which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/211">chapter 211</external-xref> of title 18, United States Code, to modify venue for certain offenses.</official-title></form><legis-body id="H184B2C782C7B4FCEA43F4337CA3202CE" style="OLC"><section id="HE40FFA22CAE44B1F8CB83E9AC3DA5C72" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Venue Named Under Exception Act</short-title></quote> or the <quote><short-title>VENUE Act</short-title></quote>.</text></section><section id="HD00E1AF51790490F839752A1121A0E92"><enum>2.</enum><header>Venue for certain offenses</header><subsection id="H6E5DF8EAC5AB4A1CB42DB7CAEE934B44"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/211">Chapter 211</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H1B7FA87E04DB4092A42C3A2B8F251DF3" display-inline="no-display-inline"><section id="H0E74027366024BC0AAA4E38669C51EF7"><enum>3245.</enum><header>Offenses committed in the National Capital Region</header><subsection id="H33ACE4806145489A8D6C84E796CDB5E8"><enum>(a)</enum><header>Offenses in National Capital Region</header><text display-inline="yes-display-inline">In the case of an offense that is committed in the National Capital Region on property under the control of the Federal Government, an indictment or information shall be filed in the district of the last known residence of the offender or of any one of two or more joint offenders, or if no such residence is known, the indictment or information may be filed in the District of Columbia.</text></subsection><subsection id="HA9069261D0864885867043813BF5B513"><enum>(b)</enum><header>Transfer</header><paragraph id="HA931AF5F70674FBA98EDD2428C44959D"><enum>(1)</enum><header>Right to transfer</header><text>Notwithstanding subsection (a), a district court shall, upon motion of the defendant, grant a transfer of an indictment or information to the district court encompassing the jurisdiction where the defendant is domiciled.</text></paragraph><paragraph id="H97E90AD171D14D338F1E6E36848FF1BD"><enum>(2)</enum><header>Multiple defendants</header><text display-inline="yes-display-inline">If multiple defendants file a motion to transfer an indictment or information under paragraph (1), the district court shall grant the motion of the defendant who filed the motion first.</text></paragraph><paragraph id="H9B9BA650FD564F6D96C029BBE5BC36E2"><enum>(3)</enum><header>Defendants not domiciled in the United States</header><text display-inline="yes-display-inline">A defendant not domiciled in the United States may not file a motion to transfer an indictment or information under paragraph (1).</text></paragraph></subsection><subsection id="H68BDF7DEC3854C0BAEC6D818A898AAF6"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H4BDDE1AB4E3D409CA684EA621E0CDBDD"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>National Capital Region</quote> means the geographic area located within the boundaries of—</text><subparagraph id="HF3758BE7D9E3461FAD2E1D00F523EE65"><enum>(A)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="H88EA60410BAC48F08C9DEFF738D5B9F2"><enum>(B)</enum><text>Montgomery and Prince George’s Counties in the State of Maryland;</text></subparagraph><subparagraph id="H51E1359B11B4475F94BCCBADEB7E6064"><enum>(C)</enum><text>Arlington, Fairfax, Loudoun, and Prince William Counties and the Cities of Alexandria and Falls Church in the Commonwealth of Virginia; and</text></subparagraph><subparagraph id="H400CA12B439E4FFEA619A0C6D7066DDB"><enum>(D)</enum><text>all cities and other units of government within the geographic areas of such District, Counties, and City.</text></subparagraph></paragraph><paragraph id="HB6CCA4FEF8254B95AF8D8A827BBD4948"><enum>(2)</enum><text>The term <quote>property under the control of the Federal Government</quote> means property owned or leased by the United States, or any agency thereof, except in the case of the United States Postal Service.</text></paragraph></subsection><subsection id="H53EB709FEC6F464B86282A8CCC71B577"><enum>(d)</enum><header>Pending cases</header><text display-inline="yes-display-inline">This section shall apply to any offense with respect to which a trial has not been scheduled as of the date of enactment of this section.</text></subsection><subsection id="H1B4095227BC44DFDBC6419230B85C4D8"><enum>(e)</enum><header>Limitation</header><text>This section shall only apply to an offense not otherwise subject to section 3235, 3236, 3237, 3238, 3239, 3241, 3242, 3243 or 3244.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8ECDAFE625E9452F9054EEB87A58A486"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/211">chapter 211</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="HF23DDA589363403CAEDAC3A1C8E161B8" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">3245.
