EB4AE80A963D32DDB02"><enum>(II)</enum><text>placed by or on behalf of an individual described in subparagraph (C), (D), or (E) of paragraph (4); and</text></subclause><subclause commented="no" id="H7EC004FFA5DD4D6F907DF47A44907055"><enum>(III)</enum><text>accepted by the sports wagering operator.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H8F30FB784DCB4A01B8D5CB466B686E6A"><enum>(B)</enum><header>State regulatory entity</header><text>Provide that the State regulatory entity shall cooperate with any lawful investigation conducted by—</text><clause commented="no" id="HB12B588B72FB4F81A6F8A4E76CC50A54"><enum>(i)</enum><text>Federal or State law enforcement; or</text></clause><clause commented="no" id="H82C1EC3FC4F944DCADEE32DDF91AEDFC"><enum>(ii)</enum><text>a sports organization, with respect to a sports wager—</text><subclause commented="no" id="H39CA9B74CE184DB5A5141AC8CED775A2"><enum>(I)</enum><text>on a sporting event sponsored, organized, or conducted by the sports organization; and</text></subclause><subclause commented="no" id="HD7F144D2A69345B692AADA36EFABA684"><enum>(II)</enum><text>accepted by a sports wagering operator located or operating in the State.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H3A6E7003FD874F36842BE594705AE29A"><enum>(16)</enum><header>Internal controls</header><subparagraph commented="no" id="HC3FA2E44D93D46B6A8910E82CB3EDD87"><enum>(A)</enum><header>In general</header><text>Provide that each sports wagering operator shall devise and maintain a system of internal controls sufficient to provide reasonable assurances that sports wagers are accepted in accordance with all applicable laws, regulations, and policies.</text></subparagraph><subparagraph commented="no" id="HDBA24F7A05DE42F895EAC9E5DD1513DD"><enum>(B)</enum><header>Minimum standards</header><text>Provide that the State regulatory entity shall adopt and publish minimum standards for internal control procedures.</text></subparagraph><subparagraph commented="no" id="H468E3BA3896B457AB064D83090FB854A"><enum>(C)</enum><header>Report</header><text>Provide that each sports wagering operator shall submit to the State regulatory entity not less frequently than annually the written system of internal controls of the sports wagering operator.</text></subparagraph><subparagraph commented="no" id="H5DC4329FF775485888EF046F6C05AE2B"><enum>(D)</enum><header>Audit</header><text>Provide that system of internal controls of a sports wagering operator shall be evaluated on a periodic basis, but not less frequently than every 3 years, by the State regulatory entity or an independent third-party auditor.</text></subparagraph></paragraph></subsection></section></title><title commented="no" id="HC4E4831A9F144F85A9405805791E07FE"><enum>II</enum><header>Public health in sports betting</header><section commented="no" id="HEC1A10DB558D441E80B5D0F88C80F45D"><enum>201.</enum><header>Annual nationwide survey on online sports betting</header><text display-inline="no-display-inline">Part D of title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd">42 U.S.C. 290dd et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF6598330FD3A4E3EB6C2015ADC802563"><section commented="no" id="H9CB3E2FD4C7B4C61B3E522205FF6FCE4"><enum>553.</enum><header>Annual nationwide survey on online sports betting</header><subsection commented="no" id="HE5BEFDD19B2C4156AA17B3E5C6C0A7BA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, and annually thereafter, the Secretary shall—</text><paragraph commented="no" id="H65745B7181AB4EC4A340479E939FD8BA"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a nationwide survey designed to provide quantitative data regarding the scope of problem gambling and gambling-related harm experienced by individuals using online sports betting; and</text></paragraph><paragraph commented="no" id="HA5852D68477B40998FDEE05E740F18AF"><enum>(2)</enum><text>make available to the public summaries and analyses of the data collected pursuant to surveys under paragraph (1).</text></paragraph></subsection><subsection commented="no" id="HF01690129D8648A982B596C8B0FD77B3"><enum>(b)</enum><header>Issues To be surveyed</header><text>Each survey under subsection (a) shall include—</text><paragraph commented="no" id="HA1AC7ED093B5477AAB89D7BD33A1B7F9"><enum>(1)</enum><text>a survey of the rates and outcomes of online sports betting; and</text></paragraph><paragraph commented="no" id="HF10CBF67B26D4CDDA9E3301F6C14EA18"><enum>(2)</enum><text display-inline="yes-display-inline">examination of the rates of potential problem gambling and gambling-related harm by administering the Problem Gambling Severity Index (Ferris and Wynne, 2001) to a select sample of individuals engaged in online sports betting over the 12-month period covered by the survey.</text></paragraph></subsection><subsection commented="no" id="H3A9D16FBE23947F585322604A8854822"><enum>(c)</enum><header>Requirements</header><text>The Secretary shall ensure that each survey under subsection (a) is—</text><paragraph commented="no" id="H5A05DA1C967E4934B9CE8674D5D5A8FD"><enum>(1)</enum><text>conducted by qualified researchers; and</text></paragraph><paragraph commented="no" id="HC63F953624394AD683EBCEB97FEEB809"><enum>(2)</enum><text>not conducted, funded, or instructed by the gambling industry.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="HF386371861D942B292B044AF26C01B7C"><enum>202.</enum><header>National self-exclusion list</header><text display-inline="no-display-inline">Part D of title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd">42 U.S.C. 290dd et seq.</external-xref>), as amended by section 201, is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H763ED9415462421CA4BFDDA65C6EC10A"><section commented="no" id="H44CC26C252614C10973829FC22AB7A03"><enum>553A.</enum><header>National self-exclusion list</header><subsection commented="no" id="HEFC4B14D56F845998A9FEA258AB97F74"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In cooperation with State regulatory entities, the Secretary shall maintain and administer—</text><paragraph commented="no" id="HBB6E371FE5204FCB814DE62DBCD898FB"><enum>(1)</enum><text display-inline="yes-display-inline">a list (to be known as the <quote>national self-exclusion list</quote>) of individuals who, by placing themselves on the list, restrict themselves from placing a sports wager with a sports wagering operator located in any sports wagering opt-in State, including by imposing sports wager limits; and</text></paragraph><paragraph commented="no" id="H7C12BB4135A94F3192308234866330E5"><enum>(2)</enum><text>a process by which an individual may add or remove himself or herself from the national self-exclusion list.</text></paragraph></subsection><subsection commented="no" id="HA83665B94BCC459E853DF01112D01C59"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms <term>sports wager</term>, <term>sports wagering operator</term> and <term>sports wagering opt-in State</term> have the meanings given to such terms in section 2 of the <short-title>Supporting Affordability and Fairness with Every Bet Act of 2024</short-title>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="HCE9544B340844B0898FB82E19E8E572F"><enum>203.</enum><header>Surgeon General’s Report on Public Health Challenges Associated with Sports Betting</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Surgeon General shall submit a report to Congress on the public health challenges associated with widespread sports betting.</text></section><section commented="no" id="H6F033453E75E4CDD89E8ED51A631B8A1"><enum>204.</enum><header>Surveillance of gambling disorder</header><text display-inline="no-display-inline">Title III of the Public Health Service Act is amended by inserting after section 317V (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-24">42 U.S.C. 247b–24</external-xref>) the following:</text><quoted-block id="H8F95B34D581A416B8580BF37C68E3C7E" display-inline="no-display-inline" style="OLC"><section commented="no" id="H6E117757FBF046058A6ACE3803F180B2"><enum>317W.</enum><header>Surveillance of gambling addiction</header><subsection commented="no" id="H75C4753C82844FC6BDB745E3D658DB79"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention and in coordination with other appropriate agencies, shall, as appropriate—</text><paragraph commented="no" id="HC8F62FC6F2F54B40B812467BBC834D88"><enum>(1)</enum><text>enhance and expand infrastructure and activities to track the epidemiology of gambling addiction; and</text></paragraph><paragraph commented="no" id="HAB638A3A28644AFDAA82FD3C321DDBAD"><enum>(2)</enum><text>incorporate information obtained through such infrastructure and activities into an integrated surveillance system, which may consist of or include a registry, to be known as the <quote>National Gambling Addiction Surveillance System</quote>.</text></paragraph></subsection><subsection commented="no" id="H3292D2D2DA244FE7A3EE9D9F224CBBAF"><enum>(b)</enum><header>Research</header><text>The Secretary shall ensure that the National Gambling Addiction Surveillance System, if established, is designed in a manner that facilitates further research on gambling addiction.</text></subsection><subsection commented="no" id="H55E4D9D8106D4B21BC83F62865FB8C0D"><enum>(c)</enum><header>Public access</header><text>Subject to subsection (d), the Secretary shall ensure that information and analysis in the National Gambling Addiction Surveillance System, if established, are available, as appropriate, to the public, including researchers.</text></subsection><subsection id="HDDFA087205DC43B9896974505A9B57AD" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Privacy</header><text>The Secretary shall ensure that information and analysis in the National Gambling Addiction Surveillance System, if established, are made available only to the extent permitted by applicable Federal and State law, and in a manner that protects personal privacy, to the extent required by applicable Federal and State privacy law, at a minimum.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H196F08D14C764BB099274E1E12CD69A1"><enum>III</enum><header>General provisions</header><section commented="no" id="HCD614C18BFC4460DB21CE75C5F45731D"><enum>301.</enum><header>State and Tribal authority</header><subsection commented="no" id="H1C653FB85DFD420E97D06A3908518843"><enum>(a)</enum><header>Relation to Indian Gaming Regulatory Act</header><paragraph commented="no" id="HB98C1F474516468FAF60A690B00F72BD"><enum>(1)</enum><header>In general</header><text>For purposes of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701 et seq.</external-xref>), a sports wager made through an interactive sports wagering platform shall be deemed to be made at the physical location of the server or other equipment used to accept the sports wager.</text></paragraph><paragraph commented="no" id="H1136D843B1A64BEE9C9D9D05E6B96B7F"><enum>(2)</enum><header>Server on Indian lands</header><text>With respect to a sports wager described in paragraph (1) accepted through a server or other equipment located on Indian lands, the sports wager shall be considered to be exclusively occurring on Indian lands if—</text><subparagraph commented="no" id="H5AB8B5A855964BCAA0D2A0A6AA9940C2"><enum>(A)</enum><text>the sports wager and the server are in the same State; and</text></subparagraph><subparagraph commented="no" id="H5411EC4ED0D1477E9D74B30A916BFCE2"><enum>(B)</enum><text>the applicable State and Indian Tribe have entered into a Tribal-State compact authorizing the placing of sports wagers through interactive sports wagering platforms.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HAE3DE27A91334E658609FF80CACBF371"><enum>(b)</enum><header>No preemption</header><text>Nothing in this Act preempts or limits the authority of a State or an Indian Tribe to enact, adopt, promulgate, or enforce any law, rule, regulation, or other measure with respect to sports wagering that is in addition to, or more stringent than, the requirements of this Act.</text></subsection><subsection id="HE1429069186D41B7AFD0757DF93746DA" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Taxation of sports wagering</header><text>Nothing in this Act limits or otherwise affects the taxation of sports wagering by a State, an Indian Tribe, or a locality.</text></subsection></section><section id="H3921BA11EE954BF796B35A46732CF0C3"><enum>302.</enum><header>Severability</header><text display-inline="no-display-inline">If a provision of this Act, an amendment made by this Act, a regulation promulgated under this Act or under an amendment made by this Act, or the application of any such provision, amendment, or regulation to any person or circumstance, is held to be invalid, the remaining provisions of this Act, amendments made by this Act, regulations promulgated under this Act or under an amendment made by this Act, or the application of such provisions, amendments, and regulations to any person or circumstance—</text><paragraph id="H725A64D0635447CD9A90CC55C45BFF4B"><enum>(1)</enum><text display-inline="yes-display-inline">shall not be affected by the invalidity; and</text></paragraph><paragraph id="HF3F3CC8D01CB4D1795C6FB0E82BE672D"><enum>(2)</enum><text display-inline="yes-display-inline">shall continue to be enforced to the maximum extent practicable.</text></paragraph></section></title></legis-body></bill>
